Remembering National Crime Victims Rights Week

Until recently, our criminal justice

system singularly focused on protecting the rights of the accused.

It’s central to our notion of the rule of law and constitutionally guaranteed. The Bill of Rights, speciÞcally the Fourth, Fifth, Sixth and Eighth amendments, enumerate the fundamental rights of the accused.

The Constitution recognizes no rights for victims of the accused nor affords them par-allel protections. But in 1981, then-President Reagan set out to ensure the equal treatment of victims.Regan proclaimed the Þrst Crime Victims

Rights Week to recognize “the innocent victims of crime who have frequently been overlooked by our criminal justice system.” He formed a task force to study crime victims’ needs. A nationwide review by the panel found a crimi-nal justice system “appallingly out of balance” in the treatment of crime victims and called it “a national disgrace.” The task force offered 68 recommendations that formed the framework for new programs and policies.In 1982, Reagan signed into law the Victim

and Witness Protection Act to establish “fair treatment standards” for crime victims and witnesses in the federal criminal justice system and the Missing Children Act to provide rights to parents with missing children. The Reagan administration established the OfÞce for Victims of Crime and the National Center for Missing and Exploited Children.Reagan signed the Victims of Crime Act in

1984, creating the Crime Victims Fund and the Justice Assistance Act to support new state and local government victims’ services programs. That touched off victims’ rights legislation in states and counties. Now, most employ crime victims’ advocates. They advise crime victims of their rights, help them access beneÞts through the appropriate Crime VictimÕs Compensation Fund and provide support during the criminal judicial process. And every state has a Crime VictimsÕ Bill of Rights.

The international community followed suit in 1985, when the General Assembly adopted the United Nations Declaration on the Basic Principles of Justice for Victims of Crime and Abuse of Power. It speciÞes the rights of victims to be treated with respect and recognition, be referred to adequate support services and receive information about the progress of the case. It also speciÞes the rights of victims to be present and give input in the decision-making process, counsel, protection of physical safety and privacy, and compensation from the offender and the state.

The campaign started by President Reagan has produced a more equitable system and critical protections for the general public. The long-overdue recognition of victims’ rights in the criminal justice system provides greater safeguards for all of us, as do the constitutional protections for the accused.

The distress and often the suffering resulting from the trauma of criminal victimization lasts a lifetime. The offender steals something precious that can’t be recovered. But a justice system that recognizes the distress and suffering of crime victims and has processes and resources in place to see to their crime-related needs shoulders some of the dreadful burden.Every year since 1981, every president has

declared National Crime Victims Rights Week. This year, it was observed April 10-16, with thousands of events across the country.

Ortiz also said he and the members of his large family pay their taxes on time.

“We want to support our city and be in good standing,” Ortiz said.

In Kansas, undocumented workers pay $10,302,380 in personal income taxes. In addition, they pay $3,868,286 in property taxes and $43,082,114 in sales taxes.

In Missouri, undocumented workers pay $11,169,268 in personal income taxes, $3,394,769 in property taxes and $35,590,400 in sales taxes.U.S. citizen Eduardo Zavala of Kansas City, Kan. believes the tax contributions made by undocumented workers are important “because they contribute to our country,” Zavala said.Undocumented workers pay their taxes to

avoid problems with the law and live a good life in the United States, he said.

¡La Migra y Tú!Trayendo noticias de inmigración a tu puerta

La semana pasada fui a una entrevista con un cliente al Servicio de Inmigracion. Hace unos

años nosotros pedimos una visa para él, porque está casado con una residente permanente. La petición I-130 fue aprobada en octubre y otra vez le expliqué que, aunque entró con visa, su mujer tenía que hacerse ciudadana si quería hacer la segunda parte del caso y ganar la residencia. Por suerte, su mujer ya tenía la residencia por casi 5 años y podría aplicar para naturalización pronto.

En febrero, el cliente me notificó que tenía una cita para ajuste de estatus. Me confundió y repasé su expediente. Yo no había hecho ninguna solicitud para él y le dije que quería verlo.

M e v i s i t ó , presentándome el aviso de la cita. Me contó que él había investigado su situación en Internet y no había visto ningún problema en presentar su solicitud… entonces lo hizo por sí mismo.

Inmediatamente le dije que no podía ir a esa cita, pero no me creía. Él tenía una petición aprobada y había una visa disponible; entonces no entendía por qué no podía presentar su solicitud.

Le expliqué otra vez: Sólo las personas que entraron con visa y que están casados con ciudadanos, pueden presentar una solicitud para ajuste de estatus. Hay unas excepciones, pero su situación no cae dentro de alguna.

No me creía todavía.Finalmente, lo convencí que debíamos pedir una

continuidad para darle tiempo de pensarlo bien. Su permiso de trabajo debe llegar pronto y podría obtener un número de seguro social, pero insistí que no podía acudir a la segunda entrevista.

Escribí una carta pidiendo otra fecha y en dos meses llegó el aviso para su segunda entrevista. Otra vez nos juntamos y otra vez él insistió en ir a la entrevista.En Þn, bien frustrada, le dije que si �l iba a la

entrevista, correría el riesgo de salir esposado.“¿Por qué me van a arrestar?”, me preguntó. “No

he hecho nada malo.”“¡Usted está aquí ilegalmente!”, respondí.

Me miró pálido y dijo: “¿Sólo por eso?”“¡Ay! Sí, sólo por eso.Después me di cuenta que él creía que ellos

no estaban arrestando a la gente que no tienen ningún problema criminal. Eso es otra cosa que leyo en Internet. Pues, tengo muchos clientes en deportación que no tienen ningún récord criminal.

Sólo por mala suerte fueron arrestados… nada más.

Pero esta situación era diferente. Este hombre quería ir p e r s o n a l m e n t e a l S e r v i c i o d e Inmigrac ión , en contra del consejo de su abogada. Decidí acompañarlo.

La oficial que nos a t end ió e ra muy amable, muy simpática. Preguntó a la esposa si era residente o ciudadana.

Cuando respondió, la oficial me miró. “Si e l la es só lo residente, tenemos un problema”.

“ Yo l o s é ” , r e s p o n d í . “ H e

hablado con ellos pero...”“No lo captan”, interrumpió.“Sí, no entienden”, dije.Entonces, ella les explicó precisamente lo mismo

que yo hab�a dicho antes. Y no llam� a los oÞciales de ICE para sacarlo en esposas, pero me informó que no tenía opción; que tenía que mandar el archivo a “las personas de la NTA”.

El NTA es el documento que ICE usa para empezar el proceso de deportación. Lista las alegaciones contra el inmigrante (que es ciudadano de tal país, que no es ciudadano de EE.UU., que entró en tal fecha con tal visa y que se quedó demasiado tiempo. Adem�s, el cargo oÞcial contra el inmigrante). En resumen, ella va a mandar el caso de ICE.

Es muy frustrante para mí, cuando un cliente no escucha mi consejo. Este hombre podría haber retirado su solicitud para ajuste de estatus y probablemente no habría pasado nada. CIS habría mandado su archivo al Centro de Archivos y nada más. Ahora, eventualmente, este hombre tendra que ir frente a un juez y pagar mucho más dinero por este error. Su mujer tiene que hacerse ciudadana, lo cual tal vez será muy difícil, porque después de 5 años acá, todavía no habla mucho ínglés.

Si su abogado le da un consejo que no cree, vaya con otro abogado para una segunda opinión. Eso sería mucho mejor que encontrarse en deportación… ¿no cree?

On April 13, the Samuel U. Rodgers Health Center hosted a signing ceremony for the

contractors, founders and employees involved with its new facility in Kansas City, Mo.

“This is a serious moment and we have an opportunity (to leave a mark),” CEO Hilda Fuentes said.The new center is in its Þnal phase of construc-

tion. More than $25 million has been invested in the project.

Upon completion, the center is expected to offer care to more than 7,500 Kansas City area patients.

“We are going to meet the future and take care of everyone who walks in that door to receive care,” Fuentes said. “Signing this means moving forward and putting (down) our mark…. It is our commitment to saying, ‘Yes.’ ”

Since its foundation, Samuel U. Rodgers has been revered for its commitment to serving the area. According to statistics from Samuel U. Rogers, the center serves around 18,000 area residents.

Emira Palacios, Immigrant Rights Initiative Coordinator at Sunßower Commmunittee Action, attended the protest to oppose Kobach’s poten-tially harmful policies.

“Once a law [similar to AZ’s SB1017] was passed in Oklahoma, they suffered greatly and lost many workers. In housing, for example, so many homes went unÞnished,Ó Palacios said.

When the law passed in 2009, the SCA tracked a exodus of roughly 25,000 workers.

“What we’re here to do is say, ‘Immigrants don’t affect the economy; they support it and, honestly, they probably contribute more than some citizens’,” Palacios said.

SCA has found for immigrant rights and contributed to the effort to offer undocumented students in-state tuition in Kansas.

LAND organizer and KU Freshman Sean Weston also came to turn a lecture, a one-way conversation, into a very loud conversation.

“According to Kobach, immigrants are a drain on social services,” Weston said. “That argument hinges on the idea that they don’t pay taxes, which is false.”

One of Kobach’s views the protestors came out to oppose was the barring of undocumented students in the education system. According to him, undocumented students don’t belong in the school system because it’s a “public service,” as are Social Security and Medicare.

In Missouri, Kobach has helped craft policies that prohibit undocumented students from attend-ing college. He defended his policies in a speech titled Security Impact.Ó Citing Þgures such as the $235 million per year undocumented students consume in services, the $89.1 billion per year the undocumented population uses in public services and the 7 million workers in the workforce, he argued for stricter enforcement of immigration laws. He even argued for the enforcement by considering it a job creation strategy.

“If you want to create a job for a U.S. citizen tomorrow, deport an illegal immigrant today,” Kobach said.

He also criticized the Obama administration for taking a lax approach to immigration law, pointing out there were 17,000 cases that were

In the end, people need an informed media to discuss the points Kobach addressed, according to Sethi.

“We need to have greater truth telling in (the) media,” Sethi said.

Through the years, many of the Venezuelan president’s political adversaries have opted

to leave the nation after being targeted and harassed by the regime. The ones who remain dare not confront Chavez directly or challenge him publicly.

Maria Corina, as she’s known in Venezuela, is different.

Since September 2010, when she was elected by an overwhelming majority to a seat in the National Assembly, Maria Corina has constantly challenged Chavez’s authoritarian regime,

which has retained power in the nation since 1999. In doing so, she has quickly become among the opposition’s most influential leaders, insisting the time has come for a new era of openness and true democracy in Ven-ezuela. During an impassioned speech in late February on the National Assem-bly ßoor, she deÞ-antly held up a card that read “649.”

“ T h a t ’ s t h e number of days left for this govern-ment,” she said. “Mr. President, your time is Þnished ... our time is just starting.”

During a recent interview, I asked Maria Corina about

the efforts in Venezuela to oust Chavez, an astute politician who’ll seemingly go to any lengths to stay in power. Can he be defeated with votes, rather than with violence?

“Absolutely – and the president knows it,” she answered with conviction. “That’s the reason for the fear he has exhibited.”

Chavez seems afraid. He has often attacked Maria Corina directly, daring her to run for president against him in 2012.

“That little bourgeois woman with a nice Þgure,Ó Chavez called her in a recent speech, quoting a popular song. “Go ahead and get into the fray so you can know the fury of the people.”

She remains undeterred by Chavez’s taunts.“The president has lost touch with the Venezu-

elan people,” she told me. “I don’t care what the president of the republic calls me. I care what my fellow citizens call me. They call me Maria Corina – and they call me that with affection.”

Maria Corina is a co-founder of Sumate, an election-monitoring organization in Venezuela that tried unsuccessfully to remove Chavez from power in 2004 through a national recall referen-dum. In 2002, Sumate’s leaders were charged with treason and conspiracy for allegedly lending their support to an attempted coup d’état against Chavez and accepting funds from the United States. Maria Corina denies having supported the coup, but admits to having received money from abroad, “as hundreds of organizations in the world do,” she explained.

“In Venezuela, we received funds from the United States Congress and from other govern-ments,” she said. “This happens with all the organizations that champion human rights.”

The charges against her are pending.As for the 2012 presidential election in Venezu-

ela, Maria Corina isn’t naive. She knows Chavez will have a huge advantage against any challenger.

“President Chavez indeed has financial resources,” she told me, pointing out that he also essentially controls the media in Venezuela and will likely resort to intimidating voters and opposing candidates. But Maria Corina, a mother of three, refuses to be intimidated.

“Venezuela’s elections will not be free and fair,” she said. “But the strength of the people will not be hampered by a president – or by any other autocrat – who tries to bring Venezuela to its knees.”

Marina Corina believes Venezuela’s next president must exhibit the moral authority and executive ability to lead, and must be a true rep-resentative of the people, not of special interests. Will she be that president?

“I have decided to dedicate my life to my country,” she said.

When pressed to reveal whether she would run, she would only say, “It’s premature to discuss names at the moment.”

For now, Maria Corina knows her mission to remove Chavez from power is a massive under-taking, a daily battle to be fought.

“You have to conquer liberty every day. It is not a given,” she said.

But her dedication to the nation and its people keep her committed to this cause.

“I worship my country – Venezuela is an extraordinary country where I want to live, and where I want my children’s children to grow up,” she said.

The political opposition in Venezuela remains fractured, and those divisions make it difÞcult to piece together a uniÞed action plan thatÕs acceptable to all anti-Chavez factions. We must wait until December 2012 to see if this changes.

In the meantime, whether or not Maria Corina decides to run, she’s the most courageous voice of opposition challenging the Chavez regime. She’s nothing less than the woman he fears most.

Muchos de los opositores políticos de Chávez han dejado Venezuela, han sido inhabilitados

o no se han atrevido a enfrentarse directamente a él o a retarlo en público.

Pero María Corina, como es conocida popularmente en Venezuela, es distinta.

Desde septiembre de 2010, cuando fue elegida a la Asamblea Nacional por una abrumadora mayor�a de votos, ella ha desaÞado una y otra vez al régimen autoritario de Chávez, que ha conservado el poder desde 1999. Y al hacerlo, se ha convertido rápidamente en una de las líderes opositoras más inßuyentes, insistiendo en que ha llegado la hora de una nueva era de apertura y democracia real en Venezuela.

Durante un apasionado discurso a Þnales de febrero en la Asamblea, ella alzó, desaÞante, un letrero en el que se leía “649”.

En una entrevista reciente, pregunté a María Corina acerca de los esfuerzos en Venezuela para derrotar a Chávez, un político astuto que al parecer hará lo que sea -- legal o no -- para permanecer en la presidencia. ¿Se le puede ganar a Chávez por las buenas, con votos y no con balas?

“Absolutamente y el Presidente lo sabe”, me dijo, segura. “Y por eso el miedo que está demostrando y las reacciones agresivas, de desca l i f icac ión , de intimidación”.

Efectivamente, Chávez parece tener miedo. Frecuentemente ha atacado directamente a María Corina, retándola a postularse como candidata a la presidencia contra él en 2012. Ò�sa es una burguesita de Þna estampaÓ, dijo el Presidente venezolano en un discurso reciente, citando la letra de una canción popular. “Ahh, lánzate pues, burguesita de Þna estampa para que t� veas lo que es la furia del pueblo”.

Y ella aceptó el reto. “Eso lo que demuestra es que el Presidente perdió el contacto con los venezolanos”, me dijo. “A mí no me importa; me tiene absolutamente sin cuidado cómo me llame el Presidente de la república. Me importa como me llamen mis conciudadanos. Me llaman María Corina -- y lo hacen con afecto”.

Chávez y María Corina se saludaron una vez en la Asamblea. ¿Qué pasó? “El presidente Chávez me habló a mí, me dijo que conocía a mi madre. Le envió saludos a mi madre y yo le regresé saludos a la suya”. Vi el video del encuentro. Pura frialdad. Ninguno parpadeó.

María Corina es de las fundadoras del grupo Súmate, una organización de monitoreo electoral venezolana que en 2004 intentó, sin éxito, sacar a Chávez del poder con un referendo nacional revocatorio.

Dos años antes, los líderes de Súmate fueron acusados de traición a la patria y conspiración por apoyar el golpe de Estado contra Chávez y por haber recibido dinero de Estados Unidos.

María Corina niega haber apoyado el golpe, pero sí reconoce haber recibido ayuda del extranjero. “como lo hacen cientos de organizaciones en el mundo”, me explicó, “en Venezuela recibimos fondos del Congreso de Estados Unidos y de otros gobiernos. Ocurre con todas las organizaciones que deÞenden los derechos humanos”.

Las acusaciones judiciales en su contra están pendientes. Pero ella sigue adelante. “No aceptamos el atropello, la ofensa y cómo se ha sembrado la violencia y la confrontación de los ciudadanos en medio de la bonanza petrolera más grande de nuestra historia”, dijo.

En cuanto a los comicios presidenciales del año entrante en Venezuela, ella no es ingenua. Sabe que Chávez tendrá una enorme ventaja contra cualquier adversario.

“Oiganme bien: efectivamente el presidente Chávez tiene recursos financieros”, me dijo, señalando que él también esencialmente controla los medios de comunicación en Venezuela, y que es muy probable que recurra a la intimidación tanto de votantes como de candidatos de oposición. Pero María Corina se niega a ser intimidada.

“Las elecciones en Venezuela no serán libres y justas. Pero la fuerza del pueblo de Venezuela no la puede detener ni el presidente Chávez ni ningún otro autócrata que trate de poner a Venezuela de rodillas”.

Ella cree que el próximo presidente de Venezuela debe tener autoridad moral, capacidad ejecutiva para dirigir y ser un verdadero representante del pueblo, no de intereses especiales.

Esta madre de tres, que se rehusa a vivir en otro país, cree que el próximo presidente o presidenta de Venezuela debe tener autoridad moral, capacidad ejecutiva y no representar a ningún sector en particular.

Pero ¿será ella?“Yo decidí dedicar mi vida a servir a mi país”, me

comentó. Y cuando la presioné al preguntarle si se lanzaría por la presidencia, me dijo que “es prematuro hablar en este momento de nombres”.

La oposición política a Chávez se ha caracterizado por sus divisiones y por su falta de un plan común de acción. Ya veremos si para diciembre del 2012 las cosas son distintas. Mientras tanto, se lance o no, María Corina es hoy en día la voz más clara, directa y valiente frente al chavismo. Ella es la mujer a la que más le teme Chávez.

María Corina sabe que su tarea -- sacar a Chávez del poder- es cuesta arriba.

“La libertad se conquista todos los días. No se hereda”. Pero ya sabe por qué lo hace.

“Yo adoro mi país; Venezuela es un país extraordinario donde quiero vivir y donde quiero que crezcan los hijos de mis hijos”.

Aunque sus “niños” adorados son unos perros retriever dorados, Jake y Nikita, la nativa de Kansas City, Mo, está comprometida a una colaboración plena con la educación y a alentar a chicos humanos. Ella sirve en la junta de la preparatoria charter Alta Vista. Duranto 8 años de los casi 27 que estuvo en AT&T, encabezó una campaña nacional para recabar fondos para la Asociación Hispana del Fondo de Becas de Empleados de AT&T. También ha sido voluntaria con la Competencia del Área Metropolitana de Kansas City por la Inspiración y Reconocimiento de las Ciencias y Tecnología Robótica y sirvió en un grupo asesor para el programa puente a la universidad ‘Escalera’ de los Centros Guadalupe Inc. (GCI).

Coyazo’s involvement with BizFest 2011, though, was hands-on. She recruited one of the judges for the business plan competition. During the workshop, she helped behind the scenes and coached participants.

Although her beloved “chil-dren” are golden retrievers, Jake and Nikita, the Kansas City, Mo., native is committed to full partnership in educating and encouraging human kids. Coyazo serves on the board for Alta Vista Charter High School. For eight of the nearly 27 years she was with AT&T, Coyazo

headed national fund raising for the Hispanic Association of AT&T Employees scholarship fund. She’s also volunteered with the Greater Kansas City For Inspiration and Recognition of Science and Technology Robotics Competi-tion and served with an advisory group for the Escalera College Bridge program at Guadalupe Centers Inc. (GCI).

“I like working with students,” Coyazo said. “I can share my business knowledge, answer their questions and be a role model for them.”

Coyazo’s community service isn’t limited to youth-serving interests. She’s on the board of the Women’s Foundation of Greater Kansas and chairs the annual fund-raising golf tourna-ments for the Mid-America Minority Business Development Council (MAMBDC) and GCI. The beneÞt matches are consistently on the upswing, growing annually in popularity and proÞt. Coyazo credits Westside civic leader Robert Soltero and Kansas City area residents and merchants for that.

“Bob taught me what I needed to know to plan a golf tournament,” she said.

To carry it off successfully, Coyazo said, “You get a committee of hard-working people and a lot of volunteers, golfers and sponsors. Luckily, we have a lot of really committed, community-oriented people here. Even in this economy, these events get bigger every year, which is great.”

The annual MAMBDC tournament raises money for local charities. GCI tournament proceeds support the Tony Aguirre Scholar-ship Fund.

As supplier diversity manager for the Kansas City Power & Light (KCP&L) Co. since 2008, Coyazo works to swell the utility’s ranks of small vendors and women- and minority-owned businesses. She works to improve access and generally smooth the way for qualiÞed Þrms to win contracts on merit. KCP&L has about 1,600 Þrms in its supplier base. Coyazo held the same position from 2005 to 2008 at Aquila Inc.CoyazoÕs daily dealings with proÞtable

small and minority-owned Þrms have yielded an impressive portfolio of smart business practices and inspiring success stories. That’s what she shares with youngsters through her community service.

Andrew inscribió a Liliana en Southwest el verano pasado poco después que el distrito había recortado $50 millones en su presupuesto y cerrado 28 escuelas. Como resultado, la población estudiantil de Southwest se triplicó por la absorción de otros alumnos.

Liliana fue sincera con respecto a su experiencia en Southwest: no perfecta, pero satisfactoria.

“Este año ha sido un desafío”, comentó. “Pero realmente, eso no se registr� hasta el Þnal. Permanec� con maestros y amigos buenos. Mis amigos y yo nos aguantamos con nuestros profesores”.

Después de la preparatoria, Liliana está decidiendo dos caminos educativos. El primero involucraría asistir dos años al Colegio Comunitario Penn Valley, para estudiar posteriormente en la Universidad de Missouri-Kansas City (UMKC) y dar clases a nivel preparatoria. El otro involucraría ir directo a UMKC y luego a la enseñanza urbana.

Aunque sus padres adoptivos le han allanado el camino para conseguir su estatus legal, ella sabe que no todos son tan afortunados. Como maestra, promete enseñar a cualquiera que esté deseoso de aprender.

Alumnos de East superan la adversidad política y social

Liliana was candid about her experience at Southwest: not perfect, but satisfactory.

“This year’s been a challenge,” she said. “But really, (that) didn’t register until the end. I stayed with good teachers and good friends. My friends and I stick out to our teachers.”

Liliana said she would improve Southwest by offering more comprehensive services to those learning English as a second language.

“We could have more Spanish teachers, even more teaching in Spanish,” she said. “These students are very good assets. They have some-thing to bring to the table.”

After high school, Liliana is deciding between two educational paths. The Þrst would involve attending two years at Penn Valley Community College, followed by studying at the University of Missouri-Kansas City (UMKC) and teach-ing at the high school level. The other would involve going straight to UMKC and then into urban teaching.

Although Liliana’s adoptive parents have smoothed her path to achieving legal status, she knows not all are as fortunate. As a teacher, she pledges to teach to anyone willing to learn.

“People are people,” she said. “Of all the individuals, they are most deserving of an education.”

East students overcome social, political adversity

In May, Magali Rojas, Scarlett Vargas and Ruth Aguilera will graduate from East. Aguilera will be the class valedictorian.

“I don’t want to leave,” Aguilera said. “I do and I don’t.”

One reason she doesn’t want to leave is because of the solidarity at East. Although East has had a difÞcult year because of the doubling of the student body and accommodating high school and middle school students in one build-ing, Aguilera still loves the school, she said.

The other girls share her opinion. When Vargas’ family moved to Independence, Mo., she had the opportunity to attend Van Horn High School, which is in the Independence School District. Even with its better funding and nicer facilities, Vargas stayed at East.

“When I talk to students who go to Van Horn, they’re like, ‘We’re so much better,’ ” said Aguilera.

East’s instructors have to address the com-parison issue.

“(Our) teachers tell us not to compare our schools to others and just do our best,” said Rojas. “But it would be nice to have that new soccer Þeld (Van Horn has).Ó

Rojas is the captain of East’s soccer team and involved in JROTC. Aguilera also is in JROTC and involved with the student council. Vargas is active in her church.

Vargas will attend Penn Valley in the fall and study to be a registered nurse. Rojas will attend Donnelly College in Kansas City, Kan. Aguilera is considering Rockhurst University and Donnelly.

Aguilera’s status as an undocumented immi-grant has inßuenced her educational path.

Ella es capitana del equipo de fútbol de East y participa en JROTC. Ruth también está en JROTC y participa en el Consejo Estudiantil. Scarlett es activa en su iglesia.

Scarlett irá a Penn Valley en el otoño y estudiará para ser enfermera registrada. Magali irá al Colegio Donnelly en Kansas City, Kan.

Ruth está considerando la Universidad Rockhurst y Donnelly; su estatus como inmigrante indocumentada ha inßuido en su camino educativo. Las instituciones estatales en Missouri no pueden admitirla. Sin embargo, Donnelly puede porque está en Kansas y Rockhurst tiene más margen de maniobra ya que la escuela de Kansas City, Mo., es una institución privada. un “futuro más brillante” para el distrito escolar. Con $37 millones en recortes anticipados, 38 ediÞcios vacíos y más de 100 maestros programados para ser reemplazados por reclutas de Teach for America (Enseñando por América), el futuro parece incierto para el distrito.

Conseguir alumnos que asistan a las escuelas de Kansas City puede ser algo difícil de vender, admitió Brittney McGinley, Asesora universitaria de East. Aún así, ella cree que el distrito está en alza.

State institutions in Missouri cannot admit her; however, Donnelly can because it’s in Kansas and Rockhurst has more leeway because the Kansas City, Mo., school is a private institution. Aguilara and her mother petitioned Rockhurst to attend. The school consented.

“I thought it would be impossible, but I knew I had to go to college,” Aguilera said.

Aguilera’s experience at East has prompted her to continue her education.

“I know what happens in these schools,” she said. “I know how it feels. I want to be part of the solution.”

Brighter future wantedA recent Kansas City Star editorial called for

a “brighter future” for the school district. With $37 million in anticipated cuts, 38 vacant build-ings and more than 100 teachers scheduled to be replaced with recruits from Teach for America, the future looks uncertain for the district.

Getting students to attend the Kansas City schools can be a hard sell, admitted Brittney McGinley, East’s college advisor. Still, she believes the district is on the upswing.

“It’s true there has been a lot of change,” McGinley said. “We’re only moving forward from here.”

Southwest Principal Ben Boothe feels positive about his school, even though he’s the third Southwest principal this year.

“Southwest has its challenges, but 99 percent of the students are as willing to work as hard students (as) anywhere,” Boothe said. “Look at beginning of year to now. We’ve turned things around. We are improving.”

Boothe will leave Southwest at the end of the school year to work in the Leavenworth (Kan.) School District, which will afford him more time to work on his doctorate.

Bakery serves Mexican and American types of bread

Fanny Rivera dreamed of owning a bakery in Kansas City, Mo.’s Westside neighborhood.

In March, after waiting for 14 years, she got her chance.

Rivera recently opened Fanny’s Cakes. Open 8 a.m.-9 p.m. Monday-Sunday and located on 906 Southwest Blvd., the bakery offers various types of Mexican and American bread.

For Rivera, offering a variety of products means a lot.

Fanny proviene de una familia de panaderos. Su tía tiene su propia panadería. Su abuelita le enseñó varias recetas de pasteles.

“La idea de mezclar azúcar, harina y huevos, y el ver todo el proceso me hace pensar sobre cuán increíble es el negocio de la pastelería”, concluyó.

Types of Mexican bread the bakery offers include conchas, orejas, bande-rillas and empanadas. Other products include cookies, polvorones, bolillos and doughnuts.

In addition, Rivera bakes the tradi-tional “pastel tres leches” (“three-milk cake”), a mocha latte cake and a lemon pie. Her cakes are sold in three sizes: sliced, small and medium.

Customers may order a customized cake for children by placing the order between two and three days in advance. Regular cakes may be ordered with a one-day advance notice.

Fanny’s Cakes also offers traditional Mexican desserts, such as ßan, lol-lipops and ice cream.

Rivera prides herself in the qual-ity of material she uses.

“I try to use the best products to offer my clients the best bread,” Rivera said.

Rivera came with the idea of opening her bakery when people started telling her she had baking talent. “I started cooking my grand-ma’s recipes and people started loving them,” Rivera said.

Rivera comes from a family of bakers. Her aunt had her own bakery. Her grandma taught her various cake recipes.ÒThe idea of mixing sugar, ßour,

Forum held to discuss DREAM Act

On April 13, Penn Valley Community Col-lege in Kansas City, Mo., hosted a forum

to discuss the Development, Relief and Education for Alien Minors (DREAM) Act.

Organized by Communities Creating Oppor-tunity (CCO), Advocates for Civic Engagement (ACE) and the Organization of Latin American Students (OLAS), the forum was designed to examine various issues related to the proposed federal legislation, which was introduced in 2004. Since then, the DREAM Act has endured a long Þght for approval, as part of other bills at times and as stand-alone legislation.

“We work with communities in the North-east (part of Kansas City, Mo.) and they’re

pretty disillusioned,” said CCO leader Wendy Medina, who’s also in the ACE and OLAS. “We were getting questions like, ‘What is this?’ and ‘When will it be passed?’ So we wanted to Þnd a way to bring the DREAM Act to Penn Valley and advance civic engage-ment.”

If approved, the DREAM Act would pro-vide a path to citizen-ship for undocumented U.S. residents, provided they could meet cer-tain requirements. For example, they would need to graduate from

high school, keep a clean criminal record and plan to attend college or enlist in the armed forces.

The need for a forum also became evident after Sen. Richard Durbin, the chief spokesman for the DREAM Act, recently reintroduced the bill. A mere Þve votes defeated the bill.

Participants in the discussion included Medina; immigration attorney Angela Ferguson; Pastor Chuck Tobin of St. Sabine in Belton, Mo.; Joshua Flowers, ACE president; and Judy Ancel, direc-tor, Institute for Labor Studies at the University of Missouri-Kansas City (UMKC).Ancel clariÞed the complex history of college

admissions’ policies regarding undocumented students. When the DREAM Act was introduced in 2004, Missouri legislators called for the University of Missouri to testify before the legislature on their admissions policies for undocumented students, which the school denied admitting. In 2008, House Bill 1549 was drafted by the House Immigration and Trade Committee, which required schools to check the legal status of each student. It was written with the help of Kris Kobach, who appeared before the committee and suggested making it a crime to admit undocumented students under federal law.

In 2009, with Kobach’s help, the Missouri Leg-islature crafted House Bill 390 to replace House Bill 1549, calling for the veriÞcation of student status only where students are receiving federal aid, about two-thirds of undergraduates, accord-ing to the Department of Education.

“In my view, it’s bad policy,” Ancel said. “There aren’t any other states that do that. In Kansas, (undocumented students) can pay in-state tuition;

Se realiza foro para discutir la ley DREAMEl 13 de abril, el Colegio Comunitario Penn Valley

en Kansas City, Mo., organizó un foro para discutir la ley DREAM (Desarrollo, Ayuda y Educación para Menores Extranjeros).

Organizado por Comunidades Creando Oportunidades (CCO), Defensores de la Participación Ciudadana (ACE) y la Organización de Estudiantes Latinoamericanos (OLAS), el foro fue diseñado para examinar varios asuntos relacionados con la legislación federal propuesta, que fue presentada en el 2004. Desde entonces, la ley DREAM ha pasado por una larga lucha para su aprobación, como parte de otros proyectos de ley en algunos momentos y como una legislación independiente.

“ N o s o t r o s t r aba jamos con comunidades en el Northeast (parte de Kansas City, Mo.) y ellos están bastante desilusionados”, comentó la líder de CCO Wendy Medina, que también e s t á en ACE y OLAS. “Estábamos recibiendo preguntas como: ‘¿Qué es esto?’ y ‘¿Cuándo va pasar?’ Así que queríamos encontrar una forma de traer la ley DREAM a Penn Valley y avanzar la participación ciudadana”.

De ser aprobada, la ley DREAM otorgaría una camino hacia la ciudadanía a los residentes de EE.UU. indocumentados, siempre que pudieran cumplir ciertos requisitos. Por ejemplo, necesitarían graduarse de preparatoria, mantener un récord criminal limpio y planear asistir a una universidad o enrolarse en las fuerzas armadas.

La necesidad de un foro también se volvió evidente después de que el Sen. Richard Durbin, Vocero principal del DREAM, reintrodujera recientemente el proyecto de ley. Por tan sólo 5 votos fue derrotada.

Ancel aclaró la compleja historia de las políticas de admisión universitaria con respecto a los estudiantes indocumentados. Departamento de Educación.“Bajo mi punto de vista, es una política mala”, señaló

Ancel. “No hay ningún otro estado que haga eso. En Kansas, (los alumnos indocumentados) pueden pagar matrícula dentro del estado; en Missouri, ni siquiera pueden asistir. Es como decirles, ‘Ni siquiera se molesten por hacerlo bien’ ”.

La relación no sólo es discordante, sino también irónica: la escuela charter Alta Vista en Kansas City, Mo., tiene lazos estrechos con UMKC y Penn Valley, y aún así ninguno de sus alumnos indocumentados puede ser admitido en ninguna de esas escuelas.

Ancel insistió que el derecho de los estudiantes indocumentados de buscar un estatus legal en Estados Unidos es esencial debido a las malas perspectivas de empleo en México.ÒSi Kobach se molestara en ir a M�xico y veriÞcar las

posibilidades de empleo, él encontraría que esencialmente las únicas posibilidades de empleo son el ejército, las narcopandillas e ir a EE.UU.”, agregó.

La economía mexicana ha sido devastada tanto por la pobreza y corrupción como por las políticas de intercambio comercial injustas, como el Tratado de Libre Comercio Norteamericano (NAFTA), según ella.

“El efecto de NAFTA en México fue llevar a la bancarrota a millones de productores rurales”, indicó. “Entre NAFTA y los ajustes requeridos por el Fondo Monetario Internacional, su clase media ha sido devastada. El aumento posterior de la inmigración no autorizada hacia EE.UU. es un resultado directo”.

“Hasta que tengamos un claro entre la relación entre la política exterior y las leyes de inmigración, no vamos a resolver esto”, continuó. “Cualquier propuesta de reforma migratoria debe también ocuparse de lo que está impulsando a la gente fuera de M�xico Ð y eso signiÞca cambiar nuestras políticas exterior, de comercio y de inversión”.

Por otro lado, pareciera que las políticas de Missouri son sólo políticas promulgadas por la Junta Coordinadora de Educación Superior y no es una ley estatal; por lo tanto, pudiera ser cambiada sin pasar por la legislatura de Missouri. Eso es lo que está tratando de hacer CCO.

“Nosotros estamos tratando de ayudar a grupos estudiantiles a establecer una relación con (gente en) admisiones”, informó Medina.

Un cambio en la política podría entonces abrir las puertas a estudiantes indocumentados en Missouri mientras la ley DREAM espera ser aprobada en el Congreso. Medina permanece positiva de que el proyecto de ley será aprobado.

“La gente ha estado trabajando en esto por mucho tiempo. Sólo es cuestión de tiempo”, concluyó.Requisitos para la ley DREAM:

The relationship is not only discordant, but also ironic: Alta Vista Charter School in Kansas City, Mo., has close ties with UMKC and Penn Valley, yet none of its undocumented students may be admitted to either school.

Ancel insisted the rights of undocumented students to pursue legal status in the United States are essential because of the ill job pros-pects in Mexico.

“If Kobach would bother to go to Mexico and check out the job possibilities, heÕd Þnd that essen-tially the only job possibilities are (the) military, narco-gangs and going to the U.S.,” Ancel said.

Mexico’s economy has been ravaged as much by poverty and corruption as it has by unfair trade policies, such as the North American Free Trade Agreement (NAFTA), according to Ancel.

“NAFTA’s effect on Mexico was to bank-rupt millions of rural producers,” Ancel said. “Between NAFTA and the adjustments required by the International Monetary Fund, its middle class has been devastated. The subsequent surge of unauthorized immigration into the U.S. is a direct result.”

“Until we get a clear between relationship between foreign policy and immigration law, we’re not going to solve this,” she continued. “Any immigration reform proposal must also deal with what’s driving people out of Mexico – and that means changing our foreign, trade and investment policies.”

On the other hand, the Missouri policy appears to be only a policy enacted by the Coordinating Board of Higher Education and is not a state law; thus, it could be changed without going through the Missouri Legislature. That’s what the CCO aims to do.

“We’re trying to help student groups establish a relationship with (people in) admissions,” said Medina.

A change in policy would then open the door to undocumented students in Missouri while the DREAM Act awaits approval in Congress. Medina remains positive the bill will be passed.

“People have been working on this for a long time,” she said. “It’s only a matter of time.”QualiÞcationsfortheDREAMAct:

Established in 1990, the f e s t i v a l i s designed to create a greater sense of aware-ness of the mul-tiple cultures cohabitating in Wyandotte County.

In keeping with that, the festival will feature booths

represent ing various coun-tries, includ-ing Colombia, Paraguay, Peru, Slovenia, Ger-many and The Netherlands.

In addition, there will be various shows, including pre-s e n t a t i o n s of native folk dances. Visitors also may sample various ethnic

foods. Moreover, various prizes will be given away.

KCP&L’s ProposalKCP&L’s petition in this case includes a request for predetermination of ratemaking principles that will apply to the recovery of costs to be incurred during the environmental upgrade of its LaCygne power plant. The LaCygne Generating Station is comprised of two coal-�red units. Unit 1 has a net generating capacity of 736 MW, and Unit 2 has a net generating capacity of 682 MW. KCP&L owns 50% of LaCygne. Kansas Gas and Electric Company, a wholly owned subsidiary of Westar Energy, owns the other 50% of LaCygne. KCP&L is responsible for operating both units.

KCP&L’s Application states signi�cant investment in environmental equipment and a common chimney for both LaCygne units is needed in order to meet current and pending environmental rules and regulations. The estimated total cost of these investments is $1.23 billion for the total project excluding Allowance For Funds Used During Construction (AFUDC) and property taxes. Of this amount, $281 million affects KCP&L’s Kansas customers.

Under traditional ratemaking, KCP&L estimates that its Kansas annual revenue requirement will increase $58.2 million starting in 2016 and then decrease over time. Under this method, KCP&L estimates the average residential customer bill (assuming 12,000 kWh per year – 1,200 kWh per summer month and 800 kWh per winter month) will initially increase $8.27 per month beginning in 2016 with the impact decreasing over 20 years to about $3.70/month. Alternatively, KCP&L requested an Environmental Cost Recovery rider for the LaCygne Environmental Project. If this alternative method is approved, KCP&L would instead be able to recover the cost incurred from the proposed plant upgrades through a line item on customer bills beginning in 2012 that will be updated annually. The expected impact to the average residential customer bill under this alternative would start at $0.60/month, gradually increasing to $7.77/month in 2016, and then decreasing to about $3.51/month over 20 years.

KCP&L needs to upgrade the emissions control equipment for its LaCygne Generating Station by June 1, 2015. This will allow the Company to meet its obligations under its agreement with the Kansas Department of Health and Environment, the agency responsible for ensuring compliance with federal EPA air quality regulations. Our analysis indicates making these environmental retro�ts and continuing to oper-ate LaCygne is the best option for providing reliable affordable electricity to our customers.

> KCP&L initiated a process to provide information and seek approval from the KCC.

In February, KCP&L made a �ling with the Kansas Cor-poration Commission that seeks approval of the costs for these environmental retro�ts and determination on how these costs will be included in our rates. This is known as the predetermination process. It provides a framework for approval to move forward with the pro-posed environmental retro�ts and to determine how the cost of the retro�ts might be recovered in rates.

Two weeks later, I learned they were reunited. I was embarrassed! Why did I have to open my big mouth and tell her what I thought

of him?I told my

mom about what had hap-pened. She knows about t h e s o c i a l graces. She said, “Didn’t you know it’s bad manners to talk trash about some-oneÕs ex?Ó

I found out that, accord-ing to the rules of eti-quette, what I had done was wrong. The right thing to do in that situ-

ation is to offer your friend your support, with-out saying anything insulting about their ex.

That episode made me wonder what other rules of etiquette I hadn’t followed. I researched the subject and discovered countless norms of correct behavior for every imaginable place, relationship and occasion.

There are rules of etiquette guiding the use of cell phones, sending e-mails, weddings, using Facebook and Twitter. Even public parking lots have their norms of good behavior. But who deÞnes whether conduct is acceptable or not?

The Emily Post Institute offers guidelines for proper etiquette and good manners. According to a study it did, it identiÞed the seven most offensive, vulgar behaviors. They are as follows:

*Using obscene language in public.*Telling racist jokes.*Talking on the telephone in a loud voice

so others can hear.*Treating a service worker (waiter, driver,

etc.) as if they’re inferior.*Not offering your seat to an elderly, preg-

nant or handicapped person.*Cutting in line while everyone else patiently

waits their turn.*Lighting a cigarette around people who

donÕt smoke without asking permission Þrst.Always be your best self and treat everyone

as respectfully as you’d like them to treat you. If, like me, you ever put your foot in your mouth and said something bad about a friend’s ex and then they reunite, you should apologize. If you don’t, your comment could affect your friendship. In my case, I said, “I’m so sorry for saying those things about your husband. I was worried about you, and I was just trying to make you feel better. Forgive me. I’m really very glad to know you are both committed to working on your marriage.Ó

The one and only queen of etiquette Emily Post, once said having good manners means caring about others’ feelings, regardless of the fork you use. So if you consider how other people feel, then you have good manners!

confesé: “nunca te lo dije, pero siempre pensé que tu marido era un arrogante y egoísta”. Dos semanas después me enteré que se habían reconciliado. ¡Quería que me “tragara la tierra!” Pensé arrepentida: ¿para qué tuve que abrir la boca y dar mi opinión sobre su ex?

Le conté a mi m a d r e , q u i e n sabe mucho de protocolos, y me dijo: ¿acaso no sabías que es mala educación hablar mal del ex de otra persona? Así me enteré que, según las reglas de etiqueta, mi comportamiento fue incorrecto. Lo correcto en esta situación es ofrecer apoyo sin hablar despectivamente de un ex. Este incidente me hizo cuestionarme qué otros protocolos hay que ignoro. Indagué información acerca del tema de los buenos modales y descubrí innumerables normas de formalidad para cada lugar, relación y ocasión.

Existen reglas de etiqueta para el uso de celulares, envío de correos electrónicos, bodas, facebook, twitter y hasta los estacionamientos públicos tienen normas de comportamiento. Pero, ÀQui�n deÞne si una conducta es aceptable o no?

El Emily Post Institute en los Estados Unidos ofrece guías de etiqueta y buenos modales, y de acuerdo a sus reglas de protocolo, según un estudio que realizó, determinó siete de los comportamientos más ofensivos y vulgares:

1.- Utilizar lenguaje obsceno en público.2.- Contar chistes racistas.3.- Conversar por teléfono con tono de voz

elevado que otros oigan.4.- Tratar a personal de servicio (mesero, chofer,

etc.) como si fueran inferiores.5- No ceder tu asiento a una persona mayor,

embarazada o incapacitada.6.- Adelantarte en las filas cuando todos

ordenadamente esperan su turno.7.- Encender un cigarrillo alrededor de personas

que no fuman, sin antes pedir permiso.Te motivó a que siempre des lo mejor de ti y

trates a todo el mundo con el mismo respeto que quieres ser tratado. Si al igual que yo, “metiste la pata” y hablaste mal del ex de una amiga y ahora ellos están juntos, debes disculparte. De otra manera tu comentario afectara la amistad entre ustedes. En mi caso, le dije: “Siento mucho haber hablado mal de tu marido. Estaba preocupada por ti y lo hice para hacerte sentir mejor. Perdóname, realmente me alegra saber que ambos están comprometidos en arreglar la relación”.

La famosa gurú en reglas de etiqueta, Emily Post, una vez dijo: “tener buenos modales es tener consideracion sobre los sentimientos de otra persona. No importa el tenedor que uses, si tomas en cuenta los sentimientos de otro, !tienes buenos modales!”

Barto, Wise sense lethargy in Command after loss to Rattlers

and kick returner/wide receiver Christian Wise sensed something was wrong with the Command’s energy level when the team faced the Arizona Rattlers April 16 in the Sprint Center.

“I thought we looked very lethargic all night, especially (at) the skill positions,” Barto said after

the Command’s 63-49 Arena Football League loss dropped the team to 1-4. “We didn’t have any bounce in our step.”

Actually, the energy level was down for both teams, according to Wise, who returned a third-quarter kickoff for a touchdown and had 150 total kick returning yards.

“It just seemed like there was a (sense of) �atness within the game,” Wise commented. “But … we �nished (it). And that’s pretty much the main thing about this game – … �nishing and not giving up.”

Wise suggested the Command would have more energy for Friday’s (April 22’s) road meeting with the Chicago Rush, which will air on nationally on the NFL Network.

“We’re de�nitely going to put our hard hats on Monday (April 18) and get to work,” he said.

Barto, on the other hand, wondered if the Command’s coaching sta� needed to adapt its

approach to the Chicago game, based on the Arizona performance.

“Maybe we’ve got to give them a little more time to try to recuperate (the use of) their legs…. We’re on a short week (and) going to play a tough team in Chicago at their home,” he said.

That stated, it’s sometimes the players’ responsibility to maintain a team’s energy level, according to Barto. As proof, he pointed to Wise’s 54-yard kickoff return for a touchdown, which opened the second half and tied it 28-28. Brie�y, he noticed a spike in the Command’s energy level. But to the Rattlers’ credit, “they kind of stymied that and just kept holding on,” he said.

“We’ve just got to �nd some way to get emotional and get excited,” Barto said.

But Wise suggested it would help the team to take a calm, workmanlike approach to the season overall.

“It’s a long season, and we have a lot stu� that we have to work on as a team,” Wise said.

Pineda defeats KC, impresses Royals with fastball

Seattle Mariners starting pitcher Michael Pineda felt satisfaction after his outing Sunday (April 17) against the Kansas City Royals at Kau�man Stadium.

Making only his third major-league start, the 22-year-old Dominican Republic native struck out �ve, walked four, and allowed only three hits and one run through six innings to help the Mariners edge the Royals 3-2. Of his 94 pitches, 62 were for strikes.

“I’m very happy, very content,” said Pineda, who answered questions in English and Spanish after improving to 2-1. “And I give thanks to God because he gave the opportunity (to pitch).”

Pineda wowed Kansas City Royals manager Ned Yost. According to Yost, there aren’t any adjustments the Royals can make to better prepare for future outings against the right-hander.

“That kid’s got electric stu�,” Yost said during his postgame press conference. “It’s easy to sit back and say we’d make adjustments, but we had a great (game) plan…. The kid threw enough strikes. We weren’t chasing at pitches outside of the (strike) zone. When you’ve got that type of stu� and you throw strikes with it, (as an opposing team), you’re going to have trouble scoring runs.”

Royals out�elder Alex Gordon, who had an 11-game hitting streak through Sunday, including a first-inning single o� of Pineda, agreed.

“He’s got an unbelievable fastball – and that’s what

we knew (about him), so we were kind of sitting on it,” Gordon said. “And I don’t know about everybody else, but he threw me a couple of sliders … for strikes. And if he can locate that (slider), it’s (a) pretty good (pitch)…. With that fastball, … it’s hard to adjust to it.”

Pineda expects his fastball to be his go-to pitch during his big-league career.

“My fastball is the best pitch (I have),” he said. “My fastball was pretty good today.”

Pineda helped the Mariners get their only win in their four-game series with the Royals, who had won seven of 11 games entering their four-game series with Cleveland, which began Monday (April 18) at Kau�man. Kansas City won the �rst three games, played April 14-16, 5-1, 6-5 and 7-0.
