La empresa clasifica y contabiliza sus inversiones temporales y permanentes como se indica a continuación: / The Company classifies and records its short-term and long-term investments as follows:

Inversiones temporales: Las inversiones con vencimientos corrientes de los excedentes de caja realizadas con el fin de obtener rentas fijas son reflejadasdentro del disponible como equivalentes de efectivo.

Inversiones permanentes: 1) Inversiones en subsidiarias - Como parte de la preparación de estados financieros separados de ETB, la NIC 27 requiere que contabilice susinversiones en subsidiarias, de alguna de las formas siguientes: · al costo; o.· at cost; or.· al valor razonable de acuerdo con la NIIF 9.

La exención de la NIIF 1 establece que si ETB en la adopción por primera vez de las NIIF midiese una inversión al costo de acuerdo con la NIC 27, debemedir esa inversión en su estado de situación financiera separado de apertura conforme a las NIIF mediante uno de los siguientes importes: · el costo determinado de acuerdo con la NIC 27; o.· el costo atribuido. puede ser: / · the deemed cost, which can be:· Su valor razonable (determinado de acuerdo con la NIIF 9) a la fecha de transición de ETB a las NIIF en sus estados financieros separados; o.· el valor en libros en esa fecha según los PCGA anteriores.

ETB SA ESP optó por aplicar esta exención y utilizó como costo atribuido de las inversiones en subsidiarias, entidades controladas de forma conjunta yasociadas, el valor en libros de dichas inversiones a la fecha de transición. 1 de enero del 2014 determinado según PCGA anteriores.

a. Inversiones en subordinadas Una subordinada o controlada es una sociedad donde su poder de decisión se encuentre sometido a la voluntad deotra u otras que serán su matriz o controlante, bien sea directamente, caso en el cual se denominará filial o por intermedio de las subordinadas de la matriz,en cuyo caso se llamará subsidiaria. El control está dado por el cumplimiento de uno o más de los siguientes casos: i). Cuando más del 50% del capital pertenezca a la matriz, directamente o por intermedio o con concurso de sus subordinadas o las subordinadas de estas. ii). Cuando la matriz y las subordinadas tengan conjunta o separadamente el derecho de emitir los votos constitutivos de la mayoría mínima decisoria en lajunta de socios o en la asamblea, o tengan el número de votos necesario para elegir la mayoría de miembros de la junta directiva, si la hubiere. iii). Cuando la matriz, directamente o por intermedio o con el concurso de las subordinadas, en razón de un acto o negocio con la sociedad controlada o con) p gsus socios, ejerza influencia dominante en las decisiones de los órganos de administración de la sociedad.

Las inversiones en subordinadas son incorporadas a los estados financieros utilizando el método contable de participación, excepto si la inversión o unaporción de la misma, es clasificada como mantenida para la venta, en cuyo caso se contabiliza conforme a la NIIF 5, Conforme al método de participación, lasinversiones en subsidiarias se contabilizan inicialmente en el estado de situación financiera al costo, y se ajustan posteriormente para contabilizar laparticipación de la Compañía en ganancias o pérdidas y en otro resultado integral de la subsidiaria.

Short-term investments: Short-term investments: Investments with current maturities of cash surplus made in order to obtain fixed income, are reflected in cash as cash equivalents. Long-term investments: 1) Investments in subsidiaries - As part of the preparation of ETB's separate financial statements, IAS 27 requires it to account for its investments insubsidiaries in one of the following ways: · at cost; or. · at fair value according to IFRS 9. Beneficios de personal

Pensiones de jubilación

Los planes de pensiones de beneficios definidos establecen el monto de beneficio por pensión que recibirá un empleado a su retiro, el que usualmente depende de uno o más factores, tales como,

edad del empleado, años de servicio y compensación.

El pasivo reconocido en el estado de situacion financiera, respecto de los planes de pensiones de beneficios definidos, es el valor presente de la obligacion del beneficio definido a la fecha del estado

de situación financiera, menos el valor razonable de los activos del plan, junto con los ajustes por ganancias o pérdidas actuariales no reconocidas y los costos por servicios pasados. La obligacion por

el beneficio definido se calcula anualmente por actuarios independientes usando el método de unidad de crédito proyectado. El valor presente de la obligación de beneficio definido se determina

descontando los flujos de salida de efectivo estimados usando las tasas de interés calculada a partir de la curva de rendimiento de los bonos del Gobierno Colombiano ( curvas de TES B )

denominadas en unidades de valor real (UVR) que tienen términos que se aproximan a los términos de la obligación por pensiones hasta su vencimiento.

Las ganancias y pérdidas actuariales que surgen de los ajustes basados en la experiencia y cambios en los supuestos actuariales, se cargan o abonan en otros resultados integrales en el período en el

que surgen.

Los costos de servicios pasados se reconocen inmediatamente en resultados, a menos que los cambios en el plan de pensiones estén condicionados a que el empleado continúe en servicio por un

periodo de tiempo determinado (periodo que otorga el derecho). En este caso, los costos de servicios pasados se amortizan usando el método de línea recta durante el período que otorga el derecho.

Beneficios a largo Plazo

La empresa otorga a sus empleados beneficios asociados a su tiempo de servicio, como lo son las cotizaciones de pensiones y salud, quinquenios, servicio médico y retroactividad de las cesantías (en

este último caso sólo a un número reducido de trabajadores (41 trabajadores aproximadamente), Los costos esperados de estos beneficios se devengan durante el período de empleo, usando una

metodología semejante a la que se usa para los planes de beneficios definidos. Las ganancias y pérdidas actuariales que surgen de los ajustes por la experiencia y de cambios en los supuestos

actuariales, se cargan o abonan en otros resultados integrales en el período en el que surgen. Estas obligaciones se valorizan anualmente por actuarios independientes calificados.

Los quinquenios son un auxilio correspondiente al 0,33 de un salario mínimo legal mensual vigente por cada 5 años. Es decir, al cumplir 10 años el reconocimiento corresponde al 0,66 y así

sucesivamente.

La retroactividad de las cesantías se liquida a aquellos trabajadores pertenecientes al régimen laboral anterior a la Ley 50 de 1990 y que no se acogieron al cambio de régimen, se liquida esta

prestación social por todo el tiempo laborado con base en el último salario devengado.

Las cotizaciones de pensiones y salud son los pagos que le corresponden a los empleados y que son asumidos por la Empresa de acuerdo a lo estipulado en la convención colectiva de trabajo. ETB

SA ESP paga las cotizaciones de pensión hasta cumplir los requisitos para pensionarse con el ISS, al personal jubilado que compartirá la pensión con el Instituto.

El servicio médico son los servicios de salud prestado a los hijos, padres y cónyuge o compañera permanente de los trabajadores y pensionados de la Empresa de acuerdo con las cláusulas 33 y 34

de la convención colectiva de trabajo y reglamentada mediante la Resolución 3873 de mayo de 1988.

Employee benefits

Retirement pensions

Defined benefit pension plans establish the amount of pension benefit that an employee will receive upon retirement, which usually depends on one or more factors, such as the employee's age, years

of service and compensation.

The liability reported in the statement of financial position, regarding defined benefit pension plans, is the present value of the defined benefit liability at the date of the statement of financial position, less

the fair value of the assets of the plan, along with the adjustments for unrecognized actuarial gains or losses and the costs of past services. The defined benefit liability is calculated on a yearly basis by

independent actuaries using the projected unit credit method. The present value of the defined benefit liability is determined by deducting the estimated outgoing cash flows using the interest rates

calculated based on the Colombian Government Bond yield curve (TES B curves) denominated in real value units (UVR), whose terms are similar to the terms of the pension liability to maturity.

Actuarial gains and losses arising from the adjustments based on experience and changes in the actuarial assumptions are debited or credited in other comprehensive income in the fiscal period during

which they arise.

Costs of past services are recorded immediately in income, unless the changes in the pension plan are conditioned to the employee's continued service for a specific period of time (entitlement period).

In this case, the costs of past services are amortized using the straight line method during the entitlement period.

Long-term benefits

The company grants benefits to its employees associated with their time of service, such as pension and health care payments, five-year bonuses, medical service and retroactive severance pay (in the

latter case, it is only for a reduced number of workers - approximately 41). The expected costs of these benefits are earned during the period of employment using a methodology similar to that used for

the defined benefit plans. The actuarial gains and losses arising from the adjustments based on experience and changes in the actuarial assumptions are debited or credited in other comprehensive

income in the period during which they arise. These liabilities are calculated on a yearly basis by qualified independent actuaries.

Five-year bonuses correspond to 0.33 of a minimum monthly salary for every five years. That is to say, when an employee has worked 10 years, the recognition corresponds to 0.66, and so on.

Retroactive severance pay is liquidated for employees that belong to the labor system in force prior to Law 50 / 1990 who did not agree to switch over to the new system; this social benefit is liquidated

for the entire time worked based on the last salary earned.

Pension and health-care payments are those to be made by employees, but are assumed by the Company in accordance with the provisions set forth in the collective labor agreement. ETB S.A. E.S.P.

makes employee pension payments until they meet the requirements to retire with the Social Security Institute (ISS, for the Spanish original) for retirees whose pension will be allocated with the Institute.

The medical service is the health care service provided to the children, parents and spouse or life partner of Company employees and retirees in accordance with Clauses 33 and 34 of the collective

labor agreement, regulated by Resolution 3873 / May 1988.

Principales hechos, y esultados al primer semestre de 2016 / Main facts and results for the first half of 2016

La Gerencia de Asuntos Regulatorios se enfocó en el diseño y participación activa de estrategias enmarcadas en los lineamientos promovidos por el Ministerio de Tecnologías de la Información y las Comunicaciones (MINTIC) en el Plan Vive Digital 2.0 (2014-2018), así como las

recomendaciones realizadas por la Organización para la Cooperación y el Desarrollo Económico (OECD) sobre Políticas y Regulación de Telecomunicaciones en Colombia en el 2014 y la ejecución del nuevo Plan Nacional de Desarrollo (PND) que fija la hoja de ruta del gobierno

para los próximos 4 años.

La estrategia regulatoria se centró en el impulso y gestión ante el regulador de los diferentes proyectos regulatorios en pro de las iniciativas que adelanta la compañía, tales como el despliegue de Fibra al Hogar (FTTH), la prestación del servicio de TV IP y los nuevos servicios,

contribuyendo a apalancar la objetivos definidos por el Gobierno de convertir a Colombia en un país pionero en conexiones de acceso a internet de calidad.

In 2015, the Department of Regulatory Intelligence was focused on the design and active participation of strategies in line with ETB's strategic programs, framed in the guidelines promoted by the Ministry of Information Technologies and Telecommunications (MINTIC) in Plan

Vive Digital 2.0 (2014-2018), as well as the recommendations made by the Organization for Economic Cooperation and Development (OECD) on Telecommunication Policies and Regulation in Colombia in 2014 and the implementation of the new National Development Plan (NDP)

which sets the government's roadmap for the next four years.

The topics on which the regulatory strategy was based include the promotion of the initiatives being carried out by the Company in the deployment of Fiber to the Home (FTTH), IP TV Services and new services, which helps leverage the objectives established by the Government

to make Colombia a pioneer in quality Internet access.

1. Surgimiento de nuevos actores en el mercado – OTT (Netflix, Yotube Amazon video)

En la medida que los OTT no tienen obligación de tipo regulatorio ni pecuniarias a diferencia de los operadores de televisión por suscripción quienes tiene exceso de cargas regulatorias, la gestión regulatoria se centró en plantear propuestas regulatorias que permitan mejorar

las condiciones de competencia de mercado alivianando las cargas regulatorias de los actores tradicionales.

2. Nuevas fuentes de financiación para la Televisión pública.

En conjunto con los demás operadores se elaboró y presentó al Gobierno Nacional una propuesta de financiación de la Televisión pública.

3. Hurto de celulares: Se continuó con la revisión, gestión y observancia del proceso regulatorio asociado a la lucha contra el hurto de celulares.

4. Definición de banda ancha: la Gerencia de Asuntos Regulatorios participó en las mesas de trabajo de la CRC en el desarrollo del proyecto regulatorio para incluir la nueva definición de banda ancha. Por ser ETB el proveedor que mayor velocidad oferta en el mercado,

resulta de suma importancia que esta definición este en línea con la evolución, económica y tecnológica que experimenta el país y con las condiciones de competencia del sector de las telecomunicaciones. Por lo cual, ETB espera que se defina una banda ancha ultrarrápida

que incluya las velocidades ofrecidas por ETB, como el único proveedor en el país en ofrecer éste servicio.

5. Modificación del Régimen de Protección al Usuario: dentro de la propuesta de modificación publicada por la CRC se trabajó en conjunto con el regulador para construir la nueva propuesta.

Principales normas de carácter regulatorio que han representado un mayor impacto para ETB en lo corrido del período

• Resolución CRC 4900 2016: Mediante esta norma la CRC desregula la tarifa para llamadas originadas en redes fijas y terminadas en redes móviles, cuando éstas son titularidad de los proveedores de telefonía fija. La tarifa para las llamadas fijo a móvil se mantiene regulada

sólo para los casos en que éstas sean de titularidad de un proveedor móvil, que actualmente solamente sucede en el caso del proveedor TIGO - UNE. En este caso, durante el año 2016, el precio por minuto de las llamadas fijo móvil que terminan en la red de dicho proveedor

no podrán tener un precio por minuto superior a $77,4 antes de impuestos o de $92,88 después de impuestos. Esta medida es producto del proyecto ""Análisis del Mercado de Terminación de Llamadas Fijo Móvil"", a través del cual se revisaron las condiciones del mercado

de las llamadas originadas en las redes fijas y terminadas en las redes móviles con el fin de identificar y establecer medidas regulatorias para promover la competencia en el mercado.

• Resolución CRC 4930 de 2016: modificó lo relativo a las cláusulas de permanencia mínima en los contratos de prestación de los servicios fijos de telefonía, internet y televisión, en el sentido de autorizar la estipulación de esta cláusula solamente cuando estas correspondan

al cargo por conexión del servicio. La medida determina que el cargo de conexión solo pueda incluir los costos asociados a la instalación de los servicios y no otros rubros. En los casos que el operador preste varios servicios a un mismo usuario (telefonía, internet y televisión),

el cargo debe corresponder al valor de uno solo más los costos adicionales que se necesiten para conectar los otros. La Resolución indica que el valor del cargo por conexión deberá descontarse mensualmente de forma lineal y dividida en los meses de permanencia. Por

consiguiente, cuando un usuario manifieste intención de terminar anticipadamente el contrato con su operador, deberá pagar las cuotas relacionadas con los meses que falten para lo pactado. Además esta Resolución, estipula medidas de transparencia en la facturación del

servicio.

• Resolución CRC 4960 de 2016: modifica la Resolución 2058 de 2009 y la Resolución CRC 3036 de 2011, y se dictan otras disposiciones. Incluye el empaquetamiento de servicios de TIC y tv como un mercado relevante. Precisa que los servicios empaquetados se deben

ofrecer también individualmente con las mismas características informando los precios para cada uno. Establece la obligación de incluir en la página web un comparador de tarifas en el que el usuario debe poder identificar precios individuales por zonas y por estrato. La CRC

hará un monitoreo del mercado para con base en posibles hallazgos tomar las medidas regulatorias pertinentes.

• Resolución CRC 4868 de 2016: adiciona condiciones para la identificación y depuración de IMEI en la Resolución CRC 3128 de 2011 y se modifica el artículo 13.1.2 del Capítulo I del Título XIII de la Resolución CRT 087 de 1997. Establece medidas adicionales para

contrarrestar el hurto de celulares en Colombia, incluyendo la categoría de IMEI INVÁLIDO, entendido como el IMEI cuyo valor TAC (Type Allocation Code) no se encuentra en la lista de TAC de la GSMA ni en la lista de los TAC de los equipos homologados ante la CRC.

• Resolución CRC 4937 de 2016: determina las condiciones de implementación y operación para el proceso de verificación centralizada de equipos terminales móviles, como medida adicional contra el hurto de celulares en Colombia.

• Resolución MINTIC 895 del 2016: el Ministerio de Tecnologías de la Información y las Comunicaciones busca establecer los requisitos operativos, incluyendo los requisitos formales para la presentación y formulación de planes, programas o proyectos para la ejecución de las

obligaciones de hacer cuando las misma están establecidas como forma de pago total o parcial de la contraprestación económica por el otorgamiento y renovación de los permisos para el uso del espectro radioeléctrico. cuales se aprobará dichos planes, programas y proyectos, y la forma en la que se hará seguimiento a su ejecución, y posterior verificación y cuantificación.

• Resolución ANE 387 de 2016: Dentro de las estrategias adoptadas por el Gobierno Nacional para mejorar el servicio de telefonía móvil del país, la Agencia Nacional del Espectro - ANE expidió esta norma que tiene por objeto reglamentar las condiciones que deben cumplir

las estaciones radioeléctricas, con el objeto de controlar los niveles de exposición de las personas a los campos electromagnéticos. La Resolución pretende facilitar el despliegue e instalación de infraestructura, a efectos de que los operadores amplíen su infraestructura en

todo el territorio nacional para mejorar la calidad de la señal. Para tranquilidad de los ciudadanos, esta Resolución cumple con las recomendaciones internacionales frente a los niveles de exposición a campos electromagnéticos de organizaciones como la ICNIRP (Comisión

Internacional sobre Protección Frente a Radiaciones No lonizantes) y la OMS (Organización Mundial de la Salud).

4. Definition Broadband: the Department of Regulatory participated in the workshops of the CRC in the development of regulatory project to include the new definition of broadband. Being ETB provider that faster supply in the market, it is extremely important that this definition

is in line with, economic and technological developments experienced by the country and the conditions of competition in the telecommunications sector. Therefore, ETB expects a wide band including ultra-fast speeds offered by ETB, as the only provider in the country to offer

this service.

5. Modification of User Protection Regime: within the proposed amendment published by the CRC worked with the regulator to build the new proposal.

The main standards of a regulatory nature that have represented the greatest impact for ETB throughout the period are:

• CRC Resolution 4900 / 2016: Through this standard, the CRC deregulates the rate for calls made from landline networks to mobile networks, when these are held by the landline providers. The rate for landline to mobile calls are regulated only for those cases where they are

held by a mobile provider, which currently is only the case of the provider TIGO - UNE. In this case, during 2016, the price per minute of landline to mobile calls placed on the network of that provider may not have a price per minute greater than COP 77.40 before tax and COP

92.88 after tax. This measure came from the project “Market Analysis on the Destination of Landline to Mobile Calls,” through which the market conditions of calls originating from landlines and ending on mobile networks were reviewed, in order to identify and establish

regulatory measures to promote competition in the market.

• CRC Resolution 4930 / 2016: changed everything related to the clauses on minimum terms in the service provision contracts for landline, Internet and television services, as regards authorizing the stipulation of this clause only when they correspond to the charge for service

connection. The measure determines that the connection charge can only include costs related to the installation of services and not any other items. In cases where the carrier provides many services to one user (telephone, Internet and television), the charge must correspond

to the value of only one plus additional costs needed to connect the others. The Resolution indicates that the value of the connection charge must be discounted monthly in a linear way and divided over the months of the term. Therefore, when a user states their intention to

terminate the contract with their carrier early, they must pay the fees related to the months that are left on the agreement. This Resolution also stipulates transparency measures in service billing.

• CRC Resolution 4960 / 2016: modifies Resolution 2058 / 2009 and CRC Resolution 3036 / 2011, and enacts other provisions. Including the package offer of ICT and TV services as a relevant market. It specifies that packaged services must also offer the same features

individually, informing [users] of the price for each one. It establishes the obligation to include a rate comparison on the website, where the user can identify individual prices by zone and stratum. The CRC will monitor the market so that, based on possible findings, it can take

the appropriate regulatory measures.

• CRC Resolution 4868 / 2016: adds conditions for the identification and refinement of IMEI in CRC Resolution 3128 / 2011 and modifies Title XIII, Chapter I, Article 13.1.2 of CRT Resolution 087 / 1997. It establishes additional measures to counteract cell phone theft in

Colombia, including the IMEI INVALID category, understood as IMEI whose TAC (Type Allocation Code) value is not found on the GSMA’s TAC list or on the TAC list of approved equipment with the CRC.• CRC Resolution 4937 / 2016: determines the conditions for the

implementation and operation for the centralized verification process of mobile terminal equipment, as an additional measure against cell phone theft in Colombia.

• MINTIC Resolution 895 / 2016: the Ministry of Information Technology and Telecommunications seeks to establish the operating requirements, including the formal requirements for presenting and formulating plans, programs or projects aimed to fulfill the obligations

undertaken, when they are established as full or partial payment for the economic compensation for granting and renewing the use permits on the radioelectric spectrum. This resolution also defines the criteria under which such plans, programs and projects will be approved,

and the manner in which their execution will be monitored, as well as their later verification and quantification.

• ANE Resolution 387 / 2016: Within the strategies adopted by the National Government to improve the country's mobile telephone service, the National Spectrum Agency (ANE, for its Spanish original) issued this standard with the aim of regulating the conditions that the

radioelectric stations must fulfill, with the goal of controlling people's exposure levels to the electromagnetic fields. The Resolution intends to facilitate the deployment and installation of infrastructure, such that the carriers expand their infrastructure to the national territory as a

whole, to improve signal quality. For citizens’ ease of mind, this Resolution meets the international recommendations for exposure levels to electromagnetic fields from organizations like the ICNIRP (International Commission for Non-Ionizing Radiation Protection) and the WHO

(World Health Organization).
