Reglas oficiales del Concurso de Ensayos de Supervivientes “Historias de Héroes” de Susan G. Komen 2016 (las “Reglas Oficiales”)

ACERCA DEL CONCURSO: El Concurso “Historias de Héroes” de Susan G. Komen 2016 (el “Concurso”) busca nominaciones de supervivientes del cáncer de mama en los Estados Unidos y Puerto Rico que estén haciendo “más” en la lucha contra el cáncer de mama. Basándose en los criterios de evaluación que se detallan en estas Reglas Oficiales, los Jueces del Concurso elegirán a dos ganadores (los “Ganadores”). Los Ganadores recibirán los premios que se detallan a continuación. Tenga en cuenta que los premios se entregan a los “nominados” y que estos podrán ser, o no, las mismas personas que los participantes. Los detalles completos del Concurso se indican a continuación. LA PARTICIPACIÓN ESTÁ ABIERTA SOLO PARA LOS RESIDENTES LEGALES DE LOS 48 ESTADOS CONTINENTALES DE ESTADOS UNIDOS, EL DISTRITO DE COLUMBIA Y PUERTO RICO QUE SE ENCUENTREN FÍSICAMENTE Y RESIDAN EN ESTOS Y SEAN MAYORES DE 18 AÑOS O QUE SEAN MAYORES DE EDAD EN SU LUGAR DE RESIDENCIA AL MOMENTO DE PARTICIPAR. NULO DONDE ESTÉ PROHIBIDO POR LA LEY O RESTRINGIDO EN ALGUNA FORMA QUE SEA INCOMPATIBLE CON ESTAS REGLAS OFICIALES. PATROCINADOR: El Concurso está patrocinado por The Susan G. Komen Breast Cancer Foundation, Inc., que opera bajo el nombre Susan G. Komen (el “Patrocinador”). La dirección postal del Patrocinador es: 5005 Lyndon B. Johnson Freeway, Suite 250, Dallas, Texas 75244 (la “Dirección del Concurso”). EL CONCURSO 1. PERÍODO DE INSCRIPCIÓN: La inscripción en el Concurso comienza a las 12:01 a.m., Hora del Centro (“CT”), del 20 de junio de 2016 y finaliza a las 11:59 p.m. CT del 15 de julio de 2016 (dicho período se denominará de aquí en adelante como el “Período de Inscripción”). La computadora designada por el Patrocinador es el dispositivo oficial para contar el tiempo en este Concurso. 2. CÓMO PARTICIPAR EN EL CONCURSO: SIN OBLIGACIÓN DE COMPRA. Durante el Período de Participación, visite el Sitio del Concurso en www.komen.org/historias (el “Sitio del Concurso”) y (1) complete el formulario de inscripción en línea accediendo a este por medio de un enlace o banner en el Sitio del Concurso; (2) nomine a un superviviente del cáncer de mama (es decir, una persona que haya sido diagnosticada con cáncer de mama) que sea mayor de 18 años o mayor de edad en su lugar de residencia, y que resida legalmente en cualquiera de los cuarenta y ocho (48) estados contiguos de los Estados Unidos, Washington DC o Puerto Rico y que resida en estos al momento de participar (puede nominarse a usted mismo o a otra persona), y que usted considere que deba ser el Ganador de un premio; y (3) presente un ensayo escrito de 999 caracteres o menos en donde comparta cómo la persona nominada se vio afectada por el cáncer de mama, su historia de coraje y supervivencia y qué ha hecho para superarse a sí misma y/o para ayudar a aquellas personas que la rodean desde que fue diagnosticada. También puede incluir una foto de la persona, pero no es obligatorio. Cada ensayo, y cualquier foto que se incluya, enviado por un participante al Concurso será denominado “Presentación” y, conjuntamente con cualquier otro contenido o información proporcionados por un participante en relación con el Concurso, será denominado “Inscripción”. En las Reglas Oficiales, a veces podrá denominarse “participante” a la persona que presenta la Inscripción, y “nominado” a la persona

nominada. El participante, los miembros de su “familia directa” (según se definen a continuación) y el nominado serán las únicas personas identificables por su nombre en una Presentación y todas las personas identificables que figuren en una Presentación deberán haber otorgado su consentimiento (o el padre/tutor legal de los menores deberá haber otorgado su consentimiento) para el envío de una Presentación y el uso de cada Presentación, según se contempla en estas Reglas Oficiales. A exclusivo criterio del Patrocinador, a cualquier persona a la que se haga referencia por nombre o de otra manera sea representada en una Presentación, incluido cualquier nominado distinto del participante, podrá solicitársele que firme y devuelva formularios de consentimiento/divulgación que confirmen las representaciones, garantías y concesiones de derechos contempladas en las Reglas Oficiales antes de publicar una Inscripción en línea y/o antes de adjudicar cualquier premio. Cualquier donación opcional realizada al Patrocinador será utilizada para apoyar su causa: acabar con el cáncer de mama para siempre. LÍMITE: Se permite una Inscripción por persona. Si una persona envía más de una Inscripción, quedará descalificada automáticamente. Al participar en el Concurso usted acepta que su Presentación será publicada en línea, a exclusivo criterio del Patrocinador. El Patrocinador se reserva el derecho, a su exclusivo y absoluto criterio, de descalificar cualquier Inscripción o participante que no cumpla con estas Reglas Oficiales. 3. REQUISITOS: A fin de que su Presentación participe en el Concurso, los potenciales participantes deben cumplir con las instrucciones de registro al enviar su Presentación La Presentación debe cumplir con los siguientes requisitos:

debe estar escrita en inglés o en español;

debe tener 999 caracteres o menos;

si incluye una fotografía, esta debe tener un tamaño inferior a 8 MB y enviarse en uno de los siguientes formatos: .jpg, .jpeg, gif, .tif, .png;

debe ser apta para el público familiar;

o a título enunciativo, no deberá incluir contenidos que:

sean indecentes, obscenos, odiosos, delictivos, difamatorios, calumniosos o injuriosos;

promuevan la intolerancia, el racismo, el odio o el daño contra cualquier grupo o persona, o que promuevan la discriminación basada en la raza, sexo, religión, nacionalidad, discapacidad, orientación sexual o edad;

contengan blasfemias o contenido sexual;

promuevan el consumo de alcohol, drogas ilegales, tabaco o el uso de armas o armas de fuego;

promocionen productos o servicios de terceros o que de otra forma incluyan mensajes comerciales o promociones con respecto a productos o servicios de terceros;

sea ilegal, viole o sea contrario a las leyes o normas federales y estatales de los Estados Unidos o de Puerto Rico;

haya sido copiado o plagiado. Todas las Inscripciones deben ser una obra original y única del participante designado;

sea propiedad de un tercero, incluya contenidos de terceros o de otra forma difame, viole o infrinja (o pueda infringir) cualquier derecho de autor, marca registrada, marca u otro identificador de origen, u otro derecho de propiedad de una entidad o persona (ya sea viva o difunta) (incluidos, a título enunciativo, los derechos de privacidad, de publicidad o de representación falsa);

puedan resultar en cualquier tipo de lesiones o daños físicos; y/o

que sea lascivo, inadecuado, ofensivo o no se adecue a la imagen del Patrocinador, incluidos actos de violencia u otros actos que el Patrocinador considere objetables.

Cualquier Inscripción o porción de la misma que, a exclusivo y absoluto criterio del Patrocinador, viole cualquiera de las prohibiciones arriba mencionadas u otras y/o las representaciones o garantías del participante, no será publicada en línea (o podrá ser eliminada si fue publicada anteriormente) y será descalificada del Concurso. Podrá descalificarse cualquier Presentación que no cumpla con lo mencionado anteriormente y que no cumpla con los requisitos del Sitio del Concurso. En el caso de que una Presentación sea editada, eliminada y/o descalificada, el participante no será eximido de su responsabilidad por el cumplimiento de estas Reglas Oficiales. Las Inscripciones son propiedad del Patrocinador y no serán confirmadas como recibidas ni devueltas. Los Participantes y Ganadores reconocen y acuerdan que el Patrocinador tiene derecho a editar, adaptar, modificar, reproducir, promocionar y utilizar o no (o eliminar) las Inscripciones en cualquier forma que considere conveniente sin notificación, consentimiento o pago de ningún tipo. Al participar, usted acepta ceder cualquier derecho que pueda tener sobre una Inscripción enviada, incluidos todos y cualquier derecho moral que exista sobre la Inscripción y cualquier obra derivada que pueda surgir de ahí. 4. DECLARACIONES SOBRE LAS INSCRIPCIONES; CONCESIÓN DE DERECHOS: Al presentar una Inscripción en relación con el Concurso, cada Participante manifiesta y garantiza al Patrocinador que: (i) la Inscripción es un trabajo original del participante y que este posee el derecho exclusivo para presentarla en el Concurso; (ii) la Inscripción no viola en forma alguna los derechos de terceros, incluidos, a título enunciativo, derechos de autor y otra propiedad intelectual, derechos de privacidad o publicidad; (iii) la Inscripción no viola ninguna ley aplicable; (iv) el participante ha obtenido todas las licencias o permisos necesarios de todos los terceros involucrados para la Inscripción presentada en el Concurso y para su uso según se permite en estas Reglas Oficiales; (v) la publicación y/o exhibición de la Inscripción y cualquier otro uso permitido en las Reglas Oficiales no viola los derechos de ningún tercero ni incurre en incumplimiento de ninguna disposición de las normas o leyes aplicables; (vi) el uso y publicación de la Inscripción o de cualquier parte de ella en relación con el Concurso o de otra forma permitido por estas Reglas oficiales es y será considerada sin revisión, notificación, aprobación, contraprestación o remuneración adicional (excepto por la adjudicación del premio según se contempla en estas Reglas Oficiales), independientemente de si la Inscripción resultara ganadora o no; y que (vii) la Presentación enviada en este Concurso no ha sido presentada en ningún concurso previo. Cada participante por el presente garantiza al Patrocinador una licencia perpetua, exenta de regalías, transferible, irrevocable y sin restricciones para usar, utilizar, replicar, alterar, adaptar, modificar, publicar, transmitir, traducir, producir obras derivadas, distribuir, presentar, exhibir, sublicenciar y ejercer todos los derechos de autor, propiedad intelectual y otros derechos con respecto a cada

Inscripción a nivel mundial y/o para incluir, en todo o en parte, cualquier Inscripción en otras obras en otros medios conocidos o por crearse, en cualquier lugar y a perpetuidad, sin revisión, notificación, aprobación, contraprestación o remuneración adicional. Excepto donde esté prohibido legalmente, presentar una Inscripción en este Concurso constituye el permiso irrevocable del participante para que el Patrocinador use el nombre, ciudad y estado de residencia del participante; ya sea en forma completa o parcial, en medios impresos, electrónicos o de radiodifusión, ya sean conocidos o a crear en el futuro, a perpetuidad, en la forma que el Patrocinador considere apropiada con respecto a la promoción del Concurso, de la causa del Patrocinador y de cualquier otro propósito sin revisión, notificación, aprobación, contraprestación o remuneración adicional. 5. EVALUACIÓN PARA SELECCIONAR A LOS GANADORES: Una vez finalizado el Período de Inscripción, profesionales empleados o asociados con el Patrocinador evaluarán todas las Inscripciones elegibles y escogerán 15 finalistas, que luego serán presentados ante un distinguido panel de ejecutivos de Komen y talentos de Telemundo para seleccionar a los dos Ganadores finales (los profesionales y el panel serán denominados conjuntamente en el presente como “Jueces del Concurso”). Los Jueces del Concurso aplicarán los siguientes criterios para realizar su selección:

una historia emocionante de coraje y supervivencia en la lucha contra el cáncer de mama (puede ser en primera persona o presentada en nombre de un ser querido (40% del concepto);

la calidad de “más”: qué ha hecho el nominado para superarse a sí mismo y/o para ayudar a aquellas personas que lo rodean desde que fue diagnosticado con cáncer de mama (40% del concepto); y

cumplimiento de las Reglas Oficiales y calidad de la presentación (20% del concepto).

En el caso de que ocurriera un empate entre más de dos inscripciones; los Jueces del Concurso volverán a evaluar aquellas inscripciones que estén empatadas basándose únicamente en la historia de coraje y supervivencia del nominado y su impacto positivo en la concientización para la lucha contra el cáncer de mama como se describan en la Presentación. Al concluir la evaluación de los jueces (y sujeto a la verificación del Patrocinador y a la formalización en tiempo y forma de la Declaración Jurada de Elegibilidad y Exención de Responsabilidad y Autorización de Uso Publicitario y la declaración de cesión de derechos correspondientes por parte del participante y del nominado), los dos nominados que reciban la mayor cantidad de votos serán elegidos como Ganadores. Al participar, los participantes y nominados aceptan que las decisiones de los Jueces del Concurso con respecto a la evaluación serán vinculantes y finales en todos los aspectos. El Patrocinador y los Jueces del Concurso se reservan el derecho de no adjudicar un premio o premios en particular en el caso de que no hubiera suficientes Inscripciones para otorgar todos los premios y/o las Inscripciones recibidas sean insuficientes para otorgar un premio. 7. PREMIOS Y PRECIO DE VENTA MINORISTA APROXIMADO (“ARV”): Sujeto al cumplimiento de las Reglas Oficiales, los premios del Concurso se adjudicarán a dos personas nominadas en las Inscripciones ganadoras (estas pueden ser, o no, las mismas personas que los participantes). Un nominado puede recibir solo un premio en el Concurso. Cada nominado que sea un Ganador recibirá lo siguiente (en conjunto, un “premio”):

Pasajes de avión en clase económica (ida y vuelta) para el Ganador y un invitado desde el aeropuerto principal del lugar de residencia del Ganador, incluido el transporte terrestre desde el hotel hasta el aeropuerto (o si la distancia es menor a 200 millas de Miami, otro medio de transporte según lo determinen Telemundo Network Group, LLC y NBC Universo, LLC (en conjunto, los “Proveedores del Premio”, a su exclusivo criterio) para asistir a los Premios Tu Mundo en Miami el 25 de agosto de 2016. (ARV $1.000)

Transporte hacia/desde el aeropuerto de Miami hacia/desde el hotel local. (ARV $250)

Alojamiento por dos (2) noches en un hotel seleccionado por los Proveedores del Premio para el Ganador y su acompañante (llegada el 24 de agosto de 2016 y salida el 26 de agosto de 2016). (ARV $600)

Servicio de cambio de look y spa en destino según determinen los Proveedores del Premio. (ARV $200)

Una (1) tarjeta de regalo de $300 para cubrir gastos varios, incluidas comidas, transporte terrestre y cualquier gasto adicional no cubierto por los Proveedores del Premio. (ARV $300)

Un (1) paquete de regalo, cuyo contenido será determinado a exclusivo criterio de los Proveedores del Premio, pero que podría incluir productos autografiados, productos Komen, etc. (ARV $100)

La oportunidad de participar en la grabación de Un Nuevo Día (“Spot”) y de un anuncio de servicio público con talentos de Telemundo, NBCUniverso y WWE (“PSA”).

Los precios solo incluyen los ítems mencionados arriba y cada Ganador y su invitado serán responsables por el pago de cualquier cargo aplicable, cargos o recargos por servicio y todos los seguros, traslados en tierra hacia y desde los aeropuertos locales del Ganador y su invitado, cargos por equipajes, suvenires, excursiones, propinas, gastos varios y todos los demás gastos no especificados que el Ganador y su invitado incurran en relación con el uso del premio. El ARV puede variar según las sustituciones de regalos y/o cambios de precios. Si el valor real de un premio es menor al ARV indicado, la diferencia no será entregada. Podrían aplicarse otras restricciones. No se permiten las sustituciones, canje por efectivo o transferencia de un premio. El Patrocinador no asume responsabilidad por la cancelación, demora, suspensión o reprogramación de los eventos. Si un evento fuera cancelado debido a circunstancias imprevistas, climatológicas o de otro tipo, el premio ya no será válido y la oportunidad se considera nula y sin efecto. Todos los premios están sujetos a cambios y/o cancelaciones. El Patrocinador y los Proveedores del Premio se reservan el derecho a denegar la entrada a un evento en cualquier momento. Los boletos que se hayan perdido o hayan sido robados no podrán ser reemplazados. Las fechas y horarios de los eventos están sujetos a cambios. Está prohibida la reventa o intento de reventa de un boleto, y, si se descubriera, el boleto será anulado y no se entregará ningún premio sustituto, ni cambiará o pagará ningún valor equivalente en efectivo. Se presentará el Formulario 1099 ante el IRS por el valor justo de mercado del premio y se entregará una copia a cada Ganador. Cada Ganador deberá proporcionar al Patrocinador su número de seguridad social para poder presentar el Formulario 1099. Todos los cargos e impuestos federales, estatales, locales y otros asociados con el premio y los gastos no detallados relacionados con la aceptación y el uso del premio son de exclusiva responsabilidad del Ganador.

La participación del Ganador y del invitado en Un Nuevo Día o en un PSA podría no aparecer en la versión final transmitida del Spot; esta decisión está sujeta al criterio exclusivo y requerimientos del productor. Ni el Patrocinador ni las Partes del Concurso (según se

definen a continuación) son responsables por la cancelación o preferencia de la aparición del Ganador y su invitado en un Spot o PSA. Los cameos en el Spot y PSA no tienen valor en efectivo. El Ganador y su invitado no recibirán compensación, sin importar si efectivamente participan o aparecen o no en un Spot o PSA. Si el productor, a su exclusivo criterio, optara por incorporar la grabación de audio y video de un Ganador o invitado (“Grabación”) en un Spot o PSA, la inclusión de la Grabación y/o el Spot/PSA no serán considerados como una oportunidad de empleo, y el Ganador y su invitado no tendrán derecho a percibir compensación o créditos en el mismo. El Ganador y/o su invitado no tienen derecho a revisar, criticar o aprobar el contenido de un Spot o PSA. Estas Reglas Oficiales y el Concurso no son un contrato ni una postulación a un empleo. El Patrocinador, los Proveedores del Premio y el productor se reservan el derecho a descalificar a un Ganador y/o a su invitado y quitarlo de un Spot o PSA en cualquier momento si estos consideran que su conducta es perturbadora, si puede causar o causa daños a las personas, los bienes o la reputación del Patrocinador o de cualquiera de las Partes del Concurso o que de otra forma viola las políticas del presente, o si el Ganador y/o su invitado no siguen las indicaciones del Patrocinador, de los Proveedores del Premio o del productor en todo momento.

El contenido de la Grabación será determinado por el Patrocinador y los Proveedores del Premio a su exclusivo criterio. Si la Grabación es una transmisión, dicha transmisión será en un horario, por una duración y en una fecha o fechas determinadas por los Proveedores del Premio a su exclusivo criterio. El Ganador y su invitado deberán formalizar y presentar renuncias de divulgación de aparición y ubicación y otros documentos similares según puedan ser requeridos por los Proveedores del Premio (“Documentos de Aparición”). Si el Ganador y/o su invitado no formalizaran los Documentos de Aparición en tiempo y forma, según lo determinen los Proveedores del Premio a su exclusivo criterio, las apariciones podrían ser canceladas y el premio podría perderse. El Ganador y/o su invitado no tienen derecho a revisar, criticar o

aprobar el contenido de la Grabación o de cualquier transmisión de la misma.

8. NOTIFICACIÓN - EL TIEMPO ES DE CRUCIAL IMPORTANCIA PARA ACEPTAR Y PROVEER LA DECLARACIÓN JURADA Y LA EXENCIÓN DE RESPONSABILIDAD REQUERIDAS. Cada Ganador tentativo

será notificado telefónicamente y/o por correo electrónico aproximadamente el 1 de agosto de 2016. La persona notificada podrá, a su exclusivo criterio, renunciar al premio al no reclamarlo o al no completar y devolver al Patrocinador la Declaración Jurada de Elegibilidad y Exención de Responsabilidad y Autorización de Uso Publicitario dentro de las setenta y dos (72) horas de realizada la notificación. En tal caso, se seleccionará un Ganador tentativo alternativo y se repetirá este proceso hasta tanto el Ganador tentativo y su invitado completen y devuelvan al Patrocinador la Declaración Jurada de Elegibilidad y Exención de Responsabilidad y Autorización de Uso Publicitario dentro de las setenta y dos (72) horas de realizada la notificación. En tal ocasión, sujeto a la verificación del Patrocinador, se considerará al Ganador tentativo de un premio en particular como el Ganador confirmado de dicho premio. Excepto donde esté prohibido por la ley, cada Ganador concede además al Patrocinador y a sus personas designadas el derecho a usar el nombre, fotografía, voz, imagen y ciudad de residencia del Ganador y su invitado a los fines de publicitar o promocionar los esfuerzos y actividades del Patrocinador y del Concurso, sin recibir compensación, y a divulgar su nombre a las personas que soliciten conocer el nombre de los Ganadores del Concurso. El no

cumplimiento o la devolución de cualquier notificación de premio como imposible de entregar podrá resultar en la descalificación y selección de un Ganador alternativo. 9. ELEGIBILIDAD: El Concurso está abierto a los participantes y nominados que sean residentes legales de los cuarenta y ocho estados contiguos de los Estados Unidos, el Distrito de Columbia y/o Puerto Rico, que se encuentren físicamente y residan en estos, que sean mayores de 18 años o sean mayores de edad en su estado de residencia a la fecha de participación en el Concurso, según sea el caso, y sean elegibles de conformidad con estas Reglas Oficiales. Nulo en todas las demás jurisdicciones. No son elegibles para participar en el Concurso los empleados, contratistas, directores, funcionarios y proveedores del Patrocinador, Telemundo Network Group, LLC y NBC Universo, LLC (conjuntamente, las “Partes del Concurso”); ninguna de sus respectivas compañías subsidiarias y afiliadas, agencias de publicidad y selección subsidiarias involucradas en la administración, desarrollo, cumplimiento y realización de este Concurso; ninguno de los familiares directos de estos (cónyuge, conviviente, padres, hijos, hermanos, abuelos y sus respectivos cónyuges, convivientes o parientes por afinidad) ni las personas que vivan en la misma vivienda. El Concurso está sujeto a todas las leyes y normas federales, estatales y locales. Nulo donde esté prohibido por la ley o restringido en alguna forma que sea incompatible con estas Reglas Oficiales. 10. INFORMACIÓN ADICIONAL SOBRE LOS PREMIOS: El Patrocinador y las Partes del Concurso no asumen responsabilidad u obligación alguna por daños, pérdidas o lesiones que resulten de la aceptación o uso del premio o de la participación en el Concurso. El Patrocinador se reserva el derecho de solicitar a cualquier participante o nominado la documentación adicional que considere necesaria para validar cualquier Inscripción o para otorgar cualquier premio. Los premios no son transferibles. 11. REGLAS GENERALES: Al participar en el Concurso, los participantes aceptan estas Reglas Oficiales y las decisiones del Patrocinador y de los Jueces del Concurso, según corresponda, con respecto al Concurso y al otorgamiento de los premios, las cuales serán vinculantes y finales en todos los aspectos. El Patrocinador y sus agentes no son responsables de las fallas técnicas, de hardware, de software, de conectividad a Internet o telefónicas de ningún tipo; la pérdida o imposibilidad de conexión de redes; las comunicaciones electrónicas fallidas, incorrectas, incompletas, imprecisas, cifradas o demoradas provocadas por el usuario o por cualquier equipo o programa asociado o utilizado en este Concurso; la correspondencia, comunicaciones, solicitudes, reclamos u otros errores o problemas relacionados con el Concurso que se hayan perdido, demorado, robado, estén incompletas, ilegibles, imprecisas, no entregadas, demoradas, mutiladas, con franqueo insuficiente o mal dirigidas, incluyendo a título enunciativo, cualquier error humano que pudiera ocurrir en el procesamiento de las inscripciones de este Concurso; ni por daños a cualquier sistema de computación que resulte de la participación, acceso o descarga de información en relación con este Concurso. La omisión del Patrocinador en hacer cumplir cualquiera de los términos de estas Reglas Oficiales no constituirá una renuncia a dicha disposición. Si por cualquier motivo el Concurso o la votación en línea no pudieran realizarse según lo planeado debido a infecciones de virus informáticos, errores de software (bugs), alteraciones, intervenciones no autorizadas, fraude, fallas técnicas o cualquier otra causa que esté más allá del control del Patrocinador y que pueda corromper o afectar la administración, seguridad, imparcialidad, integridad o buen funcionamiento del proceso del Concurso, entonces el Patrocinador se reserva el derecho, a su exclusivo criterio, de cancelar el Concurso y seleccionar los Ganadores haciendo que los Jueces del Concurso hagan su evaluación entre todas las Inscripciones elegibles recibidas antes de la cancelación, basándose en los criterios de evaluación que se detallan más arriba en la Regla n.º 5.

2016 Susan G. Komen Historias de Héroes Survivor Essay Contest Official Rules (the "Official Rules")

ABOUT THE CONTEST: The 2016 Susan G. Komen Historias de Héroes Contest (the “Contest”) is looking for nominations of breast cancer survivors in the United States and Puerto Rico who are doing “more” in the fight against breast cancer. Based upon the judging criteria identified in these Official Rules, the Contest Judges will determine the two winners (“Winners”). The Winners will receive the prizes as detailed below. Please note that prizes are awarded to “nominees” and that nominees may or may not be the same individuals as entrants. Complete details regarding the Contest are provided below. ENTRY IS OPEN ONLY TO LEGAL RESIDENTS OF THE CONTIGUOUS 48 UNITED STATES, THE DISTRICT OF COLUMBIA AND PUERTO RICO WHO ARE PHYSICALLY LOCATED AND RESIDING IN THE SAME AND ARE 18 YEARS OF AGE OR THE AGE OF MAJORITY IN THEIR PLACE OF RESIDENCE AT THE TIME OF ENTRY. VOID WHERE PROHIBITED BY LAW OR RESTRICTED IN A MANNER INCONSISTENT WITH THESE OFFICIAL RULES. SPONSOR: The Contest is sponsored by The Susan G. Komen Breast Cancer Foundation, Inc. d/b/a Susan G. ENTRY PERIOD: Entry in the Contest begins at 12:01 a.m. Central Time (“CT”) on June 20, 2016 and ends at 11:59 p.m. CT on July 15, 2016 (such period referred to herein as the “Entry Period”). Sponsor’s designated computer is the official time keeping device of this Contest. 2. HOW TO ENTER THE CONTEST: NO PURCHASE IS NECESSARY. During the Entry Period, visit the Contest Site at www.komen.org/historias (the “Contest Site”) and (1) complete the online registration form accessible via a link or banner at the Contest Site, (2) nominate a breast cancer survivor (i.e., a person who has received a diagnosis of breast cancer) age 18 years or the age of majority in his or her place of residence, who is a legal resident of any the contiguous forty-eight (48) United States, Washington DC or Puerto Rico and who is residing in the same at the time of entry (you can nominate yourself or someone else) and who you believe should be a Winner of a prize, and (3) submit a written essay of 999 characters or less sharing how your nominee has been affected by breast cancer, his or her story of strength and survival and what he or she has done to better himself or herself and/or those around him or her since being diagnosed. An optional photo may be included but is not required. Each essay, and any included photo submitted by an entrant in the Contest, is referred to as a “Submission” and together with any other content or information provided by an entrant in connection with the Contest, an “Entry.” The individual submitting the Entry is sometimes referred to in the Official Rules as an “entrant.” The individual nominated by an entrant is sometimes referred to in the Official Rules as a “nominee.” The entrant and members of his/her “immediate family” (as defined below) and the nominee, may be the only identifiable individuals referenced by name in a Submission and all identifiable individuals appearing in a Submission must have provided their consent (or the parent/legal guardian of the minors have provided consent) for submission of a Submission and use of such Submission as contemplated in these Official Rules. In Sponsor’s sole discretion, anyone referenced by name or otherwise depicted in a Submission, including any nominee other than the entrant may be

required to execute and return consent forms / releases confirming the representations, warranties and grants of rights contemplated in the Official Rules prior to having an Entry published online and/or prior to the award of any prize. Any optional donations made to Sponsor will be used to support Sponsor’s mission to end breast cancer forever. LIMIT: One Entry per person is permitted. An individual submitting more than one Entry will automatically have his or her Entries disqualified. By entering the Contest, you agree to have your Submission(s) posted online (in Sponsor’s sole discretion). Sponsor reserves the right, in its sole and absolute discretion, to disqualify any Entry that, or entrant who, does not comply with these Official Rules. 3. REQUIREMENTS: In order to have their Submission(s) entered into the Contest, prospective entrants must comply with registration instructions when submitting each Submission. Each Submission:

Must be in English or Spanish;

Must be 999 characters or less;

If it includes a photograph, such photograph should be under 8 MB and submitted in one of the following formats: .jpg, .jpeg, gif, .tif, .png;

Must be suitable for family audiences;

o without limitation, must not contain any content that:

is indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;

promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

contains profanity or sexual content;

promotes alcohol, illegal drugs, tobacco, firearms or weapons;

promotes any third party product or service or otherwise contains commercial messages or endorsements regarding third party products or services;

is unlawful, in violation of or contrary to the federal and state laws or regulations of the United States or Puerto Rico;

has been copied or plagiarized. All entries must be the sole, original work of the designated entrant;

is proprietary to a third party, contains any third party content, or otherwise defames, violates or infringes (or may infringe) any copyright, trademark, mark or other identifier of source, or other proprietary right of any entity or person (whether living or deceased) (including but not limited to, rights of privacy or publicity or portrayal in a false light);

appears to result in any injury or bodily harm; and/or

is lewd or inappropriate or offensive or not in keeping with Sponsor’s image, including acts of violence or acts that are otherwise objectionable to Sponsor.

Any Entry or portion thereof that, in Sponsor’s sole and absolute discretion, violates any of the above or other prohibitions and/or representations or warranties of entrant may not be posted online (or may be

removed if previously posted) and will be disqualified from the Contest. Any Submission not in compliance with the above and that does not meet the Contest Site’s requirements may be disqualified. In the event that an entrant or Submission is edited, removed and/or disqualified, entrant is not relieved from responsibility for compliance with these Official Rules. Entries become the property of the Sponsor and will not be acknowledged or returned. Entrants and Winners acknowledge and agree that Sponsor has the right to edit, adapt, modify, reproduce, promote and otherwise use or not use (or remove) Entries in any way it sees fit without notification or further consent or payment of any kind. By entering, you agree to waive any rights you may have to any Entry submitted, including any and all moral rights that exist in the Entry and any derivative works made therefrom. 4. REPRESENTATIONS REGARDING ENTRIES; GRANT OF RIGHTS: By submitting an Entry in connection with the Contest, each Entrant represents and warrants to Sponsor that (i) the Entry is the original work of the entrant and that entrant has the sole right to submit it to the Contest; (ii) the Entry does not violate in any way rights of third parties, including but not limited to copyright and other intellectual property, privacy or publicity rights; (iii) the Entry does not violate any applicable laws; (iv) entrant has obtained all necessary licenses or permissions from all third parties for the Entry submitted into the Contest and for use as permitted in these Official Rules; (v) the posting and/or display of the Entry and any other use permitted in the Official Rules will not violate rights of any parties or otherwise breach any provision of any applicable law or regulation; (vi) use and posting of the Entry or any part of the Entry in connection with the Contest or as otherwise permitted by these Official Rules is and will be without any further review, notice, approval, consideration or compensation (except for any awarded prize as contemplated in these Official Rules), regardless of whether the Entry is a winning Entry; and (viii) the Submission submitted in this Contest has not been entered in any previous contest. Each entrant hereby grants to Sponsor an everlasting, royalty-free, assignable, irrevocable, unrestricted, license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, display, sublicense and exercise all copyright and other intellectual property and other rights with respect to each Entry worldwide and/or to include, in part or in whole, any Entry in other works in any media now known or later created, anywhere and forever, without further review, notice, approval, consideration or compensation. Except where legally prohibited, submission of an Entry into this Contest constitutes entrant’s irrevocable permission for Sponsor to use the entrant’s name and city and state of residence, in whole or in part, in print, electronic media, broadcast media, or any other media or manner, whether now known or later created, in perpetuity, in any way Sponsor deems appropriate in connection with promoting the Contest and Sponsor’s mission or any other purposes without further review, notice, approval, consideration or compensation. 5. JUDGING TO DETERMINE WINNERS: At the conclusion of the Entry Period, professionals employed by or associated with Sponsor will review all eligible Submissions and will pick 15 finalists who will then be provided to a distinguished panel comprised of Komen executives and Telemundo talent to select the final two Winners (the professionals and panel collectively referred to herein as “Contest Judges”). The Contest Judges will use the following criteria to make their selections:

Compelling story of strength and survival in the battle against breast cancer (can be either first person or submitted on behalf of a loved one (40% weight);

The “more” quality: What the nominee has done to better herself or himself and/or those around her or him since being diagnosed with breast cancer (40% percent); and

Adherence to the Official Rules and quality of submission (20% weight).

In the event that there is a tie resulting in more than two entries, the Contest Judges will re-judge those that are tied solely based on nominee’s story of strength and survival and positive impact on the fight against breast cancer awareness as shown in the Submission. At the conclusion of the judging (and subject to Sponsor’s verification and applicable entrant’s and corresponding nominee’s timely execution of the Affidavit of Eligibility and Liability and Publicity Release and affirmation of assignment of rights), the two nominees who receive the highest number of votes will be deemed the Winners. By participating, entrants and nominees agree to the decisions of the Contest Judges with respect to judging, which shall be final and binding in all respects. Sponsor and Contest Judges reserve the right not to award a particular prize or prizes in the event that there are insufficient Entries to award all prizes and/or the Entries received are insufficient to warrant the award of a prize. 7. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): Subject to compliance with the Official Rules, Contest prizes will be awarded to two nominees nominated in the winning Entries (this may or may not be the same persons as the entrants). A nominee may receive only one prize in the Contest. Each nominee who is a Winner will receive the following (collectively, a “prize”):

Roundtrip coach airfare for the Winner and his or her guest from the major airport where Winner resides, including ground transportation from hotel to airport, (or if less than 200 miles away from Miami, other transportation as determined by Telemundo

Prizes only include the items stated above, and each Winner and his or her guest will be responsible for any applicable fees, service charges or surcharges, and all insurance, ground transportation to and from Winner and his or her guests localairport, luggage fees, souvenirs,

excursions, gratuity, incidentals, and all other unspecified expenses that each Winner and his or her guest incur in connection with their use of the prize. ARV may vary depending upon gift substitutions and/or price changes. If the actual value of a prize is less than the stated ARV, the difference will not be awarded. Other restrictions may apply. No substitution, cash redemption or transfer of a prize is allowed. Sponsor assumes no responsibility for cancelled, delayed, suspended or rescheduled events. If an event is cancelled due to unforeseen weather or other circumstances, the prize is no longer valid and the opportunity is null and void. All prizes are subject to change and/or cancellation. Sponsor and the Prize Providers reserve the right to deny entrance to an event at any time. Tickets lost or stolen cannot be replaced. Event times and dates are subject to change. The resale or attempted resale of a ticket is prohibited and if discovered will result in the ticket being voided without the award of any substitute prize, exchange or payment of any cash equivalent value. An IRS Form 1099 for the fair market value of the prize will be filed and a copy provided to each Winner. Each Winner must provide Sponsor with his or her social security number so that the Form 1099 can be provided. All applicable federal, state, local and other taxes and fees associated with the prize and expenses not stated related to acceptance and use of a prize are solely the responsibility of the Winner.

The Winner’s and any guest’s appearance on Un Nuevo Dia or in a PSA may not actually appear in the final broadcast version of the Spot; decision is subject to producer’s requirements and sole discretion. None of Sponsor or the Contest Parties (as defined below) is responsible or liable for cancellation or preemption of the Winner’s and his or her guest’s appearance in a Spot or PSA. Role(s) in the Spot and PSA have no cash value. Winners and their guests will receive no compensation regardless of whether or not they actually participate in or appear in a Spot or PSA. If producer, in his/her sole discretion, elects to incorporate the audio and video recording of a Winner or guest (“Recording”) in a Spot or PSA, the inclusion of the Recording and/or the PSA/Spot will not be considered an employment opportunity, and the Winner and his or her guest will not be entitled to compensation or credit therefore. Winners and/or their guests will have no right of review, notice, or approval of the content of a Spot or PSA. These Official Rules and the Contest are neither a contract nor an application for employment. Sponsor, the Prize Providers and producer reserve the right to disqualify a Winner and/or his or her guest and remove him, her or them from a Spot or PSA at any time, if his, her or their behavior at any point is deemed by them to be disruptive, if it may or does cause damage to person, property, or reputation of Sponsor or any Contest Party or otherwise violates the policies thereof, or if the Winner and/or his or her guest do not follow the directions of Sponsor, the Prize Providers or producer at all times.

The content of the Recording will be determined by Sponsor and the Prize Providers in their sole discretion. If the Recording is broadcast, such broadcast will be at a time, for a length of time, and on a date or dates determined by the Prize Providers in their sole discretion. Winners and their guests will be required to execute and return appearance and location releases and such other documents as may be required by the Prize Providers (“Appearance Documents”). If a Winner and/or his or her guest fails to execute and return Appearance Documents in a timely manner, as determined by the Prize Providers in their sole discretion, the appearances may be cancelled and prize may be forfeited. Winners and their guests will have no right of review, notice, or approval of the content of the Recording or any broadcast thereof.

8. NOTIFICATION – TIME IS OF THE ESSENCE TO ACCEPT AND PROVIDE REQUIRED AFFIDAVIT AND RELEASE. Each tentative Winner will be notified via telephone and/or email on or about August 1, 2016. A notified person, at his or her sole discretion, may disclaim the prize by not claiming such prize or by not completing and returning to Sponsor, the Sponsor’s Affidavit of Eligibility and Liability and Publicity

Release within seventy two (72) hours of attempted notification, and in such case an alternate tentative Winner will be selected and this process will be repeated until such time as a tentative Winner and his/or guest complete and return to Sponsor the Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within seventy two (72) hours of attempted notification. At such time, subject to verification by Sponsor a tentative Winner of a particular prize will be deemed the confirmed Winner of such prize. Except where prohibited by law, each prize Winner further grants to the Sponsor and its designees the right to use the name, photograph, voice, likeness and city of residence of the Winner and his/her guest for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Contest without further consideration and to release his or her name to persons requesting the name of the Winners of the Contest. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate Winner. 9. ELIGIBILITY: The Contest is open to entrants and nominees who are legal residents of the contiguous forty-eight United States, the District of Columbia and/or Puerto Rico and are physically located and residing in the same, who are 18 years of age or older or the age of majority in the state of residence as of the date of entry in the Contest, as the case may be, and eligible in accordance with these Official Rules. Void in all other jurisdictions. Employees, contractors, directors and officers, and vendors of Sponsor, its subsidiary and affiliated entities, advertising, and fulfillment agencies involved in the administration, development, fulfillment and execution of this Contest, Telemundo Network Group, LLC and NBC Universo, LLC (collectively, “Contest Parties”), and the immediate family members of each (spouse, domestic partner, parent, child, sibling, grandparent, and spouse, domestic partner or “step” of each) and those living in the same households of each are not eligible to participate. The Contest is subject to all federal, state, and local laws and regulations. Void where prohibited or where restricted by law in a manner inconsistent with these Official Rules. 10. ADDITIONAL INFORMATION REGARDING PRIZES: Sponsor and the Contest Parties assume no responsibility or liability for damages, losses, or injury resulting from acceptance or use of prize or participation in the Contest. Sponsor reserves the right to request from any entrant or nominee additional documentation it reasonably believes is necessary to validate any Entry or to award any prize. Prizes are not transferable. 11. GENERAL RULES: By participating in the Contest, entrants agree to these Official Rules and the decisions of Sponsor and the Contest Judges, as applicable, with respect to the Contest and the awarding of prizes, which shall be final and binding in all respects. Sponsor and its agents are not responsible for technical, hardware, software, online or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Contest, or for lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, mutilated, postage-due or misdirected mail, correspondence, communications, requests, claims or other errors or problems in connection with or relating to the Contest, including, without limitation, any human error which may occur in the processing of the entries in this Contest, or for any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with this Contest. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Contest or online voting is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any

other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest process, then Sponsor reserves the right at its sole discretion to cancel the Contest and determine the Winners by having the Contest Judges judge from among all eligible Entries received prior to cancellation, based on the judging criteria listed above in Rule #5. If a court of competent jurisdiction deems any provision of these Official Rules invalid or unenforceable, such provisions shall be enforced to the maximum extent permitted and the remaining provisions of the Official Rules shall remain in full force and effect. 12. UNSPORTSMANLIKE CONDUCT: Sponsor reserves the right in its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest, the Contest Site; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Any attempt to use multiple e-mail or user accounts or other tactics to enter or vote more than the stated limit of this Contest may result in disqualification and all associated Entries and/or votes will be void. 13. RELEASE AND LIMITATION OF LIABILITY: In connection with any involvement and/or activities related to any prize, each Winner and his/her guest does hereby: (1) acknowledge and accept sole responsibility for all of the hazards and risks to him/herself and his/her property associated with or related to participation and for any damage or injury that he/she may cause to others; (2) acknowledge and assume all risk and danger incidental to participation in events in connection with the prize; and (3) hereby release, waive and forever discharge any and all claims of damages or causes of action, including but not limited to, death, personal injury or loss or damage to property, which he/she or any of his/her representatives, heirs, next of kin or assignees (collectively "Representatives") may have or which may hereinafter accrue to him/her or his/her Representatives as a result of participating or otherwise which may be asserted by his/her or his/her Representatives against the Released Parties (as defined below), whether caused by the acts, omissions or negligence of the Released Parties or by any other person or entity. RELEASE: BY PARTICIPATING IN ANY ASPECT OF THE CONTEST, YOU AGREE TO THE FULL EXTENT PERMITTED BY LAW TO RELEASE AND HOLD HARMLESS SPONSOR, CONTEST JUDGES, CONTEST PARTIES, THEIR RESPECTIVE PARENT, SUBSIDIARIES, AFFILIATED COMPANIES, AGENTS, RETAILERS, ADVERTISING AND CONTEST AGENCIES, AND ALL OF THEIR RESPECTIVE SHAREHOLDERS, OFFICERS, DIRECTORS, EMPLOYEES AND ASSIGNS, MEMBERS, REPRESENTATIVES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”), FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN ANY PART OF THE CONTEST (INCLUDING, WITHOUT LIMITATION, PREPARING FOR OR PARTICIPATING IN OR SUBMITTING ANY ENTRY AND/OR FROM ANY CONTEST RELATED ACTIVITY) OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH. YOU FURTHER AGREE THAT IN ANY CAUSE OF ACTION, THE RELEASED PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE CONTEST, AND IN NO EVENT SHALL ANY OF THE RELEASED PARTIES BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES, AND YOU WAIVE THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER. YOU HEREBY REPRESENT AND WARRANT THAT YOU HAVE READ THESE OFFICIAL RULES AND ARE FULLY FAMILIAR WITH THEIR CONTENTS. 14. APPLICABLE LAWS AND JURISDICTION: Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Texas. All disputes arising out of or connected with this Contest will be resolved individually, and without resort to class action, exclusively by a state or federal court located in Dallas, Texas. Should there be a conflict between the laws of the State of Texas and any other laws, the conflict will be resolved in favor of the laws of the State of Texas. All judgments or awards shall be limited to actual out-of-pocket damages (excluding attorneys’ fees) associated with participation in this Contest and shall not include any indirect, punitive, incidental and/or consequential damages. 15. WINNERS LIST: For the name of the Winners, available online after the awarding of the final prize per Rule #1, visit the Contest Site. To receive a copy by mail, send a self-addressed stamped envelope (except where not required by applicable law) to: Sponsor at the Contest Address. Limit one request per outer mailer which should be marked “The 2016 Susan G. Komen Historias de Héroes Contest Winners List Request.” Requests must be received by December 31, 2016. 16. PRIVACY: Sponsor collects and uses entrants’ personal information for the purpose of administering

this Contest. The Winners’ names may be listed on the Contest Site and may be listed elsewhere in

Sponsor’s materials. No marketing communications will be received by entrants by virtue of entry unless

entrants provide express permission.

this Contest; and are not responsible for the administration of the Contest or the

collection of the Entries.
