Introducció: el TTIP i els seus efectes
L’Acord Transatlàntic de Comerç i Inversions (TTIP, en les seves sigles en
anglès) és una veritable ofensiva neoliberal. Una manca total de transparència
caracteritza les negociacions del que es vol presentar com un acord per
potenciar la cooperació entre els Estats Units i la Unió Europea. Però el
transfons, no explicitat, és el d’enfortir les grans corporacions i soscavar el
poder dels governs.
El TTIP és més que un acord per fer possible el lliure comerç: es tracta d’obrir nous mercats
donant la possibilitat de liberalitzar i privatitzar els serveis públics. Degradar els drets laborals,
encara més. Suavitzar les normatives europees en matèria ambiental. Fer possible que productes
agrícoles o ramaders avui prohibits a Europa puguin entrar sense problemes. Reforçar les
patents farmacèutiques. Desregular de forma definitiva el sector financer. I un llarg etc. Les
perspectives són doncs terrorífiques si el confronta amb aquell vell “model social europeu” que
actualment s’està polvoritzant.
Els tribunals d’arbitratge, pensats per resoldre les disputes entre inversors i Estats, són un
veritable atac a la democràcia. S’atorga de fet a les corporacions el poder qüestionar decisions
democràtiques preses pels Estats i demanar indemnitzacions si consideren que els perjudiquen o
fan disminuir beneficis. Exemples d’aquests n’hi ha molts, especialment a Latinoamèrica.
No sabem prou encara què comporta el TTIP, però sí sabem que afectarà greument a la nostra
societat i a les nostres vides. Per això és important conèixer més a fons en què consisteix el
Tractat i les seves conseqüències. Els articles que trobareu en aquesta publicació donaran llum a
molts dels interrogants que avui ens plantegem.

En el marc del Dia d’Acció Global contra el Fracking i el TTIP (Transanlantic Trade
and Investment Partnership), es va organitzar a la ciutat de Barcelona les jornades
“No al TTIPP” sota el lema: Sobirania segrestada – Drets en perill. Les jornades, van
comptar amb la col·laboració de la Universitat de Barcelona; El Grup de Recerca
sobre Exclusió i Control Social (GRECS); i el Centre de Cultura Contemporània de
Barcelona (CCCB).
A través d’una visió global i crítica, es va parlar i debatre sobre els impactes del
Tractat de Comerç i Inversions que s’està negociant entre la Unió Europea i Estats
Units. Reflexions que van comptar amb la participació d’importants acadèmics i
professionals, entre els quals s’hi trobava Susan George del Transnational Institute i
Attac de França.

Moltes gràcies. Vull donar les gràcies a totes les organitzacions de la coalició contra el TTIP de
Catalunya.
Aquest acte se celebra a tota Europa. El 10 i l'11 d'octubre se celebraran de maneres diferents a
gairebé tots els països europeus.
El TTIP és un tema especialment important, perquè afecta tots els països i empitjorarà les vides
dels ciutadans de tots els països europeus en cas que s'aprovi. I entre aquesta nit i demà rebrem
moltes notícies dolentes, perquè el TTIP en comporta moltes. Per això, voldria començar dient
que aquesta és una batalla que podem guanyar. I, com que m'han demanat que parli del context,
acabaré parlant sobre per què guanyarem. Però vull recordar que això forma part del context.
Estem carregant les armes per a aquesta lluita, i hem d'aprendre a utilitzar-les tots junts. Però
crec que podem fer-ho i que podem vèncer les persones que desitgen aquest tractat i que ens
volen desafiar.
Però primer deixeu-me que us parli del context. Ho faré en tres parts. En primer lloc, el context
és geopolític. Seguidament, adopta una estratègia a llarg termini d'una població multinacional a
ambdós costats de l'Atlàntic. I, finalment, hi ha un context a l'oposició europea.
Així doncs, sense més preàmbul, parlaré de manera molt ràpida del context geopolític. Potser
sabreu que, al mateix temps que el TTIP, també s'està negociant l'Acord Transpacífic, procés
que va començar dos anys abans que el Diàleg i la Col·laboració Transatlàntics. Ara mirem-nos
el món: Aquí tenim el Pacífic, aquí els Estats Units i aquí Europa. Si els Estats Units
aconsegueixen aprovar els dos tractats, llavors tindran una posició de privilegi aproximadament
en dos terços de totes les transaccions comercials, i aproximadament tres quartes parts del PIB
del món, perquè s'hi inclou el Japó, i els Estats Units i Europa tenen els majors PIB del món.
D'aquesta manera, i si ho tenim tot en compte, això implica una enorme concentració de la
indústria. No obstant això, també sabem que s'han exclòs els BRIC. El Perú s'inclou al tractat
del Pacífic, però els BRIC s'han exclòs: el Brasil, la Xina, l'Índia, Rússia i les grans economies
comercials han quedat fora. I, per suposat, també s'està fent l'esforç geopolític d'excloure la
Xina. Per què? Doncs perquè si els americans i els europeus ho poden aconseguir tot per a les
seves empreses en particular, llavors, en tenir el control sobre tant de comerç i PIB, serà molt
més fàcil dir a la Xina, l'Índia, el Brasil, etc.: "O bé accepteu exactament les mateixes coses que
contenen aquests dos tractats, o se us anirà marginant gradualment". Aquest és el missatge. I la
Hilary Clinton ha dit: "Aquest tractat té tant a veure amb la geopolítica com amb el comerç".
Quan ho va dir era la Secretària d'Estat, i això ho hauríem de tenir present. I també hauríem de
tenir present per a qui s'està negociant.
I això em porta a la segona part del context. (I us demano perdó, tinc la gola molt malament i no
us espanteu si començo a tossir…)
El tractat és un pla a llarg termini de les empreses dels Estats Units i Europa. No tinc dades
sobre les empreses d'Àsia, potser tenen un pla similar. No ho he pogut documentar
personalment. Només m'he centrat en les grans empreses dels Estats Units i Europa. Però unes
70 empreses es van agrupar el 1995 en una nova organització que treballava a petició del
Departament de Comerç dels EUA i la Comissió de Comerç Europea. I es van ajuntar a partir de
les seves pròpies organitzacions, que a Europa era la Taula Rodona Europea d'Industrialistes i
que ara s'anomena BUSINESSEUROPE, que llavors es deia UNICE. Als Estats Units, venien
d'organitzacions similars de les taules rodones empresarials, com la Cambra de Comerç dels
EUA. I sabem que el mateix any, el 1995, es va crear l'Organització Mundial del Comerç. A
més, des del principi el Diàleg Empresarial Transatlàntic fou una operació política i, si entrem a
la seva pàgina web, es pot veure que no ho mantenien pas en secret. Des del principi ja deien:
"Aquí tenim una organització política, i estem treballant en completa harmonia amb els nostres
representants d'estat respectius, que ho estan enllestint en representació nostra, les empreses
multinacionals”. Així, tenim 70 empreses que es reuneixen, les més grans, de tota mena de
sectors, de tots els àmbits, empreses farmacèutiques, químiques, d'advocats i consultories,
empreses molt grans. Totes les principals indústries, i també el gas i el petroli, per suposat. I tots
junts van crear grups de treball. I en què van treballar? Per suposat, volien parlar sobre els
aranzels, encara que no són gaire alts ni als Estats Units ni a Europa. De mitjana són d'un dos o
un tres per cent. També van parlar de les normatives sobre inversions. Ara no parlaré
d'inversions, però el procés d'arbitratge de diferències estat-inversor, l'ISDS, és un dels grans
elements de preocupació d'aquest tractat. Sobretot van parlar de normatives, sobre el que volien
eliminar en l'àmbit de les normes. Els americans es queixen constantment que Europa té una
manera de regular completament estranya i contrària a la ciència, i que aquí s'utilitza allò que els
americans anomenen “Suport d'advertiment”. I que això no tenia cap mena de sentit. I que no hi
havia res de dolent en els OMG (Organismes Modificats Genèticament), ni en el fet de donar
hormones a les vaques, i que tampoc no passava res amb uns 70.000 o 80.000 productes químics
que s'estaven escampant lliurement pels Estats Units, i que per què no se n'havia de permetre
l'ús a Europa, etcètera, etcètera.
Per tant el context principal era el negoci, desenvolupar una sèrie de demandes comunes
juntament amb els seus negociadors estatals oficials. El significat sempre ha estat el negoci, un
negoci a molt gran escala. I sempre hi han estat per dir: "Volem això, allò i el de més enllà". I, a
totes les àrees, sempre han fet les propostes inicials. Ara, com ja sabeu, aquest tractat s'està
negociant en secret. Els nostres representants al Parlament Europeu no tenen dret a veure els
textos. Els en parla el Comissari, fins ara Karel de Gucht. Es convoca els parlamentaris del
Comitè de Comerç a una sala, on Gucht explica en anglès, sense traducció, allò que els volia dir.
Però res més. No poden veure cap mena de document, i encara menys fer-ne una còpia, i no ho
poden debatre en públic, tot això es fa en secret. Els nostres representants no tenen ni la més
mínima idea del que està passant. Així, una part del tema que estem debatent aquí és
condicional: no tenim informació detallada. El que sabem és que les empreses sempre han
plantejat una sèrie de demandes que diuen que no es poden negociar. "Si no aconsegueixo
aquest ISDS no seguiré el vostre joc". Saben el que volen, i hi treballen tots junts.
Per això, l'únic obstacle que es troben pel camí –i aquest és el tercer element del meu context–
som nosaltres. Nosaltres, tots nosaltres. Com que saben exactament allò que volen ho mantenen
en secret, i pensaven que podrien anar endavant i fins i tot imposar el silenci sobre aquest any.
Ara uns diuen que s'haurà d'esperar fins al 2015, i d'altres que fins al 2016. Però s'equivoquen,
perquè, encara que pensen que han fet tot el que poden en secret, se n'han revelat prou detalls.
Per tant, els europeus i els americans estan molt alarmats. I estan alarmats sobre allò que passarà
amb el medi ambient, la salut, l'educació, i tot el que s'ha assolit en democràcia a gran part
d'Europa des de la Segona Guerra Mundial, i a Espanya i Portugal i Grècia des del final de les
seves dictadures. Tots ells són el seu objectiu. Si se signa aquest tractat deixarà d'haver-hi
democràcia, o només n'hi haurà en zones molt reduïdes i restringides. El fet és que volen
dominar la judicatura, volen controlar la funció legislativa, les normes i els processos
determinants. I posaran la por al cos als executius sobre noves lleis democràtiques. També volen
tornar-s'hi amb els treballadors. Aquest tractat va clarament en contra dels treballadors.
Aquest, doncs, és el context. I el context del fet que nosaltres som un obstacle en el seu camí,
vosaltres i jo i totes les altres persones que s'assabentaran d'aquest tractat, que no en saben res
ara, però que n'obtindran més informació gràcies als nostres esforços, i a través del ressò que en
farem. I també gràcies als mitjans que publiquen una bona història quan la veuen, perquè
aquesta és una bona història.
Gràcies a tot això, estic segura i crec fermament que podem guanyar. Alguns de vosaltres potser
recordareu –tot i que no tots sou prou grans— el MAI, l'Acord Multilateral sobre Inversió, del
1997 al 1998. Només contenia més o menys la meitat del que conté ara el TTIP, però ja era
perillós. Però, quan la gent en va sentir parlar, quan van saber què hi havia dins aquesta cambra
obscura, en aquest MAI, van dir: "No, això no ho permetrem!". Així, es van fer moltes
protestes, sobretot a França, on vam començar amb tot això, entre els ciutadans francesos. Al
final el govern va dir: "No necessitem això", i es va fer enrere i tot es va desmuntar. El TTIP és
més complicat, però també estem més ben organitzats. Com a europeus tenim una millor
organització, perquè en els darrers 20 anys hem après a treballar amb altres grups europeus.
L'ATTAC és un bon exemple. Tenim l'ATTAC europea, i tenim l'hàbit de col·laborar en els
mateixos temes.
Per això, us vull dir el següent: Penseu en Dràcula, penseu en el vampir. El vampir, quan
s'exposa a la llum del dia, no pot viure. Es marceix i mor. I aquesta és la nostra feina: lluitar
contra aquests Dràcules i treure aquest vampir a la llum, a plena llum del dia, davant de tota la
gent que puguem. D'aquesta manera, garanteixo que quan la gent sàpiga què conté aquest tractat
i què suposa per a tothom, per als seus fills, la seva salut, el medi ambient, la feina i el futur,
s'asseguraran que el vampir s'arrugui i torni al taüt, i finalment podrem tornar a un terreny
democràtic.

Thank you very much. Thanks to all the organizations of the anti TTIP-coalition here in
Catalunya.
This is a Europe-wide event. The 10th and 11th of October are going to be celebrated in
different ways in almost all European countries.
The TTIP is a particularly important issue, because it does cover every single country
and will make the lives of the citizens in all European countries worse if it passes. And
we´ll be getting a lot of bad news tonight and tomorrow, because the TTIP contains a lot
of very bad news. So I would like to start by saying that this is a battle that we can win.
And since I have been asked to speak about the context, I will end on why we´ll win.
But I want to remember that this is part of the context. We are locking out our weapons
for this fight, and we must learn how to use them together. But I think that we can do
this and that we can beat the people who want this treaty and who want to fight back.
Let me give you the context first. I will do this in three parts. The context is, first of all,
geopolitical. Next, it takes a long-term strategy of a transnational population on both
sides of the Atlantic. And finally, there is a context in the European opposition.
So, without any further introduction, let me try to be very quickly with the geopolitical
context. You may know that, at the same time as the TTIP is being negotiated, the
Trans-Pacific Partnership is also being negotiated - it began two years earlier than the
Transatlantic Dialogue and Partnership. Now just look at the world: Here you have the
Pacific, here you have the United States, and here you have Europe. If the United States
can manage to pass both of these treaties, they will then have the central place in
approximately two thirds of all trade transactions, and about three quarters of the
world’s GDP, because Japan is in this, and the United States and Europe have the
largest GDPs in the world. So if you put it all together, it means a tremendous industry
concentrated. However, we know also that the BRICs are excluded. Peru is in the
pacific partnership, but the BRICs are excluded: Brazil, China, India, Russia, the large
trading economies are out. And of course there is also the geopolitical effort to exclude
China. Why? Because if the Americans and the Europeans can get everything for their
companies in particular, then, if they have the control over so much trade and so much
GDP, it will be far easier to say to China, to India, to Brazil, etc.: ‘Either you accept
exactly the same things that are in these two treaties, or you will be gradually
marginalized.’ That is the message. And Hilary Clinton has said: ‘This is a treaty which
is as much about geopolitics as it is about trade.’ She was Secretary of Stare when she
said that – we should remember that. And we should also remember who it is being
negotiated for.
And this brings me to the second part of the context. (And please forgive me, I have a
very bad throat, so if I start coughing, don´t be alarmed …)
The treaty is a long-term plan of the corporations in the United States and in Europe. I
don’t know about the corporations in Asia, maybe they have a similar plan. I have not
documented that for myself. I only worked on the large corporations in the US and in
Europe. But there about 70 corporations came together in 1995 in a new organization
which was working at the request of the US Department of Commerce and the
European Commission for Trade. And they came together from their own organizations,
which in Europe were the European Round Table of Industrialists and what is now
called BUSINESSEUROPE, which then was called UNICE. And in the United States
they came from similar organizations of the business round tables there, like the US
Chamber of Commerce. And we know that the same year, 1995, the World Trade
Organization came to existence. And the Transatlantic Business Dialogue was from the
very beginning a political operation, and if you look at their website, you will see that
they were not secret about this. They said from the very beginning: ‘We have a political
organization here, and we are working in complete harmony with our respective state
representatives, who are closing it for us, the transnational corporations”. So you have
70 companies that come together, the largest ones, from all kind of sectors, from all
spheres, pharmaceuticals, chemicals, lawyers and consultant companies, very large
firms. Every major industry, also oil and gas, of course. And they went into working
groups together. And what did they work on? Of course they wanted to talk about their
tariffs. But tariffs aren’t very high in the United States and Europe. Their average are
two or three percent. They also discussed regulations on investments I won´t go into
investments right now, but the Investor State Dispute Settlement, ISDS, is one of our
very big worries in this treaty. What they most did talk about was regulations, about
what they wanted to get rid of in the realm of regulations. The Americans complaining
constantly that Europe has a completely bizarre and anti-scientific way of regulating,
that they use something what the American called the so called “Cautionary support”.
And that this was total nonsense. And that there was nothing wrong with GMOs -
Genetically Manipulated Organisms- , and feeding hormones to the cows, and that
there´s nothing wrong with 70.000 or 80.000 chemicals, that were freely weeping
through all over the United States, and why would they not be allowed in Europe,
etcetera, etcetera.
And so the main context there was business, developing a common set of demands
along with their official state negotiators. The meaning has always been business, a very
large business. And they have been there to say: ‘We want this, this and that.’ And in
every area, they have made the initial proposals. Now as you know, this treaty is being
negotiated in secret. Our representatives in the European Parliament have no right to see
the texts. They are told by the Commissioner, until now this is Karel de Gucht. The
parliamentarians who are in the Trade Committee are being led into a room, where de
Gucht explains in English, with no translation, what he wants to tell. But nothing more.
They can’t see any documents, much less copy them, and they cannot debate on it in
public, all this goes on in secret. Our representatives have no idea of what is really
going on. So part of what we are talking about here is conditional: we don´t know in
detail. What we do know is that the corporations have always set up a certain number
of demands which they say are not negotiable. ‘If I don´t get this ISDS I won’t play
your game’. They know what they want. And they work it out together.
So the only thing that is in their way - and this is the third element of my context – the
only thing in their way is us. Us – all of us. Because they know exactly what they want,
they are keeping it secret, they thought they could brace through and lay even silence
over this year. Now they say it will take until 2015, and others say 2016. But they are
wrong with this. Because even though they have done everything they can in secret,
enough has leaked. So the Europeans and the Americans are very alarmed. And they are
alarmed about what will happen to the environment, to health, to education, to all of the
gains of democracy which have been established in most of Europe since the Second
World War, and in Spain and Portugal and Greece since the end of the dictatorships.
They are after all of them. There will be no more democracy if this treaty is signed, or
only in very small and restricted areas. Because they want to take over the judiciary,
they want to take over the legislative function, of determinant rules, and processes. And
they will scare the executives to death about any new democratic laws. They also want
to get even with labour. This is a very anti workers treaty,.
So that is the context. And the context of the fact that what is in their way is us, you and
me and all the other people who are against this treaty, and all the other people who will
learn about this treaty, who don’t know about it now, but who will learn about it
through our efforts, and through our work in publicising this. And through the media
that publish a good story when they see one - because it is a good story.
Thanks to all of this, I am sure and I really believe that we can win. Some of you may
remember – not all of you are old enough -, the MAI, the Multilateral Agreement on
Investment, 1997 – 1998. And that contained only about half of what TTIP contains, but
it was dangerous. But when people heard about it, when they learned what was in this
darkroom, what was in this MAI, they said: ‘No, we won´t let that pass!’ So there were
so many protests, particularly in France, where we started all of this, among the French
citizens. The government just said finally: ‘We don´t need this’, and they pulled out of
it, and the thing collapsed. The TTIP is more difficult, but we are also better organized.
As Europeans we are better organized, because over the last 20 years, we have learned
to work with other European groups. ATTAC is a good example. We have the European
ATTAC, we have a routine to work together on the same issues.
So I want to tell you: Think of Dracula, think of the vampire. The vampire, when it is
exposed to the light of day, cannot live. It shrivels and dies. And that´s our job: to fight
this Draculas back and show that vampire in the light, in the broad daylight, to as many
people as we possibly can. And that way I guarantee that when people learn what is in
this treaty and what news is there for them, for their children, for their health, for their
environment, for their work and for their future, they will make sure that the vampire
shrivels and gets back into the coffin, and we will finally get back to democratic soil.
