    SABER MS IIIINTHE RIGHTTO KNOW DAY

    TheAlianza Regional por la Libre Expresin e Informacin presents its regional reportcalled SABER MAS III, Acceso a la Informacin y Proteccin de DatosPersonales".

    In the third year of its publication, the report explains the relationship and coexistenceof access to public information and ensuring the protection of personal data. Therelationship between both rights experience permanent tension, when invoking theprinciple of maximum disclosure of public events over the right to privacy of privateevents. This tension should not exist, if it was provided a clear line between public andprivate. However, this does not often happen, because the boundaries are blurred in

    both the promotion and the implementation and, with greater emphasis, on the defenseof the right of access to public information. This report details cases in severalcountries that exemplify these concepts.

    Fourteen countries participate of this report, represented by member organizations oftheAlianza, this time adding the organization Article XIX - Brazil with a detailed reportof the current Brazilian situation on access to information. Access - Info from Spainalso participated showing the balance of these rights in Europe; and the Cyrus VanceCenterwith a technical-legal report on the relationship between access to informationand personal data protection in the United States.

    SABER MS IIIcontains a diversity of views from members of the Alianza Regionaland the other authors, based on their experiences in the exercise of the promotion,implementation and defense of access to public information.

    Progress and setbacks in terms of transparency and access to information in LatinAmerica over the last decade allow us to assess access to information as a democratictool to meet the State's public activity.

    Also, it requires us to deepen the analysis to balance the exercise of rights. Thus,individuals are strengthened by the protection and guarantees provided by the stateand the full exercise of fundamental rights.

    The "Right to Know Day" - September 28, allows us to realize the collective needto make it a practice to ask the state for information regarding its publicactivities. Understand and develop our views is essential to strengthen andconsolidate democratic life.
