The Comú d’Escaldes-Engor-dany has eliminated the re-quirement to have, prefe-rably, Andorran, Spanish,

French or Portuguese nationality when accessing its competitions for temporary positions. The decisi-on was made yesterday morning af-ter Guilherme Pereira, a 22-year-old man of Brazilian origin but living in the Principality since 2006, was deni-ed participation in the tourist infor-mant exam.

As Pereira explained to EL PERI-ÒDIC, on June 7 he and his partner of Andorran nationality presented themselves to an edict to fill the po-sitions of informants and tourist gui-des. While on the 10th she went to the commune to look for the documen-tation to take the exam, she got no response from the corporation. Ac-cording to his own partner, Pereira was denied participation because he had Brazilian nationality. «A fact that I found classist and racist by the co-mú,» said the young man. And despi-te the fact that, according to his pass-port, he has been living in Andorra for 14 years, has attended primary, secondary and high school in the An-dorran school and has been a mem-ber of several groups, as well as chest-nut and escudellaire of the Associati-on of Friends of the Pont dels Escalls, of Escaldes-Engordany. «As if I wasn’t involved enough with Andorran cul-ture, I’m also a history student at the University of Barcelona (UB), and I thi-nk my profile fits very well with that of a tourist informant,» added Perei-ra, all claiming to be the only rejected candidate before taking the test.

COMPLAINT TO THE MINISTER AND THE CON-

SUL / Faced with this situation - «and taking into account that I study in the Raval», where the Faculty of History of the UB is located -, he decided to make a one-man demonstration «of a peace-ful and vindictive nature», chaining in a chair in front of the comú buil-ding. To have the approval of the Ad-ministration, he went directly to the Minister of Justice and Interior, Josep Maria Rossell, who directed him to the Consul General of Escaldes-Engor-dany, Rosa Gili. However, Pereira ack-nowledged that he was «asking for a symbolic permit» to have permission or not «I was thinking of protesting.»

On the same day that the Escal-des-Engordany municipality recei-ved the letter, the general secretary, Cerni Escalé, met with him. Escalé explained that the rule follows from the Civil Service Law which specifies that «contestants who intend to ap-

ply for competitions for temporary positions must be of Andorran, Spa-nish or French […] or Portuguese na-tionality» based on the good neigh-bourly agreements between these countries. Against this, Pereira appe-aled to the Law on Equal Treatment and Non-Discrimination, which “es-tablishes the principles of action of the public authorities and the mea-sures aimed at intervening, re-edu-cating, preventing, eliminating and correcting all forms of discriminati-on. », And which also applies to access to the comuns.

“BROAD INTERPRETATION” / However, Es-calé understood Pereira’s protest and pledged to “a quick study to find a so-lution”. Only 24 hours later, and af-ter a report prepared by the same ge-neral secretariat and another of legal made by an external lawyer, it was ex-tracted that “it is possible to make an extensive and wide reading and inter-pretation of the law, in the precept of the preferential necessity to accredit one or the other nationality ”. Thus, the municipality will allow Pereira to take the exam for tourist informant next Thursday, June 25.

«According to this measure, lega-lly endorsed, from now on the pro-cedures for temporary positions in progress and all future ones will also enjoy the new interpretation» and it

will only be necessary to prove the re-sidence and work permission, he re-ported to the comú, at the same time he clarified that the restriction will remain in the fixed.

A decision that Pereira hopes will be implemented by other corporati-ons, as it would pave the way for an «inclusive and non-discriminatory» administration. «I’m very happy to have contributed my grain of sand,» said the young man. H
