    In relation to wood packaging, the provisions introduced by Commission Directive 2004/102/EC (OJ L30906/10/2004) (CELEX32004L0102)establish thatwoodpackagesofanytype (cases,boxes,crates,drums,pallets,boxpalletsandotherloadboards,palletcollars,etc.)shallgothroughoneoftheapprovedtreatmentsspecifiedinAnnex I to FAO International Standard for Phytosanitary Measures No. 15, bear the corresponding mark asspecified in Annex II and bemade from debarkedwood (this requirement is postponed until 1 January 2009accordingwithCommissionDirective2006/14/EC(OJL3407/02/2006)(CELEX32006L0014).CommissionDecision2005/51/EC (OJL2125/01/05) (CELEX32005D0051),authorizesMemberStates toprovidederogationswithregardtotheprohibitionsreferredtoinpoint14ofAnnexIIIPartAandpoint34,sectionI,PartA,Annex IVabovementioned forsoiloriginating incertainthirdcountriesunderspecificconditionsprovided for intheAnnexofthesameDecisionanddestinedfortreatmentindedicatedhazardouswasteincinerators.CertainareasoftheEU,thatarefreefromplantpestsestablishedelsewhere intheEU,havebeendesignatedasprotected zones and may be affected by special bans and requirements to prevent spreading of harmfulorganisms toparticular crops (Annex IPartB;Annex IIPartB;Annex IIIPartB andAnnex IVPartB toCouncilDirective2000/29/EC).2.Phytosanitarycertificateand/orphytosanitarycertificateforreexport.Imports of plants and plant products listed in Annex V, Part B to Council Directive 2000/29/EC must beaccompaniedeitherbyanofficialphytosanitarycertificateoraphytosanitarycertificateforreexport(incasetheconsignmentafterbeingdispatchedfromathirdcountry,hasbeenstored,repackedorsplitupinanothernonEUcountry).Thosedocumentscertifythephytosanitaryconditionsofplantsandplantsproducts,andalsothattheshipmenthasbeenofficiallyinspected,complieswithstatutoryrequirementsforentryintotheEUandisfreeofquarantinepestsandotherharmfulpathogens.TheyshallbeatleastinoneoftheofficiallanguagesoftheEUandshallbeissuedbythedesignatedauthoritiesofthethirdcountryofexportorreexportandmadeoutnotmorethan14daysbeforethedateonwhichtheplants,plantproductsorotherobjectscoveredbyithaveleftthecountryofissuance.PhytosanitarycertificatesshallbeissuedincompliancewiththeprovisionsoftheIPPCandtakingintoaccounttheFAOInternationalStandardforPhytosanitaryMeasuresNo12onGuidelinesforphytosanitarycertificates.3.Customsinspectionandplanthealthchecks.Inadditiontotheabovementionedcertificates,theplantsandplantproductslisted inAnnexV,PartBtoCouncilDirective 2000/29/EC shall, from the time of their entry in the EU, be subject to customs inspections andsupervisionbytheresponsibleofficialbodies.Theinspectionsshallconsistin:

    Documentarychecksestablishingthattherequiredcertificates,alternativedocumentsormarkshavebeenissuedorsatisfiedIdentitychecksestablishingthattheplants,plantproductsorotherobjectsconformtotheonesdeclaredontherequireddocumentsandPlanthealth checksestablishing that theplants,plantproductsorotherobjects, including theirwoodpackingmaterial ifany,complywith thespecificrequirementsandphytosanitarymeasuresspecified inCouncilDirective2000/29/ECandcanbeimportedintotheEU.

    The inspectionsmustbemadeatthepointofentry intotheEUattheproperMemberStatesborder inspectionpost (BIP).     CouncilDirective96/23/EC(OJL12523/05/1996)(CELEX31996L0023)outlinestheproceduretoevaluatewhetherwhen importinganimalsandanimalproducts,theguaranteesonresiduesofchemicalsubstancespresentedbyathirdcountrycanbedeemedequivalenttothoserequestedtotheproductsproducedunderEUrules.Such products shall only be imported from authorized countries included in the list published in CommissionDecision 2004/432/EC (OJ L154 30/04/2004) (CELEX 32004D0432). Inclusion and retention on this list shall besubjecttosubmissionbythethirdcountryconcernedofaplansettingouttheguaranteeswhichitoffersasregardsthemonitoringofthegroupsofresiduesandsubstancesreferredtoinAnnexItotheDirective.

    Plants,plantproductsandtheirprotection

    CouncilDirective91/414/EEC(OJL23019/08/1991)(CELEX31991L0414)laysdownrulesandproceduresforactivesubstances tobemarketed in theEUand for theauthorizationbyMember Statesofplantprotectionproductscontaining them. Active substances cannot be used in plant protection products unless they are included in apositiveEUlist.SuchsubstancesareincludedintheEUPesticideDatabase.Onceasubstanceisincludedinthelist,MemberStatesmayauthorizetheuseofproductswhichcontainit.

    ControlofpesticideresiduesintheEU:themaximumresiduelevels(MRLs)

    Asfrom1September2008,Regulation(EC)No396/2005oftheEuropeanParliamentandoftheCouncil(OJL7016/03/2005)(CELEX32005R0396)definesafullyharmonizedsetofrulesforpesticideresidues.ThisRegulationlaysdownprovisionsforthesettingofEUpesticidemaximumresiduelevels(MRLs)infoodandfeed.

    Importsofplantandanimalproductsmustcomplywith suchMRLs setby theEuropeanCommission toprotectconsumersfromexposuretounacceptablelevelsofpesticideresidues.AnnexestoRegulation(EC)No396/2005oftheEuropeanParliamentandoftheCouncilsetoutthelistofproductssubjecttocontrolandMRLsapplicabletothem:The listofproductstowhichtheMRLsapplyhasbeenestablished inAnnex I,which includesanimalproducts,fruits,vegetables,cereals,spicesandcertainedibleplants.ThelistofEUdefinitiveMRLsislaiddowninAnnexII.ThesocalledEUtemporaryMRLs(pesticidesforwhich,before1September2008,MRLswereonlysetatnationallevel), are listed inAnnex III.The listofpesticides forwhichnoMRLsareneededbecauseof their low risk isincludedinAnnexIV.AnnexV,whichwillcontainthe listofpesticides forwhichadefault limitotherthan0,01mg/kgwillapplyandAnnexVI,whichwill contain the list of conversion factors ofMRLs for processed commodities, have not beenpublishedyet.AnnexVIIcontainsalistofpesticidesusedasfumigantsforwhichtheMemberStatesareallowedtoapplyspecialderogationsbeforetheproductsareplacedonthemarket.SpecificinformationonthesubstancesandtheMRLsincludedinthelistsofAnnexesII,IIIandIVisavailableattheEUPesticideDatabase.

    MemberStateauthoritiesareresponsibleforthecontrolandenforcementoftheMRLs.SuchcontrolwillbecarriedoutbymeansofacoordinatedmultiannualCommunitycontrolprogrammeofpesticideresidues infoodofplantand animal origin established by Commission Regulation (EU) No 915/2010 (OJ L269 13/10/2010) (CELEX32010R0915).According to this scheme,during the years 2011, 2012 and 2013,Member States shall take andanalyzesamplesfortheproduct/pesticideresiduecombinationssetoutintheRegulation.
