 http://www.alianzaregional.net  1 THE  ALIANZA  REGIONAL  POR  LA  LIBRE   EXPRESIÓN   E   INFORMACIÓN  MANIFEST THE NEED FOR  RESPECT OF FREEDOM OF EXPRESSION BY  THE LEGISLATIVE  ASSEMBLY  OF COSTA  RICA The Alianza Regional constituted by 21 nongovernmental organizations from 17 countries of the Americas, specializing in issues of freedom of expression and access to information states that the full exercise of freedom of expression is fundamental to democracy´s consolidation, operation and preservation, and considers: That Inter-Americ an jurisprudence has characterized f reedom of thought and expression as a two dimensions right: an “individual dimension” consisting of the right of everyone to express their thoughts, ideas, information; and a “collective dimension consisting of the right of society to seek and receive information, to know the thought, ideas and information of o thers and be well informed. That Principle 10 of the Declaration of Principles on Freedom of Expression states “that privacy laws should not prohibit or restrict investigation a nd dissemination of information of public interest”, so it is essential that the protection of someone´s reputation should only thought civil sanctions, in those cases in which the person offended is a public official or public or private person who has voluntarily become involved in matters of public interest. There´s a need to strengthen the work of the communicator so when the news is distributed and in case he/she is being legally persecuted, the prosecutor must prove that the communicator intended to inflict harm, was fully aware that false news was disseminated, or acted with gross negligence in search for truth or falsity of them. This, in order to end the crimin alization of the practice of journalism and strengthen the collective right of society to know all information of public interest. The Alianza Regional in the "Declaration of San Salvador" of June 3, submitted to the OAS General Assembly, urged repeal or amend those laws th at cri minalize contempt, defamation, libel and slander. We alsourged to exempt from any penalty manifestations of those information and ideas of public interest, by reference to the provisions stated in the case “Kimel v. Argentina” and previous rulings by the Inter -  American Court of Human Rights in the subject.

 We therefore, requests:

1. Costa Rican deputies and political parties to discuss, analyze and incorporate these

fundamental approaches in Costa Rican legislation to comply with standards promoted

  by the Special Rapporteur for Freedom of Expression and the OAS Inter-American

Commission on Human Rights.

2. Encourage the government of the Republic of Costa Rica, organizations, media and

civil society to push for these reforms to strengthen democracy in Costa Rica

3. Take into account the recent resolution adopted by the General Assembly (CP/CAJP-

5211/11) on “Freedom of Thought and Expression and the importance of media”,

inviting Member States to consider the recommendations of the Special Rapporteur for

Freedom of Expression and urge to take all necessary measures to prevent violations of 

the right to freedom of thought and expression, and to create the necessary conditions

for that purpose.
