I completely agree with the proposal to prohibit. Campers have had little respect for residents causingunnecessary tension. Campers have been urinating in the reserve and leaving the area in an untidystate that residents have had to clean up. Please prohibit freedom camping. There is a campingground in Otama which is a short distance away they do not need to freedom camp.

We agree with the above and have reservations about the use of the Moore Ave Reserve. This areais often used by local residents and particulary children as one of the few green open spaces in thebay for games and outdoor activities. The home owners pay considerable rates for the views andopportunities the bay offers and looking at several ugly motorhomes is not what they paid and pay alot of money for.There are a number of health and safety issues and the policing of this area that needto be considered.There is a campground in Otama that caters for everyone.We object to any FreedomCamping especially during the peak times.

I am one of the owners of the property at 873 Black Jack Road, which is close to the areas at thenorthern end of Opito Bay which are proposed to be changed from restricted to prohibited. I and theother owners of the property support those changes. From our own observations of freedom campingat various locations in the Bay, the area has limited infrastructure available to support freedom campers,particularly in any numbers and for significant lengths of time. We believe that the changes proposedwill assist to manage freedom camping numbers in the Bay, while still permitting a reasonableopportunity for freedom camping access.

Our only concern would be if prohibition of camping in the newly-prohibited areas pushed freedomcampers in material numbers on to the reserve in front of the seaward houses between Skippers Roadand the phone box further down Black Jack Road. That area is used by many people, both residentsand visitors, particularly over the summer. It would be unfortunate if one group came to dominate by"staking a claim" for a sustained period. If the proposed changes have this effect, we would encouragethe Council to review the bylaw again in the future.

1.We support the banning of freedom camping at the Moore Crescent reserve because it resrictsaccess for families and play e.g. cricket, volley ball etc.

2. The damage being done to the cliff top and grassed area plus the rubish and faeces left behind.

3.The failure of campers to abide by regulations i.e. drinking and using the public toiet because theyare not self contained and not keeping to the numbers allowed.

I would like to make a submission supporting the prohibition of freedom camping at Opito Bay Roadand Skippers Road Reserves for the following reasons: Maintaining access to the beach . We havefrequently observed, in particular at the Skippers Road reserve, that Camper vans tend to partially orwholly, block access to the beach. They seldom park unobtrusively and often seem to have littleconsideration for others.

Maintaining the health of the sand dunes and protecting the area. The area of Skippers RoadReserve where the vans invariably park, is actually where sand dunes have built up over a number ofyears, raising the level from what was wet beach to to the reasonably firm area that it is now. I believethat In order to enhance and protect he sand dunes, and develop better setback, it is bad practice toallow camping and parking on those dunes. Freedom camping should not be permitted and generalparking should be restricted to beside the stream

Maintaining general health and safety . I believe that health and safety requirements would bediminished if freedom camping was permitted in these areas.

I support the submission to prohibit freedom camping at Opito Bay.

Since three has been access to the Moore Cres reserve - we have seen significant erosion of theforeshore immediately in front of the allowed camping areas, where campers tramp through the grassand on to the beach. This has created bank slipage and general deteriation of the foreshore.

We have seen accumulated vans and busses extending through the reserve - that would inhibit theWestpac rescue helicopter being able to safely land

The general safety and wellbeing of the direct communitee has also being impacted with some camperschoosing to excrete human faeces in the grass along the foreshore, rather than in their self containedvans (a number of vans are not self contained that have been camping)

So I support the proposed amendment to prohibit freedom camping at Opito Bay to protect the areaand the helath and safety of the people in the area

Freedom Campers and in particular the "self contained" campers rented to these travellers take theproverbial piss out of the current generous concessions granted under the freedom camping bylaw.Our family has holidayed in Opito for over 30 years and since the freedom campers have arrived theyhave camped in tents from cars on the verge (not even in the approved zones) and left rubbish. Thecurrent toilet facilities can't support these campers who really need to stay in campgrounds (Otama,Kuaotuna, Whitianga etc). The Big motorhomes that park up are unsightly and make the beachfrontseem like a giant campground, making it hard for even day trippers to park up and enjoy the bay. Ifeel TCDC currently do a poor job at enforcing the current bylaw, and I agree with the proposedammendment.

I am a ratepayer at 892 Blackjack Rd Opito Bay. I strongly support the ammendment to prohibit FreedomCamping on the Opito Bay Road and Skippers Road Reserves. It is good to see TCDC responding tothe issues in the current Bylaw.

With reference to the Map 1 of 2 in the draft Bylaw, the triangle shaped reserve with the public telephonebox in Opito Bay is also included. This reserve is on Blackjack Rd, Not Opito Bay or Skippers Roads.I support the prohibition of Freedom Camping on this reserve as indicated on the map.

Opito Bay is quite inappropriate for Freedom Camping vehicles. The road from Otama to Opito isnarrow, dangerous and in poor condition. It is irresponsible to encourage large vehicles to take thattrip by having Freedom Camping locations in Opito Bay. As Opito is at the end of a no exit road,campers who find that the Opito parking places are occupied have to travel back over the same roadto leave the bay. More likely, having made that trip, they will park outside the designated areas.

I fully support the prohibition. My family has had a property opposite Moore Ave Reserve since 1982and I have spent over 3 years living and holidaying in this area. Since 'restricted' Freedom Campingwas allowed at the coastal edge of the Moore Ave Reserve I have witnessed regular misuse anddisrespect of the site, including but not limited to: too many vehicles on site; campers staying at thesite for more than the maximum two nights; vehicles parked two to four rows deep into the reserve,removing the ability to use the reserve for recreation; multiple vehicles that are not self-contained;campers catching undersized fish and/or taking more shellfish than legal limits; disposing of fish frames/ guts in the surf. In one instance I witnessed a camper discard an undersized kingfish frame into thesurf, promptly followed by a large bronze whaler shark coming in amongst bathers to retrieve thecarcass. Due to these constant abuses of the site I fully support the return of the Opito Bay Road andSkipper Road Reserve sites to fully prohibited freedom camping sites.

I am in favour of retaining the sites at Opito Bay. As a ratepayer our family has enjoyed Opito Bay forover 30 years and feel that Opito Bay was traditionally enjoyed by many campers who later were ableto buy into Opito Bay as subdivisions became available. Some of those campers now own sectionsand do not want other people to enjoy Opito Bay for selfish reasons. We now have tourists enjoyingthese area's, therefor bringing in much needed overseas funds to the country. Without thesefunds provinsial towns may not servive, we are seeing this happen with many businesses strugglingto survive. The current bylaw is working fine with most of the campers very responsible and wellbehaved

We are not opposed to freedom camping as such, but feel that the road to Opito Bay is alreadydangerously clogged with logging trucks and holiday makers during the summer. Freedom campershave to go over the road twice, once in and once out, and when it is established as a good freedomcamping site, the traffic will increase with campers who may have driven on the off-chance of a goodsite, and perhaps to drive back over again without finding a decent site. Camper vans are notoriouslywide, they travel slowly and not easy to manoeuvre, making it even more difficult to manage two-waytraffic on an already difficult road.Surely it would make more sense to find areas that are on theCoromandel “circuit” with sealed roads and good access, so we would support the prohibition of sitesat Opito Bay. THank you for the opportunity of making a submission.

I have studied the proposed change to the Freedom Camping By Law and am definitely in favour ofthe Prohibition proposed. The issue is that the old by law, prior to the change to the restricteddesignation, specifically prohibited “Opito Bay Road and Associated Reserves including Skippers RoadReserves, Jack Mills Reserve, Stewart Stream Reserve, Opito Bay Esplanade South” (Moore Crescent).This proposed change only specifically prohibits “Opito Bay Road and TCDC Reserves SurroundingSkippers Road" of which is clearly marked on the map.

However, Jack Mills Reserve, Stewart Stream Reserve, Opito Bay Esplande South (Moore Crescent)are not named nor marked off on the map, which if left open for interpretation could deem themcompletely open for freedom camping as they are neither restricted nor prohibited.

I would like to see it go back to the old detailed wording and request the red areas on the map reflectall the previously restricted reserves as supported by the high court ruling in 2014.

Our concern with Campers having the ability to park on Moore Cres Reserve is there distruction of theresurve with their heavy trucks on a surface that during winter they may cause erosion on the beachside. The also restrict the ability for a helicopter to land on the reserve in an emergency given thereserve is a dedicated rescue landing spot. the other issue is the increased pressure these heavyvehicles place on the Black Jack road.

Background

Holiday Accommodation Parks Association of NZ Inc. (HAPNZ)Established in 1955 as the Camp and Cabin Association, HAPNZ is the industry associationthat represents the commercial holiday park sector in New Zealand.

There are 420 commercial holiday parks in New Zealand that annually provide in excess of6.8 million guest nights 32% of which are international visitors.

HAPNZ has 300 member parks and over 90 trade members. HAPNZ is a full member of theTourism Industry Association (TIANZ) and all HAPNZ members are affiliate members ofTIANZ. HAPNZ is a national partner of the New Zealand Cycle Trail, a full member of theBackpacker, Youth and Adventure Tourism Association (BYATA) and an allied member of theTourism Export Council of New Zealand.

While staying at Holiday Parks, visitors contribute around $1 billion in direct expenditure toNew Zealand’s economy each year. Approximately $594 million, or 59% of this expenditure,is contributed by domestic visitors and the remaining $405 million, or 41%, by internationalvisitors. Expenditure by international visitors also contributes directly to New Zealand’sexport earnings.

An average of just 23% of daily expenditure by Holiday Park visitors goes toward holidaypark accommodation costs. The balance, which totals approximately $769 million annually,is typically spent outside of Holiday Parks in areas such as hospitality (cafes, restaurants,bars), activities and attractions, transport (rental vehicles, fuel, buses, taxis), retail goods andservices, and entertainment.

Holiday Accommodation Parks Association Position of Freedom Camping

As an Association we support freedom camping in New Zealand in appropriate locations.

As part of local communities our members take an active part in the development of policiesand bylaws which apply to freedom camping. Our members provide feedback on suggestedfreedom camping areas. In some cases we will support freedom camping areas and in otherswe will oppose them; these decisions will be linked to the appropriateness of the locationand the mood of the community. In most instances we do not consider urban locations asbeing appropriate for free camping.

While we do not seek special protection for our members from the bylaws it is sensible thatsome buffer around commercial Holiday Parks be put in place. This can assist in discouragingthe unlawful use of facilities e.g. showers toilets and dump stations, which occur at manyparks, but also remove the inevitable tension that will arise from campers overnighting forfree in close proximity to commercial holiday parks.

HAPNZ has been an active participant in the NZ Responsible Camping Forum since itsinception and fully supports the key messages and information that has been agreed andpromoted by group members. We believe that strong, consistent national messages, backedby comprehensive regional information will help remove much of the tension that hasexisted over vehicle-based camping and result in better experiences for campervan holiday-makers and communities.

Urban AreasMany TLA’s are choosing to prohibit freedom camping within Urban Areas and we wouldencourage council to take this approach when considering reviews of the Bylaw. It is notappropriate for visitors to be sleeping in vehicles overnight in residential urban areas.

Fire & Gas SafetyWe strongly recommend that the Council enforce in all free camping sites Regulation 6 (2)from the Camping Ground Regulations 1985.

“(2) No temporary living-place shall be erected or placed on any camp site within 3 metres ofany other temporary living-place, or within 1.5 metres of any camp site boundary, as the casemay be.”

This is to ensure that fire safety is maintained with vehicles maintaining an appropriate gapbetween other vehicles. This can be achieved by painting suitable lines in parking areas.Failure to enforce this may put the Council in the position of not taking all reasonable care.

Visitor ExperienceThe New Zealand tourism industry has developed a framework for the industry Tourism2015. One of the five key components of this is “driving value through outstanding visitorexperience”.

The visitor experience of both domestic and international visitors to Napier will be impactedby allowing free camping in urban areas.

Having people sleeping in vehicles on the side of the road in towns is a third worldexperience. This is not how we want New Zealand to be seen by our international anddomestic visitors.

Health and SafetyIn considering this bylaw the Council should take into account their responsibilities forworkplaces under the Health and Safety in Employment Act 1992 and as a PCBU under theHealth and Safety Reform Bill.

The designated freedom camping area can be considered a “place of work” under the Actand the Council is responsible for the health and safety of:

it’s employees whilst working in that area (sections 6 of the Act);

other people, in terms of where the actions/inactions of its employee’s harms anyother person (campers) in that area (section 15 of the Act); and

other people (campers) who are there for leisure and recreation or who pay to bethere (section 16 of the Act).

Under the Health and Safety Reform Bill, “place of work” changes to “workplace”, which is awider definition, so the above advice will equally apply.

EnforcementIt is essential that no matter what decisions as are made regarding the Freedom CampingBylaw that Council provides sufficient resources to enforce them. As has been seen inQueenstown Lakes District Council area, the enforcement can provide sufficient funds tocover all enforcement costs.

I do not agree with this proposal as this is a residential area with the closest houses only being a fewmeteres from the proposed area. This will limit visitors to the reserve and kids fishing on the pontoon.Also any visitors for these houses will be severely limited with their parking. The parks are only smallso if large campers were to try and park there would be a risk that they could be backedinto by residentsand tkae up part of the road.

When town planning was done originally, those carparks were put there for a reason - to service theresidents and anyone that wanted to use the reserve. If these parks are taken up up by campers thenthere will be no room for other cars to park. These parks are fully populated in the summertime, whenthe campers would be wanting to park here.

I dont believe that it is appropriate to have campers close to residential housing ie straight across theroad

Any large campers would not fit in the car parks and therfore hang over the road or take up morecarparks if they parked parallel to the road.

Why now has there been a change to the ability to have campers here at Waterways parade, whenthere are other sites more appropriate (with no residnetial houseing close by) like Plesant Point orRoyal Billy Point and Southern End of Pauanui beach? The fact that it is in our face - right across theroad , that is not appropriate.

Why is this being forced upon us in 2015?

The Opito Bay community has long been a very special part of the Coromandel.The ratepayers of thebay have always fiercely opposed the introduction of any commercial development; shops, cafés,camping grounds etc, in an effort to preserve the integrity and safety of this very special community.That’s who we are and what makes Opito Bay special.

The bay attracts people who seek remoteness and are prepared to pay rates, participate in localenvironmental initiatives and be part of a special community.

This is a community where we can safely sleep with our doors unlocked and where our children canplay on the beach and reserves, relatively unsupervised.

Freedom camping changes all of that. Freedom campers by their very nature are itinerant, spendingno more than a couple of nights in one spot. Often they show no regard for the communities they’recamping in and care little about the future of the environments they have free access to.

In Opito Bay we know of cases where:

1 Resident children, playing on the reserve near camper vans have been verbally abused andchased away by campers

2 Campers have helped themselves to resident’s water supplies and electricity3 Campers have made use of resident’s properties and furniture while the owners are away.4 Rubbish, glass and human waste are sometimes left for residents to clean up - this in an area

where children play.

Welcoming anonymous campers is about much more than aesthetics (although, perched on primebeach-front sites they are undoubtedly an eyesore). It potentially threatens the security, safety andhealthy community values we have all fought so hard to preserve.

The spirit of freedom camping is to provide campers with free access to remote areas of New Zealand.This is quite different to camping in - and taking advantage of – ratepayer’s backyards. True freedomcamping doesn’t impact the health and safety of communities, or compromise property owners’ outlooks.

The freedom camping site near the Kuaotunu boat ramp is a good example of a suitable location forfreedom campers. Another nearby alternative is the Otama Campsite, just minutes away it offers fullcamping facilities, with easy day-trip access to Opito Bay.

Please be assured that there is strong and widespread opposition to freedom camping in Opito Bay.We are a small, remote community, treasured for its isolation in a country where remoteness is becomingrare and highly sought-after.

Our submission is to prohibit freedom camping in the whole of Opito Bay; simply shifting the zone,only shifts the issue. In completely banning freedom camping in Opito Bay, the council will preservea New Zealand community that is safe and iconic. It will ensure this Coromandel treasure cannot beruined at the hands of others who are not invested in, and do not value it the way we all do.

I would propose that the entire Matapaua Bay Road including the carpark/ turnaround area at the endof the road be a freedom camping prohibited area.

I am a long time resident of Matapaua Bay and I have noticed in recent years an increasing numberof camper van vehicles coming into the bay. The majority of these vans are the smaller NONself-contained types but we also get the much larger self-contained types albeit in smaller numbers.Often these vehicles come in under the cover of semi darkness and in some cases stay several days.I have personally cleaned up rubbish and mess from these people in the past as we have no rubbishbins, toilet facilities or potable water supplied by council. The road is narrow, steep and twisting. Theturnaround area is minimal and cramped.

As a ratepayer in Moore Crescent Opito Bay, I strongly object to allowing any sort of camping eitherFreedom or otherwise in any part of the Bay.

The numbers of vehicles seen camping on the Moore Crescent Reserve can't be controlled.

See the enclosed photographs of vehicles seen extending into the reserve.

Often their dogs are let free to roam on the beach and reserve. See the enclosed photograph of thedog faeces left on the reserve .

Freedom campers vans are supposed to be fully self-contained . If this is the case why do they usethe long drop toilet on the Moore Crescent reserve? See enclosed photographs. I have even seenladies walk to the toilet while the TCDC ranger was present.

The public long drop toilet on the reserve is over taxed when campers constantly use it.

Hanging washing lines strung from the vans to the pohutakawa trees is visually polluting for the localresidents. See enclosed photographs.

Some campers have been known to verbally abuse children playing on the Moore Crescent reserve.

Allowing any camping on the Moore Crescent reserve or on the land between the road and the beachwill only block the residents view to the see in that area .

Often campers do not always camp in the prescribed areas. See enclosed photographs.

These objections are additional to those already expressed by other residents.

2 Van occupying the area in the reserve where children play.3 Campers leaving human faeces on the beach.As ratepayers who pay rates to TCDC why should we provide free facilities and areas to campers whomake no financial contribution to the area. Freedom campers damage the reserve areas where theypark. This is especially so in winter when the two wheel drive vehicles loose traction . Some of thelarge buses put other vehicles at risk especially on the narrow windy areas of the Black Jack Road.What happens when a big Freedom Campervan meets a logging truck????

RE: DRAFT FREEDOM CAMPING BY LAW AMENDMENTS - PROPOSED AMENDMENT TO OPITOBAY AND SKIPPERS ROAD RESERVES FROM RESTRICTED TO PROHIBITED I support theamendment to the Freedom Camping Bay-Law amending Opito Bay from a restricted area to a prohibitedarea. I would also like to express my desire to be heard at the meeting on 5 November. After readingthe proposed amendment I feel that it is not tight enough in its definition of the specific prohibitedareas. If left as it is presented in the proposed amendment, I believe further issues will arise in theinterpretation of what areas are defined as prohibited areas, with particular reference to Opito BayEsplanade South (Moore Crescent Reserve) where all the problems have occurred over the last tenmonths. The definition of the prohibited areas need to be specific and the map needs to be clearlymarked in red OVER the prohibited areas, including Opito Bay Esplanade South (Moore CrescentReserve). Currently Opito Bay Esplanade South (Moore Crescent Reserve) is not marked in red atall, which could be interpreted as open slather for freedom campers in this area. Based on myexperiences over the last ten months with rude, entitled, arrogant campers who think they come firstover the environment and locals I would prefer NOTHING be left to interpretation.The definition shouldread: "Opito Bay Road and all associated TCDC reserves, Skippers Road and all associated TCDCreserves, and Moore Crescent and all associated TCDC reserves. This includes Skippers RoadReserves, Jack Mills Reserve, Stewart Stream Reserve, and Opito Bay Esplanade South (MooreCrescent Reserve)." My long list of issues encountered, as a landowner directly on Opito Bay EsplanadeSouth (Moore Crescent Reserve) have been presented at numerous council meetings with photographicevidence. Hopefully, these letters will still be on the council's freedom camping files for considerationwhen changing the By-Law. I have tracked the days since 1 December with freedom campers andthere continues to be over 80% non-compliance. The campers are now parking directly in front of theTCDC sign that tells them the area is closed and to go to Stewart Stream. A sample of issues usingthe three allowable areas of concern for prohibition are noted below: To protect the area: • Dotterels

and Oystercatchers and the breeding programs in the area are threatened with increased people andtheir dogs • Significant erosion of the foreshore in front of the campers due to heavy vehicles and thecampers "inability" to use the stairs thirty steps away to access the beach • Human and pet excrementnow an issue on the beach and reserves • Large inorganic items being left behind by the garbage binsbecause they are too big to fit • Children exposed to campers with "happy when you sit on my face"written on them Health and Safety of People who visit the area: • Westpac Helicopter inhibited withchoice for landing • A freedom camper had a heart attack and locals had to assist by moving vehicleas wife didn't have a clue how to drive it in order to save his life and get her out over the Blackjack •Road is an issue and with the large camper vans driving over cause a safety issue for everyone. The22 kms of narrow, windy, partial gravel road is a first for many we have spoken to making it dangerous.They are like learner drivers with huge camper vans. • Incident happened where capacity was reached,compliance officer came but was unable to move people as they were intoxicated so couldn't driveover the unsafe road • If a camper gets in an accident on the Blackjack TCDC could be held responsibleas they have attracted them to the area by opening the area to freedom camping deeming the areaand road "well maintained" and safe to travel on, which is required in all insurance policies. To protectAccess to the area: • Due to the numbers of freedom campers arriving last summer and the fact thatthey don't want to leave and drive back over the harrowing Black Jack, which was once considered abanned road for insurance purposes, they stayed and often left no room for the day trippers • The localchildren on their summer holiday or at their permanent home were told to play somewhere else or gohome • I was told I didn't belong in this country and should go home. Ironically this has been my homesince 1988 and I hold a NZ passport and live in Opito Bay on the reserve and work in Whitianga. Theytake over whole reserves at the expense of the ratepayers and rental accommodation guests with theirchairs, laundry, and water toys and support vehicles During wet season campers got stuck andcompletely chewed up reserve. It is now cordoned off to recover and no-one can use it Other: Wemoved to this area to have a stress free, peaceful, private life in a pristine coastal environment thatwe could look after as local caretakers. We now dread going home from work as we are faced withrude, abusive, messy and environmentally ignorant campers that we have to keep in check and haveno consideration for the fact we pay to live there. If we wanted to be policemen we would have chosenthat as our career. We make significant contributions to the local area with our chosen careers andphilanthropy. We hope that this change is made so we can continue to live here. What is the solutionto freedom camping? Lobby against it. The problems will worsen every year across the Coromandeland nation with gypsies already taking advantage of living for free. In the meantime, put aside blockof land out of the way of the locals and tourists who pay to live in/see the most stunning places NewZealand has to offer where the campers can all stay in their self-contained vehicles and day trip to theplaces everyone else has to. Ultimately, it is up to councils to lobby the government to ban freedomcamping - the experiment hasn't worked.

I support the amendment to the Freedom Camping By-Law changing Opito Bay from a restricted areato a prohibited area. I was born and raised in Whitianga and spend a lot of time in Opito Bay duringthe summer months. Lately, my visits have not been as pleasant due to the campers taking over andpreventing day-trippers quiet enjoyment of Opito Bay.

The definition of the prohibited areas should read: "Opito Bay Road and all associated TCDC reserves,Skippers Road and all associated TCDC reserves, and Moore Crescent and all associated TCDCreserves. This includes Skippers Road Reserves, Jack Mills Reserve, Stewart Stream Reserve, andOpito bay Esplanade South (Moore Crescent Reserve)" to ensure there is no confusion that freedomcamping is prohibited in all TCDC Reserves in Opito Bay to protect the area. These reasons wereclearly thought out before the change making certain areas of Opito Bay Restricted and the High Courtwas happy with the methodology taken by the council to prohibit this area. Over the ten months it hasbeen restricted every one of these three areas has been put at risk thus we need to go back toprohibiting the area but with a very clear definition of the specified areas.

What is the solution to freedom camping? Put them in out of way places that dont affect the locals orthe environment. They are self-contained so dont need to use the facilities in parks, recreation areas,and the top tourist spots. Leave these facilities for the people who pay to be here and respect what aprivilege it is to have access to these places.

This is a pristine coastal environment. The freedom campers in the area over the past 9 months haveeroded the foreshore, killed the grass, and turned the ground into a quagmire. The damage was sodire, the area had to be fenced off to recover. Now even day trippers cannot access the reserve. Ihave often seen campers arrive, the doors opened and their dogs let out unrestrained. The dogsimmediately crap on the reserve (more often than not left) and then charge into the sand hills. Thenesting Dotterels and Oystercatchers don't have a chance. Unfortunately it's not just the dogs crappingin the area. I've witnessed a number of freedom campers using the beach as a toilet and emptying outtheir holding tanks onto the reserve. Access to Opito via the Blackjack Road is very steep and windy.The road surface varies from day to day. We can have a dry smooth surface one day and muddy andslippery clay the next. There have been a number of close calls with freedom campers and it is onlya matter of time before a serious incident occurs. The state of the road could spark some seriousinsurance issues and litigation should there be an accident. The health and safety of visitors andresidents have been further eroded by the campers blocking helicopter access to Opito Bay EsplanadeSouth (Moore Crescent Reserve). Westpac Rescue have the reserve pegged on their GPS and thelocals have supplied A & E Equipment beside the reserve for everyone using the area including diversand fishing boats around the Mercury Islands. We want helicopter access 24/7. Freedom campingnegated this. What is the solution to freedom camping? I don't know. The problem is going to get

worse. Letting freedom campers stay for free at the most beautiful and pristine places other peoplehave to pay to visit is simply not fair. Perhaps purchasing several blocks of land in out of the way areas,such as behind the airport in Whitianga, may be a solution. They can then day trip to the beautiful andpristine areas like the rest of us.

The land wouldn't need to be expensive or have any facilities. They are after all, self-contained.

In conclusion we totally support the Board in its desire to change the classification of the SkippersRoad and Opito Bay Road Reserves and the Proposed Amendment to be extended to clarify that itincludes the Moore Crescent Reserve.

Forty years ago, the Moore Crescent area was a swamp. Subsequently it was filled in with clay whena subdivision was created. Consequently, after rain, it can become a very boggy area. The 2014-15holiday period was an exceptionally dry one over the extended summer period. The full range of sizesof camper vans used this site during this trial year. This includes large converted buses and alsoincludes large Wheelers. With the area designated by TCDC as a freedom camping site becoming aboggy area during this winter and being completely roped off, it illustrates what could happen in a wetsummer. 2. Westpac Helicopter. The Moore Crescent Reserve has been used as the prime landinglocation for the Westpac Rescue helicopter in the past, on occasions, twice a day. This is a veryvaluable resource to all people in the vicinity of Opito Bay, including day trippers and boaters. It iscurrently hampered by the room that freedom campers occupied in the 2014-15 holiday period. 3. Anowner of one of the bachs at Opito after the 2014-15 holiday season received what he described asan earful from an acquaintance at what a dirty smelly public toilet it was on the reserve at Opito afterstaying there with his motor home. It seems to be human nature that if a toilet is on the reserve, motorhome people prefer to use it, rather than fill the holding tank in their van. Over the years the TCDChas done an excellent job in keeping the sunny dunny clean but an excess of use during the 2014-15summer appears to have caused this problem. -0 4. We have over many years had the privilege ofmeeting overseas visitors to Opito and helping them out with small amounts of water, help in pullingout stuck cars, and enjoying their company. However, during the 2014-15 year the motor home visitors

took advantage of our goodwill by stealing water from precious stores, defecating on tracks to thebeach, leaving toilet paper and rubbish lying around and fish frames on the beach. Some also abusedyoung children from the wider areas including day trippers who enjoy playing on the reserve in theevening.

I fully support this proposal. Opito Bay is a wonderful place for those who have holiday homes and forday trippers, of which there are increasing numbers. However the issue comes with Freedom campingovernight. I have been coming up to Opito yearly since I was born (over 30 years now) and know whata special place it is for children and their families. I witnessed the restriction that Freedom campershave on these activities over the last summer.

- Not being able to use the reserve in full for cricket and volleyball, golf etc…

- Being aware that children were disturbing Freedom Campers (especially at night) in places thatthey used to be able to freely play around.

- I have also witnessed Freedom Campers; unaware that there is no water supply, think they canhave a shower and wash in the long drop toilets and then seek out fresh water from locals.

- Also the idea of Freedom camping has changed a lot recently with very budget travellers ableto rent or put a portable toilet in their van (that they don't intend to use) and think that they are Freedomcamping 9and meet some loose guideline), but are not equipt either physically or mentally for theresponsibility it holds.

- The volume of Freedom campers has also increased hugely, and we have watched them jostle3 vans deep to get the perfect spot!

- There will also be no site at Opito Bay where the locals will be happy with Freedom campingbeing allowed as it does impact on the view and the atmosphere of the place, a place that we allcherish.

- Although not the majority of Freedom campers and also an issue with day trippers are rubbishand fish carcasses being discarded

- The access to Opito Bay is not really ideal for big Camper Vans nor people unfamiliar with theroad and it does increase the large vehicle traffic on the BlackJack road.

Those with campervans are able to enjoy the Coromandel as day trippers and in camp sites but I don'tthink freedom camping will improve on the area and others experience of it. I know the FreedomCamping Lobby group and Grey Nomad population will be significant and I hope you weight up ourlocal views also. Thankyou for considering my submission. That is really good news that the council is prohibiting freedom camping in opito bay completely. Peoplehave been regularly freedom camping in places in opito bay that they weren't meant to since freedomcamping was allowed as the freedom campers seemed to think they could camp anywhere. Now withthe new draft there will be no freedom camping in the bay at all - it will be nice & clear for everyone. By having no freedom camping it will protect the area, protect public health & safety & protect accessto the area - it was so dangerous on black jack road with the influx of campervans when word spreadfreedom camping was allowed here. Hopefully now there will be less campervans on this road nowthey won't be able to stay over night. Thanks so much!

I am in full agreement with council to prohibit Fredom Camping in Opito Bay.This is a small communitywith limited facilities and over time freedom campers have proved to be a nightmare for ratepayers inthis area. At times children have been intimidated, rubbish and excrement left behind, with freedomcampers offering nothing to our community.

TCDC moved the freedom campers from one end of the bay to the other, because of issues, and allthat has been achieved is that the same problems are occuring at the Stewart Stream end. Nothingpositive has come out of this.

We are ratepayers at Opito and did not purchase our property to clean up after freedom campers, orhave to look at them as opposed to our view, which we paid a lot of hard earned money for.

Everyone is entitled to picnic in New Zealand, but free camping is not an entitlement councils can offeron behalf of communities.These people need to be in designated camping areas for which they shouldpay.

We are strongly opposed to the proposed amendments to the Freedom Camping Bylaw in respectofOpitoBay. The proposed freedom camping sites will increase rubbish and pollution in the area,increase pressure on public facilities, reduce road safety, negatively impact the environment andobstruct the view and the right to quiet enjoyment by local residents. These reasons are discussed infurther detail below:

Rubbish and Pollution – The proposed freedom camping sites at OpitoBay will create significant rubbishand potentially increased levels of pollution. Freedom campers at the Moore Crescent site are reportedto have repeatedly left rubbish behind. Although freedom campers are required to be fully self-containedby law, we are still concerned that many will not abide by these laws and will pollute the local area anddischarge waste water. The proposed site is directly next toStewartStream, which is used by childrento swim in and which directly flows into the sea.

Putting Road Users in Danger – Opito Bay is a difficult beach to get to and involves navigating a narrowgravel road over steep terrain. At numerous points the width of the road doesn’t allow two cars to passby each other, let alone a motor home. The proposed freedom camping sites will increase the amountof heavy traffic that will come over the Black Jack road. Although there are limited camping spacesbeing proposed, there is no way for campers to know whether there are spaces available and, it istherefore highly likely that far more campervans than the number of allocated spaces will cross the

Black Jack. We have also experienced freedom campers attempting to flout current camping restrictionsand be moved on late in the evening by council patrol. This issue is likely to become more prevalentas more people become aware of the freedom camping spot, and will result in large motor homescrossing the Black Jack at times of low visibility.

Environmental Impact – A primary concern is that the proposed site is directly next to a dotterel birdprotection area. DOC have been working at this site for at least 20 years to protect and build the localendangered dotterel population. The proximity of the freedom camping site is likely to have a negativeimpact on the local dotterel population.

Position – The use of the Moore Crescent site atOpitoBay by freedom campers has resulted in extensivecomplaints regarding noise and pollution. The proposed site next to Stewart Stream will involve movingthose same problems that were experienced at Moore Crescent to a different part of Opito Bay.

Day Campers – Opito Bay has always had day trippers who enjoy the beach and use of the publicfacilities. It is difficult to appreciate why freedom camping should be offered in prime locations at OpitoBay. There are numerous camping sites throughout the Coromandel that provide over nightaccommodation for campers at a charge which ensures appropriate provision of facilities and sanitation.We are of the view that freedom campers will obstruct, and place additional demand on, the use ofthe facilities that day trippers currently use (i.e. BBQ areas, fresh water supply and rest room facilities).

Obstruction to Views – The proposed site at Stewart Stream is in an area which obstructs the viewsof private residents at Opito Bay.

We propose that there be no freedom camping sites at Opito Bay.

As a very frequent visitor to Pauanui and its Waterways, I fully support TCDC's proposal to prohibitfreedom camping in Waterways Parade, Pauanui.

The parking is needed for access to the reserve and for visitors to residents. Pauanui Community Office (Pauanui Resident and Ratepayers Association Inc) supports this proposedamendment. Waterways Parade is a narrow residential road in this particular portion. As such, thereis no allowance for parking excepting the car park that is currently designated for Freedom Camping.This car park serves as parking for the public pontoon located in the Waterways canals that is frequentlyused by recreational fishermen. The TCDC Reserve Management plan policy states that this area(Waterways Esplanade Reserves) must be protected to "Maintain public access to jetty and pontoon".Access to the pontoon, reserve and residential homes during any emergency situation may also becompromised due to the narrowness of the street being additionally restricted by large camping vehicles.Designating this as a specific freedom camping area is in contravention of the Reserve ManagementPlan policy.

I believe we need to protect public health and safety and preserve access to the area, toensure its scenic quality, green public spaces and unique wildlife . I also have safety concerns withincreased usage by larger vehicles on the narrow Blackjack Road especially given the rumouredclosure of the Otama Bay Camping ground.

I spoke at the TCDC Community board meeting in Whitianga on the 14th April 2015 and also left awritten submission in support of that submission setting out 8 specific points against freedom campingin Opito Bay. Further to that submission and on reading the above proposals from Council up fordiscussion. I submit the following:

What council are proposing for the Bay is excellent but does not go far enough. The Prohibited areais not specific enough and open to mis interpretation. The whole of the previously prohibited areaclearly stated Opito Bay Road and associated reserves includingSkippers Rd Reserves, Jack MillsReserve, Stewart Stream Reserve,Opito Bay Esplanade south reserve (Moore Crescent).This is quiteclear and totally legal.The map should be red marked completely to show all roads and reserves totallyin red. Moore Cres only has the coastal slice marked. Camper vans will park further back in the greenmarked area. All these areas were supported in the High Court ruling in 2014.

I would be prepared to attend the Thames Meeting on 5th November and speak to my former writtensubmission and all 8 points, of which the lack of road safety into and out of Opito for these large vehicleson a no exit gravel road with major issues was one of the most important. I request that my formersubmission be coupled with this submission. I request a total Prohibition for freedom camping for thewhole of Opito Bay be reinstated and clearly delineated to show that. Read the document, and very disappointed. Rather than a list of where you can't camp, it would easierand much shorter to issue a list of where you can park. In particular I disagree that this is consistentwith the right to travel anywhere, this is systematically reducing that right. If campers are self contained,there is no problem.

General comments

I also would like to add - We regularly holiday in the property directly opposite from the toilet block andthe sign to show the park is offensive as in our direct eye line and ruins our beautiful view from whenlooking out from the house - why on earth would you place a sign knowing people's view will be effected24/7. Even if it was lowered or put to the side would be fine after all if a car is in there it wouldn't matterif the sign couldn't be read as the park is already in use and unavailable. Most people use that parkwhen using the rest rooms.

Also surely by putting a park for freedom camping beside a toilet block when the whole issue is theyare self contained is only going to encourage its use by these people lets face it its easier to use publicfacilities than to empty a tank. Why not designate them in a area with lots of space which effectsnobodys' direct view is away from roads and a designated waste drop nearby, also protected by winds

I support the prohibition of these roads but would like to add in particular, Moore Cres and all roadsat Opito Bay. I do not believe that Freedom Camping is appropriate at Opito for the following reasons:

1. Safety on the Blackjack Road for all current users. The road is narrow and difficult. Large vehiclessuch as motorhomes add to the challenge of navigating the road safely. There have already beennumerous accidents on this road, additional traffic especially large vehicles make the road more difficult.

2. Safety at the Opito Reserve, Moore Cresent for residents especially children

Last summer we experienced a number of concerning situations with the Freedom Campers. Mychildren use this Reserve regularly both day and night. Often in the summer it was not possible to playfootball or tag ( the usual daytime games) with the neighbours children because the motorhomesoccupied the prime flat spots in the Reserve. More concerning were the incidences at night. My childrenalong with the neighbours children regularly play 'spotlight' (a game of tag ) at night. Numerous timesthe children were approached, insulted and frightened by annoyed Freedom Campers because it waseither late at night or too noisy for the visitors. We also witnessed campers drinking alcohol. Of coursemy greatest concern is the safety of my children, however, I had to limit their freedom significantly asthe Reserve was busy with unknown people who often drank alcohol.

3.Pollution

The experience of last summer was that Freedom Campers at the Moore Cres Reserve left generalrubbish, toilet pollution, camping pollution such as oil, cooking water and also made their own tracks

to the beach rather than using the stairs which eroded the grass bank quickly. I am concerned aboutthe environmental damage to Opito.

4. Unmanaged problem when camping spots were full

Last summer the area reserved for Freedom Camping could accommodate two Motorhomes. Shouldthe space be full, additional campers were in theory supposed to return over BlackJack Rd and findan alternative spot. Many times last summer, Freedom Campers arrived to find that there were noparking spots available and had to choose between parking illegally (using precious Reserve space)or return over Blackjack in the dark which is a difficult road and risk an accident. Additional campersput pressure on the Bay's resources and the Environment. There was no management of this problem.

Support the proposed Bylaw change on the grounds of my previous correspondence.

The concern is that the nesting sites of Dotterel and Variable Oyster Catchers are within 2 to 5 metersof where the freedom camping takes place.

The Pataki etc. all nest well away from the designated freedom camping area.

It has taken Jude till now to increase the Dotterel nesting pairs to 3 which are right along the shoreline .

There are several pairs of Variable Oyster Catchers also affected but not to the same extent.

Surely it is prudent that there is no freedom camping here during the nesting and chick raising periodto encourage these endangered birds further.

Freedom camping outside of this period is a non-issue in my view.

They are very easily disturbed and don’t come back to breed.

There other places (e.g.Tiara Point ) where there is an exclusion zone of 100 meters from such nestingsites.

It doesn’t appear that people making this decision were aware of just how close these nesting siteswere.

At high tide there is only a meter or two of foreshore.

The Dotterel sites are right along a big chunk of the Eastern end of Carey Road on the other side ofthe wee creek (culvert).

It should be noted that we have Rails running around now.

As a permanent resident of Opito Bay I fully support the Council proposal to prohibit freedom campingin Opito Bay (as defined in Maps 1 & 2 of FC2015_082) and fully concur with the Council reasoningfor this proposed prohibition.

Should not the entire large reserve area in front of the houses on the seaward side of Blackjack Rd -between Skippers Rd and the Spark phone box be included in the prohibited area.The maps showonly the immediate roadside area adjacent to the phone box. The larger elevated grass area in frontof the houses is part of the reserve and is attractive for day trippers and historically the smallercampervans ( Jucy,Wicked etc) as it affords a premium view.

Access to Opito Bay via the Blackjack Road is precarious at the best of times( neglible camber, blindcorners,badly corrugated surface and deep water tables on a narrow gravel road) and damn dangerousduring the peak summer visitor season with boats ,trailers and inexperienced city and overseas drivers.

It is entirely sensible to limit the access of larger vehicles across this road. It is not practical to prohibitall large vehicles as it is after all a public road (classified even as Class1 by some in TCDC !!) but toprohibit freedom camping and hence at least the larger camper vans and motor homes is a prudentsafety mitigation.

When the proposal is adopted, to add weight to the intended prohibition, should not an informationsign be erected at Kuaotunu to give fair warning of the general road condition and advice along thelines that the road is not recommended for Camper Vans & Motor Homes.

Freedom Camping Bylaw Submission

1.0 Introduction

We are the owners of 607 Waterways Parade, Pauanui. We were significantly adversely affected by

the designation of Waterways Parade as a Schedule 2 Freedom Camping Area in the 2014 Bylaw.

We strongly support the proposed amendments to the 2014 Bylaw as proposed by Council. We are

grateful that Council has taken an early step to fine tune the bylaw.

The key factor in a positive freedom camping experience for a region, for all stakeholders, appears to

be a good bylaw. We note the difference, for example, between the positive experience in

Queenstown Lakes compared with the experience in Christchurch, which is continually in the media

for all of the wrong reasons.

On the whole, we believe the TCDC bylaw is a good bylaw. However, a small minority of property

owners are severely impacted by it, including us. It is appropriate that Council has reviewed aspects

of the Bylaw and proposes to make adjustments.

While we support all of the proposed changes, our comments relate largely to Waterways Parade,

Pauanui.

2.0 Description of the Area

� The Street and Formed Parks

Many of Pauanui’s streets are very wide (up to 18 metres). There is ample room for parking on both shoulders of the road and in most cases, on the

grassed median strip as well. In contrast, the North end of Waterways Parade (i.e. the area at issue) is one of the narrowest streets in Pauanui at eight

metres wide.

Furthermore, parking on the grass verge on the Southern side of the street is not possible because of the proximity of the footpath to the road, and there is

no median strip. The Northern side of the street is the location of the formed car parks that are described in the bylaw (“Formed Car Parks”). Those car

parks are used by:

� visitors to the adjacent reserve, including many families who visit with children to fish from the jetty, picnic on the reserve, or go

kayaking; and

� Visitors to residents-given the aforementioned lack of parking on the Southern side of the street

The Formed Parks are comprised of two blocks of parallel parks marked perpendicular to the road. There are 11 marked car-parks in total; three in the

Western block and Eight the Eastern block. It is neither a large parking nor a Reserve (a notable difference from most Schedule 2 areas), rather a small

number of parks in a residential street. In aggregate, the Formed Parks measure 33m by 5.5m

The Formed Parks are only 13 metres from residential housing (including our house). They are so close, the Draft Bylaw referred to their location by

referencing our addresses (607 and 611 Waterways Parade).

3.0 Council’s Initial Freedom Camping Proposal for Waterways Parade

In the draft 2014 bylaw, Council anticipated providing for 8 motorcampers in Pauanui. Two at Royal Billy Point Boat Ramp, two at South End Reserve and

four in the Formed Parks in waterways Parade.

We understand from the Community Board, that it was intended that the designated parks would run parallel to the road (contrary to how the Formed

Parks are marked). Most self-contained motorcampers are at least 7 meters long. Therefore 28 meters would have been required without allowing for any

maneuvering area.

That proposal would have been out of all proportion with the available area and would have looked something like this:

The resulting Designated Area would have comprised approximately 90% of the Formed Parks. At that level of coverage, the outcome would not have

protected access to the area. The primary outcome would have been to enable freedom camping-at the exclusion of other users. It would have

compromised the availability of parks to visitors to the reserve and visitors to residents.

The relevant Reserve Management Plan specifically provides that access to the area is important to enable people to fish from the jetty. It is difficult to see

how that objective can be met if sufficient parking is not maintained, particularly given the distance from the village and the fact that most people do arrive

by car as they need to transport fishing gear.

4.0 Determination of the Current Designated Area

In the final adopted 2014 bylaw, Council dispensed with prescribing the number of parks in restricted areas, instead creating flexibility to determine,

without the need for further Public Consultation, the designated areas within each Restricted Area.

The residents of Waterways Parade became aware of the bylaw after it had been made but before the Designated Area was finalized. We were able to

have input via the Community Board process into determination of the Designated Area. We were able to express concerns about access to the area and

impact on residents. The Community Board determined that the Designated Area should:

1. Allow for one motorhome only; and

2. Respect the existing markings of the Formed Parks: i.e. the Designated Area should run perpendicular to the street

Thus the current Designated Area is as below:

The current Designated Area provides greater protection of access to the area and results in a better outcome for immediately affected residents (and we

are grateful for the assistance of the Community Board in exercising discretion).

However, most campers are too long for the parks. Most motorhomes average around 7metres in length. The marked parks are 5.5 metres in length. We

have conducted a survey of the types of campers available for hire from the major rental companies (Maui, Kea, Britz, Jucy and Apollo). In aggregate they

offer 28 models of self-contained motorcampers. Of that number, 26 are too long to park in the Designated Area.

We have seen many motorhomes arrive, survey the designated area, realize that their motorcampers won’t fit, and drive off. Aside from the fact that the

parks are clearly unsuitable for this purpose, there is a risk that a holidaymaker with an oversize camper, perhaps arriving late at night, is tempted use the

park and overhangs into the street. This would create a hazardous situation with the risk that another motorist drives into it in the dark.

Whichever way the Designated Area is marked, an unacceptable outcome occurs. If the area is marked:

• Parallel to the road-a disproportionate amount of the Formed Parks would be set aside for campers and restrict access for other users; or

• Perpendicular to the road-a safety issue arises.

What all this points to, is that the Formed Parks in Waterways Parade were never a suitable location for a designated Freedom Camping area.

5.0 Impact on Waterways Property Owners

The property owners in the immediate vicinity of the Formed Parks are the most affected by the

Freedom Camping Bylaw in the whole Coromandel. As set out above, the Formed Parks are only 13

metres from our properties. Furthermore, the Formed Parks are between our properties and the

sea.

The issue is one of proximity. Because the Formed Parks are so close and because our properties are

not elevated, motorcampers would not only impede or restrict our view, they would completely

block it. Particularly if campers were allowed to park parallel to the road. All we would see from our

lounge is the side of a motorhome. We estimate that if this occurred, the value of our property

would be reduced by $100,000 to $200,000 (possibly more). While the current Designated Area is

certainly better than what was originally proposed, there is no certainty that the status quo will

continue as the Designated Area can be changed at any time. Given the wide range in outcomes

already contemplated for this site (in the space of a year) we have grave concerns that sooner or

later something less palatable (such as the original proposal) will be implemented.

Aside from the impact on our views, there are other consequences of being so close to a Freedom

Camping site, including noise and litter. While we believe that most Freedom Campers are

responsible, there will always be a small proportion (as with any bylaw) that don’t abide by the rules.

If Freedom Camping sites are a little further away from private dwellings, then the impact on others

of any non-compliance. Most of Council’s Schedule 2 sites are well away from dwellings. The

current exceptions are Waterways Parade and Te Puru.

As Freedom Camping is now enabled around the Coromandel on many thousands of hectares of

Council land, it appears to us that it was and is, completely unnecessary to allow and encourage

Freedom Camping near to houses in order to facilitate an effective and fair bylaw.

We absolutely respect that the Formed Parks are Council property and that Council is free to do with

them as it pleases. We also understand that sometimes individual’s property rights may be

compromised by either Central or Local Government when it is in the public interest and where

there is no practical alternative. For example, to compulsorily acquire land to make way for a new

road (as provided for in the Public Works Act). However, in this instance our properties have been

compromised, unnecessarily, and without any obligation on Council to see us recompensed for loss.

We would like to think that Council would not allow such a situation to occur simply because it

could.

6.0 Schedule 1 Versus Schedule 2 Protection

Waterways Parade is currently included in Schedule 2 of the Bylaw. The current Statement of

Proposal proposes that it be included in Schedule 1.

We believe that the current Schedule 2 classification for the Formed Parks is inappropriate. We

agree with Council’s proposal that the protection of the area should be way of Schedule 1

Prohibition.

� The primary reasons are that the area is simply too small and unsuitable for freedom camping.

As set out above, there are issues with access to the area, safety and fairness to neighbours

� However, there are other reasons why we believe Council should think carefully before placing a

Schedule 2 Designated Area near any housing:

� Council staff have suggested to us that as Waterways Parade is included in Schedule

2, it is afforded greater protection than if the Bylaw had been silent (in which case

camping would have been available without restriction). On one hand, that

statement is correct. However, on the other hand, Schedule 2 Areas are the areas

that Council encourages people to camp in. Council’s marketing materials list

Schedule 2 Areas as the appropriate places to camp. A residential street is not an

appropriate place to encourage camping. While campers may camp outside these

areas, it would appear that they do try and camp where they are encouraged to –

i.e. in Schedule 2 Areas.

� Schedule 2 Areas allow Council executives to make fundamental changes to

Designated Areas without further consultation. Sections 2 and 3 above demonstrate

the wide range of views of what is an appropriate provision for Freedom Camping in

Waterways Parade. The difference between Council’s original proposal and the

Designated Area ultimately implemented by the Community Board was vast.

Council has structured the bylaw in a way that allows flexibility regarding designated

areas without needing to undertake a formal consultation process. We understand

why it would want to do that and believe it is a sensible mechanism in relation to

large areas (eg. parks and reserves). However we would urge Council to think

carefully about whether such an approach is appropriate in more sensitive areas-in

particular where people’s property rights could be directly affected. We believe

property owners should be entitled to a reasonable degree of certainty.

There is no doubt or dispute that the Formed Parks in Waterways Parade need to be protected.

Waterways Parade was included in the original Section 11 analysis in relation to the 2014 Bylaw

as needing protection. It still needs protection; however the appropriate protection is Schedule

1 Prohibition.

7.0 Consistency and Adequate Provision For Freedom Camping Elsewhere

� Comparison With Other Schedule 2 Sites

Of the 35 Schedule 2 sites in the current bylaw, only two are in close proximity to housing. They

are Waterways Parade and Te Puru. They are clear anomalies.

� Treatment of Similar Sites in the Draft Bylaw

In the draft 2014 bylaw four Schedule Two sites were proposed near residential properties;

Beach Road Whangamanta, Gallagher Park Lane Pauanui, Waterways Parade, and Te Puru.

Unlike Waterways Parade, residents Beach Road and Gallagher Park Lane were aware of the

Public Consultation process and made submissions. Council listened, and Ocean Road and

Gallagher Park Lane were included as Schedule 1 Prohibited Areas in the final bylaw. Amending

Waterways Parade to Schedule 1 will be entirely consistent with the approach taken at Ocean

Road and Gallagher Park Lane.

� Adequate Provision Elsewhere in Pauanui (existing)

When the designated areas for the three Pauanui sites were being considered by the Community

Board, we understand that Council’s expectation was that there would be provision for six

motorcampers in aggregate. What has actually eventuated is seven parks in aggregate: four at

Royal Billy Point, two at South End and one in Waterways Parade. Therefore, even after

Waterways Parade is changed to Schedule 1, there will still be six parks-in line with Council’s

intention. We note that there are many nice spots in Pauanui that are neither prohibited nor

restricted already available to campers and that Council could increase the Designated Area at

South End if it so desired.

� Other Potential Sites in Pauanui

If Council considers there needs to be another Schedule 2 area in Pauanui, it should be located

at Pleasant Point. Pleasant Point is subject to a Schedule 1 Prohibition. This should be reviewed.

Pleasant Point is probably the largest reserve in Pauanui; it is away from houses and a public

toilet. Most notably, it is the only location in Pauanui that has a dumping station.

8.0 Conclusions

For the reasons set out above, we support Council’s current proposal to prohibit freedom camping in

the Formed Parks for the following reasons:

o Safety

o To Protect Access to Access to the Area

� Other residential areas

o Fairness to Property Owners in the immediate vicinity

o There are adequate sites elsewhere in Pauanui.

Submission on Freedom Camping by-law for Moore Crescent, Opito Bay :

I would like to propose the designation change from Restricted to Prohibited for freedom campingon Moore Crescent , Opito Bay, and that the area be marked in RED on the map as it was prior tothe change to restricted.

Reasons why

-To protect the reserve and the foreshaw

We have viewed the consequences on the freedom campers this year. I has destroyed the grass,caused significant erosion of the grass bank overlooking the water, and littered the beach in that area

-Health and Safety

The reserve on Moore Crescent serves as a rescue helicopter landing site. It is the most accessiblefor access in Opito, where cellphone coverage is also present(the other landing site has no cellularreception. Cellular reception is important to transmit information to the rescue and medical teams upuntil they arrive) . This year we have witnessed freedom campers hinder helicopter access on someoccasions, and on other occasions, campers being placed in possible danger from the helicopter beingnear to them and thirdly campers' possessions flying all over the beach due to the wind generated bythe helicopter.(and flying into helicopter on one occasion)

-Access to the area

The Blackjack road and the road from Otama to Opito are difficult to negotiate (narrow, gravel,unevensurfaces, blind corners, and logging trucks regularly coming to and fro). Increased heavy trafficfrom camper vans increase the risk of accident. Camper vans also get stuck on the road and needtowing away-seen last summer.This is quite an ordeal as Opito is isolated and this may block the roadfor extended periods

-Public interest

Moore Crescent reserve serves as a playground for local residents. Several local children have beenabused by campers who did not ant them playing in the area

-Security of local properties

There is no fresh water available on the reserve. Campers both in camper vans and freedom comeand help themselves to running water from the local properties,and help themselves to whats there,e.g. have afternoon tea on the decks! . We are on tank water, and if taps are not closed properly thewater not only runs out but the water pumps burn out.

An additional point:

The Reserve cannot be all things to all people.

Prior to opening it up to Freedom campers, it was the place for the day trippers (who frequently filledthe whole forefront), all the local kids to play their cricket, volleyball, touch rugby, etc…, and a landingplace for the Rescue Helicopter.

With the Freedom campers, they have expanded beyond their prescribed area every weekend oversummer, and often during the week as well. This does not leave room for the day trippers, or the otherreserve activities.

The Freedom campers need to be positioned somewhere where they will not interfere with all this,where they can access water and toilet facilities, as below – many seem not to have these themselves.

I object to the use of public land and amenities for Freedom Camping on Moore Crescent and alsoadjacent roadside and beachfront areas, and outline the reasons for my objection in the attachmentbelow. In general I feel that it is better for Freedom Campers to stay in more accessible places withsafer roads where they can be more readily supervised and where there are better facilities nearby

TCDC Freedom Camping Submission: Alison Mackrell: October 2015

SUBMISSION- to Create and ENLARGE a Prohibited Area at the Waterways Parade Stage One Estuary to include car parks & roadside parks between 606 and 633.

CONSULTATION with ME, the affected property owner- NONE since May 2014

If a PROHIBITED Area is not accepted- we DO NOT want a returned to the previous situation as it was NOT thought through by TCDC. It needs to be given more consideration

For the Greater Good of the Freedom Camping fraternity, TCDC should reconsider Pleasant Place Reserve as their Pauanui Estuary Freedom Camping area.

TCDC: Discovery & Proposal at Waterway Parade Car Parks, Pauanui

The Waterway Parade car parks are currently a restricted area in the Bylaw. Staff have raised concerns that the use of this site for freedom camping presents access issues for both residents of Waterways Parade, a narrow, short no exit street, and for users of the Pauanui Waterways Esplanade. In addition to this, there are concerns that these access issues may give rise to health and safety risks for both freedom campers and residents and ratepayers.

Staff propose that the Waterways Parade car parks in Pauanui change from restricted to prohibited in the Bylaw.

 My  name  is  Alison  Mackrell  &  my  family  bach  is  directly  opposite  the  only  Freedom  Camping  car  park  in  the  Waterways  Parade  Restricted  Area.    My  original  submission  in  2013  regarding  the  3  proposed  Freedom  Camping  restricted  areas  in  Pauanui  at  that  time  (Royal  Billy  Point,  South  End  Beach  &  Pleasant  Point)  was   Freedom Camping at stated reserves- we agree, with provisos- - NOT during 25 Dec to 10th-ish January, - limited sites, to be administered, - to be reviewed regarding rubbish & other issues that may affect neighbours & the community. Unfortunately for TCDC & us, Pleasant Place residents were excellent submission writers and their area was removed as a possible Freedom Camping Area. Might I say, Pleasant Place Reserve would still be an excellent area. Everything bought up in their submissions in 2014 as reasons why their Reserve wasn’t suitable for overnight stays, also applies to everyone who uses the Reserve during the day- large, dangerous trees, unformed carparks, flooding, no residential boundaries, lots of vehicles using the reserve, community events held there. These issues also apply to the other Pauanui Restricted Freedom Camping sites so are hardly relevant. Pleasant Point Reserve is still the best site for Freedom Camping on the Pauanui Estuary side and it is a shame the TCDC didn’t go ahead with the original plan ‘for the greater good‘ of the Freedom Camping community. Without consultation, Waterways Parade was then used as a replacement site. The lack of consultation from the TCDC is a point that we have been plagued with throughout this process- and it is verging on being devious. It is this reason we have little trust in future changes to the Freedom Camping policies that could affect us, without our prior notification. Even with these submissions being presented now- no one from TCDC or Pauanui Ratepayers have contacted me- yet I was an original submitter in 2013 & the campervan site is opposite my house. This is NOT consultation- this is hoping I don’t read the TCDC website so it slips through. Now to why I feel this proposal doesn’t go far enough. The rule as it stands is that self-contained Campers can park ANYWHERE in Pauanui on public land EXCEPT in areas prohibited or restricted (where rules apply). The Stage 1 Waterways Reserve carparks & roadside parks are in a residential street, where, at peak times, the area can be full of cars from fisher-folk using the public jetty, to reserve users, toilet users and visitors to the holiday homes. Having camper vans parked in these sites for 2 nights is going to greatly restrict local people’s access to their facilities. I would be interested to know how many Campers have been documented staying there overnight by the TCDC warden who, I know, checks 5x a week before 9am; with a security firm checking in weekends. When speaking to the only campervan I’ve seen stay at our site, they commented: Why here & not Pleasant Point? The site is only suitable for a small van.

Shame about the view- the sign is in the road We couldn’t put down steps- the sign & post were in the road I came across this- a web page to comment on Freedom Camping sites- rankers.co.nz - there was only one comment of our Waterways Parade site- by Zoe ‘A bit of a strange spot tucked away in suburbia - in a world where the houses (baches) have their own private jetty. Only room for one small vehicle so you would get it all to yourself.’ My Concern with the proposed Prohibited Area is- It only includes the 2 Carparks (read 2 car parking areas) according to the TCDC written word. In typical TCDC confusion, the map shows the 2 Carparking Areas & the roadside between. Given the TCDC 2014 Bylaw - Freedom Camping on the Coromandel says A key general approach is that all freedom campers must be certified self-contained. The bylaw includes two schedules - areas where freedom camping is prohibited at all times (Schedule One) and areas where freedom camping is restricted subject to certain conditions (Schedule Two), including where to park. Outside the prohibited and restricted areas and on local authority land, freedom camping in a certified self-contained vehicle is permitted, subject to any other controls that may be in place. This means all areas in our street other than the prohibited area can have self-contained campers parked there. The Freedom Campers don’t seem to get this. THIS IS WHAT OUR STREET COULD LOOK LIKE EVEN WITH THE PLANNED TCDC PROHIBITED FREEDOM CAMPING AREAS. (Campers superimposed on the photos)

This is the roadside between the 2 carparking areas - not sure if this is included in the prohibited area or not. TCDC information is ambiguous. Given the other restricted camping sites in Pauanui are in large parking areas away from residential homes, this outcome for Waterways Parade seems ridiciculous. The fact that people tiki-tour down our no-exit street and may need to contend with this is verging on dangerous. We frequently have adults & children on bikes, walking or running, sometimes with dogs, who use the paths & cross this road. Also from a property owners’ perspective, to have the potential for a vehicle as large as a bus to be parked across our view for 48 hours, in close proximity to our home, seems unfair. The view was of course reflected in the price of the section & therefore in our TCDC rates. These camper vans are parked here, potentially over 2 nights with no cost benefit to the TCDC.    

This  is  the  view  from  our  day  bed  window  24/7-­‐  this  sign  is  not  pleasing  .  The  positioning  of  the  sign  has  not  been  thought  through  by  TCDC-­‐  it  could  have  been  on  the  side  of  the  car  park  &  lower.

   This Submission Request should NOT be about numbers of submissions. Most people in Pauanui would say ‘so long as it isn’t in their front yard- who cares’. This area being considered only affects 5 properties in the Waterways- all in close proximity to the parked campers. It will also affect local users of the area, especially at Peak Times. Pleasant Place Reserve had about 30 properties affected and the 1-2 campers would have been parked some distance away. Yet their submissions resulted in a Prohibited area. Thank you for this opportunity to present my submission and I hope you decide that Freedom Camping in a suburban street is not the experience the Freedom Campers are looking for.  Here are some further comments for TCDC to consider:  As  pointed  out  by  a  camper,  the  sign  at  the  Waterways  car  park  doesn’t  even  make  sense.  It  says    ‘between  arrows’  but  there  is  only  one  park  available.   Pleasant Point Reserve photos- yes, the Freedom Camping dumping facility is there. But you can imagine people missing the sign saying NO Freedom Camping. ↓

Also earlier, when reviewing the 2014 Bylaw I noticed what I assume are errors. South End Reserve- Restricted - said 51 Pauanui Beach Rd- this is confusing & should read ‘opposite 76’ - 12 m long= 2 parks (long was omitted) Royal Billy Point Reserve- Restricted - The blue map shows the restricted area from El Dorado Leader around to the air sock at Pauanui Boulevard. But it states- Restricted area is 1A Vista Paku and 110 Tangitarori Lane. However Tangitarori Lane is up the estuary & is covered by the Pauanui Waterways Esplanade prohibited map - 15m wide= 4 car parks (wide is omitted) Access- if their official Freedom Camping spots were taken by local people parked to go to the beach during the day, as the car parks are often full during peak times, can the Freedom Campers park elsewhere in the restricted area, set up camp and not get fined? Just some thoughts from reading the TCDC information & signage

Council has proposed that the restriction of the area between Tatahi Street and Aputa Avenue,TePuru in the Freedom Camping Bylaw 2014 continue.

Carol & I own 26 Aputa Avenue Te Puru, where we have lived for 10 years. Our property adjoins thereserve between Tatahi St and Aputa Avenue. The designated Freedom Camping area extends forthe full length of the boundary between our property and the Reserve. It does not currently extend toadjoin any other private property. The area is plenty large enough to accommodate the current usageof up to 5 self-contained vehicles at any one time. As a member of the NZMCA for over 10 years, Iapproach nearly all of these vehicles and offer advice support and fellowship. In my 10 years experienceof living alongside this reserve both before and during the Total Ban on Freedom Camping and withthe current rules since Dec 1st 2014, I have never observed any Self-contained Freedom Camperleaving rubbish or abusing our beaches. I have, however, observed day trippers and local residentslittering the reserve and loading the rubbish bins with trash. It is difficult to quantify the DOG problemin this reserve as it is used by a large number of dog walkers who arrive on foot and by car from farand wide. Many of these dogs are allowed to run free with very little control and the resulting foulingof the reserve and indeed my own lawn, is sadly apparent. The current "Dogs on Leads Rules" applyfrom Labour Weekend to March 15t and as there are endangered Dotterels nesting in the area wellbefore those dates and in view of the poor control that many owners have over their dogs, I wouldencourage the TCDC to extend the Dogs on Leads Rules throughout the year. This would not onlyremove the excuse many dog walkers use for not cleaning up after their dogs, but would also removethe perceived, though miniscule, problem of dogs belonging to Freedom Campers being out of control.I am in full support and congratulate the TCDC for their current Freedom Camping rules. This is sucha change from the period of Total Ban and encourages us all to believe that our administrators cansee sense when given the right incentives. It is of interest to note that there are a multitude of placesnot otherwise designated, where a Self-contained Freedom Camper may safely and legally stay

overnight. This information is hidden behind layers of overlapping regulations and will be difficult tounravel. It would probably be much more acceptable to the humble ratepayer, if designated freedomcamping spots were easier to find and administered in a more friendly way rather than having FreedomCampers, legally parking overnight in residential streets.

In my 10 years experience of living alongside this reserve both before and during the Total Ban onFreedom Camping and with the current rules since Dec 1st 2014, I have never observed anySelf-contained Freedom Camper leaving rubbish or abusing our beaches. Why is the Tapu Camp surrounded to its boundary by the blue camping? There are 2 reserves in Tapuand both have marked off freedom camping areas. Why can't places like Waikawau Flat coloured redthat is out of every ones way, or the reserve up the Temata creek coloured red be used. Tapu has twocamping grounds within 3 kms of each other. This should be enough camping area in Tapu. I wouldlike to speak on this as there are 2 sides

At present, only one CSC campervan is permitted to freedom camp within the restricted area. Thereason behind the proposed prohibition is not entirely clear. For example, Scott Summerfield’s reportto Council confirms that nearby property owners (i.e. the Brew Family Trust) are unhappy with the useof one car park for freedom camping, suggesting this has created access issues, and have also soughta judicial review. Paul Davies’ report to the Tairua-Pauanui Community Board confirms that followinga summer review (as agreed to by the Trust) there were no issues with freedom camping that wouldwarrant further prohibition. Council officers are comfortable with the way the site has been operatingso far. We support Paul Davies’ recommendation to the community board that the car park remainsavailable for CSC freedom camping. As a compromise, the community board could relocate the siteto an adjacent car park (within the restricted area) without requiring further consultation.

INTRODUCTION

1. The New Zealand Motor Caravan Association appreciates the opportunity to

submit on the draft amendments to the freedom camping bylaw (the FCA

bylaw) and the proposed standards of camping bylaw (the SOC bylaw). Many of

the NZMCA’s 60,000 members share a passion for exploring the Coromandel at

leisure in their certified self-contained (CSC) motorhomes and caravans. Both

bylaws will have an impact on the ability for NZMCA members to explore the

district at their leisure.

2. Since passing the FCA bylaw in 2014, the Council has welcomed responsible

campers in CSC vehicles. We acknowledge freedom camping is an historical and

contentious issue across the Coromandel, and therefore commend the Council

for making a concerted effort to provide responsible campers with more

freedom camping opportunities.

3. We note the Council’s preference for private land owners to accommodate

campervan visitors in order to reduce demand and alleviate pressure on local

authority areas. Whilst the SOC bylaw sets a district-wide standard that aims to

protect public health, the bylaw will affect the ability for many private land

owners to accommodate campervan visitors (staying free of charge) in line with

the Council’s preferred approach.

4. The FCA bylaw statement of proposal is silent on the reasons supporting the

proposed amendments to each of the six local authority areas. Therefore, we

have relied on various officer reports to help understand the prevailing issues

triggering this review. Reports include (as attached);

6. The NZMCA generally supports the proposed SOC bylaw in part only.

We make the following recommendations:

a) Exempting CSC vehicles from the sanitary provisions; and

b) Inserting an additional clause providing the Council’s CEO with

discretionary power to waive certain requirements on case-by-case basis.

COMMENTS ON THE FCA BYLAW

general restrictions. Understanding the community’s desire to protect the area

and access to the area, we submit a more appropriate response to the

perceived problem is to restrict freedom camping to defined areas. This

approach is consistent with other Council and community board decisions.

9. As the below photo demonstrates, a typical campervan can park safely on site

without damaging low hanging Pohutakawa or compromising traffic safety.

For example, Scott Summerfield’s report to Council confirms that nearby

14. We support the Council’s proposal to continue allowing restricting freedom

camping on site.

COMMENTS ON THE SOC BYLAW

15. The NZMCA generally supports the purpose and scope of the SOC bylaw.

However, it is unclear whether camping in a CSC vehicle complies with Section

6 and Schedule A of the bylaw. If not, then despite CSC vehicles providing on-

board ablution facilities to accommodate each vehicle occupant, property

owners must also provide un-restricted access to additional on-site sanitary

facilities. This requirement seems superfluous to the purpose of the bylaw.

16. Requiring private property owners to effectively open their dwellings to each

CSC campervan visitor will discourage participation in the NZMCA’s park over

property scheme. This is counter-productive insofar as the Council’s preferred

approach is concerned. We submit CSC camping should be exempt from the

sanitation requirements. The CGR’s allow local authorities to make similar

exemptions, and therefore similar provisions should apply here.

17. We also recommend inserting a clause that enables the Council’s CEO to waive

certain requirements on a case-by-case basis. This provision is similar to the

FCA bylaw where people can apply for waivers to certain restrictions and

prohibitions.

18. The NZMCA would appreciate the opportunity to speak to this submission and

elaborate on the above points.

My niece and her family have a property at 609 Waterways Parade and I am a frequent visitor whenI travel to an apartment I own in Whitianga.I find that parking outside the property is difficult at mosttimes and I mostly have to park in the area allotted to motorhomes opposite. At times this is also notpractical, particularly if large vehicles are present. Large vehicles are forced to parallel park thus takingthree of the spaces available.I am not against freedom parking per se and I feel Council should supportit where possible as the economic advantages to the area are numerous. I am of the opinion howeverthat there are more suitable areas in Pauanui which have wider roads, better access and larger parkingareas.I trust Council will give due consideration to this submission and decline consent for freedomcamping in Waterways Parade.

We are opposed to all forms of freedom camping in the Waterways area.

Every time they come and stay they leave rubbish and behind.

The last group that stayed close the board walk side of the waterways where found on private propertyusing the seats and hammocks. And when asked to leave they became abusive and rude.

There are plenty of places around the Coromandel people can stay without it impacting on rate payersprivate properties.

General comments

Firstly I should say that I am a member of the Petone Community Board and have been a membernow for 20 years. I also served two terms as Chair and one term on the NZ Community Boards ExecutiveCommittee.

The Hutt City Council, of which the Petone Board is part of, doesn’t have a Camping standards by-law.Nor do we have areas set aside to ‘freedom’ camp.

I would tend to the view that if these matters came up of not to have by-laws relating to campingstandards and ‘freedom camping’. I would be generally of the view that by--laws should cover mattersonly relating to the public good.

Laws should be sensible and enforceable. By-laws should not contain provisions that cannot bereasonably implemented or are a restriction on the rights of private persons without any due cause.

‘Freedom’ camping. There are some issues with how TCDC enforces the current ‘Freedom’ Campingby-law.

This by the way is a restriction and has nothing to do with the word ‘freedom’ and rather is the completereverse.

A station wagon with camping gear parked on the side of a country road with the occupants nowhereto be seen is deemed to be evidence of illegal camping and they are subject to a fine.

This I would suggest turns justice on its head. Evidence is evidence. Evidence deemed to be evidenceis not evidence.

Also at Christmas I heard stories of Council inspectors giving warnings at 6pm to the occupants ofvehicles, not self-contained, at one of the popular beaches, deemed (that word again) to be intendingto stay overnight, that if they are still there at 8pm they will be fined.

This kind of thing gives the Council a bad name.

In the past Council’s just declared that there was to be no camping at certain places and put up signsto the effect. They also didn’t go around looking for offences.

The position of the TCDC is unduly harsh and unreasonable. The right to camp is a Kiwi traditionenjoyed by generations. Anyone who has had any degree of outdoor training such as through theScouts will know how to dig a latrine and the importance of removing rubbish, proper hygiene, controllingfire , building a shelter and so on. Rather than handing out penalties to overseas travellers, the answermight be just education and working with Backpacker hostels and Immigration to educate youngtravellers on the basic requirements of camping.

Also could I finally raise an issue with respect to the road rules. These stipulate when you are tiredyou stop driving, but in the TCDC district this would be deemed to be illegal camping should you spendthe night on the side of the road. I do know of a case where a group of poor young people were finedby another local authority (Queenstown and Lakes District) for exactly this. This, I would suggest, isa case of where the Power of General Competence is exceeded : Council’s do not have the power tooverturn Acts or Regulations.

I would urge a complete re-think with respect to the two by-laws. I am not in favour of the changesmooted. Furthermore I do not support any by-law relating to camping standards and ‘freedom’ camping.

General comments

There is a need to review and realign standards for camping in the District. However if the new rulesare made too restrictive the effect will be to turn many potential tourists away from theThames-Coromandel District which has long been recognised as a great destination to experiencethe idolised New Zealand camping holiday.

Control of Roadside Camping: We note that no more Freedom Campsites have been allotted to thePort Jackson Road.That has been a very wise decision. As we have discussed on previous occasionsthe threat of fire in the Pohutukawa trees that line the coastal fringe is very great. In our experienceall category of camper is liable to light a picnic or campfire and it doesn't matter to some that there isprobably a total fire ban in place.

Random roadside camping is still taking place all through the year. Most of the vans, cars and utesthat are used for camping are not equipped with toilets and there are no toilets or waste disposalfacilities provided along the Port Jackson road. Pohutukawa trees, flax, and other shrubbery both onthe roadside and in private property and private driveways, stock yards, roadside sheds are used astoilets and rubbish dumps.Toilet facilities are provided in the DOC camp grounds but those who chooseto camp on the roadside do not want to stay in designated camp grounds.

Another form of roadside overnight parking/camping that is building in volume up here are over nightfishers". They do fish at night but also stay parked up all day as well and over long holiday weekendsthis can amount to four or five days.

To stop the escalation of random camping and a return to the situation of camping being a generalfree for all as it was in the past along this road; TCDC needs to go back to having an enforcementofficer readily available to manage the perpetrators.

There is a need for such an officer to be stationed much closer. Coromandel is far enough away foran effective officer to be travelling into this area. They need to be on site early in the daylight hours

and/or before dark in the evening. Arriving here in the middle of the day is not effective. Early intervention is by far the most effective. Officers stationed in Whitianga and Ngatea are a way too far away to deal with problems on the northern end of the Peninsula. Cost is always the top Submission when it comes to officers being appointed. Travelling costs to send vehicle and officer from Whitianga and Ngatea adds considerable travelling cost. Early intervention is by far the most effective and in the long term would resolve the problem and reduce future costs of such a service.

Council has proposed to prohibit the sites at Opito Bay Road and Skipper Road Reserves, Opito Bayin the Freedom Camping Bylaw 2014.

I do not believe it is the role of Councils to provide free camping for any person, and I strenuouslyobject to freedom campers at Opito Bay.

The purpose of local government is defined in the Local Government Act 2002 as follows-

1 To enable democratic, local decision-making and action, by and on behalf of communities; and2 To meet the current and future needs of communities for good quality local infrastructure, local

public service performance of regulatory functions, in a way that is most cost effective forhouseholds and businesses.

Offering free foreshore camping sites to bus and van owners, and rental companies, does not meetsthese purposes.

We live in a user pay world. It is not Council’s role to supply free camping areas to bus owners andrental vehicle companies, or any other party. Residents and rate payers, of any area should be allowedthe quiet enjoyment of their property, and the views they pay for, by way of property prices and ratesthereon. Such residents should not have to put up with an array of vehicles littering landscapes andforeshores, and the rubbish they leave in their wake.

All New Zealanders should have the right to picnics and day trips, but there should be no free lunchesfor the owners of old buses and rental vehicles, the inhabitants of which, in general show little respectfor the environment in which they camp.

If areas are to be made available for freedom campers, then they should not be in strategic foreshorepositions such as Opito Bay; they should be in sidling areas, and there should be a user pay charge.

There have obviously been serious problems at Moore Reserve at Opito Bay. Those problems willnot be resolved by moving freedom campers to Stewart’s Stream; such action will merely move theproblem, and it will create division amongst the residents of the Bay; if they don’t want them downthere, why would we want them at Stewart’s Stream.

Some years ago, there was a move to put the mo-lock rubbish system in the picnic area at Stewart’sStream at Opito Bay; the passage of time shows that this would have been an absolute nightmare,as despite the assurances at that time, that mo-lock system is still a very messy smelly area. Stewart’sStream was not appropriate for rubbish collection, and it is not appropriate for freedom campers.

Living close to Stewart’s Stream, there are few days during which we are in residence that we do notpick up rubbish from either the beach or the picnic area at Stewarts’s Stream. We do this by choicebecause we love and are passionate about the area, and while I believe every New Zealander hasthe right to picnic, there should not be a right of free camping. We do not want buses, campervansand other vehicles parked up for indefinite periods of time on our foreshore, and we definitely don’twant the rubbish that they leave behind.

Households and businesses fund Councils and are the community. Freedom campers make minimalcontribution to any community, and they make absolutely no contribution to Opito Bay. Because of thefree parking offered by councils, their numbers are increasing and a stand must be taken.

There is absolutely no benefit to anyone in Opito Bay by allowing freedom campers on our foreshore.

Councils should be supporting private business within their communities such as camping grounds;they should not be competing with them, by providing free camping facilities.

I believe there should be a total prohibition on freedom camping in Opito Bay.
