SUPREME COURT SETSTONE FOR THE

NATION – VICTORYOR DEFEAT

The Supreme Court in all of its infinitewisdom recently set a tone for the nationin several key areas including MandatedHealth Care, Life Sentences for JuvenileOffenders and SB-1070 Immigrant relatedlegislation passed in Arizona and copiedin many other anti-immigrant states. TheSupreme Court justices found in favor ofMandated Health Care Coverage, againstthe sentencing of Juveniles to life sen-tences and against harsh and discrimina-tory elements of Arizona’s SB-1070. TheSupreme Court set a significant tone ofexercising its judicial authority to pre-serve the federal government’s role inmandating healthcoverage for mil-lions of Americanswithout health in-surance leading togreat debate aboutthe role of govern-ment in serving themedical insuranceneeds of its citi-zens. Supportersof controlling thehigh cost of med-ical insurancehailed the actionwhile critics remain critical about the fed-eral government controlling free enter-prise. There remain many in Congressand political organizations that believethe mandate can be reversed with a newpresident elected in November and a newCongress with more conservatives in of-fice.

On the question of the constitutionalityof life sentences for juveniles who com-mit serious crimes, the court ruled infavor of the youngsters who are currentlyserving life sentences without parole.The matter of whether or not youth donot realize the level of severity of their ac-tions because they are immature doesnot ring well with the families of victimswho have lost their loved ones to the vio-lence that surrounds many of our na-tion’s youth. Why we cannot youngpeople to realize the consequences oftheir actions is still a puzzle for mostadults in America. “Sometimes we expecteven the youngest of these perpetratorsto just grow up and be responsible.” Oh,wouldn’t that be a change in the right di-rection. Unfortunately, the message of“Zero tolerance,” is effectively abandonedby the action of the court. The gruesomecrimes of many youth would send shiversdown your spine. Young people whocommit murder are just as wrong asadults. We should adhere to the laws wecreated as appropriate punishment and a

deterrent for others. Our laws shouldserve to mold behavior!

Arizona’s SB-1070 continues to be dis-turbing since it is intended to control un-wanted immigration into Arizona byMexican and other Latin American groupsusing the southwestern borders to enterthe United States to escape abjectpoverty. The actions of immigrants whoenter the country by sneaking in withoutproper documentation should not crimi-nalize them as a result. The borders canbe a security problem that every respon-sible American recognizes needs atten-

tion. We shouldreview and re-form immigra-tion and secureour bordersthrough a hu-mane processwhich considersthe value ofhardworking,non-threaten-ing, peacefulimmigrants whohave been en-ticed to come

here and are gainfully employed in manyjobs that Americans refuse to work in.

“Show me your papers,” actions of policeagencies in the State of Arizona will con-tinue to be a concern for foreign lookingpersons living and working in Arizona. Itwill also affect tourists traveling throughthe state. The enforcement of the part ofSB-1070 allowed to stand by the SupremeCourt will certainly bring legal challengesof racial-profiling and will be just a mat-ter of time before it is completely out-lawed.

The question of victory or defeat by themany groups who lined up on the issuesbefore the court is simple. The SupremeCourt provided us a confirmation that ourprocess works! The judicial branch ofour system adequately reviewed the le-gality of our laws with the good of our cit-izens in focus. It decided tough issuesand allied itself with the people. Whichpeople? Obviously, the people in favor oragainst interpret the victory or the defeat.I join the group that wishes the courtwould rule with greater certainty on is-sues, thumbs up, or thumbs down. Thismiddle of road sometimes frustrates meas I am sure frustrates many Americans.We will continue to live and work to-gether as one big family regardless of ourdifferences. This is the American way!

Medal of FreedomPresident Barack Obamarecently presented the“Medal of Freedom,” thehighest civilian honorgranted in the U.S., toMexican American mi-grant farm worker organ-izer Dolores Huerta and12 other persons whomhe described as “heroes.”She is in good company.Among the 13 recipientsare Madeleine Korbel Al-bright, John Doar, BobDylan, Bill Foege, JohnGlenn, Gordon KiyoshiHirabayashi, DoloresClara Fernandez Huerta,Jan Karski, Juliette Gor-don Low, Toni Morrison,

John Paul Stevens and Pat Summitt.

During a packed ceremony in the East Room of the White House, Obama saideach of the award recipients had “profoundly” changed his life. Some of theachievements that had earned them this place in history were cited during theaward ceremony. President Barack Obama honored the recipients with praiseand a fitting bit of humor. “This is the highest civilian honor this country canbestow, which is ironic, because nobody sets out to win it.  No one ever picksup a guitar, or fights a disease, or starts a movement, thinking, ‘You knowwhat, if I keep this up, in 2012, I could get a medal from a guy named BarackObama.” The audience laughed.

“But that’s exactly what makes this award so special. ..Together, the honoreeson this stage, and the ones who couldn’t be here, have moved us with theirwords; they have inspired us with their actions. They’ve enriched our lives andthey’ve changed our lives for the better.  Some of them are household names;others have labored quietly out of the public eye.  It’s our job to let them knowhow extraordinary their impact has been on our lives,” the President said.According to the printed program: “It was ‘originally established as the Medalof Freedom by Pres. Truman on July 6, 1945. The medal was re-established asthe Presidential Medal of Freedom by Pres. John F. Kennedy on February 22,1963.”

Mrs. Huerta also has been an elementary school teacher, and is president ofthe Dolores Huerta Foundation  in Bakersfield, Calif., which advocates forhealth, environmental, education, economic, and youth issues. She's beenawarded the Eugene V. Debs Foundation Outstanding American Award and theUnited States Presidential Eleanor Roosevelt Award for Human Rights in addi-tion to the Presidential Medal of Freedom, our nation's highest civilian award.Dolores Huerta visited Grand Rapids Michigan last year to highlight a dedica-tion ceremony for a mural in her honor and Cesar Chavez, painted by artist

Paul Collins.

‘What distinguishes these men and women is the incredible impact they havehad on so many people, not in short stunning blows, but for a lifetime,”Obama said. They have all “enriched our lives.”Obama noted the impact made by the works of novelist Toni Morrison, and thesongs by Bob Dylan, and the heroism of retired astronaut John Glenn.

Dylan captured in his songs “something about this country that was so vital,”and many artists, “from Bruce Springsteen to U2 should be grateful. There isno bigger giant in the history of American music,” Obama said.The president said he chose Glenn for the award because in his mind, his ex-ploits, including being the third American in space and the first to orbit theEarth, makes him “a hero in every sense” of the word.

The medal recipient list also includes Madeleine Albright, the first woman toserve as Secretary of State (1997-2001), leading efforts to expand NATO andstrengthen its leadership in the fight against terrorism, in addition to spear-heading peace efforts in Africa and the Middle East; Attorney John Doar for hisleadership during the civil rights era; Dr. William Foege, who helped to eradi-cate smallpox in the 1970s; African American novelist Toni Morrison, the re-tired Supreme Court Judge John Paul Stevens and basketball great Patricia “Pat”Summitt.

Obama presented the award posthumously to relatives of three of the winners:Juliette Gordon Low (1860-1927), founder of the Girl Scouts; Jan Karski (1914-2000), Polish-American who fought the Nazis in World War II, and GordonHirabayashi (1918-2012 ), a sociologist who led the resistance to the relocationof Japanese Americans to internment camps during that war.Obama said he would issue the 1994 Nobel Prize medal to President ShimonPeres personally in a visit to the White House planned later.

EVIDENCE JAZZ GROUP/ ORQUESTA TRADICION

July 30th — Evidence and Orquesta Tradicion will be joining forces to bring us a night ofhot Latin Jazz. The group, Evidence, was started by saxophonist Michael Doyle when hemoved from New York to west Michigan. Many of the state’s best jazz performers havebeen a part of Evidence. The group has made appearances at many places across Michi-gan the Chris Lawrence plays trumpet and flugelhorn for the group, Steve Talaga coversthe ivories, the acoustic bass is played by multi-instrumentalist Tom Lockwood and FredKnapp sets the groove on drums. Michael is bringing his other group, Orquestra Tradicionto complete this concert of Latin Jazz at its finest. Joining Michael on stage will be threemembers of the group who all sing vocals and play percussion; they are Xavier Rosario,Bryan Rosario and Luis “Wiso” Rosario Sr. Other members of the group include Luis“Luisita El Pianista” Rosario Jr. who will play piano and also join in on vocals while VictorDeJesus plays Guiro and Carlos Cruz provides more percussion sounds. This will be a fun-

filled evening of high energy Latin jazz.

Health Care Ruling Critics led bySmall Business Owners

In reaction to the ruling by the U.S. Supreme Court decision on the "Afford-able Care Act," the Small Business & Entrepreneurship Council (SBE Council)said the decision that keeps intact most of the law - including the individualmandate being deemed constitutional as a "tax" - will continue to impose aheavy burden on small business owners and entrepreneurs, thus harmingthe economy, U.S. competitiveness, job creation and the future of entrepre-neurship."Most self-employed Americans and small business owners would purchasehealth insurance for themselves and their employees if they could afford it.The costly, tax-laden health care law with its individual mandate and intru-sive regulations missed this entire point. Rather than providing Americanswith affordable choices through better competition, the health care law co-erces Americans to buy packages designed by government bureaucrats inmarkets micromanaged by government bureaucrats," said SBE Council Pres-ident & CEO Karen Kerrigan.SBE Council Chief Economist Raymond Keating added:"The U.S. Supreme Court's decision to uphold ObamaCare is an egregious,irresponsible decision that ignores the clear intent of the U.S. Constitutionto limit the powers and reach of government. By allowing the governmentto force individuals into a commercial transaction just because they are citi-zens, it's hard to think of any limits that can be placed on federal power -as long as such action is called a tax. He went on calling upon the U.S.Congress to repeal the act. SBE Council will continue to urge Congress and President Obama to pareback many elements of the health care law that hurt small businesses in-cluding the employer mandate, SBE Council is a national, nonprofit advo-cacy and research organization dedicated to protecting small business andpromoting entrepreneurship.

“SHOW ME YOUR PAPERS LAWSB-1070” STANDS BUT OUTLAWSANTI-IMMIGRANT PROVISIONS

The Supreme Court has put a freeze on further criminalizingimmigrants without proper documentation and clarified itsdue authority in all matters regarding immigration laws. Thecourt held that federal authority outweighs state authoritycreating and enforcing immigration laws. The court struckdown provisions of SB 1070 that would make entering Ari-zona as an undocumented immigrant a crime. The court heldthat the state of Arizona clearly overstepped its authority.Immigration enforcement is a responsibility of the federalgovernment. Cooperation between state and federal enforcement authori-ties will continue, as will the most controversial part of thebill allowed to stand called “Show me your papers.” The stop-ping of individuals merely because they “Look Mexican” or bydetaining individuals for extended periods while investigatingtheir immigrant status thereby acting in a discriminatingmanner to foreign looking persons could be the basis of fur-ther lawsuits for racial profiling and unlawful discrimination. Latino groups applauded the decision to declare SB 1070 un-constitutional and are urging Hispanics and other “foreignlooking persons” to carry their identification papers and docu-ment abuses and discrimination in routine stops by police.

According to the governor’s office, gang members convicted of criminalconspiracy under the new law could face more than 30 years in prison andfines of up to $250,000. The office also said Illinois joins 31 other statesin having racketeering statutes.Chicago Mayor Rahm Emanuel also lobbied for the legislation. He said thenew law is a part of community policing effort.“Those are the streets of our children and those are the streets of ourgood law-abiding citizens,” Emanuel said. “This is gonna help us makesure that those citizens own those streets, not these gangs.”The Chicago Police Department said nearly 80 percent of the city’s homi-cides are gang-related. It also said there are approximately 100,000Chicago street gang members.

In the United States, we enjoy abundant, affordable produce year round.Yet, few of us realize where that food comes from and who grows it.

Each year, three to five million farmworkers and their families labor infields and factories across the country to bring us fresh fruits, vegetablesand other agricultural products. Many farmworkers leave their permanenthomes for months at a time to follow the crops, working in isolated, ruralareas of the U.S. Farmworkers are typically hired seasonally and are es-sential during periods of peak production; they plant, cultivate, harvestand process the crops that become our food. The multi-billion dollar UnitedStates agricultural industry relies heavily on farmworkers to produce andharvest the crops that feed and nourish our families.

Although farmworkers clearly provide invaluable and necessary goods andservices they often earn low wages and endure many job-related hazards,substandard working and living conditions, instability, long hours and iso-lation. Due in part to the isolated agricultural work environment, migrat-ing workforce, language and cultural barriers, and immigration status, littlereliable information exists about farmworkers as a group or about theirhealth. It is widely believed, however, that farmworkers in the United Statesface extreme occupational risks and exposures; suffer poorer than averagehealth; and have a life expectancy significantly shorter than average.

Michigan has traditionally celebrated a tribute to the Farm Workers dur-ing the month of July under previous governors. The CommunityVoice/La Voz Magazine annually salutes the valuable contributions that

Migrant Farm Workers make to our nation as they plant, cultivate, andharvest the vast majority of the food that is brought to our tables formeals.

Por desgracia, el mensaje de "tol-erancia cero", es efectivamenteabandonado por la acción de la corte. Loscrímenes horribles de muchos jóvenescausan escalofríos en la columna verte-bral. Los jóvenes que cometen asesinatosson tan mal como los adultos. Debemosapegarnos a las leyes que hemos creadocomo un castigo apropiado y un ele-mento de disuasión para los demás.

La ejecución de laparte de la SB-1070 se dejó en reposo porla Corte Suprema sin duda traerá proble-mas legales de la discriminación racial.La policía actuando basado en perfilesraciales causará problemas que será sólocuestión de tiempo antes de que estécompletamente será considerado fuerade la ley.
