ADVERTENCIA
La misión de la Junta de Seguridad en el Transporte (JST) es contribuir a la seguridad en el
transporte a través de la investigación de accidentes y la emisión de recomendaciones mediante:
a) La determinación de las causas de los accidentes e incidentes de transporte cuya investigación
técnica corresponda llevar a cabo.
b) La recomendación de acciones eficaces, dirigidas a evitar la ocurrencia de accidentes e
incidentes de transporte en el futuro.
Este informe refleja las conclusiones de la JST, con relación a las circunstancias y condiciones en
que se produjo el suceso. El análisis y las conclusiones del informe resumen la información de
relevancia para la gestión de la seguridad operacional, presentada de modo simple y de utilidad
para la comunidad del transporte por agua.
Acorde los principios de la política de seguridad en el transporte tipificados en el Artículo 2 de la Ley
27514, rige el principio de “exclusividad técnica” por el cual la investigación se limita a la
identificación de las causas probables y factores contributivos que dieran origen a los sucesos de
transporte, excluyéndose la determinación de responsabilidades administrativas, civiles o
criminales, o la asignación de culpas, cuyo ámbito pertenece a la investigación judicial o
administrativa, de la cual es independiente.
De conformidad con la Ley 27514:
Artículo 17. La Junta de Seguridad en el Transporte limita su intervención a la investigación de las
causas del accidente o incidente de que se trate y al esclarecimiento de las circunstancias con el
fin de formular informes y/o recomendaciones destinadas a incrementar la seguridad operacional y
favorecer la prevención de accidentes.
Los resultados de sus investigaciones no condicionan ni prejuzgan los de cualquier otra
investigación de índole administrativa o judicial que corresponda realizar.
Se encuentra prohibida la determinación de responsabilidades civiles o criminales o las
asignaciones de culpas a personas concretas.
Artículo 18. El objetivo de las investigaciones que lleva adelante la Junta de Seguridad en el
Transporte es la prevención de futuros accidentes e incidentes de transporte.

Artículo 19. Atento al fin establecido en el artículo precedente, no es admisible el uso en procesos
judiciales de:
a) Las entrevistas obtenidas en el marco de una investigación;
b) Los ensayos o pruebas realizados. No obstante, la Junta de Seguridad en el Transporte puede
coordinar con la autoridad administrativa o judicial a cargo de la investigación correspondiente
cuando prevea realizar ensayos o pruebas técnicas.
Artículo 20. Los informes finales de la Junta de Seguridad en el Transporte no tienen como objetivo
la determinación de la culpa o dolo a nivel penal ni la responsabilidad civil del accidente e incidente.
Son independientes de cualquier otra investigación administrativa o judicial, no afectando ningún
interés subjetivo; por lo tanto, no son recurribles ni pasibles de impugnación, no pudiendo tampoco
ser admitidos con carácter probatorio en proceso judicial alguno.

NOTA DE INTRODUCCIÓN
La Junta de Seguridad en el Transporte (JST) ha adoptado el modelo sistémico para el análisis de
los accidentes e incidentes en el transporte.
Se trata de un modelo ampliamente adoptado por organismos líderes en la investigación de
accidentes e incidentes a nivel internacional.
Las premisas centrales del modelo sistémico de investigación de accidentes son las siguientes:
Las acciones u omisiones del personal operativo de primera línea y/o las fallas técnicas del
equipamiento constituyen los factores desencadenantes o inmediatos del evento. Estos son los
puntos de partida de la investigación y son analizados con referencia a las defensas del sistema,
así como a otros factores (humanos, organizacionales y externos a la organización), en muchos
casos alejados en tiempo y espacio del momento preciso de desencadenamiento del evento.
Las defensas del sistema tienen el propósito de detectar, contener y ayudar a recuperar las
consecuencias de las acciones u omisiones del personal operativo de primera línea y/o las fallas
técnicas del equipamiento. Estas defensas se agrupan bajo tres entidades genéricas:
tecnología, normativa (incluyendo procedimientos) y entrenamiento (incluyendo formación y
capacitación).
Finalmente, los factores que permiten comprender el desempeño del personal operativo de
primera línea y/o la ocurrencia de fallas técnicas y explicar las fallas en las defensas están
generalmente alejados en el tiempo y el espacio del momento de desencadenamiento del
evento, son denominados factores sistémicos y están vinculados estrechamente a elementos
tales como, por ejemplo, el contexto de la operación, las normas y procedimientos, la formación
y capacitación del personal y la gestión de la seguridad operacional por parte de la organización
a la que reporta el personal operativo y la infraestructura.
La investigación que se detalla en este informe se basa en el modelo sistémico. Tiene el objetivo
de identificar los factores relacionados con el accidente, así como otros factores de riesgo de
seguridad operacional que, aunque sin relación de causalidad con el suceso investigado, tienen
potencial desencadenante bajo otras circunstancias operativas. Lo antedicho, con la finalidad de
formular Recomendaciones de Seguridad Operacional (RSO) que promuevan acciones viables,
prácticas y efectivas.

1. INTRODUCCIÓN.
El 13 de agosto de 2020 uno de los tripulantes del Buque Motor Strategic Equity N° IMO
9689902, resultó herido durante la maniobra de liberar el spring de proa que había quedado
atrapado entre el buque y una defensa del muelle. Durante este intento, la tensión de la amarra
en la defensa se liberó súbitamente e impactó en el rostro de un tripulante que estaba haciendo
de pasa señas a la altura de la bodega N° 1. Las heridas que recibió el tripulante provocaron su
fallecimiento. El accidente ocurrió por la noche, con iluminación artificial y condiciones
meteorológicas favorables.

2. INFORMACIÓN SOBRE LOS HECHOS
2.1 Reseña de la operación
El buque Strategic Equity zarpó de Porto Alegre, Brasil con destino al puerto de Rosario, Argentina.
El 13 de agosto de 2020 a las 21:121 horas con practico a bordo inició la maniobra de atraque a la
Terminal Servicios Portuarios S.A ubicada en el kilómetro 414,8 sobre la margen derecha del Río
Paraná. A las 22:42 horas finalizó la maniobra de amarre con su banda de babor al muelle. Una
hora más tarde, el primer oficial dio la orden de liberar el spring de proa que, según apreció, quedó
aprisionado entre el buque y una defensa del muelle.
El contramaestre se dirigió con dos marineros a la proa (marinero A y marinero B) para realizar la
maniobra. El marinero B se ubicó en la cubierta del castillo y asumió el rol de gango para hacer las
señas al contramaestre. El contramaestre se posicionó en el cabrestante y el marinero A se ubicó
a la altura de la bodega N°1, próximo a donde se aprisionó la amarra. A las 23:50 horas comenzó
la operación de carga y a las 23:55 horas comenzó la maniobra para liberar la amarra atrapada.
Tres minutos luego de iniciar esta maniobra, a 23:58 horas, la amarra se liberó repentinamente, se
rectificó y descargó violentamente la energía acumulada impactando en el mentón del marinero A.
El oficial de guardia avisó inmediatamente al primer oficial y la tripulación se dirigió hacia la ubicación
del marinero A.
A las 00:20 horas arribó al sitio del accidente una ambulancia que prestó asistencia médica. A las
00:50 horas se informó al capitán del buque del deceso del marinero A.

2.3 Asistencia a la víctima
Se trasladó al tripulante accidentado a la enfermería del buque donde recibió los primeros auxilios.
Aproximadamente 25 minutos luego del accidente arribó al lugar una ambulancia y, 30 minutos más
tarde, el personal médico de esta informó el fallecimiento del marinero A. La prefectura denunció el
accidente a la Fiscalía Federal número 3 que ordenó diferentes trámites y autorizó el traslado del
cuerpo a la morgue judicial.
2.4 Información médica
El informe del personal sanitario que asistió al tripulante indicó que la víctima presentó traumatismo
de cráneo y paro cardiorrespiratorio. Recibió en la ambulancia maniobras de RCP, oxígeno
medicinal y adrenalina hasta las 00:50 horas, cuando se informó el fallecimiento. El acta de
levantamiento de cadáver señaló traumatismo craneal bilateral con herida contusa cortante y
fractura.
Aunque se solicitó a la fiscal a cargo copia de la autopsia con informe toxicológico, al momento de
emitir este informe, la misma no se ha recibido.
El 14 de agosto de 2020 a las 02:00 horas, el capitán, acorde a los procedimientos de la compañía,
realizó la prueba de alcoholemia al primer oficial de cubierta, al tercer oficial de cubierta, al
contramaestre y al marinero B. Todas resultaron negativas.
2.5 Descripción del lugar del suceso
Las terminales VI y VII del Puerto Rosario están compuestas por dos muelles de atraque preparados
para la carga de dos buques en forma simultánea e independiente.
Esta terminal dispone también de una dársena de cabotaje con un muelle exclusivo de 9 metros de
profundidad a pie de muelle y 280 metros de longitud, sobre el cual están montadas dos grúas
marca Ganz de 27 t. de capacidad cada una, con un sistema de transporte de granos independiente,
para realizar la descarga de barcazas.
El frente de amarre se encuentra aproximadamente a 100 metros del canal principal por el cual
transitan buques de porte. Este canal principal posee un ancho de solera de 200 metros en el sector

de muelles del puerto de Rosario ubicado entre los Km 412,7 y 418,5 de la margen derecha del río
Paraná.
El control del tráfico en el área está bajo la jurisdicción del VTS Rosario (L6I) operado por la
Prefectura Naval Argentina (PNA).

2.6 Información de tráfico
En la grabación de voces del VDR del B/M Strategic Equity quedó registrada la comunicación de
los buques “Bunga Lilac” y “Skyros”, ambos con estimativas de franqueo al B/M Strategic Equity
cercanas a la hora del accidente.
Los registros del libro de guardia de la estación VTS del Centro de Control de Tráfico Rosario
confirmaron las comunicaciones del VDR antes detalladas.
El registro de las posiciones del Servidor Nacional AIS del Sistema Guardacostas indicó lo siguiente:
El día 13/08/2021 el B/M Bunga Lilac franqueó dos veces al Strategic Equity pasando
aproximadamente a 200 metros de su posición de atraque. A las 22:32 horas lo hizo en
sentido aguas arriba (norte). A las 23:54 horas lo hizo en sentido aguas abajo (sur), a una
velocidad de 8 nudos, con un calado de 9,5 metros.
El día 14/08/2021 el B/M Skyros franqueó al B/M Strategic Equity a las 00:17 horas en sentido
aguas arriba.

2.7 Condiciones hidrológicas y meteorológicas al momento del suceso
Las condiciones climáticas eran favorables; el río Paraná registraba una bajante extraordinaria.

2.8 Información obtenida de las filmaciones y fotografías
Los tres tripulantes involucrados en el suceso utilizaron overol, casco y zapatos de seguridad.
2.9 Información obtenida en las entrevistas
Como parte del proceso de investigación, se entrevistó al personal involucrado en la maniobra.
Estos indicaron que aproximadamente a las 23:40 horas, antes de iniciar la operación de carga, el
primer oficial descendió al muelle para leer los calados y observó que un spring de proa quedó
atrapado entre la defensa del muelle y el casco del buque.
El primer oficial contactó al contramaestre por radio VHF y le ordenó la liberación del spring de proa
atrapado mediante el lascado de los largos de proa.

El contramaestre manifestó que se dirigió al castillo junto con el marinero A y el marinero B, el
marinero A se encargó de las señas, pero se ubicó fuera de la línea de visión del contramaestre,

por tal motivo, el marinero A observó el estado de la amarra y realizó las señas al marinero B, quien
repitió a su vez las señas al contramaestre, quien fue el encargado de operar el cabrestante de
babor.
Repentinamente el spring de proa zafó de su posición de atrapamiento, liberó energía bruscamente
y generó un movimiento elástico de rectificación ascendente que provocó el impacto en el mentón
del marinero A.
Al momento de finalizar el atraque, las amarras operaron correctamente, luego del amarre, el spring
de proa no fue manipulado ni cambiado de posición, ni a bordo, ni en tierra.

2.10 Información del Sistema de Gestión de Seguridad Operacional
Se constató que el procedimiento 0040 Mooring Operations, vigente en ese momento, categorizaba
la manipulación de amarras como una actividad de alto riesgo y establecía las pautas operativas
vinculadas a las operaciones con amarras.
Además, señalaba que debían realizarse actividades rutinarias de evaluación de riesgos cada tres
meses, incluyendo el desarrollo de un listado de riesgos vinculados a esta tarea y las medidas de
mitigación correspondientes. La última evaluación de riesgos vigente en ese momento no incluía
los riesgos y medidas de mitigación para las operaciones de liberación de amarras atrapadas
durante la estadía del buque en muelle.
El procedimiento Mooring Operations no contemplaba una sección específica para las maniobras
de liberación de amarras durante la estadía en puerto, además, en ninguna sección se establecía
la necesidad de definir un proceso para garantizar que, durante la estadía en muelle, no se produjera
el paso cercano de otros buques de manera simultánea con la manipulación de amarras por parte
de la tripulación de guardia.
2.11 Informes de eventos similares anteriores
El 22 de mayo de 2017, en Puerto Trois-Rivières (Canadá), a bordo del buque granelero NORD
QUEBEC, bandera de Singapur, el segundo oficial recibió el impacto de un spring de proa en el
mentón que provocó su posterior fallecimiento.
La investigación del suceso estuvo a cargo de Transportation Safety Board of Canada (TSB) de la
cual surgió el Marine Investigation Report M17C0060 y el Safety Flyer 2017/01 de fecha del 5 de
julio de 2017 de la Transport Safety Investigation Bureau (TSIB) de Singapur.
Como producto de la investigación, la TSIB recomendó incorporar las operaciones con amarras
dentro del Sistema de Gestión de Seguridad (SGS) incluyendo las acciones correctas e incorrectas
para prevenir accidentes durante las maniobras. El procedimiento Mooring Operations analizado
contempla diversas precauciones que deben tomarse en la operación de amarras, aunque no
cuenta con una sección específica sobre la liberación de amarras aprisionadas, ni con las
precauciones especiales que deben tomarse dado el riesgo de liberación súbita o inesperada.

2.12 Aspectos institucionales
El buque es propiedad de la empresa SBC Equity PTE. LTD. La gestión comercial estaba a cargo
de Worthington Bulk LTD. La gestión operativa estaba a cargo de MTM Ship Management, empresa
con amplia trayectoria en la industria marítima comercial, con presencia mundial y que se encarga
de la gestión de una amplia flota de buques tanques y graneleros.

Punto 7. Es extremadamente importante que las operaciones de amarre sean reconocidas dentro del SGS como
operaciones que requieren una evaluación de riesgo incluyendo lo que hay que hacer y lo que no hay que hacer.
Punto 8. Dentro de las buenas prácticas, previo a las operaciones de amarre se debe realizar, con el personal involucrado
en las operaciones de amarre, una charla de seguridad y recordar las precauciones de seguridad que hacen a una
operación segura con amarras y asegurar que se mantenga una comunicación segura en todo momento.

3. ANÁLISIS
3.1 Los factores desencadenantes
El análisis de la información recabada y los estudios realizados durante la investigación
determinaron que el accidente se desencadenó por una liberación repentina de la amarra cuando
se intentó desaprisionarla de la defensa. Como consecuencia, el spring impactó a la altura del
mentón del marinero A, que se encontraba directamente en el camino de la amarra al ser liberada.
El propósito de la ubicación del tripulante en ese sitio fue observar la amarra y transmitir las señas
con destino a un segundo gango, quien a su vez tenía que repetir dicha señal hacia quien operaba
el cabrestante, según la planificación de la actividad.
Resulta probable que la interacción producida por el paso de otro buque (el Bunga Lilac de 147
metros de eslora y 25 metros de manga) haya afectado al buque amarrado al momento exacto de
la operación de la amarra y haya contribuido a su liberación repentina e inesperada.
Pudo determinarse, asimismo, que los tripulantes vinculados a la maniobra estaban debidamente
habilitados para realizar las tareas con amarras en cubierta, que habían cumplido con el período
reglamentario de descanso y que se utilizaron los elementos de protección personal previstos para
la maniobra.

3.2 El contexto operativo
La comprensión del desempeño del personal operativo resulta una condición necesaria, aunque no
suficiente, para determinar los factores profundos vinculados a la ocurrencia de un suceso. En
efecto, los modelos que describen la génesis de los accidentes e incidentes sostienen que el
desempeño de los operadores de primera línea no puede analizarse “en el vacío”, o sea, sin
comprender adecuadamente el contexto operativo en el que ocurre.
Así, la descripción de elementos tales como los procesos, los procedimientos y las políticas
implementadas para el control de riesgos resulta fundamental para identificar los factores sistémicos
involucrados en el accidente y, por lo tanto, para establecer las recomendaciones de seguridad
operacional más eficaces y adecuadas, capaces de prevenir su recurrencia.
Los procedimientos operativos constituyen una pieza central para la adopción de prácticas seguras
y una defensa fundamental para reducir la probabilidad de desvíos de la conducta esperada durante

la ejecución de las maniobras. En estos documentos, la organización establece los lineamientos del
desempeño esperable, de acuerdo con los riesgos estimados para las diferentes operaciones. Tanto
el adecuado diseño de los procedimientos, como la supervisión de su aplicación (o su contracara,
la denominada “deriva” práctica) y los recursos operativos para los operadores de primera línea
(como listas de chequeo, libros de procedimientos, cartelería, etc.) constituyen elementos
fundamentales para controlar los riesgos vinculados a la seguridad.
Tal como se indicó en la sección 2 de este informe, el buque Strategy Equity contaba, conforme las
regulaciones vigentes, con un conjunto de procedimientos vinculados al sistema de Sistema de
Gestión de la Seguridad (SGS). Específicamente, las prácticas vinculadas a las operaciones con
amarras estaban contempladas en el procedimiento 0040, denominado Mooring operations.
Aunque el procedimiento establecía las precauciones y previsiones a tomar en un amplio espectro
de operaciones con amarras, no se definía ningún lineamiento operativo concreto y precauciones a
tomar vinculados específicamente a la liberación de amarras en una situación de aprisionamiento
durante su estadía en muelle, como la que motiva el análisis de este accidente. Por ejemplo:
a) No pudo identificarse ninguna pauta de seguridad que estableciera directivas concretas para
asegurar que la maniobra de liberación de la amarra aprisionada se realizara sin la presencia de
tráfico de buques cercanos, a fin de evitar la interferencia por la interacción debida al franqueo de
dichos buques.
b) El procedimiento no incluía ninguna pauta para la evaluación (previa a la realización de la
maniobra) de las potenciales vías de desplazamiento que podría experimentar una amarra
aprisionada en caso de liberarse súbitamente, con el objetivo de establecer zonas no transitables,
o áreas de posicionamiento seguro para los tripulantes durante esa tarea.
c) El hecho de establecer una política para evitar la “línea de fuego” en este tipo de operaciones,
disminuye considerablemente la probabilidad de provocar una lesión a la tripulación, aun cuando
se concrete la liberación repentina de la amarra.
d) En la evaluación de riesgo trimestral, vinculada a la operación de amarras, los riesgos
relacionados con la liberación de amarras aprisionadas no estaban contemplados de forma
específica, ni tampoco las medidas de mitigación que debían tomarse al respecto.
e) Con respecto a las comunicaciones, la evaluación de riesgo para las operaciones de amarre
establecía que las señales debían ser realizadas por el oficial de guardia y que éste, en caso
necesario, podía utilizar un segundo tripulante para repetir sus señas. Sin embargo, este aspecto

no estaba aclarado para el apartado del procedimiento 0040 donde se establecía la obligatoriedad
de mantener en todo momento las amarras tensas durante la estadía en muelle.
f) Aunque el Safety Flyer 2017/01 del TSIB recomienda incluir dentro de los procedimientos del
SGS las precauciones a tomar en este tipo de operaciones, no se hallaron incorporadas en los
procedimientos operativos formales del buque.

4. CONCLUSIONES
4.1 Conclusiones referidas a factores relacionados con el accidente.
Se produjo la liberación repentina de la amarra que se encontraba aprisionada entre el buque y
la defensa del muelle.
Con alto grado de probabilidad, la liberación súbita de la amarra fue favorecida por la interacción
debido al paso de otro buque por las proximidades.
El marinero A se ubicó dentro de la zona de riesgo de movimiento de la amarra debido al efecto
de descarga violenta de energía de dicha amarra.
No se tomaron precauciones para asegurar que la maniobra de liberación de la amarra sea
realizada con ausencia de movimientos de tráfico.
No se encontró definida en el procedimiento Mooring Operations una sección específica que
establezca lineamientos operativos concretos vinculados a la maniobra de liberación de amarras
ante una situación de aprisionamiento, como la que motiva el análisis de este accidente.
Las recomendaciones del Safety Flyer 2017/01 del TSIB no se hallaron incorporados a los
procedimientos operativos del SGS.
4.2 Conclusiones referidas a otros factores de riesgo de seguridad
operacional identificados por la investigación

5. RECOMENDACIONES SOBRE SEGURIDAD OPERACIONAL
A: Se dirige la presente RSO a los siguientes organismos:
1. Como principal destinatario nacional a la Prefectura Naval Argentina, autoridad marítima
nacional, autoridad competente en la implementación de los SGS de los buques nacionales.
2. Como destinatario principal extranjero: La compañía - MTM Shipmanagement.
3. Como destinatarios secundarios, a los organismos que agrupan a los armadores -o sus
representantes- nacionales y extranjeros: Federación de Empresas Navieras de Argentina,
(FENA); Cámara de Armadores de Pesqueros y Congeladores de la Argentina (CAPECA);
Cámara Argentina de Armadores de Buques Pesqueros de Altura (CAABPA); Cámara de
Armadores de Poteros Argentinos (CAPA); Centro de navegación.

Se recomienda la incorporación dentro del SGS de los siguientes tópicos:
Una sección específica de procedimientos operativos para la liberación de amarras ante una
situación de atrapamiento.
Un proceso seguro de coordinación entre los tripulantes para evitar que las maniobras de
amarras, durante la estadía en muelle, sean realizadas durante el paso de otros buques
próximos a la posición de amarre.
La realización de una evaluación de riesgos previa al inicio de la tarea de liberación de
amarras que cuente, al menos, con:
a) una definición de la posible trayectoria de desplazamiento de la amarra en caso
de liberación súbita;
b) las zonas de posicionamiento seguro para evitar que un tripulante ingrese a la
línea de fuego, y
c) el establecimiento de que este tipo de maniobras sean realizadas con la cantidad
adecuada de personal debidamente habilitado y capacitado bajo la supervisión del

oficial de guardia, quien a su vez se encargará de las señas, procurando evitar,
siempre que sea posible, el uso de un segundo pasaseña.
Un proceso claro y concreto de capacitación sobre las medidas de seguridad para el
desarrollo de la tarea de liberación de una amarra atrapada.
La definición de un programa de supervisión de las operaciones para verificar el
cumplimiento de los estándares definidos.

NOTICE
The mission of the Transport Safety Board is to contribute to transport safety through accident
investigation and the issuance of safety recommendations by:
(a) Determining the causes of transport accidents and incidents whose technical investigation is to
be carried out.
(b) Recommending effective actions aimed at preventing future transport accidents and incidents.
This report reflects the conclusions of the JST regarding the circumstances and conditions in which
the event occurred. The analysis and conclusions of this report summarize the relevant information
for safety management, presented in a simple and useful way for the marine transport community.
In accordance with the principles of the transport safety policy set forth in Article 2, Law 27514, the
principle of "Technical Exclusivity" applies, whereby the investigation is limited to the identification
of the factors that may have had an impact on the transport event, excluding the determination of
administrative, civil or criminal liability, or the assignment of blame, the scope of which belongs to
the judicial or administrative investigation, from which it is independent.
Pursuant to Law 27514:
The Transport Safety Board limits its jurisdiction to the investigation of the causes of accidents or
incidents and the clarification of the circumstances in order to issue reports and/or recommendations
aimed at increasing safety and fostering the prevention of accidents.
The results of this investigation do not condition or prejudge parallel administrative or judicial
investigations that may be initiated.
The determination of civil or criminal liability or the assignment of blame to specific persons is
prohibited.
Article 18. The purpose of the investigations carried out by the Transport Safety Board is the
prevention of future transport accidents and incidents.

Article 19. In view of the purpose established in the preceding article, the use of the following is not
admissible in judicial proceedings:
(a) Interviews within the framework of an investigation;
b) Tests or research. However, the Transport Safety Board may coordinate tests or research with
the administrative or judicial authority in charge of the corresponding investigation when it plans to
do so.
Article 20. The final reports of the Transport Safety Board do not aim at determining criminal guilt or
fraude nor the civil liability of the accident and incident. They are independent of any other
administrative or judicial investigation, not affecting any subjective interest; therefore, they are not
subject to appeal or challenge, nor can they be admitted as evidence in any judicial proceeding.

INTRODUCTION
The Transport Safety Board (JST) adopted the systemic model for the analysis of accidents and
incidents in the four modes of transport: aviation, road, rail and marine and inland waters.
The model has been widely adopted by leading institutions dedicated to the investigation of accidents
and incidents in the four modes of transport at the global level.
The central premises of the systemic accident investigation model are as follows:
The actions or omissions of front-line operational personnel and/or technical failures of
equipment constitute the immediate or triggering factors of the event. These are the starting
points of the investigation and are analyzed with reference to the defenses of the aeronautical
system, as well as other factors, in many cases remote in time and space from the precise
moment of the event.
The system defenses have the goal of detecting, containing, and helping recover the
consequences of the actions or omissions of front-line operational personnel and/or equipment
failures. The defenses are grouped under three generic entities: technology, regulations
(including procedures), and training.
Finally, the factors that allow for an understanding of the front-line operational personnel’s
performance and/or technical failures, and for an explanation of the failure of the defenses are
generally far away in time and space from the moment at which the event happened. They are
denominated systemic factors and they are closely linked to elements such as the operational
context, the rules and procedures, personnel training, safety management on behalf of the
organization to which the operational personnel reports, and infrastructure.
The investigation included in this report is based upon the systemic model. It is directed towards
identifying the factors related to the accident, as well as other safety risk factors that, although not
causally related to the event under investigation, have a potential triggering effect under other
operational circumstances. The aforementioned has the objective of formulating recommendations
on viable, practical, and effective actions for the contribution of safety management.

1 INTRODUCTION
On August 13, 2020, one of the crew of the Motor Vessel Strategic Equity IMO N° 9689902, was
injured in the process of releasing the forward spring line which was had become trapped
between the vessel and a wharf fender. During this attempt, the forward spring’s tension from
the fender was suddenly released and impacted on the face of a crew member who was
performing the role of a signalman near cargo hold No. 1. The injuries sustained by the crewman
resulted in death. The accident occurred at night, with artificial lighting and favorable weather
conditions.

2 FACTUAL INFORMATION
2.1 Operation Summary
The motor vessel Strategic Equity departed from Porto Alegre, Brazil to the port of Rosario,
Argentina. On August 13, 2020, at 21:121, it began the berthing maneuver under Pilotage, at
Terminal Servicios Portuarios S.A., located at kilometer 414.8 on the right bank of the Parana River.
At 22:42, the vessel completed the mooring maneuver port side alongside. One hour later, the chief
officer gave the order to the crew to release the forward spring which, as he noticed, was trapped
between the vessel and a wharf fender.
The boatswain went with two seamen to the forward station (Seaman A and Seaman B) to perform
the maneuver. Seaman B positioned himself on the forecastle deck and took on the role of the
signalman to signal the boatswain. The boatswain positioned himself at the winch, and Seaman A
positioned himself at hold No. 1, next to where the mooring line was stuck. At 23:50, the loading

operation began and, at 23:55, the maneuver to free the trapped mooring began. Three minutes
after starting this maneuver, at 23:58, the mooring line suddenly broke free, straightened and
violently discharged the accumulated energy impacting the chin of Seaman A. The watch officer
immediately alerted the chief mate and the crew went to the location of Seaman A. At 00:20, an
ambulance arrived at the accident site and provided medical assistance. At 00:50, the captain of the
vessel was informed of Seaman A's death.

2.3 Assistance to Victims
The injured crewmember was taken to the ship's hospital where he received first aid. Approximately
25 minutes after the accident, an ambulance arrived at the scene and 30 minutes later, the medical
staff reported the death of seaman A. The Coast Guard reported the accident to the Federal
Prosecutor's Office No. 3, which ordered certain procedures and authorized the transfer of the body
to the judicial morgue.
2.4 Medical Information
The report of the medical personnel who assisted the crew member indicated that the victim
presented cranial traumatism and cardiorespiratory arrest. He received CPR maneuvers, medical
oxygen and adrenaline in the ambulance until 00:50 when death was declared. The coroner's report
showed bilateral cranial traumatism with blunt cutting wounds and fracture.
Although the prosecutor in charge was requested a copy of the autopsy with a toxicological report,
it has not been provided at the time of issuing this report.
On August 08, 2020, at 02:00, a breathalyzer test was performed on the first mate, the third mate,
the boatswain and seaman B by the Master, in accordance with the Company’s established
procedures. They were all negative.
2.5 Description of the Accident Site
Terminals VI and VII of the Port of Rosario are composed of two berthing docks prepared for the
loading of two vessels simultaneous and independently.
The terminal also has a coastal dock with an exclusive wharf of 9 meters or water depth and 280
meters long on which are mounted two 27 ton. Ganz cranes, with an independent grain transport
system, to unload barges.

The berth is located approximately 100 meters from the main channel through which large vessels
transit. This main channel has a navigable width of 200 meters in the dock sector of the port of
Rosario located between Km 412.7 and 418.5 on the right bank of the Paraná River.
Traffic control in the area is under the jurisdiction of VTS Rosario (L6I) operated by the Rosario Coast
Guard.

2.6 Traffic Information
The Strategic Equity’s VDR recorded the communication with the ships “Bunga Lilac” and “Skyros”.
Both have ETA at Strategic Equity position close to the time of the accident.

The Rosario VTS logbook records confirmed the VDR communications detailed above.
The Coast Guard System of AIS National Server position log indicated the following:
● On August 13, 2020, the Motor Vessel Bunga Lilac twice passed Strategic Equity position
approximately 200 meters from its berthing position. At 22:32, it did so in an upstream (North)
direction. At 23:54, it did so downstream (South), at a speed of 8 knots, with a draught of 9.5
meters.
● On August 14, 2020, the Motor Vessel Skyros passed the M/V Strategic Equity at 00:17
upstream.

2.7 Hydrological and Meteorological Conditions at the Time of the Event
The meteorological conditions were favorable. The Paraná river registered an extraordinary low
level.

2.8 Information from Videos and Pictures
The three crew members involved in the accident wore overalls, helmets and safety shoes.

2.9 Information from Interviews
As part of the investigation process, the personnel involved in the maneuver were interviewed.
They indicated that approximately at 23:40, prior to the start of the loading operation, the chief officer
went down to the quay to read the draft and observed that a forward spring was trapped between
the dock fender and the vessel's hull.
The Chief Officer contacted the boatswain by VHF radio and ordered him to free the trapped forward
spring by slacking away the head lines.

The boatswain stated that he went to the forecastle together with Seaman A and Seaman B, Seaman
A was in charge of the signals, but he was out of the boatswain's line of sight. For this reason,
Seaman A observed the state of the mooring and made the signals to Seaman B, who repeated the
signals to the boatswain, who was in charge of operating the port winch.

Suddenly, the forward spring broke free from its trapped position, released energy abruptly and
generated an elastic upward rectifying movement that caused the impact on Seaman A's chin.
Upon completion of the berthing, the moorings lines operated correctly, and after the mooring, the
forward spring was not manipulated or repositioned, either on board or ashore.

2.10 Safety Management System Information
It was found that procedure 0040 "Mooring Operations", in force at that time, categorized the
handling of mooring lines as a high-risk activity and established operational guidelines related to
mooring operations.
It was also determined that routine risk assessment activities should be carried out every three
months, including the development of a list of risks associated with this task and the corresponding
mitigation measures.
The latest risk assessment in force at that time did not include the risks and mitigation measures for
the release of trapped moorings during the vessel's stay at dock.
The mooring operation procedure did not contemplate a specific section for mooring release
maneuvers during the stay at port, and no section established the need to define a process to ensure
that, during that stay, the close passage of other vessels did not occur simultaneously with the
handling of moorings by the watchkeeping crew.
2.11 Information from Previous Similar Events
On May 22, 2017, in Port Trois-Rivières, Canada, on board the Singapore-flagged bulk carrier "Nord
Quebec", the second mate was struck in the chin by a forward spring resulting in his subsequent
death.
The investigation of the occurrence was conducted by Transportation Safety Board of Canada (TSB).
The Marine Investigation Report M17C0060 and the Safety Flyer 2017/01, dated July 5, 2017, of
TSIB of Singapore, were issued.
As a result of the investigation, the TSIB recommended incorporating mooring operations into the
Safety Management System (SMS), including correct and incorrect actions to prevent accidents
during maneuvers. The "Mooring Operations" procedure analyzed contemplates several precautions
to be taken in the operation of mooring lines, although it does not have a specific section on the

release of mooring lines, nor the special precautions to be taken given the risk of sudden or
unexpected release.

2.12 Institutional Aspects
The vessel is owned by SBC EQUITY PTE. LTD. The commercial management was in charge of
WORTHINGTON BULK LTD. The operational management was in charge of MTM SHIP
MANAGEMENT, a company with extensive experience in the commercial maritime industry, with
worldwide presence and responsible for the management of a large fleet of tankers and bulk carriers.

3. ANALYSIS
3.1 Triggering Factors
The analysis of the information gathered and the studies carried out during the investigation
determined that the accident was triggered by a sudden release of the mooring when an attempt
was made to free it from the trapped location at the fender. As a consequence, the spring impacted
the chin of Seaman A, who was directly in the path of the release of the mooring rope when it
released.
The purpose of the crew member's location was to observe the mooring and transmit the signals to
a second signal man, who in turn had to repeat the signal to the winch operator, according to the
activity plan.
It is likely that the interaction caused by the passage of another vessel (the 147 m long, 25 m beam
Bunga Lilac) affected the moored vessel at the exact time of the mooring operation and contributed
to its sudden and unexpected release.
It was also determined that the crew members involved in the maneuver were duly authorized to
perform the tasks with mooring lines on deck, that they had complied with the regulatory rest period,
and that the personal protection elements required for the maneuver were used.

3.2 Operational Context
Understanding the performance of operating personnel is a necessary but not sufficient condition to
determine the deeper factors linked to the occurrence of an event. Indeed, models describing the
genesis of accidents and incidents maintain that the performance of front-line operators cannot be
analyzed "in a vacuum", i.e. without a proper understanding of the operational context in which it
occurs.
Thus, the description of elements such as processes, procedures and policies implemented for risk
control is essential to identify the systemic factors involved in the accident and, therefore, to establish
the most effective and appropriate recommendations capable of preventing its recurrence.

Operating procedures are a central piece for the adoption of safe practices and a fundamental
defense to reduce the probability of deviations from the expected behavior during the execution of
maneuvers. In these documents, the organization establishes the expected performance guidelines,
according to the estimated risks for the different operations. The adequate design of procedures, the
supervision of their application (or its counterpart, the so-called “practical drift") and the operational
resources for front-line operators (such as checklists, procedure books, signage, etc.) are
fundamental elements to control safety-related risks.
As indicated in section 2 of this report, the Strategy Equity vessel had, in accordance with the
regulations in force, a set of procedures linked to the Safety Management System (SMS).
Specifically, the practices related to mooring operations were covered by procedure 0040, called
"Mooring operations".
Although the procedure established the precautions and previsions to be taken in a wide range of
mooring operations, it did not define any concrete operational guidelines and precautions to be taken
specifically linked to the release of moorings in a situation of entrapment during their stay in dock,
such as the one that motivates the analysis of this accident. For example:
No safety guidelines could be identified that would establish specific directives to ensure
that the release maneuver of the trapped mooring was performed without the presence of
nearby vessel traffic, in order to avoid interference by interaction due to the passing by of
such vessels.
The procedure did not include any guidelines for the evaluation (prior to performing the
maneuver) of the potential displacement paths that an imprisoned mooring could experience
in case of sudden release, with the objective of establishing non-traversable zones, or areas
of safe positioning for the crew members during this task.
Establishing a policy to avoid "line of fire" in these types of operations greatly decreases the
likelihood of crew injury, even in the case of a sudden release of the mooring.
In the quarterly risk assessment linked to the mooring operation, the risks related to the
release of entangled moorings were not specifically addressed, nor were the mitigation
measures to be taken in this regard.

With respect to communications, the risk assessment for mooring operations established
that signals should be made by the officer on watch and that he could, if necessary, use a
second crew member to repeat his signals. However, this aspect was not indicated for the
section of procedure 0040 where the obligation to keep the mooring lines taut at all times
during the stay at the dock was established.
Although the TSIB Safety Flyer 2017/01 recommends including the precautions to be taken
in these types of operations within the Safety Management System (SMS) procedures, they
were not included in the vessel's formal operating procedures.

4. CONCLUSIONS
4.1 Conclusions of factors related to the accident.
There was a sudden release of the mooring that was pinned between the ship and the dock
fender.
With a high degree of probability, the sudden release of the mooring was favored by the
interaction due to the passage of another vessel in the vicinity.
Seaman A was located within the mooring movement risk zone due to the violent energy
discharge effect of the mooring.
No precautions were taken to ensure that the mooring release maneuver was performed in
the absence of traffic movements.
No specific section was defined in the "Mooring operations" procedure that establishes
specific operational guidelines related to the mooring release maneuver in the event of an
entrapment situation, such as the one that motivates the analysis of this accident.
The recommendations of the TSIB Safety Flyer 2017/01 were not included in SMS operating
procedures.

5. SAFETY RECOMMENDATIONS
A: This Safety Recommendation (SR) is addressed to the following organizations:
1. Main national recipient: Argentina Coast Guard, as the competent authority for the
implementation of the SMS onboard national vessels.
2. Main foreign recipient: The Company – MTM Shipmanagement.
3. Secondary recipients: Argentine Chamber of Owners of Fishing and Freezing Vessels
(CAPECA); Argentine Chamber of Owners of Deep-sea Fishing Vessels (CAABPA);
Argentine Chamber of Owners of Poleboats (CAPA), Navigation Center, as a group of
maritime agencies representing ship owners operating in Argentine ports.

It is recommended to include specific processes within the SMS that include:
The incorporation of a specific section on operating procedures for the release of moorings
in a situation such as the one that motivates this report.
The provision of a safe process of coordination among the crew members to prevent mooring
maneuvers during the dock stay from being carried out during the passage of other vessels
close to the mooring position.
The obligation to carry out a risk assessment prior to the start of the mooring release task,
including at least:
a definition of the possible displacement trajectory of the mooring in case of sudden
release;

the safe positioning zones to prevent a crew member from entering the line of fire,
and
the establishment that this type of maneuver be carried out with an adequate number
of duly qualified and trained personnel under the supervision of the officer on watch
who, in turn, will be in charge of the signals, trying to avoid, whenever possible, the
use of a second gangway.
The definition of a clear and concrete training process on the safety measures incorporated
in the SMS for the development of this task.
The definition of an operation supervision program to verify compliance with the defined
standards.
