CD. DE MÉXICO – La Policía Federal informó de la captura de Flavio Méndez Santiago, “El Amarillo”, fundador de la organización criminal Los Zetas y presunto responsable del control del tráfico ilegal de indocumentados y de tráfico de droga en el sureste de México.

Ramón Eduardo Pequeño, jefe de la División Antidrogas de la Policía Federal, dijo que Méndez Santiago, de 35 años de edad, se encontraba en la lista de los 37 criminales más peligrosos de México y por él se ofrecía una recompensa de 15 millones de pesos.

Pequeño dijo que El Amarillo fue detenido el 17 de enero en el municipio Villa Etla en Oaxaca e informó que el hombre está siendo investigado por delitos contra la salud, tentativa de homicidio y delincuencia organizada.

Méndez fue uno de varios ex militares mexicanos que desertaron del ejército en la década de los noventa y se convirtieron en el brazo armado del Cártel del Golfo, antes de formar su propia asociación criminal.

De acuerdo con las investigaciones de las autoridades, Méndez Santiago ha sido identificado como la persona encargada de controlar el tráfico de indocumentados centro y sudamericanos desde la frontera sur hasta Nuevo León y Tamaulipas. Era considerado coordinador de la región sur del país para los Zetas, abarcando los estados de Oaxaca, Chiapas y Veracruz. Su centro de operaciones estaba en Oaxaca, pero también tenía presencia en Campeche y Quintana Roo.

Las autoridades también informaron que en 1998 Méndez fue escolta personal de Osiel Cárdenas Guillén, líder del Cártel del Golfo.

Además, dijeron que en 2004 El Amarillo presuntamente participó en la fuga de 21 reos del penal de Apatzingán. En 2008 fue enviado a Guatemala para enfrentarse con bandas rivales locales del narcotráfico para expandir las operaciones de la organización y rescatar a Daniel Pérez Rojas, quien se encontraba en una prisión de la capital del país.

Durante una conferencia de prensa en el Centro de Mando de la Policía Federal, Pequeño dijo que no se ha descartado la posibilidad de que El Amarillo sea responsable del secuestro de migrantes en el estado de Oaxaca, pero que esto será determinado por las investigaciones.

Junto con El Amarillo se arrestó a Carlos Alejandro Rodríguez Cepeda, su escolta personal.

MEXICO CITY – The Federal Police informed they have captured Flavio Mendez Santiago, ‘El Amarillo,’ founder of the criminal organization “Los Zetas,” and alleged responsible for the control of illegal trafficking of undocumented migrants and drugs in the southeast of Mexico.

Ramon Eduardo Pequeño, head of the Drug Enforcement Division of the Federal Police, said Mendez Santiago, 35, was included in the list of the 37 most dangerous criminals in Mexico, and a reward of about $1 million had been offered for his capture.

Pequeño said ‘El Amarillo’ (The Yellow One) was arrested Jan. 17 in the municipality of Villa Etla in Oaxaca and said the man is being investigated for crimes against health, attempted homicide and organized crime.

Mendez was one of several former Mexican Army officers that deserted from the armed forces during the 1990s and became the armed wing of the Gulf Cartel, before creating a separate crime organization.

According to investigations from authorities, Mendez Santiago has been identified as the person in charge of controlling the transit of undocumented

migrants from Central and South America from Mexico’s south border to Tamaulipas and Nuevo Leon. He was considered the coordinator of the South region for the Zetas, covering the states of Oaxaca, Chiapas and Veracruz. His center of operations was located in Oaxaca, but is area of influence included he states of Campeche and Quintana Roo.

Authorities said that in 1998 Mendez was the personal bodyguard of Osiel Cardenas Guillen, leader of the Gulf Cartel. Also they said that in 2004 ‘El Amarillo’ allegedly participated in the escape of 21 prisoners from the Apatzingan detention center in the state of Michoacan. In 2008 he was sent to Guatemala to face local rival drug trafficking organizations to expand the operations of Los Zetas and rescue Daniel Perez Rojas, who was being held at a local prison in the nation’s capital.

During a press conference at the Command Center, Pequeño said they are still investigating if ‘El Amarillo’ is responsible for the kidnapping of migrants in the state of Oaxaca.

Along with Méndez Santiago authorities arrested Carlos Alejandro Rodriguez Cepeda, his personal bodyguard.

AURORA – La semana pasada hablamos con el abogado de inmigración David Richmond sobre qué hacer si las autoridades de inmigración lo arrestan. En la segunda parte de la entrevista, el abogado Richmond habla sobre las detenciones de inmigración y qué se puede esperar.

UNA VOZ: ¿Qué es una orden de detención de inmigración y quién la emite?

DAVID RICHMOND: La Oficina de Inmigración y Aduanas, ICE, es la agencia federal que arresta a las personas por violaciones a las leyes de inmigración y trata de deportarlos de los Estados Unidos. Una orden de detención de inmigración es un mecanismo usado cuando alguien que no es ciudadano estadounidense está en este país y está siendo acusado por la agencia y puesto en proceso de remoción.

Cuando alguien está bajo custodia en una cárcel local, del condado, estatal o federal bajo cargos criminales de otro tipo, ICE le dice a los alguaciles locales que no dejen salir a esa persona hasta que ellos tenga la oportunidad de recogerlos.

UV: ¿Cuánto tiempo permanece alguien en la cárcel antes de ser transferido a la custodia de inmigración?

DR: La ley dice que si una persona ya terminó con su caso local o estatal, ICE tiene 48 horas para recogerlos .Las agencias locales de la ley llaman a ICE y casi siempre los recogen en un periodo de 48 horas.

UV: Si alguien es arrestado por la policía local, puesto bajo custodia y las autoridades le fijan una fianza, ¿la persona debe pagar la fianza o no?

DR: Las autoridades locales no les van a dejar que paguen la fianza, porque si usted paga la fianza, se le transferiría de forma automática a la custodia de Ice, y su caso local no se terminaría. Las autoridades quieren que los casaos que están en el sistema de cortes del estado sean terminados antes de que alguien sea transferido a la custodia de inmigración. Una vez que su caso en el sistema estatal y usted es liberado de prisión o de custodia federal, si existe una orden de detención de inmigración en su contra,

usted es automáticamente transferido al Centro de Detención de Broadview en Chicago.

UV: ¿Qué pasa cuando un detenido llega a Broadview?

DR: En el Centro de Detención de Broadview usted será entrevistado por un oficial de inmigración. Y lo que pasa es, considerando que las violaciones al Acta de Inmigración y Nacionalidad están consideradas como casos civiles y no criminales, usted no tiene la oportunidad de obtener un abogado de oficio, usted tiene que contratar a su abogado de inmigración.

En el centro de detención le van a decir por qué lo están deportando. Esto generalmente está incluido en un Aviso de Presentación (NTA, por sus siglas en inglés).

El Aviso de Presentación le dice por qué lo quieren deportar. Muchas personas están siendo deportadas solo porque están aquí sin autorización, es decir, entraron a los Estados Unidos de forma ilegal y no tienen autorización para estar aquí. Algunos avisos incluyen cargos criminales adicionales que también forman una base para que lo quieran deportar de Estados Unidos.

En el aviso vienen tres preguntas que todos tienen que contestar. Usted puede escoger una de las tres opciones.

En la primera opción usted puede pedir asilo o ayuda en base a crímenes contra tortura. Una persona debe solicitar asilo a más tardar un año después de haber entrado a los Estados Unidos. No hay tiempo límite para pedir ayuda en base a crímenes contra la tortura.

La segunda opción que tiene es pedir lo regresen voluntariamente a su país. ‘Me quiero ir, no quiero nada más que pueda pasar. Ya me quiero ir’.

La tercera opción es que usted quiere ver a un juez de inmigración para que él escuche su caso. Una vez que alguien indique están pidiendo ayuda en base a asilo o crímenes contra tortura, o que quieren ver a un juez de inmigración, ICE determina una fianza.

UV: ¿Qué factores contribuyen a que suba la fianza?

DR: Ice entrevistará al detenido y determinará qué tanto riesgo de escape representa esta persona. Consideran cosas como el hecho de que una persona

haya vivido en la misma área por mucho tiempo, la situación familiar, si están casados y tienen hijos, si sus familiares son residentes permanentes o ciudadanos estadounidenses, si han trabajado en el área por mucho tiempo y si son buenos miembros de la comunidad. Buscan la estabilidad de la persona.

La segunda cosa en la que se fijas es el tipo de riesgo que representa para la sociedad. ¿Han sido acusados anteriormente de alguna actividad criminal? ¿Han tenido numerosos incidentes de manejar bajo la influencia del alcohol o incidentes de violencia doméstica, o cualquier clase de actividad relacionada con las drogas? Entonces ellos van a determinar la fianza.

UV ¿Todos pueden obtener fianza?DR: ICE también hace la determinación de

que si usted está siendo deportado por una felonía agravada que haya cometido, no puede alcanzar fianza. Usted tiene que permanecer detenido. Ellos no pueden dejarle salir bajo fianza, es obligatorio que se quede detenida si la persona ha sido convicta de una felonía agravada.

Si alguien no representa un riesgo de huida y no tiene antecedentes criminales, y Ice cree que esa persona tiene una buena posibilidad de quedarse en los Estados Unidos, algunas veces le dan una fianza de reconocimiento personal, conocida comúnmente como ‘I-bond’, en la que usted firma su nombre y le dejan salir sin cobrarle nada de dinero. Si este no es el caso, la cantidad mínima para una fianza es de mil 500 dólares y puede ir hasta 10 mil dólares.

UV: ¿Se tiene que pagar toda la fianza o solamente le 10 por ciento?

DR: Estas son fianzas 100 por ciento en efectivo, así que tiene que pagar los mil 500, cinco mil o cualquier cantidad que ICE le diga para poder salir. No es como en la corte estatal, en donde usted puede pagar el 10 por ciento de la fianza y salir libre.

UV: ¿Es importante si la fianza no se paga de inmediato?

DR: Es muy importante que salga bajo fianza de la custodia de ICE lo antes posible. ICE tiene una cantidad limitada de camas en los centros locales de detención, algunos de estos centros están localizados en el Condado de McHenry, Illinois, y en los condados de Dodge y Kenosha en

Wisconsin.Lo que pasa es que si usted no puede pagar la

fianza en un periodo corto de tiempo, digamos unos cuantos días, en ocasiones si hay demasiada gente en los centros locales de detención, lo pueden transferir a la jurisdicción de otra corte.

Usted puede ser enviado a Detroit, Buffalo o Texas. Su familia todavía puede pagar la fianza en Chicago, pero cuando usted es liberado de la custodia de ICE, su caso de inmigración se encuentra bajo la jurisdicción de esa zona.

Lo que nosotros tratamos de hacer es que se transfieran los casos a la Corte de Inmigración en Chicago, porque todos sus testigos van a estar en Chicago y es más fácil viajar a Chicago si usted vive en esta área, en vez de tener que ir a Texas cada vez que tiene cita en la corte.

Es por esto que es muy importante que si hay una posibilidad, que trate de pagar su fianza a ICE lo antes posible, eso es lo que yo recomiendo.

UV: ¿Qué pasa después de que alguien sale bajo fianza?

DR: Una vez que alguien sale bajo fianza de la custodia de ICE, es muy importante que hablen con un abogado de inmigración lo antes posible. No espere hasta poco antes de su fecha de corte para hablar con un abogado de inmigración. Muchas citas en la corte se dan hasta para un año después, y durante este tiempo, mientas espera, existen algunas posibilidades de que algunas personas puedan obtener un permiso de trabajo bajo ciertas circunstancias, y una tarjeta de seguro social y una licencia de manejo. Y es muy importante que se cree una buna estrategia legal para determinar si usted va a poder tener la oportunidad de continuar en los Estados Unidos.

AURORA – Last week we spoke with immigration attorney David Richmond about what to do if immigration authorities arrest you. In the second part of the interview, attorney Richmond talks about immigration detention and what to expect.

UNA VOZ: What is an immigration detainer and who issues it?

DAVID RICHMOND: Immigrations and Customs Enforcement, ICE, is the federal agency that arrests people for immigration violations and prosecutes them to try and remove them from the United States.

An ICE immigration detainer is a mechanism used when somebody who is not a United States citizen is in the country and is being charged by the agency and put in removal proceedings.

When somebody is in custody at a local, county, state or federal facility on a different type of criminal charge, ICE tells the local sheriff not to release them until ICE has an opportunity to come pick them up.

UV: For how long does someone remain in jail before being transferred to immigration custody?

DR: The law says that if a person is finished with their local or state case, that ICE has 48 hours to pick them up. Local law enforcement agencies would contact ICE and almost always ICE would pick somebody up within 48 hours.

UV: If someone is arrested by local police, put into custody and authorities set a bond for that person, should they pay the bond or not?

DR: Local authorities would not let you pay that bond, because if you do pay that bond, you would automatically go to ICE, and then your local case would never be finished. Authorities want the cases that are in the state court system to be finished before someone is transferred to immigration custody.

Once your state case is finished and you are released from prison or federal custody, if you have an immigration detainer, you are automatically taken to

the Broadview Detention Facility in Chicago.UV: What happens once a detainee is in

Broadview?DR: At the Broadview Detention Facility you will

be interviewed by an immigration officer. And what happens is, seeing how violations of the Immigration and Nationality Act are considered civil cases, not criminal cases, you are not afforded the opportunity of an attorney. You have to pay for your own attorney, you do not get a public defender.

At the detention facility they will tell you why you are being deported. This is typically included in a Notice to Appear, N.T.A.

The notice to appear will tell you why you are being deported. Many people are being deported just because they are here without authorization, meaning they entered the U.S. illegally and have no authorization. Some notices to appear list additional criminal charges and that also forms a basis for removal from the United States.

In the notice to appear there are three questions they ask everybody. You can choose one of the three options.

The first option, you can ask for asylum or relief based on crimes against torture. A person is required to request asylum within one year of entering the United States. There is no time limit to ask for relief based on crimes against torture.

The second option you have is you can return to your home country voluntarily. ‘I just want to go, I don’t want anything else that may happen, I just want to leave.’

The third option is that you want to see an immigration judge to hear your case. Once someone indicates that they are asking for relief based on asylum or crimes against torture, or they want to see an immigration judge, ICE makes a bond determination.

UV: What factors can make the bond higher?DR: ICE will interview the detainee and determine

what type of flight risk the detainee would be.They look at things like has the person lived in the

area for a long time, what is their family situation, are

they married, have children, are family members U.S. citizens or permanent residents, have they worked in the area for a long time, are they good members of the community? They look at the stability of the person.

The second thing they look at is what type of risk to society the person is. Have they previously been charged with any criminal activity? Have they had numerous DUIs or domestic violence crimes, or any type of drug-related activity? Then they will make a determination and set a bond.

UV: Does everybody get bond?DR: ICE also makes the determination that if you

are being deported for an aggravated felony that you have committed, they will not allow you to bond out. You have to stay in detention. They cannot let you bond out, it is mandatory detention for people who have been convicted of an aggravated felony.

If somebody is not a flight risk and has no criminal activity, and ICE believes you have a very good chance of staying in the United States, sometimes they will issue a personal recognizance bond, commonly known as an I-bond, you sign your name and they let you go, they don’t charge you any dollar amount for that type of bond. Otherwise, the minimum amount that can be set is $1,500 and typically goes up to about $10,000.

UV: Do you have to pay the whole amount, or just 10 percent of the bond?

DR: These are 100 percent cash bonds, so you have to pay the whole $1,500, $5,000 or whatever ICE says in order to bond out. It is not like state court, where you can just post 10 percent of the bond and be released from custody.

UV: Does it matter if bond is not paid right away?DR: It is very important to bond out from ICE

custody ASAP. ICE has a limited amount of available beds at the local ICE detention centers, some of these facilities are in McHenry County, Illinois, Dodge County, Wisconsin, and Kenosha County, Wisconsin.

What happens is, if you are unable to bond out in a short period of time, meaning a matter of days,

on occasion, if there are too many people in local detention facilities, they would transfer you to another court’s jurisdiction.

You may be transferred to Detroit, or Buffalo, NY, or down to Texas. But what happens is your family can still pay the bond in Chicago, but when you are released from custody the new area that you are released from has jurisdiction over your immigration court case.

What we try to do is have those court cases transferred back to the Chicago Immigration Court, because all of your witnesses will be in Chicago, it’s easier to travel to Chicago, if you live in this area, versus every time having to go to Texas for court.

That’s why it’s very important if there is an opportunity, to bond out of ICE custody as soon as possible, that is what I recommend.

UV: After someone is out on bond, what’s next?DR: Once somebody has bonded out of ICE custody,

it is very important that they talk to an immigration attorney as soon as possible. Do not wait until right before the court date to contact an immigration attorney. Many court dates are more than one year in the future, during that time while you are waiting there are some opportunities under certain circumstances to obtain work authorization cards, and therefore social security card and drivers license, for select individuals, and it’s very important to come up with a good legal strategy to determine if you are going to be able to have any opportunity to continue staying in the U.S.

Officers seize 60 lbs. of pot in traffic stop

NORTH AURORA – Oficiales de la Oficina del Alguacil del Condado de Kane decomisaron alrededor de 60 libras de marihuana de alta calidad durante una parada de tránsito en esta población. La droga tiene un valor aproximado en las calles de un millón de dólares.

Dos hombres, Pablo Galeana Rueda, de 34 años y residente del estado de Washington, y José I. Hernández Calderón, de 41 años y residente de California, fueron arrestados la mañana del 14 de enero en la rampa de la Interestatal 88 y la Ruta 31 en North Aurora.

De acuerdo con las autoridades, el automóvil no puso el señalamiento para cambiar de carril en la rampa de salida para la Ruta 31 y no pagó la cuota respectiva en la caseta.

El oficial del alguacil determinó que el vehículo estaba registrado en el estado de Oregon y sus ocupantes venían de la costa oeste al área de Chicago.

Una investigación más a fondo detectó las aproximadamente 60 libras de la droga, que se encontraban en la cajuela del automóvil. Tanto el chofer como el pasajero de la unidad fueron transportados al Centro de Correccionales para Adultos del Condado de Kane.

Ambos sospechosos han sido acusados de un cargo de tráfico de marihuana, una felonía clase X; un cargo de entrega de más de 5 mil gramos de cannabis, una felonía clase X, y un cargo de posesión de más de 5 mil gramos de cannabis, una felonía clase 1.

Ambos se encuentran en la cárcel con una fianza de un millón de dólares, además de que tienen órdenes de retención por parte del Departamento de Inmigración y Aduanas (ICE).

NORTH AURORA – Kane County Sheriff’s officers seized about 60 pounds of high-quality cannabis during a traffic stop in North Aurora. The drug has an estimated street value of $1 million.

Two men, Pablo Galeana Rueda, 34 of Washington State, and Jose I. Hernandez Calderon, 41, of California, were arrested the morning of Jan. 14.

According to authorities, the vehicle failed to signal for a lane change onto the off ramp for Rt. 31 and also failed to pay the toll on the off ramp.

Officials determined the vehicle was registered in Oregon and its occupants were traveling from the west coast to the Chicago area.

On further investigation the officer who made the traffic stop discovered the drugs in the trunk of the car. Both the driver and the passenger of the vehicle were taken into custody and transported to the Kane County Adult Corrections Center.

Both suspects have been charged with one count of cannabis trafficking, a class X felony; a count of delivery of more than 5,000 grams of cannabis, a class X felony; and a count of possession of more than 5,000 grams of cannabis, a class 1 felony.

They are being held at the Kane County Corrections Center on a 1 million bond each and they are also being held on ICE detainers.

Both suspects are scheduled to be in court Jan. 26.

The new hours are 8 a.m. to 5 p.m. According to a release issued by the city, the change in schedule is due to budgetary constraints and to maintain adequate staffing levels for residents who call (630) 256-INFO.

The Customer Service Call Center is a one-stop center for nearly every call or question regarding the city, other than emergencies.

If customers call after hours, they will be directed via voicemail where to report urgent problems, such as sewer backups. Messages left on the voicemail will be addressed the next business day.

Residents can also submit their questions or problems electronically, 24 hours a day, by visiting the city’s web site at www.aurora-il.org.

Besides fielding calls, the customer service representatives handle resident requests for garbage stickers, recycling bins, water bill payments, pet registration, voter registration, Regional Transit Authority applications for seniors and conference room scheduling.

Aurora Police investigates death of homeless man found in dumpster

AURORA – Aurora Police are investigating the death of a 54 year-old homeless man whose body was found inside of a dumpster Jan. 18.

At. 1:53 p.m. officers responded to a call from the Family Dollar, 425 E. New York St., made by two employees who have found the body inside a recycling dumpster located in the store’s parking lot.

The man, Antonio Rodriguez, was pronounced dead at 2:27 p.m.Authorities don’t know yet if foul play was involved. An autopsy has

adolescente acusado de patear a guardia en Kendall

YORKVILLE – Un adolescente de 18 años que fue detenido por una infracción de tránsito terminó siendo acusado de agresión a un guardia de la cárcel en el Condado de Kendall.

Oficiales del alguacil del Condado de Kendall dijeron que ellos detuvieron a Alexander J. Lys, de 18 años y residente de Shorewood, alrededor de las 2:45 a.m. el 18 de enero, en la Ruta 52 y Line Road.

Los oficiales dijeron que Lys había bebido alcohol y fue acusado de consumo de alcohol por un menor de edad, no seguro automotriz, no traer placa en la parte delantera

CHIHUAHUA – With help from the outside, and the alleged participation of corrupt guards, 14 inmates escaped from the Aquiles Serdan Detention Center, located in the outskirts of Chihuahua.

Five escapees were recaptured within 24 hours of their escape.The State Attorney General said that several gunshots were heard at about 5 a.m. Jan. 17,

shots apparently made to distract guards, and then a vehicle with several men on board broke down part of the outside wire fence on the west side of the detention center. The wire fence was only 2 meters high and was not electrified.

Then the vehicle covered about 80 meters and got close to the detention center’s outside wall, built with simple bricks, where a hole had been made with shovels. The inmates escaped through the hole, located between two watchtowers.

Prison guards apprehended one of the inmates when he tried to escape, but the other 14 were able to flee.

Five other inmates were captured a few hours later.After the inmates escaped municipal, state and federal police, as well as the army, set up

checkpoints at main city intersections, the bus station, the airport and at several streets in neighborhoods where authorities believed the escapees could be hiding.

Three people who helped the inmates escape were apprehended in the city’s south side, including the father of one of the inmates who escaped.

So far prosecutors have heard the statements of 20 of the guards who were on duty at the time of the escape, and of 18 inmates.

A few hours after the inmates escaped, state and federal police took control of the module 4 of the detention center, where two rival groups were fighting. Authorities were able to bring the situation under control in a short period of time.

Just last week the director of the detention center, Raul Platon del Cueto Morales submitted his resignation giving personal reasons.

And on Jan. 14 Marco Munoz, chief of security guards for the low risk unit of the detention center, which is located in downtown Chihuahua, was killed. On Nov. 6, 2010 six guards died when they were ambushed while they traveled in an official vehicle.

CHIHUAHUA – Con la ayuda de personas en el exterior y la supuesta participación de guardias corruptos, 14 prisioneros escaparon del Centro de Detención Aquiles Serdán, ubicado en las afueras de la ciudad de Chihuahua.

Cinco de los prófugos fueron capturados menos de 24 horas después de su escape.

La Fiscalía General del Estado dijo que se escucharon varios disparos alrededor de las 5 de la mañana del 17 de enero, disparos que aparentemente se hicieron para distraer a los guardias. Luego un vehículo con varios hombres a bordo derribó parte de la cerca exterior de malla ciclónica en el oeste del centro de detención. La malla solo tenía dos metros de altura y no estaba electrificada.

El vehículo entonces recorrió alrededor de 80 metros hasta llegar cerca del muro exterior del centro de detención, construido con ladrillos simples, en donde se había hecho un boquete con palas. Los prisioneros escaparon por ese boquete, localizado entre dos torres de vigilancia.

Los celadores pudieron atrapar a uno de los prisioneros que trató de escapar, pero 14 se dieron a la fuga.

Cinco de los 14 prófugos fueron capturados pocas horas después.

Después del escape de los prisioneros, elementos de la policía municipal, estatal, federal y el ejército montaron retenes en las principales calles de la ciudad, en el aeropuerto, la estación de autobuses y en varias calles de colonias donde creían que se habían refugiado los prófugos.

Tres personas que ayudaron a los prisioneros a escapar fueron arrestadas en el sur de la ciudad, incluyendo el padre de uno de los prisioneros prófugos.

Hasta el momento el Ministerio Público ha escuchado las declaraciones de 20 de los guardias de seguridad que estaban de turno, así como de 18 prisioneros.

Unas horas después de la fuga elementos de la policía estatal y federal tomaron control del módulo 4 del centro de detención, donde se dio una riña entre dos grupos rivales. Las autoridades pudieron controlar la situación en un periodo corto de tiempo.

La semana pasada el director del centro de detención, Raúl Platón del Cuto Morales sometió su renuncia por motivos personales.

El 14 de enero Marco Muñoz, jefe de los guardias de seguridad de la unidad de bajo riesgo del centro de detención, localizada en el centro de la ciudad, fue asesinado. El 6 de noviembre de 2010 seis guardias murieron cuando fueron emboscados mientras viajaban en un vehículo oficial.

MEXICO CITY – The parents of a teenager who was killed last June by a U.S. Border Patrol officer have filed a lawsuit against the U.S. government and other entities for the ‘mistake’ that cause their son’s death.

The lawsuit was filed in a federal court in El Paso, Texas, on behalf of Jesus Hernandez

and Maria Guadalupe Guereca, parents of Sergio Adrian Hernandez Guereca. They are seeking $25 million in damages.

On June 7, Sergio Adrian, 15, was standing on the Mexican side of the border in Ciudad Juarez, when a Border Patrol agent made shots from the U.S. side, alleging he had been under attack.

The teenager died of a gunshot wound to

the head. Several people witnessed the incident and one of them recorded it on a cell phone.

The agent, whose name has not been released, has been identified only as a 31 year-old Border Patrol agent with seven years on the force. He has not faced any sanctions or reprimands for this incident.

In the lawsuit, the parents charge the agent used “mortal force” against their son and that he intentionally made the shots before trying to make an arrest.

The lawsuit also charges the U.S. and some government entities of “tolerating, accepting and promoting a pattern of brutality and excessive use of force by members of the

Border Patrol’ against citizens of Mexico, Central and South America.

With this lawsuit the parents of the teenager seek to obtain compensatory damages for the death of their son and the pain and suffering caused.

Robert C. Hilliard, the attorney for the Hernandez family, said on a phone interview with Notimex that once the lawsuit was accepted in court, the next step is ask for permission to obtain the official video of the incident, captured by cameras from the Border Patrol Agency.

The U.S. Department of Justice opened an investigation of the incident, but it hasn’t said if the investigation is still open.

Padres de adolescente muerto a manos de Patrulla Fronteriza interponen demanda

CD. DE MÉXICO – Los padres de un adolescente que murió el mes de junio pasado a manos de un oficial de la Patrulla Fronteriza estadounidense han entablado una demanda en contra del gobierno de los Estados Unidos y de otras entidades gubernamentales por el ‘error’ que causó la muerte de su hijo.

La demanda fue interpuesta en una corte federal de El Paso, Texas, a nombre de Jesús Hernández y María Guadalupe Güereca, padres de Sergio Adrián Hernández Güereca. Ellos buscan una indemnización de 25 millones de dólares.

El 7 de junio de 2010 Sergio Adrián, de 15 años de edad, estaba en el lado mexicano de la frontera en Ciudad Juárez, cuando un oficial de la Patrulla Fronteriza disparó desde el lado estadounidense, aparentemente diciendo que había sido atacado.

El adolescente murió de un disparo en la cabeza. Varias personas fueron testigos del incidente y uno de ellos grabó lo sucedido en su teléfono celular.

El agente, cuyo nombre no ha sido revelado, es un hombre de 31 años de edad y con siete años de experiencia con la agencia. Él no ha

enfrentado sanciones o amonestaciones por este incidente.

En la demanda, los padres dicen que el agente usó ‘fuerza mortal’ en contra de su hijo y de que intencionalmente disparó antes de intentar realizar un arresto.

La demanda también acusa a los Estados Unidos y a algunas agencias gubernamentales de “tolerar, aceptar y promover un patrón de brutalidad y uso excesivo de fuerza por parte de miembros de la Patrulla Fronteriza’, contra ciudadanos de México, Centro y Sudamérica.

Con esta demanda los padres del adolescente buscan obtener indemnización por los daños causados por la muerte de su hijo, además de una reparación por el dolor y sufrimiento que les causó.

Robert C. Hilliard, abogado de la famita Hernández, dijo en una entrevista telefónica con Notimex que una vez que la demanda fue aceptada en la corte, el siguiente paso es pedir permiso para obtener el video oficial del incidente, captado por cámaras de la Patrulla Fronteriza.

El Departamento de Justicia de los Estados Unidos abrió una investigación sobre el incidente, pero no se ha informado si esta continúa abierta.

CD. DE MÉXICO – José Jorge Balderas Garza, conocido como ‘el JJ’, quien era buscado por las autoridades por supuestamente haber disparado contra el futbolista Salvador Cabañas el año pasado, fue arrestado por la policía el 18 de enero.

Balderas, de 34 años, era buscado por las autoridades por ser el principal sospechoso de haber disparado contra el Cabañas el 25 de enero de 2010 en un bar de la Ciudad de México. La bala se alojó en la cabeza del jugador y marcó el final de la carrera del futbolista.

Ramón Eduardo Pequeño, jefe de la División Antidrogas de la Policía Federal, dijo que Balderas fue arrestado junto con otras seis personas en una zona exclusiva de la ciudad de México.

Los detenidos son Raymundo Rangel Madrid, 25, medio hermano de Bladeras Garza; Ricardo García González, 37; García Mireles, 30; Jorge Ramón Madrid, 34; un joven de 21 años, y Juliana Sossa, 25, pareja sentimental de José Jorge Balderas.

Autoridades de la Secretaría de Seguridad Pública indicaron que en el operativo habían asegurado dos paquetes en forma de ladrillo con coca, una bolsa de plástico con sustancia sólida de cocaína base, cinco armas largas de tipo fusil, armas cortas, 304 cartuchos, dos granadas de fragmetnación, 51 dólares, uan camioneta ocn compartimientos ocultos e identificaciones oficiales.

El portavoz de la policía indicó que Balderas había estado detenido antes en Estaods Unidos por tráfico de marihuana, además de que era buscado por distribución de droga en la capital mexicana.

Las autoridades también informaron que Balderas Garza conoció a Edgar Valdez ‘La Barbie’ en Tamaulipasl, con quien llegó a ir a fiestas de los hermanso Beltrán Leyva. En 2007 Edgar Valdez hizo responsable al ‘JJ’ de la distribución de entre 60 y 70 kilogramos de cocaína en el área metropolitana del Valle de México.

Al momento de su detención el JJ dijo que él no había sido el autor del disparo contra el jugador paraguayo, sino uno de sus guardaespaldas, Francisco José Barreto ‘el Contador’, quien fue detenido en junio de 2010.

Ante esto, el jefe de la Procuraduría General de Justicia del Distrito Federal, Miguel Angel Mancera Espinoza, dijo que las pruebas periciales realizadas ne la investigación del atentado contra el futbolista dieron como resultado que ‘el JJ’ había sido el autor del disparo.

En entrevista el procurador dijo que además de las declaraciones dee ‘el JJ’ hay evidencias que lo señalan como el autor del disparo.

Mientras tanto, las redes sociales se han hecho eco de un comentario que surgió cuando ‘el JJ’ fue presentado ante los medios.

MEXICO CITY – Jose Jorge Balderas Garza, ‘el JJ,’ who was wanted by Mexican authorities for allegedly shooting soccer player Salvador Cabañas last year, was arrested Jan. 18.

Balderas, 34, was wanted for being the main suspect in the incident in which Cabañas was shot in the head inside a bar on Jan. 21, 2010. The bullet was lodged in his head and marked the end of his sports career.

Ramon Eduardo Pequeño, head of the Drug Enforcement Division of the Federal Police, said Balderas was arrested along with other six people in an exclusive neighborhood of Mexico City.

Those arrested are Raymundo Rangel Madrid, 25, half-brother of Balderas Garza; Ricardo Garcia Gonzalez, 37; Garcia Mireles, 30; Jorge Ramon Madrid, 34; a 21 year-old man and Juliana Sossa, 25, Balderas’ girlfriend.

Officials with the Public Safety Office said during the operation they secured two bricks of cocaine, plastic bag with base cocaine, five long weapons, short guns, 304 bullets, two fragmentation grenades, 51 dollars, a truck with hidden compartments and official identifications.

Pequeño said Balderas had been previously arrested in the United States for marijuana trafficking, and that he was wanted by Mexico City authorities for drug distribution.

Authorities also said Balderas Garza met Edgar Valdez ‘La Barbie’ in Tamaulipas, and together

According to authorities, in 2007 Valdez made Balderas responsible for distributing between 60 and 70 kilos of cocaine in the Mexico City metropolitan area.

When he was arrested, ‘JJ’ said he was not the person who shot Cabañas, that the shot had been made by his bodyguard, Francisco Jose Barreto ‘El Contador,’ who was arrested in June of 2010.

In response to this, Mexico City Attorney General Miguel Angel Mancera Espinoza, said forensics tests made during the investigation of the incident against Cabañas showed that ‘JJ’ had made the shot that severely injured the Paraguayan player.

In an interview the Attorney General said that besides the statements made by ‘JJ,’ there is evidence that shows he made the shot.

Meanwhile social networks have been busy after ‘JJ’ was presented to the media. In his presentation Balderas was wearing a polo-type shirt with the Ralph Lauren logo, the same type of shirt worn by ‘La Barbie’ when he was presented to the media after his arrest a few weeks ago.

The similarity in the clothes the drug dealers were wearing caused controversy online, with social network members highlighting their similar tastes in fashion.

Days after ‘La Barbie’ was arrested, illegal copies of the shirt he wore during his presentation were being sold on the streets.

Three students arrested in school shooting in California

LOS ANGELES – Two students were injured, one of them critically, when a firearm went off inside a classroom at a California high school.

Three students were arrested in this incident.The accident happened the morning of Jan. 18, when

the students were getting ready to start the third period of classes at Gardena High School in Los Angeles.

A 17 year-old student entered the classroom and left his backpack on a desk. That’s when, according to authorities, the gun went off, apparently by accident, and two 15 year-old students were injured. Authorities said both victims could have been injured by the same bullet.

One of the students was shot in the neck and is in good condition, while a female student was shot in the head and is in critical condition, however, she showed some promising signs when she opened her eyes and moved her body following commands.

The incident made the school go on lockdown until authorities could investigate the incident.

About an hour after the gun went off, police found and arrested the young male student suspected of taking a gun to school.

Friends of the suspect said he wasn’t considered violent, but that he had taken the gun to school for his own protection.

According to the LA Times, law enforcement officers said one of the lines of investigation they are following is the possibility the Youngman, who is a special education student, may have been bullied on his way to or back from school.

Some witnesses said the suspect apologized to his classmates before running out of the classroom. When he left the classroom he apparently dropped the 9 mm Beretta hand gun and walked to another classroom, where students were learning piano.

“He has admitted bringing a gun to the school. He has discussed the incident with us, and as we’ve indicated, it appears that it was accidental,” Los Angeles Police Department Captain William Hayes told the media.

The suspect was charged with assault with a mortal weapon. According to ABC News, the teenager had been on probation for a school fight that happened last year. Two other students, a male and a female, were arrested, charged with helping to conceal evidence.

Authorities are now trying to locate the backpack, something police consider “key evidence” in this case. The student was able to dispose of it before being arrested.

Meanwhile, a police officer was injured when a suspected car burglar shot him Jan. 19, near a high school in the San Fernando Valley.

The bullet hit the officer’s chest but he was saved by his bulletproof vest.

The man shot the officers when he was allegedly trying to burglarize some cars on a street near the school. The man exited a car and shot several times, hitting the officer on the chest. The officer’s injuries are not life-threatening.

El incidente se registró la mañana del 18 de enero, cuando los estudiantes se preparaban para iniciar el tercer periodo de clases en la Escuela Preparatoria Gardena, en Los Angeles.

Un alumno de 17 años entró en su salón de clases y puso su mochila en un escritorio. De acuerdo a las autoridades, de alguna forma el arma se disparó, aparentemente por accidente, y dos estudiantes de 15 años resultaron heridos, uno de ellos de gravedad. Las autoridades dijeron que ambas víctimas pudieron haber sido heridas por la misma bala.

Uno de los estudiantes recibió un disparo en el cuello y está en condición estable, mientras que una joven recibió un disparo en la cabeza y estaba en condición crítica, a pesar de que había mostrado señales prometedoras al abrir los ojos y mover su cuerpo siguiendo órdenes.

El incidente causó que todos los estudiantes recibieran órdenes de permanecer en sus salones hasta que las autoridades investigaran el disparo.

Alrededor de una hora después del disparo, la policía encontró y arrestó al joven sospechoso de haber llevado la pistola a la clase.

Amigos del sospechoso dijeron que él no era considerado violento, pero que había llevado el arma a la escuela por protección.

El sospechoso fue acusado de asalto con un arma mortal. De acuerdo con al estación ABC News, el joven ya había estado en probatoria por un pleito escolar que se registró el año pasado.

Dos estudiantes más, un hombre y una mujer, fueron arrestados, acusados de ayudar a esconder evidencia.

Las autoridades están tratando de localizar la mochila, que la policía considera una “evidencia importante” en el caso. El estudiante pudo deshacerse de ella antes de ser arrestado.

Mientras tanto, un oficial de policía resultó herido cuando un sospechoso de robo de autos disparó contra el oficial acerca de una escuela preparatoria en el Valle de San Fernando.

Este incidente se registró el 19 de enero, pero el chaleco antibalas del oficial le salvó la vida.

Another train with migrants attacked in southern Mexico

OAXACA – Men with weapons attacked a freight train in which about 100 undocumented migrants were traveling. The assault happened in the Mexican state of Oaxaca. Non-government agencies reported the incident Jan. 18, saying they are not sure if any of the migrants were kidnapped.

“It has been confirmed, the train was attacked again. We don’t know if a report has been filed or if people are disappeared,” said Catholic priest Alejandro Solalinde, who administers the immigrant shelter Brothers on the Road in Ixtepec, Oaxaca.

Una de las víctimas de Kalimba da su versión, asegura que no quiere acuerdo económico

CD. DE MÉXICO – Entrevistada por el periodista Carlos Loret de Mola, la joven Daiana, una de las supuestas víctimas de abuso sexual por parte del cantante Kalimba, dio su versión de los hechos.

“Taili fue la que me invitó, me habló por teléfono y me dijo que si quería participar con ella como edecán porque iba a estar Kalimba en un bar”, dijo de la razón por la que estuvo en el bar la noche del incidente, a pesar de ser menor de edad. “Me dijo que no me iba a pagar, que mi paga era estar con Kalimba,

convivir con él”.La joven dijo que había acudido al bar sin el

permiso de sus familiares. Dijo que ella y su amiga comenzaron a bailar al lado del cantante, mientras éste realizaba su presentación en el bar como DJ.

Mencionó que Oscar, el manager de Kalimba, le llevó una bebida que éste le había ordenado mientras continuaba su actuación. Aseguró que casi al finalizar él la invitó a su hotel para festejar el cumpleaños de una amiga.

“Yo pues me emocioné, me dije ‘pues me está invitando, es Kalimba. Sí, sí voy’”, dijo

la joven. Ella contó que fue como a las 3 de la mañana cuando salieron juntos y en grupo llegaron al hotel.

Esto contradice la versión del cantante, quien aseveró que la joven se les había unido después en el hotel.

La joven dijo que ella y el cantante estuvieron platicando en una de las habitaciones del hotel, donde él le mostró algunas de sus canciones.

“YO me sentía agotada, me sentía cansada y le dije que si me podía dormir y me dijo ‘sí con confianza’. Yo me quedé dormida y en ese tiempo, entre sueños, escuché que cerró la puerta. No sé si salió o permaneció en la recámara. No sé cuanto tiempo pasé dormida y ya después fue cuando lo sentí encima”.

Ella aseguró que aunque se sentía cansada, recuerda todo lo que pasó, ya que solamente se tomó la bebida que le envió el cantante.

Dijo que cuando el cantante la forzó, ella gritó sin que nadie respondiera a su llamado, mientras él mantenía su mano en su cabeza diciéndole que se callara, hasta que él por un ataque de tos se dirige al baño mientras ella se dirige al lobby, donde permanece asustada hasta las 12 p.m. que bajan todos. Asegura que se fue con ellos al aeropuerto, pero niega

haberse despedido efusivamente de él.Daiana dijo que en un principio no les contó

nada a sus familiares, pero que decidió contarle lo sucedido a su novio, quien la animó a tomar la decisión de levantar la denuncia.

Dijo que el 21 de diciembre recibió una llamada del cantante preguntándole por la demanda, pero ella lo negó ante el temor de una represalia en su contra. Dijo que Kalimba le pidió que se tomar a una píldora para prevenir un embarazo y que hasta le pidió verse nuevamente en persona para pedirle disculpas.

“Mentí por miedo, porque no sabía cómo actuar. Yo sé que él tiene dinero, tiene a los medios. Yo no sabía si me iba a hacer algo a mí o a mi familia”, dijo la joven de la razón por la que negó haber entablado una demanda. También reconoció que le había mandado un mensaje de texto previéndolo que no contestara una llamada de sus familiares porque quería evitar una confrontación.

Para finalizar negó haber cobrado por entrevistas y dice no estar dispuesta a llegar a ningún tipo de arreglo económico con Kalimba, ya que quiere que se le castigue por el daño que le hizo.

One of Kalimba’s alleged victims speaks out, says she doesn’t want money

MEXICO CITY – In an interview with Carlos Loret de Mola, Daiana, one of two young women who have accused singer Kalimba of sexually abusing them, gave her side of the story.

“Taili invited me, she called me and asked me if I wanted to participate in an event with her as a hostess, because Kalimba was scheduled to be at a bar,” she said of the reasons why she was at the night club the night of the incident even though she is a minor. “She told me I wasn’t going to get paid, that I was getting paid by spending time with Kalimba.”

The young woman said she had gone to the bar without her relatives’ knowledge. She said she and her friend were dancing near the singer while he worked at the bar as a DJ.

Daiana said Oscar, Kalimba’s manager, gave her a drink the singer had sent her while he was still performing. She said that almost at the end of the event he invited her to his hotel for a friend’s birthday party.

“I was excited, I thought ‘well, he’s inviting me, he’s Kalimba. Yes, I’ll go,’” she said. The group left the bar and arrived to the hotel at about 3 a.m.

This contradicts the singer’s statement, who said Daiana had joined them later at the hotel.The young woman said she was chatting with the singer in one of the hotel rooms, where the

singer showed her some of his songs.“I felt drained, I felt tired and I asked him if I could go to sleep, and he said ‘yes, go ahead.’

I fell asleep and at that time, while I was still half-asleep, I heard the door close. I don’t know if he remained in the room or if he stayed. I don’t know for how long I was sleeping, and then I felt him on top of me.”

She said that even though she was tired and she only had the drink the singer sent her while they were at the bar, she remembered everything that happened.

She said hat when the singer raped her, she screamed but nobody helped her. She said all the time the singer had his hand on her head, telling her to stop screaming, until he had a cough spell and went to the bathroom. That’s when she left the room and went to the lobby, where she waited for the rest of the people until about noon. She said she went with them to the airport, but denies being affectionate with the singer at the terminal.

Daiana said in the beginning she didn’t share what had happened with her relatives, but then decided to trust her boyfriend, who encouraged her to make the decision to file the report.

She said that on Dec. 21 the singer called her to ask her about the report, but she denied it, afraid of any retaliation from the singer, who also asked her to take the morning-after pill and wanted to see her again to apologize in person.

“I lied because I was afraid, I didn’t know how to react. I know he has money, he has the media. I didn’t know if he was going to do something to me or my family,” she said of the reason why she denied filing the report. She also acknowledged she sent him a message warning him about a call from her relatives, because she wanted to avoid a confrontation

Daiana denied getting paid for interviews and said she is not willing to reach a financial agreement with the Kalimba, as she wants him to be punished for all the damage he has caused her.
