Origen de la Unión Interamericana de Organismos Electorales

En atención a las aspiraciones manifestadas en los Acuerdos suscritos en la V y VI Conferencia del Protocolo de Tikal, en el Acta Constitutiva

del Protocolo de Quito y en la “Declaración de Caracas”, emanada de la II Conferencia de esta Asociación, en el sentido de integrar ambas Asociaciones de Organismos Electorales en una estructura de carácter interamericano, se celebró en Caracas, Venezuela, una Reunión Conjunta con el objeto de constituir la Unión Interamericana de Organismos Electorales, como instancia superior de encuentro. Además de los protocolos señalados, también se adhieren los organismos electorales de México, Canadá, Estados Unidos, Puerto Rico y la ONPE de Perú.

La Unión Interamericana de Organismos Electorales es una entidad no gubernamental, cuyas decisiones tienen el carácter de recomendaciones y orientaciones para los Organismos que la integran. Sus objetivos son los que se detallan a continuación:

• Incrementar la cooperación entre las Asociaciones que integran la Unión, así como entre los Organismos Electorales que forman parte de la Unión.

• Impulsar el intercambio de información relacionada con los regímenes electorales.

• Estimular la participación de representantes de los Organismos miembros, en calidad de observadores en los procesos electorales.

• Formular recomendaciones de carácter general a los Organismos miembros de la Unión

• Promoversistemaselectoralesseguros,eficientesydemocráticosenlos cuales se garantice la emisión del voto en forma libre, universal y secreta.

• Proporcionar apoyo y asistencia, en la medida de sus recursos, a los Organismos Electorales que los soliciten.

Desde 1991 CAPEL ejerce la Secretaría Ejecutiva del Organismo Regional. Asimismo, actúa como Secretaría Ejecutiva de las Asociaciones de Organismos Electorales de Centroamérica y el Caribe (1985); y posteriormente, de América del Sur (1989).

El Órgano Superior de UNIORE es la Conferencia Interamericana de Organismos Electorales, integrada por los representantes de cada uno de ellos. Se reúne en forma ordinaria cada dos años y es presidida por el Organismo Electoral del país donde se realiza.

Principales Temas de los Acuerdos de las Conferencias

• Afirmarquelademocracia,consuscomponentescentrales de representación y participación ciudadana, es a la vez condición y consecuencia del respeto integral de todos los derechos humanos y en particular los derechos políticos.

• Asegurar la estabilidad de los funcionarios y empleados de los Organismos, así como garantizar las cualidades éticas, técnicas y profesionales de ellos.

• Apoyar proyectos regionales de Modernización de los Marcos Normativos para facilitar la Administración de los Procesos Electorales.

• Apoyar el proyecto de investigación sobre los derechos políticos de las personas con discapacidad.

• Realizar estudios, investigaciones y jornadas académicassobretemasespecíficoscomo:participación política, sistemas de representación, cartografía electoral, etc.

• Creación de módulos especializados por medio del SIII.

• Los Organismos miembros deberán ayudar, en la medida de sus posibilidades, a reducir los índices de abstención electoral y exclusión.

• Realizar análisis comparado sobre la legislación acercadelfinanciamientopúblicoyprivadodelascontiendas electoral.

• Destacar que el sistema interamericano es pionero en el reconocimiento de la democracia como un derecho de los pueblos y de los individuos, y en consecuencia, extremar los esfuerzos de los Organismos Electorales de la Región para la defensa y ampliación de las normas, prácticas y garantías que orienten a la defensa colectiva de la democracia.

• Tomar conocimiento de la diversidad de modalidades de ejercicio del sufragio que algunos Organismos Electorales de la Región están poniendo en ejecución y solicitar a la Secretaría Ejecutiva la sistematización de esta información, a efecto de que la misma constituya el acervo de todos los miembros de la UNIORE.

• Revisar las iniciativas de cooperación entre sus Organismos miembros y adoptar un marco de referencia estándar basado en el desarrollo de sus mejores prácticas, una metodología de implementación y mecanismos de evaluación.

• Destacar que la observación técnica internacional, realizada en el marco del más absoluto respeto a la legalidadvigenteenelpaísanfitrión,esunadelasactividades que mejor caracteriza y distingue a la UNIORE. En virtud de lo anterior, los miembros de la Unión se comprometen a poner especial interés en los procedimientos de invitación y acreditación de observadores electorales, así como a asegurar que sus representantes mantengan la seriedad y responsabilidad que tales actividades implican, y declaran su aspiración de que otras misiones de observación se lleven a cabo bajo las mismas normas de conducta.

• Ampliar las iniciativas de intercambio de información y de cooperación en materia de jurisprudencia electoral, mediante la alimentación y actualización de las bases de datos y la capacitación en este campo; asimismo, apoyar los esfuerzos de la Secretaría en la sistematización y distribución de esta información entre los Organismos Electorales miembros.

• Instruir a la Secretaría Ejecutiva para que en coordinación con los Organismos Electorales de UNIORE se realicen actividades académicas y estudios especializados que permitan contar con protocolos y otros instrumentos que ayuden prever o a enfrentar exitosamente situaciones potencialmente conflictivas,derivadasderesultadoselectoralescon márgenes muy estrechos, u otras situaciones especiales.

• Reiterar que la observancia de las normas de procedimiento preestablecidas, han sido y son la mayor garantía de respeto al ejercicio de la libre voluntad de los electores, y en virtud de ello, expresar los mejores deseos de que en México la situación actual se resuelva mediante canales democráticos y en el marco de la legalidad vigente en el país.

• Observar con complacencia la colaboración que, con el liderazgo de Elections Canada y del Electoral Advisory Committee of Jamaica, varios Organismos de UNIORE han brindado a las autoridades electorales haitianas, e instruir a la Secretaría Ejecutiva para que informe al Consejo Electoral Provisional acerca de las actividades de UNIORE ydelProtocolodeTikal,afindequeconsideresueventual incorporación.

• Rendir especial reconocimiento al Organismo Electoral de Panamá y en particular a sus Magistrados Eduardo Valdés, Dennis Allen y Erasmo Pinilla, por el papel jugado en la construcción de la democracia contemporánea panameña, el desarrollo de la institucionalidad electoral interamericana y el amplio ejercicio de la cooperación horizontal en la Región.

• Destacar que la observación electoral en el marco de UNIORE ha permitido enriquecer el uso de mecanismos y técnicas para perfeccionar aspectos específicosdelosregímeneselectorales,porloqueserecomienda a la Secretaría Ejecutiva que, con apoyo de los organismos electorales miembros, elabore un catálogo de los cambios o nuevas instituciones que se han originado en intercambios producidos en el contexto de las misiones de observación de UNIORE.

• Cada Organismo que conforma UNIORE se compromete a la pronta designación de un enlace técnico que junto con la Secretaría haga operativos los trabajos de desarrollo y actualización de la base de datos sobre la jurisprudencia electoral, recopilacióndeinformaciónbibliográficaytrabajosde investigación y publicaciones.

• Incentivar las investigaciones y publicaciones en materia electoral aprovechando la posibilidad de incluirlas en revistas electorales existentes en los diferentes organismos electorales y en publicaciones que se puedan canalizar a través de CAPEL.

• Promover el mejoramiento de la Red Electoral con elfindeestablecervíasinformáticasdeconexióna través de las páginas web de los organismos miembros.

• Desarrollar o compilar estudios sobre el tema de representación de las mujeres en altos puestos.

• Acompañar al TSE de Guatemala durante el proceso electoral 2011.

• Importancia de establecer límites al gasto y regular contribuciones privadas en las campañas electorales.

• Financiamiento público de la política como medida de equidad y transparencia.

• Cooperación horizontal entre los organismos electorales que han construido, desarrollado o adquirido sistemas tecnológicos de votación y escrutinioelectrónico,conelfindedesarrollarunaplataforma que pueda ser adaptada a los distinto sistemas de la región y así compartir costos.

• Impulsar un Código de Ética Universal en relación coneltemadefinanciamientodecampañaspolíticasylosprocesosdefiscalizacióndelasmismas.

• Realizar mesas temáticas sobre aspectos técnico-electorales para los miembros de la UNIORE.

• Crear un portal de UNIORE a cargo de la Presidencia.• Convocar a Reunión Extraordinaria (segundo

Instituto Interamericano de Derechos HumanosEl Centro de Asesoría y Promoción Electoral

IIDH/CAPELSecretaría Ejecutiva

El Instituto Interamericano de Derechos Humanos, IIDH, (con sede en San José, creado en virtud de un Convenio entre el gobierno de Costa Rica y la Corte Interamericana de Derechos Humanos) fue creado como organización internacional sui generis, ya que una de las principales preocupaciones de los fundadores fue dotarla de una naturaleza independiente de cualquier gobierno e incluso, de la propia institucionalidad del sistema interamericano (OEA) de protección y promoción de Derechos Humanos, del cual la Corte IDH sí es un órgano. El IIDH es, por lo tanto, una entidad independiente, con cobertura interamericana, regida por una Junta Directiva conformada por expertos en Derechos Humanos de todas las Américas y con un mandato orientado a la promoción y educación iushumanista.

Siempre orientado por ese mandato y desde muy temprano en su vida institucional (1983), el IIDH entendió claramente que el abordaje a los problemas de la democracia y los Derechos Humanos en las Américas no podría ser tratados de una manera integral, sin el trabajo sistemático en el campo de los derechos políticos y las elecciones.

Esta reflexión es el punto de partida para la creación del Centro de Asesoría y Promoción Electoral (CAPEL), un programa especializado del Instituto Interamericano de Derechos Humanos (IIDH). Fue creado en 1983 e inició sus labores en el mes de febrero de 1985. El Estatuto del Centro establece que sus fines serán la asesoría técnica electoral y la promoción de las elecciones, con un enfoque multidisciplinario, labor que ha realizado con organismos electorales, poderes legislativos, organizaciones de la sociedad civil y partidos políticos. Establece también que el IIDH/CAPEL sustentará su acción en “el principio de las elecciones libres como parte esencial de la teoría y práctica de los derechos humanos, condición de la democracia y fundamento del derecho a la libre determinación y de la paz en la convivencia nacional e internacional”.

Desde el momento en que inició sus labores, el IIDH/CAPEL estructuró su trabajo en la región a partir de cinco ejes fundamentales: 1. La asistencia técnica electoral; 2. Las misiones de observación de elecciones; 3. Actividades de capacitación y promoción (cursos, seminarios); 4. Las campañas de educación cívica; 5. Proyectos de investigación

y Publicaciones. Posteriormente, y como un elemento de apoyo y consolidación al trabajo de fortalecimiento de los procesos e instituciones democráticas, CAPEL se constituyó en la Secretaría Ejecutiva de las Asociaciones de Organismos Electorales de Centroamérica y del Caribe (Protocolo de Tikal), de América del Sur (Protocolo de Quito) y de la Unión Interamericana de Organismos Electorales (UNIORE), calidad bajo la cual se ha insertado en la dinámica democrática de nuestros países como facilitador y sujeto activo de los procesos de construcción y fortalecimiento de la democracia.

El Centro de Asesoría y Promoción Electoral (IIDH/CAPEL) que en el año 2012 conmemora su XXIX aniversario y en la actualidad actúa como Secretaría Ejecutiva de las 3 asociaciones de organismos electorales de las Américas:

• Asociación de Organismos Electorales de Centroamérica y El Caribe (Protocolo de Tikal 1985).

• Asociación de Organismos Electorales de América del Sur (Protocolo de Quito1989).

• Unión Interamericana de Organismos Electorales (UNIORE, 1991), que agrupa a las dos anteriores más a los organismos electorales de Canadá, Estados Unidos y México.

Estas Asociaciones se constituyeron con el objetivo de servir de instrumento institucional para el intercambio de conocimientos y experiencias, en pro del perfeccionamiento de los sistemas electorales (uno de los elementos para lograr regímenes auténticamente democráticos). Aprovechando el trabajo de estas Asociaciones, el IIDH/CAPEL ha diseñado, ejecutado y evaluado programas de asesoría técnica y misiones de cooperación horizontal, y ha estimulado la comunicación, las relaciones internacionales y la cooperación regional, a través de reuniones anuales. Las reuniones de trabajo de estas Asociaciones constituyen un mecanismo idóneo para el diagnóstico y análisis de los problemas que enfrentan los organismos electorales de la región en la organización de elecciones, concretando recomendaciones para la optimización de los mismos a través de la cooperación entre dichos organismos. Con estas redes de instituciones electorales, el IIDH/CAPEL propició el establecimiento de políticas de intercambio, de cooperación horizontal, asistencia técnica y facilitó la transmisión de experiencias para la transferencia de información y la observación recíproca de elecciones, lo que ha tenido como consecuencia la creación de una auténtica “red electoral interamericana”.

Se presenta a continuación una breve descripción de los principales ejes de acción del IIDH/CAPEL.

• Es una entidad que formula y administra proyectos de asistencia técnica en materia electoral o conexa con los derechos políticos. Los programas de asistencia técnica a organismos electorales están diseñados con base en los resultados de un proceso de diagnóstico, que tiene su origen en las solicitudes de asistencia técnica formuladas por los propios organismos o bien la información que en este sentido se genera en la dinámica de las reuniones anuales de las Asociaciones de Organismos Electorales. El IIDH/CAPEL brinda asistencia técnica en las siguientes áreas: modernización y fortalecimiento institucional; sistemas de administración y logística electoral (cronogramas de actividades; diseño, definición, impresión y adquisición de materiales electorales; diseño operativo para la oportuna, segura y fluida transmisión de resultados de las elecciones y su difusión pública); campañas de educación cívica y capacitación de funcionarios y de las personas encargadas de recibir el voto a los ciudadanos el día de las elecciones y de hacer el escrutinio, capacitación de fiscales de partidos políticos; diseño de programas para procesamiento electrónico de datos aplicados a procesos electorales; Registro Civil, Registro Electoral y Documento de Identificación, transmisión de resultados. La modalidad de acción del área de asistencia técnica electoral es variada, aunque marcada por una característica básica: su estrecha y directa relación con el máximo organismo electoral, los miembros y funcionarios gerenciales del país al que se presta asistencia. Por otro lado, se establecen contrapartes nacionales que guían el programa específico en coordinación permanente con el IIDH/CAPEL a través de un equipo de asesores expertos, destacados por la Dirección de CAPEL. Los programas específicos tienen una cobertura nacional o regional según la asistencia requerida por el organismo electoral respectivo.

Precisamente en el marco de este enfoque, es que CAPEL trabaja en otras actividades y en contacto con contrapartes diferentes de los organismos electorales (v.gr. partidos políticos, organizaciones de la sociedad civil que inciden en los procesos políticos de sus respectivos países, órganos legislativos, medios de comunicación, académicos, etc.).

• Es una entidad que realiza misiones de observación electoral en los países de América donde se efectúan procesos electorales. Estas misiones desempeñan un papel dual de observación técnica del proceso eleccionario y verificación imparcial de las elecciones. En este sentido, los miembros de la misión prestan especial atención a los aspectos relacionados con la administración del proceso, tales como padrón electoral, documento de identificación del elector, materiales

para el sufragio, procedimiento de votación, escrutinio y cómputo de votos, transmisión y publicación de resultados, entre otros. A su vez, cumplen la función de monitorear la efectiva aplicación, en un proceso electoral determinado, de las más elementales normas internacionales en materia de derechos civiles y políticos, para asegurar una evaluación integral y objetiva del proceso electoral. Estas misiones están integradas por miembros de organismos electorales de la región. El resultado de su labor se traduce en una evaluación de la jornada electoral y en un análisis del proceso cuyos resultados son remitidos al organismo electoral organizador de las elecciones, con el fin de que, en el espíritu de cooperación horizontal que emana de los acuerdos de las asociaciones, reciba las observaciones técnicas y sugerencias de los miembros de la misión y, de considerarlo pertinente, pueda tomarlas como base para mejorar sus futuros procesos de organización electoral.

Desarrolla proyectos y actividades de educación y capacitación. Por medio de las actividades de educación y capacitación el IIDH/CAPEL analiza diversos aspectos electorales desde la perspectiva interdisciplinaria, contando al efecto con el concurso de expertos latinoamericanos de relevantes condiciones académicas. Por medio de estas actividades el IIDH/CAPEL promueve la consolidación de regímenes auténticamente democráticos, contribuyendo al perfeccionamiento de los sistemas electorales vigentes, a través del estudio y el intercambio de experiencias. Estas actividades pueden clasificarse en tres categorías:

El Curso Interamericano de Elecciones y Democracia, cuyo aporte efectivo es la optimización de los sistemas y procesos electorales democráticos en el Continente. Supone un tratamiento de la temática electoral desde varias perspectivas, que deben adaptarse a las necesidades que la coyuntura impone.

Los Cursos y Seminarios especiales son actividades no periódicas que se enmarcan dentro de los objetivos básicos de CAPEL.

Proyectos de asistencia técnica centrados en el desarrollo de capacidades, destrezas y conocimientos necesarios para el buen éxito de un proceso electoral, especialmente en sus componentes técnicos. Los programas de educación cívica electoral del IIDH/CAPEL buscan fortalecer el sistema democrático, fomentar la participación ciudadana en los procesos políticos-electorales y crear una cultura y valores democráticos. Estos están subdivididos en:

Programas cívico-electorales que se ejecutan previa la realización de una elección, a través de los cuales se instruye a la población en relación con aspectos tales como la mecánica del voto.

Programas post-electorales, de carácter permanente, que refuerzan la transición y consolidación democrática (motivación y exaltación de valores democráticos).

político-electoral y página web. El IIDH/CAPEL edita, publica y distribuye importante material sobre temas electorales, incluyendo textos destinados a generar un mayor apoyo para la realización de elecciones libres y fortalecimiento de democracias representativas.

Haciendo una rápida valoración de la labor desplegada a lo largo de estos 29 años de trabajo ininterrumpido, podemos señalar que al año 2012 CAPEL ha ejecutado, a lo largo y ancho de la región, 534 proyectos en el espectro de los cinco ejes citados en los párrafos anteriores. Hemos destacado 243 misiones de observación de elecciones en procesos electorales del Continente; se ha brindado asistencia técnica especializada en 86 oportunidades a los diferentes organismos electorales, y hemos diseñado y ejecutado 21 programas de educación cívica con miras al fortalecimiento de los valores democráticos y la participación política. Respecto a las actividades de promoción, CAPEL ha ejecutado una serie de cursos especializados en los temas de democracia y elecciones, participación política, sistemas electorales, reforma electoral, partidos políticos, gobernabilidad, participación ciudadana, por citar algunos. Inter-American Union of Electoral Organizations

In response to the aspirations expressed in the Agreements signed in the V and VI Tikal Protocol Conferences, in the Constitutive Act of the Quito

Protocol and in the “Caracas Declaration”, emanating from the II Conference of this Association, in terms of integrating both Electoral Organization Associations into an Inter-American structure; a joint meeting was held in Caracas, Venezuela with the principal objective of constructing the Inter-American Union of Electoral Organizations. In addition to the aforementioned Protocols Mexico, Canada, the United States of America and Puerto Rico and ONPE, Perú.

The Inter-American Union of Electoral Organizations is a non-governmental body, whose decisions take the form of recommendations and guidelines for its member Organizations. Its objectives are detailed below:

• Increase cooperation between the Associations who make up the Union, as well as between the Electoral Organizations who form part of the Union.

• Promote information exchange related to electoral systems.

• Encourage the participation of representatives of Member Organizations as observers in electoral processes.

• Make general recommendations to the Member Organizations of the Union.

• Promotesecure,efficientanddemocraticelectoralsystemsguaranteeinga free, universal and secret vote.

• Provide support and assistance in terms of resources to the Electoral Organizations upon request.

Since 1991 CAPEL has been exercising the role of Executive Secretary to the Regional Organization. It has also been acting as Executive Secretary to the Associations of Electoral Organizations of Central America and the Caribbean (1985); and subsequently, of South America (1989).

The Superior Body of UNIORE is the Conference of the Inter-American Electoral Organizations, made up of representatives of each organization. Its regular session meets every two years and is chaired by the hosting Electoral Organization of the meeting.

FOUNDING CHARTER OF THE INTER-AMERICAN UNION OF ELECTORAL ORGANIZATIONS

We the undersigned, duly authorized by our respective organizations to act as the representatives of the Electoral Organizations of Antigua

y Barbuda, Costa Rica, Dominican Republic, El Salvador, Guatemala, Honduras, Jamaica, Nicaragua, Panama and St Lucia, all members of the Association of Central American and Caribbean Electoral Organizations (Tikal Protocol), and of the Electoral Organizations of Argentina, Bolivia, Brazil, Colombia, Chile, Ecuador, Peru, Uruguay and Venezuela, all members of the Association of South American Electoral Organizations (Quito Protocol): Reaffirmourunyieldingfaithindemocracyastheonlysystemwhichpermitsmankind to develop in a climate of absolute freedom. Realizing that the exchange of electoral information, the observation of electoral processes and that effective consultations, recommendations and assistance between electoral organizations are decisive factors in establishing and consolidating democracy through suffrage. Fully convinced of the importance of formalizing, through an instrument, cooperation between our organizations and the Associations composed of the members of the Quito Protocol and the Tikal Protocol.

To form the Inter-American Union of Electoral Organizations, composed of the Electoral Organizations of Central America and the Caribbean (Tikal Protocol), the Electoral Organizations of South America (Quito Protocol), and any other Electoral Organizations in the Americas which may apply and be accepted for membership in the future. This Union in no way implies the dissolution of the Associations of Electoral Organizations created under the “Quito Protocol” and the “Tikal Protocol”, nor the impairment of their independence and autonomy.

The Inter-American Union of Electoral Organizations is a non-governmental body, whose decisions are by way of recommendations and guidelines for the various member Organizations.

The Governing Body of the Union is the Inter-American Conference of Electoral Organizations, composed of the representatives of each individual organization. It shall meet in ordinary session every two years on the date and place decided by each Conference for the next. The need to alternate the site of each conference among the Union’s different member Organizations shall be taken into account in such decisions. The Conference may also meet in extraordinary session when so requestedbyatleastfivememberOrganizations,inwritingtotheExecutive Secretariat which, in consultation with the Committee mentioned in Clause Six, shall inform the members as far ahead of time as possible, of the site, date and agenda of the extraordinary Conference. The Conference shall be chaired by the Host Organization.

A simple majority of its members shall be required for the Conference to meet in formal session. The Conference’s resolutions and agreements shall be reached by consensus. Each Electoral Organization shall have one vote in the Union, regardless of the number of its representatives, to be cast by the person chairing the respective Delegation at the time of the vote.

The Conference shall appoint, for a two-year term, a Coordination and Follow-up Committee composed of one representative of the Electoral Organization which hosted the previous Conference, one representative of Electoral Organization which is to host the next conference, and the Executive Secretariat. During thefirstyear theCoordinationandFollow-upCommitteeshall be chaired by the representative of the Electoral Organization which hosted the previous Conference and, during the second year, by the representative of the Electoral Organization hosting the next Conference. This Committee is the top-level coordination and follow-up body between one Conference and the next.

The Coordination and Follow-up Committee shall be responsible for performing the following tasks:

The Union’s technical-administrative organ is the Executive Secretariat, the duties of which shall be performed by the Center for Electoral Promotion and Assistance (CAPEL), unless otherwise agreed. This shall be responsible for performing the following tasks:

Processing, through the Coordination and Follow-up Committee, applications for membership to be submitted to the Conference for its consideration. Fostering cooperation between member Organizations and any activities relating to the Union’s objectives. Any others which the Conference may decide to assign to it, as faraspracticablewithin the limitof its technicalandfinancialresources.

The Electoral Organizations belonging to the Union shall periodically forward to the Executive Secretariat information concerning the conduct of its electoral processes and copies of its laws, regulations, directives, works on doctrine, jurisprudence, electoral reports and, in general, any material which they regard as useful to the objectives of the Union, as well as any suggestions they deem appropriate. As far as is practicable, they shall forward this same material to the Union’s individual member organizations. All of the above shall provide the basis for a data base to be kept up to date by the Executive Secretariat, which in turn received, updating it on an annual basis.

The amendment of this Agreement requires the consensus of the Electoral Organizations which make up the Union. Such may be requested by any one of said organizations, in which case the item shall be placed on the agenda for the next Conference and the complete text of the proposed amendment provided.

This Founding Charter enters into force as of the date on which it is signed. Given in Caracas, Venezuela, on November 22, 1991.

The Organizations hereby agree to cooperate, as far as is practicable, for the effective attainment of the Union’s objectives.

and distribution of this information among member Electoral Bodies.

• To train the Executive Secretariat so that, in coordination with UNIORE Electoral Bodies, academic activities and specialized studies are performed so that there are protocols and other instruments to help preview and successfully face potentiallyconflictivesituations,derivedfromelectoralresults with tight margins or other special situations.

• To reiterate that the observance of pre-established standards of procedure have been and are the greatest guarantee of respect to the exercise of the electors’ free will, and in virtue of that, to express the best wishes that the current situation in Mexico is solved through democratic channels and in the framework of the current legality in the country.

• To pleasingly observe the collaboration that, with the leadership of Elections Canada and the Electoral Advisory Committee of Jamaica, several UNIORE Bodies have offered to Haitian electoral authorities, and to instruct the Executive Secretariat to inform the Provisional Electoral Council about UNIORE and Protocol of Tikal activities, in order to consider its eventual incorporation.

• To give special recognition to the Electoral Body of Panama, particularly to Magistrates Eduardo Valdés, Dennis Allen and Erasmo Pinilla, for the role played in the construction of Panamanian contemporary democracy, the development of Latin American electoral institutionality and the ample exercise of horizontal cooperation in the Region.

• To highlight that electoral observation, in UNIORE’s framework, has allowed for the enrichment of the use of mechanismsandtechniquestoimprovespecificaspectsofelectoral regimes, for which the Executive Secretariat is recommended, with the support of member electoral bodies, to prepare a catalogue of the changes or new institutions originated during exchanges produced in the context of UNIORE observation missions.

• Each Body member of UNIORE is committed to a speedy designation of a technical liaison who, along with the Secretariat, operates the development and updating of the database on electoral jurisprudence, collection of bibliographic information and investigation and publication works.

• To foster investigation and publication on electoral matters taking advantage of the possibility of including them in the existing electoral magazines in the different electoral bodies and publications that may be channeled through CAPEL.

• To promote the improvement of the Electoral Network in order to establish information technology ways to connect through member body web pages.

• To develop and compile studies on the topic on the representation of women in high positions.

• To accompany the Electoral Supreme Tribunal of Guatemala during the 2011 electoral process.

• The importance of establishing limits to expenses and to regulate private contributions in electoral campaigns.

Inter-American Institute for Human Rights The Center for Electoral Assistance and Promotion

IIDH/CAPELExecutive Secretariat

The Inter-American Institute for Human Rights, IIDH, (with headquarters in San José, established under a convention between the Costa Rican government and the Inter-American Court of Human Rights) was created as a sui generis international organization, as one of the main concerns of the founders was to grant it independence from any government, and even from the very institutions of the Inter-American system (OAS) for the protection and promotion of Human Rights, of which the Court of Human Rights is a body. The IIDH is therefore an independent body, with Inter-American coverage governed by a board composed of Human Rights experts from throughout the Americas and with a mandate aimed at iushumanista promotion and education.

Always guided by this mandate, from very early on in its institutional life (1983), the IIDH clearly understood that the approach to the problems of democracy and Human Rights in the Americas could not be addressed in a comprehensive manner without systematic work in the field of political rights and elections.

This reflection was the starting point for the creation of the Center for Electoral Assistance and Promotion, a specialized program of the Inter-American Institute for Human Rights (IIDH). It was established in 1983 and began work in February 1985. The Statute of the Center establishes that its purposes shall be technical electoral assistance and promotion of elections, with a multidisciplinary approach, work carried out with electoral organizations, legislative powers, civil society organizations and political parties. It also establishes that the IIDH/CAPEL will continue its actions on “the principle of free elections as an essential part of the theory and practice of human rights, the condition of democracy and the basis of the right to self-determination and to peace in national and international coexistence”.

From the time they began, the IIHR/CAPEL has structured its work in the region around five core themes: 1. Technical electoral assistance; 2. Electoral observation missions; 3. Training and promotional activities (courses, seminars); 4. Civic education campaigns; 5. Research projects and publications. Later, in way of support and consolidation of the work to strengthen the democratic institutions and processes, CAPEL became Executive Secretary to the Associations of the Electoral Organizations of

Central America and the Caribbean (Tikal Protocol), of South America (Quito Protocol) and the Inter-American Union of Electoral Organizations (UNIORE), under which capacity it has positioned itself within the democratic dynamics of our countries as a facilitator and active subject in the processes of constructing and strengthening democracy.

The Center for Electoral Assistance and Promotion (IIDH/CAPEL) celebrates its XXIX anniversary in 2012 and currently acts as Executive Secretary of 3 associations of the electoral organizations of the Americas:

• Association of Electoral Organizations of Central America and the Caribbean (Tikal Protocol 1985).

• Association of Electoral Organizations of South America (Quito Protocol 1989).

• Inter-American Union of Electoral Organizations (UNIORE, 1991), which brings together the two aforementioned associations as well as the electoral organizations of Canada, United States of America and Mexico.

These Associations were formed with the objective of providing an institutional instrument for the exchange of knowledge and experience towards the improvement of electoral systems (one of the elements in achieving truly democratic regimes). Making the most out of the work of these Associations, the IIDH/CAPEL has designed, implemented and evaluated programs of technical assistance and horizontal cooperation missions, and has stimulated communication, international relations and regional cooperation through its annual meetings. The working meetings of these Associations are an ideal mechanism for the diagnosis and analysis of the problems faced by the electoral organizations of the region in organizing elections and forming recommendations for the optimization of elections through cooperation between these bodies. Through these networks of electoral institutions, the IIDH/CAPEL has established policies for sharing, horizontal cooperation, technical assistance and facilitated the sharing of information and mutual electoral observation, which has resulted in the creation of a real “Inter-American electoral network”.

Below is a brief description of the main lines of action of the IIDH/CAPEL.

• It is a body which develops and manages projects of technical assistance related to electoral matters or political rights. The programs of technical assistance to electoral bodies are designed on the basis of the results of a diagnostic process, which originate from requests for technical assistance from the organizations themselves

or the information in this sense is generated in the dynamic of the annual meetings of the Associations of Electoral Organizations. The IIDH/CAPEL provides technical assistance in the following areas: institutional modernization and strengthening; administration systems and electoral logistics (activities schedules, design, definition, printing and procurement of election materials, operational design for the timely, safe and smooth transmission of election results and public disclosure); civic education campaigns and training of officials and persons responsible for receiving and counting citizens votes on election day, training of public prosecutors of the political parties; design of programs for electronic data processing applied to electoral processes; Civil Register, Electoral Register and Identification Documentation, results transmission. The mode of action in the area of electoral assistance is varied, although it is marked by a basic feature, its close and direct relationship with the highest electoral body and with the members and management officials of the country receiving assistance. On the other hand, national counterparts are established to guide the specific program in constant coordination with the IIDH/CAPEL through a team of expert consultants, headed by the leadership of CAPEL. The specific programs have regional or national coverage according to the assistance required by the respective electoral organization.

It is precisely in the context of this approach that CAPEL works in other activities and in contact with different partners from the electoral organizations (e.g. political parties, civil society organizations that influence the political processes in their respective countries, legislative bodies, media, academics, etc.).

• It is an entity which carries out observation missions in the countries of America where elections are being held. These missions perform a dual role of technical observation of the electoral process and impartial verification of the elections. In this regard, members of the mission pay special attention to administrative aspects of the process, such as voter registration, identification documentation of the voters, the ballot materials, voting methods, counting and calculation of the votes, transmission and publication of results, amongst others. In turn, in a particular electoral process they perform the function of monitoring the effective implementation of the most fundamental international standards in civil and political rights, to ensure a comprehensive and objective assessment of the electoral process. These missions are composed of members of the electoral bodies from the region. The results of the work are translated into an evaluation of the election day and an analysis of the process whose results are sent to the organizing electoral organization, so that in the

spirit of the horizontal cooperation that emanates from the agreements of the associations, they may receive the technical observations and suggestions from the mission’s members and if deemed appropriate use them as a basis for improvement in future processes of the electoral organization.

• Develop projects and activities of education and training. Through education and training activities the IIDH/CAPEL analyses various electoral issues from an interdisciplinary perspective, benefiting from the collaboration of Latin-American experts in their relevant academic capacities. Through these activities the IIDH/CAPEL promotes the consolidation of truly democratic regimes, contributing to the improvement of the existing electoral systems, through the study and sharing of experiences. These activities fall into three categories:

The Inter-American Elections and Democracy Course, whose effective contribution is the optimization of the democratic electoral systems and processes on the continent. It involves dealing with electoral topics from various perspectives, and must be tailored to the needs required by the situation.

Special Courses and Seminars are non-recurrent activities that fall within the basic objectives of CAPEL.

Technical assistance projects focus on capacity building, skills and knowledge necessary for the success of an electoral process, especially in its technical components. Some recent projects have emphasized this approach (Guatemala 2004-2008, Colombia 2006-2008, Dominican Republic 2007-2008, Ecuador 2008-2012).

• Development of electoral civic education programs. The IIDH/CAPEL’s electoral civic education programs seek to strengthen democratic systems, encourage citizen participation in political and electoral processes and create a culture of democratic values. They can be subdivided into:

Civic-electoral programs that are implemented before holding an election, through which the population are instructed on matters such as the mechanical aspects of voting.

Post-electoral programs, of a permanent nature which reinforce transition and democratic consolidation (motivation and exaltation of democratic values).

Research projects and production of doctrines in political-electoral topics and the website.

• Research projects and the production of doctrines in political-electoral topics and the website. The IIDH/CAPEL edits, publishes and distributes important material on electoral issues, including texts designed to generate major support for the free elections and the strengthening of representative democracies.

The IIDH/CAPEL’s publications are classified as follows: Elections and Democracy Series, CAPEL Notebooks series, Reports Series, Legal Texts Series, Latin-American Electoral Newsletter, Directory of Electoral Organizations, and UNIORE newsletters. Some academic publications and further specialized electoral information can be found on the capel website, the electoral network of the Americas, at the following address: www.iidh.ed.cr/capel.

Making a rapid assessment of the uninterrupted work carried out over the past 29 years, we note that throughout the region in 2012 CAPEL has implemented 534 projects within the spectrum of the five core areas cited in the above paragraphs. We have highlighted 243 electoral observation missions in electoral processes on the continent; it has provided specialized technical assistance on 86 different occasions to the different electoral bodies, and we have designed and implemented 21 civic education programs aimed at the strengthening of democratic values and political participation. Regarding advocacy activities, CAPEL has implemented a series of specialized courses in the areas of democracy and elections, political participation, electoral systems, electoral reform, political parties, governance, and citizen participation to name but a few. For its part, the wide range of themes dealt with in the CAPEL Notebooks series and in the Electoral Newsletters, as well as in the publications and specialized research, draws attention to the continuous research work of CAPEL in the field of political rights and in topics which aid the development of our democracies.
