TRANSFER NOTICE Southern SEQ Distributor-Retailer Authority Transfer Notice No. 1

1 Water infrastructure and other assets 1.1 Water infrastructure and other assets

Pursuant to section 62 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities, transfer from Gold Coast City Council to Southern SEQ Distributor-Retailer Authority the water meters and wastewater rising mains of Gold Coast City Council set out in the Transfer DVD with effect on the Transfer Day.

1.2 No transfer of land or interest in land Despite an asset transferred under this clause 1 being attached to (or otherwise forming part of) any land, nothing under this clause 1 transfers any land or interest in land.

2 Further assurance Pursuant to section 65 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities, direct and require that:

(a) Southern SEQ Distributor-Retailer Authority and its board; and

(b) Gold Coast City Council and its officers,

each do all things (including the execution of instruments) necessary, incidental or ancillary to give effect to this transfer notice.

3 Interpretation 3.1 Definitions

In this transfer notice:

SEQ Water Act means the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009 (Qld).

Southern SEQ Distributor-Retailer Authority means Southern SEQ Distributor-Retailer Authority, a distributor-retailer established under section 8 of the SEQ Water Act.

Transfer Day means the day this transfer notice is gazetted.

Transfer DVD means the DVD labelled “Southern SEQ Distributor-Retailer Authority Transfer Notice No. 1 - Transfer DVD”, a copy of which is signed by me for identification purposes on the same day as this transfer notice and will be kept available for inspection at the Queensland Water Commission, 53 Albert Street, Brisbane.

3.2 SEQ Water Act Unless the context requires otherwise, words and expression used in this transfer notice which are not otherwise defined in clause 3.1 have the meaning that those words or expressions have in chapter 3 of the SEQ Water Act.

1 Water infrastructure and other assets 1.1 Water infrastructure and other assets

Pursuant to section 62 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities:

(a) transfer from Ipswich City Council to Central SEQ Distributor-Retailer Authority the assets of Ipswich City Council set out in the schedule of the Ipswich City Council Transfer Statement;

(b) transfer from Central SEQ Distributor-Retailer Authority to Brisbane City Council the assets of Central SEQ Distributor-Retailer Authority set out in schedule 1 of the Brisbane City Council Transfer Statement; and

(c) transfer from Esk-Gatton-Laidley Water Board to Central SEQ Distributor-Retailer Authority the assets of Esk-Gatton-Laidley Water Board set out in schedule 1 of the Esk-Gatton-Laidley Water Board Transfer Statement,

with effect on the Transfer Day.

2 Land and interests in land 2.1 Trust land

Pursuant to section 62 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities, in respect of the trust land set out in schedule 2 of the Brisbane City Council Transfer Statement:

(a) remove Central SEQ Distributor-Retailer Authority and Brisbane City Council as joint trustees of, and appoint Central SEQ Distributor-Retailer Authority as trustee of; and

(b) transfer from Central SEQ Distributor-Retailer Authority and Brisbane City Council to Central SEQ Distributor-Retailer Authority, all of the rights and liabilities of Central SEQ Distributor-Retailer Authority and Brisbane City Council in respect of,

that trust land with effect on the Transfer Day.

2.2 Freehold land – transfer of whole of lot Pursuant to section 62 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities:

(a) transfer from Lockyer Valley Regional Council to Central SEQ Distributor-Retailer Authority all of the right, title and interest of Lockyer Valley Regional Council in the freehold land set out in the schedule of the Lockyer Valley Regional Council Transfer Statement;

(b) transfer from Brisbane City Council to Central SEQ Distributor-Retailer Authority all of the right, title and interest of Brisbane City Council in the freehold land set out in schedule 3 of the Brisbane City Council Transfer Statement; and

(c) transfer from Esk-Gatton-Laidley Water Board to Central SEQ Distributor-Retailer Authority all of the right, title and interest of Esk-Gatton-Laidley Water Board in the freehold land set out in schedule 2 of the Esk-Gatton-Laidley Water Board Transfer Statement,

with effect on the Transfer Day.

3 Rectification Pursuant to section 65 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities, rectify the Transfer Scheme, by:

(a) omitting items 7, 17, 119, 124, 126, 190, 289, 324, and 691 of schedule 1 of the Transfer Statement attached to the Transfer Scheme; and

(b) amending item 15 of schedule 1 of the Transfer Statement attached to the Transfer Scheme by omitting the reference to “26 x laptops” and substituting “2 x laptops”,

with effect on the Transfer Scheme Effective Date.

4 Further assurance Pursuant to section 65 of the SEQ Water Act, I, Stephen Robertson, Minister for Energy and Water Utilities, direct and require that:

(a) Central SEQ Distributor-Retailer Authority and its board;

(b) Brisbane City Council and its councillors;

(c) Ipswich City Council and its councillors; and

(d) Esk-Gatton-Laidley Water Board and its officers,

each do all things (including the execution of instruments) necessary, incidental or ancillary to give effect to this transfer notice.

Central SEQ Distributor-Retailer Authority means Central SEQ Distributor-Retailer Authority, a distributor-retailer established under section 8 of the SEQ Water Act.

Esk-Gatton-Laidley Water Board Transfer Statement means the document titled “Esk-Gatton-Laidley Water Board Transfer Statement”, a copy of which is signed by me for identification purposes on the same day as this transfer notice and will be kept available for inspection at the Queensland Water Commission, 53 Albert Street, Brisbane.

Ipswich City Council Transfer Statement means the document titled “Ipswich City Council Transfer Statement”, a copy of which is signed by me for identification purposes on the same day as this transfer notice and will be kept available for inspection at the Queensland Water Commission, 53 Albert Street, Brisbane.

Lockyer Valley Regional Council Transfer Statement means the document titled “Lockyer Valley Regional Council Transfer Statement”, a copy of which is signed by me for identification purposes on the same day as this transfer notice and will be kept available for inspection at the Queensland Water Commission, 53 Albert Street, Brisbane.

SEQ Water Act means the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009 (Qld).

Transfer Day means the day this transfer notice is gazetted.

Transfer Scheme means transfer scheme titled “Transfer Scheme (No. 1)” between Central SEQ Distributor-Retailer Authority and Ipswich City Council approved by the Acting Minister for Natural Resources, Mines and Energy on 25 June 2010.

Transfer Scheme Effective Date means 1 July 2010.

5.2 SEQ Water Act Unless the context requires otherwise, words and expression used in this transfer notice which are not otherwise defined in clause 5.1 have the meaning that those words or expressions have in chapter 3 of the SEQ Water Act.

SOUTHERN DOWNS REGIONAL COUNCIL (MAKING OF LOCAL LAW) NOTICE (NO. 1) 2011

Title

1. This notice may be cited as Southern Downs Regional Council (Making of Local Law) Notice (No. 1) 2011 .

Commencement

2. This notice commences on the 1st day of January 2012.

Making of local laws

3. Southern Downs Regional Council (the “Council”) has, by resolution dated the 12th day of December 2011, made—

(a) each local law identified in schedule 1, column 1; and

(b) each subordinate local law identified in schedule 1, column 2.

Model local laws adopted

4. Each of the following local laws made by Council is an adopted model local law—

(a) Model Local Law No. 2 (Animal Management) 2010, to be known as Local Law No. 2 (Animal Management) 2011 ,

(b) Model Local Law No. 5 (Parking) 2010, to be known as Local Law No. 5 (Parking) 2011 .

Local law that authorises a subordinate law to be made

5. The local law which authorises each subordinate local law identified in schedule 1, column 2 to be made is identified in thecorresponding part of schedule 1, column 3.

Purpose and general effect

6. The purpose and general effect of each local law identified in schedule 1, column 1, and each subordinate local law identifiedin schedule 1, column 2, is identified in the corresponding part of schedule 1, column 4.

Local laws that contain an anti-competitive provision

7. If a local law identified in schedule 1, column 1, or a subordinate local law identified in schedule 1, column 2, contains ananti-competitive provision, that fact is identified in the corresponding part of schedule 1, column 5.

Inspection

8. A copy of each local law identified in schedule 1, column 1, and each subordinate local law identified in schedule 1, column 2, may be—

(a) inspected and purchased at Council’s public offices at 64 Fitzroy Street, Warwick; 61 Marsh Street, Stanthorpe; andHerbert Street, Allora and

(b) inspected at the State office of the Department of Local Government and Planning at 63 George Street, Brisbane.

4. The purpose and general effect of Southern Downs Regional Council Control of Pests (Application of Continuing Local Law)Local Law 2011 is —

(a) to apply Warwick Shire Council Local Law No. 7 (Control of Pests) to the whole of the local government area of SouthernDowns Regional Council without changes, and

(b) to repeal Stanthorpe Shire Council (Control of Pests) Local Law No. 10.

5. The purpose and general effect of Southern Downs Regional Council Overgrown and Unsightly Allotments (Application ofContinuing Local Law) Local Law 2011 is —

(a) to apply Local Law No. 8 (Overgrown and Unsightly Allotments) 2001 of Warwick Shire Council to the whole of the localgovernment area of Southern Downs Regional Council without changes, and

(b) to repeal Stanthorpe Shire Council (Control of Nuisances) Local Law No. 14 .

6. Each of Warwick Shire Council Local Law No. 7 (Control of Pests) and Local Law No. 8 (Overgrown and Unsightly Allotments)2001 of Warwick Shire Council contain anti-competitive provisions.
