2. UnavezfinalizadoelestudioseenviaronlosresultadosalosrespectivosEstados miembrosparainformacinyexamen.VariosdeesosEstadosremitieroncorreccioneso comentariossobrelosmismos;enelpresentedocumentoseofreceinformacinsobrelas respuestasrecibidas.

Delasrespuestasalapreguntaquefiguraenelestudioenrelacinconlaproteccin jurdicaylasmedidasdesubsanacinquesecontemplancontraelhechodeeludirmedidas tecnolgicasefectivasdeproteccinsedesprendeque 22delasleyescontienendisposiciones sobreesacuestin,aunquelaterminologaempleadayelgradodeproteccinvaranmucho deunalegislacinaotra.Ladivergenciaentreleyesentornoaesetemaseapreciaen aspectoscomoelhechodequesepreveansancionescivilesy/openalesenloscasosde infraccin,incluidassancionespecuniariasypenasdeprisin.Enunadelasleyesse consideraqueelhechodeeludiresasmedidasconstituyeunaformadecompetenciadesleal. Itisallowedwithouttheauthorsapprovalandwithoutpaymentorremunerationthe reproduction,broadcastingorthecommunicationtothepublicbywireofapictureofan architectonicwork,ofafineartswork,photographicworkorappliedartsworkplaced inapublicarea,excludingthecaseswhenthepictureisthemainthemeofthe reproduction,broadcastingorcommunicationandwhenitisusedforcommercial purposes.

Article13.Freereproductionandadaptationforcomputerprograms

Thelegalownerofacomputerprogramispermitted,withouttheauthorsapprovaland withoutpaymentorremuneration,tomakeacopyoradaptationofsuchaprogram,if thiscopyoradaptationis:

a) indispensablefortheusageofthecomputerprogramandforthepurposethe programislegallyobtained;

b) usedforarchivesandifnecessary(incaseoflost,damageoroveruse)to replacethelegallyobtainedcopy.

Thecopyortheadaptationprovidedforinthefirstparagraphisdestroyedincases whentheownershipofthecopiesofthecomputerprogramsisnomorelegal.

Article14.Freeuseofcomputerprograms

Theauthorsapprovalisnotobligatoryifthereproductionofthecodeandthe adaptation(translation)arenecessarytogettherequireddatafortheinteractionofa computerprogramwhichiscreatedindependentlyoftheotherprograms.The reproductioncanbemadeuponthefollowingconditions:

a) whenthisactionsisdonebymeansofalicense,byanotherpersonwhohas therighttousethecopyoftheprogramorbyanyauthorizedperson;

b) whenthenecessarydataforinteractionarenotpreviouslygiventothe personsmentionedinparagrapha;

c) whentheseactionsarelimitedinthosepartsoftheoriginalprogramwhich areindispensableforthecreationoftheinteractioncapacity.

Theuseofthefollowingdataisprohibitedbecauseoftheprovisionsofthefirst paragraph:

a) forapurposedifferentfromthatofinteractingcapacityofthecomputer programcreatedinanindependentway;

b) forgivingthemovertothirdparties,exceptforthecaseswhenthisis indispensablefortheinteractingcapacityofthecomputerprogramcreatedinan independentway;


c) forthedevelopment,productionorhandingoverofasimilarcomputer programconcerningthewayofexpressionorforanyotherpurposewhichviolates thecopyright.

Theprovisionsofthisarticlemustnotbeinterpretedinsuchawaythatcausesits applicationstocomecontrarytothenormaluseofthecomputerprogram,orinfringes thelegitimaterightsoftheauthor.

Article15.Freetemporaryrecordingbybroadcastingorganizations

Abroadcastingorganizationcanrecordfortemporaryuse,byitsownmeans,awork onwhichitenjoysthisrightwithouttheauthorsapprovalandwithoutspecial remuneration.Thisagencyisobligedtodestroythisrecordingwithinsixmonthsfrom thedayofrecordingit,exceptwhenthereisanagreementwiththeauthorforlonger terms.However,arecordingofthiskindmaybestoredinofficialarchiveseven withoutanagreement,ifithasspecialhistoricalordocumentingvalues.

Article16.Thefreepublicperformance

Itispermittedwithouttheauthorsapprovalandwithoutpaymentorremunerationthe publicperformanceofaworkduringtheactivityofaschoolinstitution,preparedbythe staff,iftheaudienceissimplythestaffandthestudentsofthatinstitution,theparentsor tutorsofthestudents,aswellasotherpeoplewhohaveadirectrelationtothe institution.

Article38.Limitationsontheprotection

Articles35,36and37ofthislawarenotappliedwhenactsprovidedbythesearticles areundertaken:

a) forprivateuse,teachingorscientificresearch,ontheseconditionthatthe usedoesnotconflictwiththenormaluse(ofaperformance,phonogramor broadcasting)andalwayswithoutprejudiceatalargescalethelegitimateinterests oftheholdersoftherightsprovidedinthischapter;

b) forissuingcurrenttopics,providedthatonlyshortpiecesofaperformance, phonogramorbroadcastareused;

c) forcitation,inshortpiecesfromaperformance,phonogramorbroadcast, providedthatthesecitationsconcurwiththeusualpracticeoftheinformatory purposeofthesecitations;

d) forotherpurposes,whichareincludedinthelimitationsfortheeconomic rightsoftheliteraryandartisticworks,asprovidedinChapterIII.

RequirementsforanauthorizationmentionedintheArticles35,36and37tofix performancesandbroadcastings,toreproducepublishedphonogramsforcommercial purposes,arenottakenintoconsiderationwhenthereproductionisdonebya


broadcastingorganizationwithitsownmeansandforitsownprogrammesonlyincase of:

a) broadcastingthefixationofaperformanceorofitsreproduction,asdefined bythisparagraph,thebroadcastingorganizationhastherighttobroadcastexactly thisperformance;

b) broadcastingthefixationofaprogramoritsreproductionorsuchafixation ofaprogrammadeaccordingtotheconditionsofthisprogram,thebroadcasting organizationhastherighttobroadcastexactlythisprogram;

c) afixation,madeaccordingtothisparagraph,oritsreproduction,thefixation ofanyreproductionisdestroyedwithinsixtydays,exceptforasinglecopywhich canbepreservedonlyforarchivepurposes.

wasrecordedonaphonogramprotectedundertheprovisionsofthisLaw;or

hasnotbeenrecordedonaphonogram,buthasbeenincludedinaprogram broadcastortransmittedbycablethatisprotectedinaccordancewiththe provisionsofthisLaw.

(2) TheprovisionsofthisLawontheprotectionofphonogramsshallapplyto:

anyphonogramofwhichtheproducerisanationaloftheRepublicof Belarusorisalegalpersonwithheadquarterslocatedontheterritoryofthe RepublicofBelarus;

anyphonogramofwhichtheproducerisnotanationaloftheRepublicof Belarusorisnotalegalpersonwithheadquarterslocatedontheterritoryofthe RepublicofBelarus,butwhichhasbeenpublishedforthefirsttimeonthe


territoryoftheRepublicofBelarusorhasbeenpublishedonthatterritorywithin 30daysofthedateofitsfirstpublicationinanotherState.

(4) TheprovisionsofthisLawshallalsoapplytoperformers,phonogramproducers andbroadcastingorcabledistributionorganizationsofwhichtherightsareprotectedon theterritoryoftheRepublicofBelarusinaccordancewiththeinternationaltreatiesto whichtheRepublicofBelarusisparty.

2.3 DoperformershavemoralrightsintheLaw?

(1) NotwithstandingtheprovisionsofArticles31and32ofthisLaw,thefollowing shallbeauthorizedwithouttheconsentoftheproducerofaphonogrampublishedfor commercialpurposesandoftheperformerwhoseperformanceisrecordedonthe phonogram,butsubjecttopaymentofremuneration:

publicperformanceofthephonogram;

broadcastingofthephonogram;


communicationofthephonogramtothepublicinanyotherform.

ForthepurposesofthisArticle,phonogramsthathavebecomeaccessibletothepublic bywireorwirelesstransmissioninsuchawaythatanypersonmayhaveaccesstothem attheplaceandtimeofhischoiceshallbedeemedpublishedforcommercialpurposes.

(2) Thecollection,distributionandpaymentoftheremunerationprovidedforin paragraph(1)ofthisArticleshallbeeffectedbyoneoftheorganizationsforthe collectiveadministrationoftheeconomicrightsofphonogramproducersand/or performers.

2.14 ArerightsintheLawsubjecttoanyformalities?
