REGLAMENTO DEL STUD BOOK COLOMBIANO
CAPITULO I
Definición, domicilio y Objeto
Artículo 1°-. Definición. Libro Genealógico o «Stud Book», el Libro Genealógico oficial es el archivo
copiador o medio magnético en el cual se asientan, anotan o inscriben oficialmente, en forma ordenada
y secuencial, los registros de animales de razas puras.
Artículo 2º-. El Ministerio de Agricultura y Desarrollo Rural inicialmente por medio del Decreto No. 1545 de
1953 y luego por medio de la Ley 427 del 16 de enero de 1998, delegó a la Asociación Colombiana de
Criadores de Caballos P.S.I. (ASOCRIADORES P.S.I.), persona jurídica de derecho, sin ánimo de lucro, con
personería jurídica No. 534 del 30 de noviembre de 1945, actualmente vigilada por el Ministerio de Agricultura
y Desarrollo Rural, para que con carácter oficial, llevara el Libro Genealógico de los caballos Pura Sangre
Inglesa (P.S.I.), que en adelante se denominará el Stud Book Colombiano.
Parágrafo-. En el Stud Book Colombiano figurarán todos los caballos P.S.I. inscritos por la Asociación
Colombiana de Criadores de Caballos P.S.I. (ASOCRIADORES P.S.I.).
Artículo 3º-. Para desarrollar las funciones de dirección y conducción del Stud Book Colombiano,
ASOCRIADORES P.S.I., nombrará la Comisión del Stud Book Colombiano, que funcionará en la ciudad de
Santafé de Bogotá D.C., capital de la República de Colombia, domicilio legal de ASOCRIADORES P.S.I.
Artículo 4º-. La Comisión del Stud Book Colombiano, tendrá como función la de mantener el Libro
Genealógico de los caballos P.S.I. Utilizará para este fin los medios escritos o electromagnéticos que
sean necesarios para su buen funcionamiento. Velará por la pureza de la raza, ejerciendo el control y
fiscalizando la procreación, gestación, nacimiento, identificación, filiación, inscripción de la propiedad,
tenencia y sus limitaciones, transferencia, importaciones y exportaciones, y las estadísticas de los
caballos P.S.I. inscritos en el Stud Book Colombiano por la Asociación Colombiana de Criadores de
Caballos P.S.I. Así mismo expedirá las certificaciones y demás documentos que se requieran para
cumplir con sus propósitos.
Parágrafo 1º-. Adicionalmente a lo prescrito por la Ley Colombiana, por estar reconocido el Stud Book
Colombiano ante el International Stud Book Committeee, continuará adoptando las reglamentaciones
internacionales expedidas por esta autoridad, requisito para seguir siendo reconocido por los demás
Stud Books aceptados por ese organismo que operan en el resto del mundo.
Parágrafo 2º-.El Stud Book Colombiano llevará un Libro de Registro de caballos mestizos de la raza,
donde constará su procedencia, su genealogía y la propiedad de los mismos, siempre que se cumplan
los requisitos que se exijan para estos efectos. Entiéndase por caballo mestizo al ejemplar que tenga
solo uno de sus progenitores debidamente registrado como P.S.I. en el Stud Book Colombiano.
CAPITULO II
Dirección y Administración Artículo 5°-. La Comisión del Stud Book Colombiano estará integrada por el Presidente de
ASOCRIADORES PSI, cuatro (4) miembros principales y tres (3) suplentes numéricos, que serán
nombrados por la Junta Directiva de ASOCRIADORES PSI, durante la sesión en la cual se elija al
Presidente de esta entidad.
Artículo 6°-. La Comisión del Stud Book Colombiano será elegida, en los años impares, para periodos de
dos (2) años, y en la primera reunión de cada periodo elegirá un Presidente con su suplente y un secretario.
Este último cargo podrá recaer en una persona diferente a uno de los miembros de la Comisión.
Artículo 7°-. La Comisión del Stud Book Colombiano se reunirá en forma ordinaria una vez
trimestralmente, y en forma extraordinaria cuando su Presidente o su Suplente la convoquen. Se
formará quórum con tres miembros presentes. Los suplentes numéricos actuarán únicamente en caso
de ausencia de los principales. Las decisiones de la Comisión del Stud Book Colombiano se tomarán
por mayoría simple. Parágrafo -. Las citaciones a las reuniones se harán por escrito y el Secretario de la Comisión levantará una
Acta de cada reunión, que una vez aprobada será refrendada por el Presidente con su firma.
Artículo 8°-. La Comisión del Stud Book Colombiano deliberará con absoluta independencia y las
resoluciones que adopte, en relación con sus funciones y la interpretación del presente Reglamento y
su aplicación, así como las sanciones que se originen por el incumplimiento del mismo, serán
definitivas y solamente serán apelables ante la Junta Directiva de ASOCRIADORES P.S.I.
Artículo 9°-. La Comisión del Stud Book Colombiano adoptará todas las medidas y resoluciones
convenientes para asegurar la organización y el funcionamiento adecuados del Stud Book Colombiano
y para asegurar el estricto cumplimiento del presente Reglamento.
Artículo 10°-. ASOCRIADORES PSI, a través de la Comisión del Stud Book Colombiano ejercerá la
representación del Stud Book Colombiano en el orden local e internacional, pudiendo efectuar toda
presentación, tramitación o gestión administrativa tendiente a la defensa de sus intereses.
CAPITULO III
Libro Genealógico – Libros de Registro Complementarios
Artículo 11°-. En el Stud Book Colombiano o Libro Genealógico oficial se asentarán, anotarán o
inscribirán, en forma ordenada y secuencial, los registros de todos los caballos P.S.I., nacidos en el
país o importados, de conformidad con lo prescrito en el presente Reglamento, especificándose su
genealogía, identidad y filiación, propiedad, tenencia y sus limitaciones y, en general, todo elemento
vinculado a su perfecta protección jurídica.
Parágrafo -. Todos los caballos inscritos en el Stud Book Colombiano llevarán un número de registro
que se conformará de un prefijo, que serán las dos (2) últimas cifras del año de registro, seguidas de
una numeración secuencial ascendente de cuatro (4) cifras, correspondientes al orden de su
inscripción. En caso de anulación o rechazo de un número de registro asignado, este no podrá ser
utilizado de nuevo y al anotar la anulación o rechazo se deberá describir el motivo.
Artículo 12°-. El Stud Book Colombiano constará de los siguientes libros de registros complementarios:
a) Libro de registro de Padrillos
b) Libro de registro de Yeguas Madres
c) Libro de registro de declaración de servicios por padrillo
d) Libro de registro de reportes de nacimientos y estado reproductivo por yegua
e) Libro de registro de filiación y verificación de parentesco
f) Libro de registro de caballos importados
g) Libro de registro de caballos exportados
h) Libro de registro de propiedad, tenencia y sus limitaciones
i) Libro de registro de caballos mestizos
j) Libro de registro de cambios de nombre
k) Libro de registro de descalificados. Parágrafo 1°-. Para los registros de filiación y verificación de parentesco se mantendrá para cada
caballo registrado la misma numeración correspondiente descrita en el Parágrafo del Artículo 11° del
presente Reglamento. Parágrafo 2°-. La Comisión del Stud Book Colombiano, de común acuerdo con la Junta Directiva de
ASOCRIADORES P.S.I., podrá determinar los procedimientos y los medios para llevar estos registros
complementarios, así como podrá crear los libros o registros adicionales que sean necesarios.
Artículo 13°-. La Comisión del Stud Book Colombiano autorizará a las personas encargadas de hacer
las filiaciones y de tomar las muestras para la realización de la verificación de parentesco.
Artículo 14°-. Los médicos veterinarios, los zootecnistas y los particulares que deseen ser acreditados
para realizar las labores de hacer las filiaciones y/o de tomar las muestras para la realización de la
verificación de parentesco, deberán inscribirse ante la Comisión del Stud Book Colombiano y ser
autorizados por ella.
Artículo 15°-. La Comisión del Stud Book Colombiano continuará publicando los volúmenes del Stud Book
Colombiano. Este compendio de información contendrá todo lo referente a los caballos P.S.I., registrados, a
saber: padrillos y sus descendientes; yeguas madres con todos los eventos registrados durante el período,
como son sus crías, abortos, muertes, retiros de la reproducción, etc.; las importaciones de caballos con su
respectivo país de origen; las exportaciones de caballos con su respectivo país de destino y todos los listados
que considere necesarios para una adecuada información. Parágrafo -. Los volúmenes del Stud Book Colombiano podrán ser elaborados en forma electromagnética y
su distribución podrá hacerse utilizando disquetes o CD compatibles con las plataformas más usadas por
los computadores.
CAPITULO IV
Obligaciones de los criadores y propietarios de caballos P.S.I.
Artículo 16°-. Todos los criadores y propietarios de caballos P.S.I., estarán obligados a informar al Stud Book
Colombiano cuando un caballo, macho o hembra, sea destinado a la reproducción. El informe de ingreso a la
crianza permitirá realizar la comprobación de su filiación y/o verificación de parentesco. Este informe deberá
ser enviado, dentro de los plazos pertinentes, durante el primer año en que hayan sido dedicados a la
reproducción. Estos requisitos se exigirán para poder registrar a sus descendientes. Igualmente, en el caso
de los padrillos, el responsable deberá informar a la Comisión del Stud Book el lugar donde el padrillo
prestará sus servicios y cualquier cambio posterior en su ubicación.
Artículo 17°-. Los criadores, propietarios, puestos de monta o representantes de sindicatos de
propiedad de padrillos estarán obligados a llevar los siguientes libros:
a) Libro de registro de declaración de servicios por padrillo: Será el libro donde anotarán en
orden secuencial, las fechas de todos los servicios realizados por un padrillo, y deberá ser enviado al
Stud Book Colombiano antes del 30 de septiembre de cada año, para los servicios del primer
semestre; o antes del 31 de marzo del año subsiguiente, para los servicios del segundo semestre;
b) Libro de registro de declaración de nacimientos: será el libro donde anotarán en orden
secuencial, las fechas de todos los nacimientos sucedidos. Los informes contendrán además, el sexo
de la cría, el color, el padre, la madre y el abuelo materno debidamente identificados, y deberán ser
enviados a más tardar dentro de los noventa (90) días siguientes a su suceso.
Artículo 18°-. El Stud Book Colombiano basado en los registros de declaración de servicios por
padrillo producirá un Reporte de nacimiento y estado reproductivo de la yegua, que será remitido a su
propietario para ser diligenciado y devuelto dentro de los noventa (90) días subsiguientes a la fecha del
evento que se va a declarar. El Reporte de nacimiento y estado reproductivo de la yegua contendrá la
información pertinente para registrar todos los eventos posibles sucedidos en el periodo anual, como
son: propiedad de la yegua o tenencia y sus limitaciones; fecha y lugar del parto, del aborto o cualquier
otro incidente; sexo y color de la cría y nombres solicitados si desea que le sean reservados. En los
casos en que no hubiese nacimiento se deberá dar la razón por la cual esto no sucedió. Parágrafo -. Para todas las yeguas que no hayan sido servidas en el año anterior, el Stud Book
Colombiano emitirá este mismo Reporte de nacimiento y estado reproductivo de la yegua y lo remitirá al último propietario registrado, quien lo diligenciará y devolverá, dentro de los noventa (90) días
subsiguientes, anotando si la respectiva yegua ha sido vendida, ha muerto o ha sido retirada de la reproducción, o tuvo un servicio no registrado. Artículo 19°-. El Stud Book Colombiano, basado en los Reportes de nacimiento y estado reproductivo de la
yegua, cobrará de acuerdo a las tarifas vigentes, los trámites de filiación, tipificación y registro de las crías y
la enviará al propietario. Para poder continuar con estos trámites, el interesado deberá cancelar el
valor liquidado e informar a ASOCRIADORES PSI el lugar donde se debe practicar la visita. Parágrafo -. Mientras los trámites de filiación, tipificación y registro de un animal no sean cancelados
de acuerdo al Reglamento y a las tarifas vigentes, dicho animal no se considerará inscrito en el Stud
Book Colombiano.
Artículo 20°-. El Reporte de nacimiento y estado reproductivo de la yegua podrá ser transmitido a
ASOCRIADORES PSI, utilizando el informe escrito, un medio electromagnético o por correo
electrónico, a partir del momento que estos sistemas estén disponibles.
CAPITULO V
Registros – Gestación y paternidad de los caballos P.S.I. Artículo 21°-. Para todos los propósitos de este Reglamento se entenderá como registro, al proceso, que
determinando la paternidad, el tiempo de gestación y la debida identificación de un producto, resulte en la
clara identificación del mismo y permita la expedición de una certificación oficial en que así conste.
Artículo 22°-. Un producto solamente será registrado en el Stud Book cuando todos los antepasados
que conforman su pedigree o genealogía estén debidamente registrados en el Stud Book Colombiano o
en otro Stud Book debidamente reconocido por el International Stud Book Committee y cumpla con
todas las exigencias estipuladas en el presente Reglamento.
Artículo 23°-. La paternidad de un producto sólo será aceptada cuando el padrillo y la yegua madre
hayan tenido contacto sexual directo. No se registrarán productos obtenidos por inseminación artificial
ni por trasplante de embriones.
Artículo 24°-. Los procesos de filiación y verificación de parentesco serán obligatorios para el registro
de los caballos P.S.I. en el Stud Book Colombiano.
Parágrafo 1°-. Entiéndase que toda verificación de parentesco se hará por medio de una tipificación sanguínea o por un examen de ADN, cuando este último sistema sea adoptado oficialmente. No se registrará productos cuya paternidad sea negada o dudosa, después de realizados los respectivos exámenes. Parágrafo 2°-. Todos los productos PSI, nacidos en el territorio colombiano deberán tener una
tipificación sanguínea o una verificación de parentesco, y provenir de padres que la tengan. En el caso
de los productos importados en vientre, la madre deberá ser registrada en el Stud Book Colombiano y
el padre deberá estar debidamente registrado en un Stud Book reconocido.
Artículo 25°-. Cuando una yegua haya sido servida sucesivamente, en la misma temporada, por dos
padrillos diferentes, se hará todo lo posible para verificar el parentesco del producto resultante,
eliminando al padrillo que no se ajuste.
Artículo 26°-. La Comisión del Stud Book Colombiano diseñará los elementos necesarios para efectuar la
filiación, de acuerdo con los códigos descriptivos internacionales. La persona autorizada para hacer la
filiación deberá ceñirse únicamente a los términos y a la nomenclatura dictados para este efecto.
Artículo 27°-. Se considerará gestación normal la que se produzca entre los trescientos diez (310) y los
trescientos sesenta (360) días. Cuando la duración de la gestación se salga de estos límites, el Stud
Book Colombiano enviará un delegado al lugar donde esté el producto para establecer las condiciones
del nacimiento y para tomar las muestras de sangre respectivas. De acuerdo con los resultados de la
visita se podrá aceptar o negar la solicitud de registro del producto.
Artículo 28°-. Cuando no haya un reporte de servicio de un padrillo o una yegua, o éste sea extemporáneo,
si ha sido reportado después de los plazos estipulados en el Artículo 17°, y antes del parto, la Comisión del
Stud Book Colombiano podrá solicitar toda la información adicional que estime pertinente para establecer la
paternidad y podrá incluir el testimonio de por lo menos dos personas que hayan evidenciado el servicio.
Artículo 29°-. Cuando no haya un reporte de nacimiento, o éste sea extemporáneo, si ha sido
reportado después de los plazos estipulados en el Artículo 17°, la Comisión del Stud Book colombiano
podrá solicitar toda la información adicional que estime pertinente para establecer la identidad del
producto y podrá incluir el testimonio de por lo menos dos personas que hayan evidenciado el parto.
Artículo 30°-. Para todos los efectos de registro y subsecuentes, se considerará como criador de un
producto a la persona que figure registrada en los libros del Stud Book como propietaria de la yegua
madre en el momento del nacimiento del producto.
Parágrafo -. Se considerará propietario temporal de una yegua, a la persona que mediante un contrato
escrito, tenga un arrendamiento para fines reproductivos sobre esta, o haya estipulado la modalidad de
potro compartido. En este último caso serán criadores ambos contratantes.
CAPITULO VI
Nombres y pelajes de los caballos P.S.I. Artículo 31°-. Todos los caballos que se registren en el Stud Book llevarán un nombre que los
identifique durante toda su vida.
Artículo 32°-. Los nombres escogidos para los caballos PSI deberán ser solicitados al Stud Book, por
escrito.
1.- Los criadores podrán solicitar el nombre de un producto antes de que cumpla la edad reglamentaria
para participar en una carrera pública. Esta solicitud no tendrá costo alguno.
La Comisión del Stud Book Colombiano aprobará el nombre y autorizará su uso cando se cumplan los
siguientes requisitos:
a) Cuando se solicite la reserva de un nombre, antes de producirse el nacimiento, se
especificará para que producto está destinado. Esta reserva no tendrá ningún costo y será
válida por el término de seis (6) meses;
b) Cuando se solicite en el reporte de nacimiento o antes de los seis (6) meses de edad, dando
hasta tres nombres posibles para cada producto. Esta solicitud no tendrá ningún costo;
c) Cuando el nombre solicitado no esté incluido en ninguno de los numerales del Artículo 33°.
2.- Los criadores podrán dejar sin nombre un producto para que sea bautizado posteriormente por un
tercero. Esta solicitud tendrá como costo la tarifa fijada para este efecto. La Comisión del Stud Book Colombiano aprobará el nombre y autorizará su uso cuando se cumplan los
siguientes requisitos:
a) Cuando el propietario del producto solicite la aprobación del nombre antes de que cumpla la
edad reglamentaria para participar en una carrera pública.
b) Cuando el nombre solicitado no esté incluido en ninguno de los numerales del Artículo 33°. Parágrafo -. Los Traspasos de los productos sin nombre solamente se tramitaran cuando se soliciten
simultáneamente con el nombre del producto. Artículo 33°-. La Comisión del Stud Book no aceptará el uso de los siguientes nombres:
a) Los de caballos ganadores de carreras clasificadas como Grupo 1, que se encuentren listadas en
la Parte I del International Cataloguing Standards, o los de caballos ganadores de carreras
clasificadas como Grupo I, II y III para Colombia, sin importar la época en que fueron corridas;
b) Los de padrillos que hayan producido más de 15 hijos ganadores de carreras de Grupo I o
los de yeguas que hayan producido más de dos ganadores de carreras de Grupo I y un
ganador de carreras listadas, siempre que hayan sido incluidos en la lista internacional de
nombres protegidos;
c) Los de padrillos registrados en el Libro de Registro de Padrillos del Stud Book Colombiano y
que hayan tenido descendencia en nuestro medio;
d) Los que se compongan de 19 o más dígitos, considerando como tales letras, los signos
ortográficos y los espacios incluidos, o los que consten de más de cuatro (4) palabras;
e) Los que tuviesen diferencias ortográficas o fonéticas con otros ya registrados;
f) Los que sean susceptibles de considerarse como de propaganda;
g) Los de los caballos exportados, cuando no hayan transcurrido más de 10 años de su salida
del país;
h) Los que se consideren obscenos, ofensivos o vulgares, o lleven implícita tal sugerencia;
i) Los que representen números cardinales;
j) Los que estén compuestos de números o siglas;
k) Los que vayan seguidos de números o siglas;
l) Los que afecten creencias religiosas o políticas;
m) Los correspondientes a nombres de criaderos, caballerizas o hipódromos que funcionen en
Colombia, cuando no medie una autorización escrita expedida por sus propietarios;
n) Los que estén incluidos en la lista de nombres protegidos determinada por el International
Stud Book Committee y ratificada por la International Racing Conference;
o) Los de gente notable o famosa, cuando no medie autorización escrita de la persona;
p) Los de caballos que hayan sido inscritos en el Libro de Registro de Descalificados.
Artículo 34°-. Podrán ser aceptados los nombres ya utilizados en anteriores registros cuando:
a) Se trate de machos que no figuren inscritos en el Libro de Registros de Padrillos, ni hayan
sido utilizados para la reproducción o hayan sido castrados, pasados diez (10) años de la
fecha de su registro;
b) Se trate de hembras que hayan salido de la reproducción sin dejar descendencia, pasados
quince (15) años de la fecha de su registro.
c) Se trate de caballos que nunca corrieron y que no fueron utilizados para la reproducción,
pasados diez (10) años de la fecha declarada de su muerte, o en el caso de no tenerse
conocimiento de ésta, quince (15) años de la fecha de su registro. Parágrafo -. En los casos de interpretación dudosa, para aceptar un nombre la Comisión del Stud
Book podrá sugerir al interesado modificarlo, cuando a su juicio haya méritos para ello, así como
rechazarlo cuando lo juzgue no adecuado. Artículo 35°-. La Comisión del Stud Book podrá conceder, por una sola vez, el cambio de nombre a un
caballo, cuando no haya corrido o no haya entrado a la reproducción, previo el pago del valor fijado
para este concepto. Parágrafo 1°-. Cuando un caballo registrado, sea exportado y posteriormente se le cambie de nombre,
porque la reglamentación del país de destino así lo permita, se deberá informar al Stud Book
Colombiano. Parágrafo 2°-. Siempre que se acepte el cambio de nombre a un caballo, en su
pasaporte y en su pedigree tabulado se hará constar su nombre anterior.
Artículo 36°-. No se aceptarán cambios de nombre a los caballos importados al país. Será obligatorio
el uso, entre paréntesis, de la abreviación del nombre del país de nacimiento a continuación del
nombre del caballo importado para distinguirlo.
Artículo 37°-. Los pelajes de los caballos registrados deberán ser establecidos con la mayor precisión
en el reporte de nacimiento o en la respectiva filiación, describiéndolos de acuerdo a las siguientes
denominaciones:
a) ALAZAN: toda la capa general, la crin, la cola y las extremidades son del mismo color, que
va de un amarillo rojizo claro hasta un amarillo rojizo oscuro.
b) CASTAÑO: la capa general es de un color que varía de un amarillo claro a un rojizo
brillante, la crin, la cola y las extremidades son siempre de color negro.
c) ZAINO: la capa general es de un color pardo con áreas de pelo amarillo alrededor de los ojos, en
la nariz, los hombros, ijares, parte interior de los muslos y la parte superior de las extremidades; la
crin la cola y la parte inferior de las extremidades son siempre de color negro.
d) NEGRO: toda la capa general, incluyendo el hocico, ijares y extremidades, la crin y la cola
son de color negro.
e) TORDILLO: toda la capa general, la crin, la cola y las extremidades son de color gris,
resultante de una combinación de pelos blancos y negros.
f) RUANO: toda la capa general, la crin, la cola y las extremidades son de color rosado, resultante
de una combinación de pelos blancos y rojos. Artículo 38°-. Los productos alazanes, tordillos o ruanos deberán cumplir con el siguiente:
a) Los productos hijos de ambos padres alazanes, serán siempre alazanes;
b) Los productos tordillos o ruanos, deberán ser hijos de padre o madre tordillo o ruano. Parágrafo -. Cuando un producto descienda de un padre o madre tordillo o ruano, se exigirá un reporte
escrito del color final del pelaje, antes de que pasen seis (6) meses de la fecha de nacimiento.
Artículo 39°-. La Comisión del Stud Book no registrará caballos cuya descripción del pelaje esté en
desacuerdo con las normas anteriormente establecidas.
CAPITULO VII
Pasaporte, Propiedad y Tenencia y sus Limitaciones
Artículo 40°-. La inscripción en el Libro de Registro de Propiedad acredita la propiedad del caballo
correspondiente, salvo prueba en contrario conforme a derecho. A tal efecto, no se podrá inscribir un
caballo en el Libro de Registro de Propiedad, sin haber comprobado previamente el derecho que
corresponde a quien pretende aparecer como propietario. Parágrafo -. Para todos los efectos, sin perjuicio de los derechos de los derechos de terceros, se
tendrá como propietario de los caballos que se registren en el Stud Book Colombiano al que figure
como tal en el Libro de Registro de Propiedad.
Artículo 41°-. El Stud Book Colombiano expedirá un pasaporte para todos los caballos nacidos en el
país, o los importados que no lo tengan, documento que deberá acompañarse para todo trámite
concerniente a su titular.
Artículo 42°-. El pasaporte contendrá la siguiente información:
a) Número de Registro,
b) Nombre, sexo y color del caballo titular,
c) Lugar y fecha de nacimiento,
d) Padre, Madre y Abuelo Materno,
e) Filiación,
f) Registro de propiedad, tenencia y sus limitaciones,
g) Tipificación sanguínea,
h) Registro de su campaña en los hipódromos,
i) Fotografías, cuando estas sean requeridas,
j) Vacunaciones. Parágrafo -. Cuando un producto sea registrado sin nombre, el Stud Book Colombiano no emitirá el
pasaporte hasta cuando medie una solicitud de nombre, tramitada por escrito por el criador o por el
nuevo propietario que solicite el correspondiente traspaso.
Artículo 43°-. Para toda tramitación ante el Stud Book se deberá enviar el pasaporte con la respectiva
solicitud. Una vez aquella sea tramitada, este será devuelto a su propietario.
Artículo 44°-. No se expedirán copias ni duplicados de los pasaportes. En caso de pérdida o
destrucción debidamente comprobadas, el interesado hará una solicitud y previo el pago de las tarifas
fijadas, la Comisión del Stud Book podrá autorizar su reexpedición.
Artículo 45°-. Cuando un caballo sea vendido, el propietario llenará en el pasaporte, los espacios
correspondientes con el nombre, identificación y dirección del comprador y lo enviará al Stud Book,
donde el comprador, previo el pago de los derechos fijados por este concepto, lo recibirá.
Artículo 46°-. Los propietarios podrán autorizar a un tercero para firmar los traspasos de venta, pero
deberán informar por escrito al Stud Book, de esta autorización.
Parágrafo -. No se registrarán traspasos que vengan firmados por personas que no están debidamente
autorizadas por el último propietario que figure en el registro de un caballo.
Artículo 47°-. Cuando un padrillo sea sindicalizado, o sea que su propiedad haya sido dividida en
varios derechos o acciones, el documento de sindicalización deberá ser enviado al Stud Book para que
se pueda registrar la propiedad del sindicato en el libro respectivo. El sindicato deberá nombrar un
vocero, que será la persona que tendrá la representación ante el Stud Book para todo lo relacionado
con el presente Reglamento.
Artículo 48°-. El propietario de un caballo podrá efectuar contratos de arrendamiento de éste para
correr en un Hipódromo, o para utilizarlo para la reproducción. De estos contratos deberá enviar una
copia debidamente firmada y autenticada al Stud Book, que lo registrará en el correspondiente libro.
Artículo 49°-. Los contratos de potro compartido, en los cuales el propietario de una yegua la entrega
temporalmente para recibir una parte de la cría resultante, deberán ser registrados ante el Stud Book,
para que los contratantes puedan ser reconocidos como propietarios temporales y así poder ser
inscritos como criadores del producto. Parágrafo -. En los casos de arrendamiento para la reproducción se reconocerá al arrendatario como
propietario temporal para los efectos del Artículo 30°, del presente Reglamento.
Artículo 50°-. Toda limitación que afecte la propiedad o tenencia de un caballo P.S.I., deberá ser
comunicada por escrito, antes de que pasen treinta (30) días de su hecho, para ser registrado en el
pasaporte y en el libro correspondiente. Estas limitaciones sólo podrán ser dejadas sin efecto cuando
medie una resolución de la Comisión del Stud Book Colombiano, en obediencia al levantamiento de las
órdenes que las hubiesen causado.
Artículo 51°-. A la muerte de un caballo, el propietario devolverá al Stud Book el pasaporte donde
registrará la fecha y causa de la misma, dentro de un plazo máximo de un año.
CAPITULO VIII
Importación y Exportación de Caballos P.S.I. Artículo 52°-. Todos los caballos P.S.I., que sean importados al país deberán ser registrados en el
Stud Book Colombiano. Para estos efectos su importador presentará una solicitud de registro dentro de
los sesenta (60) días siguientes a su llegada al país. El importador será el responsable de cumplir con
lo estipulado en el presente Reglamento.
Artículo 53°-. La Solicitud de registro deberá venir acompañada de una filiación, realizada por una persona
autorizada por el Stud Book, y de las muestras de sangre para su tipificación, cuando el caballo venga de un
país donde esta no se realice. Por acuerdo con las normas internacionales, el Stud Book del país exportador
enviará directamente al Stud Book Colombiano un pasaporte o un Certificado de Exportación, según sea el
caso, donde se acrediten su identidad, propiedad, filiación y tipificación sanguínea o examen de ADN,
campaña, si hubiere corrido, para su correcta inscripción en el Libro de Registro de Importados. Artículo 54°-. El importador o el propietario que figure en el Certificado de Exportación será inscrito
como primer propietario del caballo en el Stud Book, y deberá cancelar previamente los derechos de
inscripción que estén fijados para este efecto. Artículo 55°-. No se registran caballos provenientes de países cuyos Stud Books no estén reconocidos
por el International Stud Book Committee.
Artículo 56°-. Hasta que no se haya comprobado la coincidencia de la filiación y la verificación de
parentesco de un caballo importado con el Pasaporte o el Certificado de Exportación, no se procederá
a registrarlo. Los importadores tendrán un plazo máximo de ciento veinte (120) días para aclarar
cualquier diferencia que se presente en el proceso de registro. Una vez terminado este plazo, no será
registrará el animal.
Artículo 57°-. Todos los caballos P.S.I., que sean exportados deberán ir acompañados de su
Pasaporte o de un Certificado de Exportación, que será expedido por el Stud Book Colombiano. Antes
de la salida de un caballo del país, se deberá ratificar su identificación y filiación, y se deberán
presentar cuatro fotografías del producto (vista de frente, lateral izquierda, lateral derecha y posterior).
Por acuerdo con las normas internacionales, el Stud Book Colombiano enviará directamente al Stud
Book del país de destino, el Pasaporte con sus fotografías, o un Certificado de Exportación, según sea
el caso donde se acrediten su identidad, propiedad, filiación y verificación de parentesco, campaña, si
hubiere corrido, para su correcta inscripción allí. Parágrafo -. El Stud Book Colombiano podrá entregar al exportador una copia del Certificado de
Exportación cuando así lo demanden las autoridades competentes.
Artículo 58°-. Cuando un caballo importado al país sea reexportado, el Stud Book Colombiano enviará
el Certificado de Exportación Original que recibió al país de origen del caballo, conservando en sus
archivos una copia autenticada de este documento, junto con la constancia de su envío
CAPITULO IX
Tarifas, Sanciones y Multas
Artículo 59°-. La Comisión del Stud Book fijará periódicamente los conceptos por los cuales se deberá cobrar una tarifa, y enviará su propuesta a la Junta Directiva de ASOCRIADORES P.S.I., antes de la finalización del año respectivo.
Artículo 60°-. Los criadores, propietarios o interesados en efectuar trámites ante el Stud Book Colombiano deberán cancelar previamente el valor de las tarifas fijadas. ASOCRIADORES P.S.I., podrá determinar el sistema de cobro de estas tarifas para sus socios.
Artículo 61°-. La Comisión del Stud Book fijará los plazos válidos dentro de los cuales se podrán hacer los trámites ante el Stud Book. Dichos plazos serán incorporados al presente Reglamento, cuando difieran de los aquí descritos. Parágrafo -. Una vez vencido el plazo máximo determinado, el Stud Book Colombiano no podrá aceptar
declaraciones de servicio, nacimiento, estado reproductivo de una yegua, solicitudes de registro, cambios de
nombre, expedición de certificados, ni ningún otro trámite descrito en el presente Reglamento.
Artículo 62°-. Para todos los efectos se considera que las personas interesadas conocen el presente Reglamento. Por lo tanto la violación comprobada de alguna de sus normas será sancionada por la Comisión del Stud Book.
Artículo 63°-. La Comisión del Stud Book conocerá de las violaciones al presente Reglamento y dependiendo de su gravedad aplicará las sanciones pertinentes. De las decisiones tomadas pasará un informe a la Junta Directiva de ASOCRIADORES P.S.I. Parágrafo 1°-. Cuando la violación al presente Reglamento implique un intento de registrar un caballo con
documentación alterada o falsa, o se compruebe mala fe, se procederá a la descalificación del caballo y a su
eliminación de los respectivos libros, sanciones que se harán extensivas a los responsables. Parágrafo 2°-. Cuando se cancele la solicitud de registro de un caballo, ésta no se podrá volver a solicitar. Tampoco será aceptado como haras, criador o propietario, quien haya propiciado el proceso.
CAPITULO X
Disposiciones Generales
Artículo 64°-. La Comisión del Stud Book podrá reformar este Reglamento, cuando lo estime conveniente, o cuando la expedición de leyes o normas nacionales o internacionales así lo ameriten. Toda reforma al presente Reglamento deberá ser ratificada por la Junta Directiva de ASOCRIADORES P.S.I.
Artículo 65°-. Los casos no previstos en el presente Reglamento serán estudiados y resueltos por la Comisión del Stud Book Colombiano, que tomará las decisiones del caso, por mayoría de votos y vigilará su aplicación.
COLOMBIAN STUD BOOK RULES AND REQUIREMENTS
CHAPTER 1
Concept, address and Purpose
Article 1°-.Concept. The official Stud Book is a magnetic media or copy file, where
records of purebred animals are kept, recorded or officially enrolled in an orderly and
sequential fashion.
Article 2°-. The Ministry of Agriculture and Rural Development by Decree No. 1545
of 1953 and then through Law 427 of January 16, 1998, appointed Asociación
Colombiana de Criadores de Caballos PSI (ASOCRIADORES PSI), a legal entity,
non-profit organization, with operating under No. 534 of November 30, 1945,
currently overseen by the Ministry of Agriculture and Rural Development, to have the
responsibility to keep the Stud Book of Thoroughbred horses, hereinafter referred to
as the Colombian Stud Book.
Paragraph. The Colombian Stud Book shall include all thoroughbred horses
registered by the Asociación Colombiana de Criadores de Caballos Pura Sangre
Inglesa (ASOCRIADORES P.S.I.).
Article 3° -. To develop the leadership and management functions of the Stud Book
Colombian, ASOCRIADORES PSI elects the Colombian Stud Book Commission,
which will operate in the city of Bogotá DC, capital of the Republic of Colombia,
ASOCRIADORES PSI legal domicile
Article 4º -.The PSI Colombian Stud Book Commission will seek to maintain the
horses Stud Book PSI., using for this purpose written or electromagnetic means
necessary for its proper functioning; ensuring the purity of the breed, overseeing
exerting control on procreation, pregnancy, birth, identification, affiliation, registration
of property, tenure and its limitations, transfer, import and export and statistics of the
Thoroughbred horses registered in the Stud Book Colombia by Asociación
Colombiana de Criadores de Caballos P.S.I. Also issue certificates and other
documents required to fulfill its purposes.
Paragraph 1 -. In addition to the requirements of the Colombian law, it is its function
to have the Colombian Stud Book recognized by the International Stud Book
Committee and continue to adopt the international regulations issued by such
authority, which is the requirement to remain recognized by others Stud Books
recognized by that agency operating in the rest of the world.
Paragraph 2 -. The Colombian Stud Book shall maintain a Register of crossbred race
horses, stating their origin, their genealogy and ownership thereof, provided that the
requirements are met for such effects. The specimen crossbred horse is defined as
that which has only one parent duly registered as a Thoroughbred in the Colombian
Stud Book.
CHAPTER II
Management and Administration
Article 5°-. The Colombian Stud Book Commission shall consist of the President of
ASOCRIADORES PSI, four (4) core members and three (3) alternate members which
will be elected by the Board of ASOCRIADORES PSI, during the same session in
which the President of such entity is elected.
Article 6 -. The Colombian Stud Book Committee will be elected in odd years, for
periods of two (2) years, and the first meeting of each period a President with his
deputy and a secretary shall be appointed. The latter position may be held by a
person other than a member of the Commission.
Article 7 - .The Colombian Stud Book Commission will meet in regular sessions
once every three months, and extraordinarily when the President or his Deputy
convene such meeting . Quorum will be formed with three members present.
Alternates shall act only in the absence of the core member. The decisions of the
Colombian Commission Stud Book shall be by simple majority.
Paragraph 1- . Citations to meetings shall be in writing and the Secretary of the
Commission shall be responsible for the Minutes of each meeting that, once
approved, shall be countersigned by the President.
Article 8°-.The Colombian Stud Book Committee deliberates independently and the
resolutions adopted in connection with its functions, the interpretation of these
regulations, their application and the penalties that arise from the breach thereof,
shall be final and may be appealed only to the Board of ASOCRIADORES PSI
Article 9°-. The Colombian Stud Book Commission shall take all appropriate
measures and resolutions to ensure the organization and proper functioning of the
Colombian Stud Book and to ensure strict compliance with its Regulations.
Article 10° -. ASOCRIADORES PSI, through the Colombian Stud Book Commission, shall represent Colombian Stud Book at the local and international levels, and may make any filing, prosecution or administrative management aimed at the defense of its interests.
CHAPTER III
Stud Book - Supplemental Record Books Article 11°- . In the Colombian Stud Book or Genealogical Book all Thoroughbreds born in Colombia or imported will be enrolled in an official, orderly and sequential fashion, in accordance with the requirements of this Regulation, specifying their genealogy, identity and affiliation, ownership, possession, limitations and, in general, any element linked to its perfect legal protection.
Paragraph 1- . All horses entered in the Colombian Stud Book bear a registration
number which will be formed by a prefix, which will be the two (2) latest figures from the
year of registration, followed by a sequential numbering upwards of four (4) digits corresponding to order of entry. In case of cancellation or rejection of a registration number assigned, it cannot be used again and the record the cancellation or rejection shall describe the reason.
Article 12°-. The Colombian Stud Book shall include the following additional ledgers:
a) Register of Stallions b) Register of Broodmares c) Stallion Services Register d) Logbook of reports of births and reproductive status by broodmare e) Register of filiations and parentage verification f) Register of imported horses g) Register of exported horses h) Register of ownership, tenure and its limitations i) Register of crossbred horses j) Register of name changes k) Register of disqualified horses
Paragraph 1-. For records of filiations and parentage verification for each horse will have the same numbering described in Paragraph of Article 11 of these Regulations. Paragraph 2°-. The Colombian Stud Book Commission, in accordance with the ASOCRIADORES PSI Board, may determine procedures and means to have complementary registers or can keep additional records as deemed necessary.
Article 13°-. The Colombian Stud Book Commission shall authorize the individuals responsible for affiliations and to take samples for parentage verification.
Article 14°-. Veterinarians, animal scientists and individuals who wish to be
accredited for such work of affiliating and/or taking samples for parentage verification,
shall register and be authorized by the Colombian Stud Book.
Article 15°-.The Stud Book Commission shall continue to publish Colombian Stud
Book volumes. This book contains the information of all Thoroughbreds recorded,
namely stallions and their descendants, broodmares, all the events recorded during
the period, as are their foals, abortions, deaths, services, etc., the import of horses
with their country of origin, exports of horses with their country of destination and all
listings are deemed necessary for adequate information.
Paragraph 1-. The volumes of the Colombian Stud Book may be developed in the
electromagnetic form and distribution can be done using (CD or USB) using the
software compatible with computers.
CHAPTER IV
Obligations of Thoroughbred Breeders and Owners
Article 16°-. All breeders and thoroughbred owners, will be required to report to the
Colombian Stud Book when a horse, male or female, enters stud duty. Such report
will trigger the verification of affiliation and parentage registration. This report shall be
sent by the breeder, within the first year and it is required to register its descendants.
Similarly, for stallions, the responsible party must report the place where the stallion
shall stand and any subsequent changes in its location.
Article 17°-. Breeders, owners, and syndicate representatives of stallions are
required to report the following information:
a) For the Register of stallion services: It will be where all services will be
recorded in sequential order, the dates of all services performed by a stallion
and should be sent to the Colombian Stud Book before 30 September of each
year, for the services performed during the first semester, or before March 31 of
the following year, for the services of the second half.
b) For the Logbook of births statement: It will be where the dates of all births
will be recorded in sequential order. The reports shall also contain, the sex
of the offspring, the color, the father, the mother and maternal grandfather
properly identified, and should be sent no later than within ninety (90) days
of its occurrence.
Article 18°-. The Colombian Stud Book register for stallion service statement will
produce a Report of Birth and Reproductive Status of the mare, to be sent to the
owner to be completed and returned within ninety (90) days following the date of
event to be declared. The Report of birth and reproductive status of the mare contain
relevant information to record all possible events that occurred in the annual period,
such as: ownership or possession of the mare and its limitations, date and place of
birth, abortion or any other incident, sex and breeding color and requested names, if
the breeder wants to reserve it. In the cases where there was no birth it should state
the reason why it did not occur.
Paragraph 1 -. For all mares that have not been served in the previous year, the
Colombian Stud Book issues a report (the Foal / No Foal report), this report is
forwarded to the last registered owner, who shall complete and return it within ninety
(90) days. stating if the mare has been sold, has died, has been removed from stud
duties, or had an unregistered service.
Article 19°-. The Colombian Stud book, based on the reports of birth and reproductive
status of the broodmare, will charge according to its current rates, the formalities of
affiliation, genetic typing and registration of foals and send it to the owner. In order to
continue with these formalities, the applicant shall pay such amount and inform to
ASOCRIADORES PSI the place where the mare and fosl can be visited. Paragraph 1 -. Until the formalities of affiliation, genetic typing and registration of an
animal are paid, in accordance with this Regulation and the current rates, the animal
will not be registered in the Colombian Stud Book.
Article 20°-. The Report of birth and reproductive status of the broodmare may be
transmitted to the Colombian Stud Book, using the written report, electromagnetic
media or by email.
CHAPTER V
Registration - Genetic Typing and Parentage Verification of Foals
Article 21°-. For all purposes of this Regulation registration shall mean, the process
which, determining paternity, the gestational period and proper identification of a foal,
shall result in there proper identification of the product and shall allow the issuance of
an official certification.
Article 22°-. A foal will only be registered in the Stud Book when all its ancestors,
part of its pedigree or genealogy, are duly registered in the Colombian Stud Book or
in another Stud Book recognized by the International Stud Book Committee and in
compliance with all the requirements contained in this regulation.
Article 23°-. The paternity of a product will only be accepted when the stallion and
mare have had direct sexual contact. Products obtained by artificial insemination or
embryo transfer will not be registered.
Article 24°-. The processes of filiations and parentage verification will be mandatory
for the registration of Thoroughbred in the Colombian Stud Book.
Paragraph 1-. Meaning that all parentage will be verified through a blood typing or
DNA testing, as the latter system is officially adopted. No products whose paternity is
denied or doubtful, after carrying out the respective reviews will be registered.
Paragraph 2°-. All Thoroughbreds born in Colombian territory must have parentage
verification and its parents too. In the case of imported broodmares in foal, the mare
must be registered in the Colombian Stud Book and the sire must be properly
registered in a recognized Stud Book.
Article 25°-. When broodmare has been served successively in the same season by
two different stallions, every effort will be made to verify parentage of the resulting
product, eliminating the stallion that does not fit.
Article 26°-. The Colombian Stud Book Commission has designed the information
necessary for affiliation, according to international descriptive codes. The person
authorized to make the affiliation shall adhere only to the terms and nomenclature
issued to this effect.
Article 27°-. Normal pregnancy is considered to occur between three hundred and ten (310) and three hundred sixty (360) days. When the duration of pregnancy is out of
these limits, the Colombian Stud Book shall send a delegate to the place where the
product is, to establish the conditions of birth and to take the respective blood
samples. According to the results of the visit it can accept or deny the application for
registration of the product.
Article 28°-. When the product does not have a report of service of a stallion or mare, or it
has been reported after the deadline stipulated in an Article 17°, and before the birth
occurs, the Colombian Stud Book Commission may request all information considered
appropriate to establish the paternity and may include the testimony, at least two
individuals who have attended the service.
Article 29°-. When there is no report of birth, or it is extemporaneous, if it has been
received after the deadline stipulated in Article 17°, the Colombian Stud Book
Commission may request any additional information it deems appropriate to establish
the identity the product and may include the testimony of at least two individuals who
have attended delivery.
Article 30°-. For all purposes of registration the breeder will be the person appearing
on the records of the Stud Book as the owner of the mare at the time of the birth of
the product.
Paragraph 1-. Temporary owner of a mare is a person that, by a written contract,
has a lease for breeding such mare, or has a shared foal clause. In the latter case,
both parties will be registered as breeders.
CHAPTER VI
Names and Coats of Thoroughbreds Article 31°-. All thoroughbreds to be registered in the Stud Book shall bear a name
that identifies them throughout their lives.
Article 32°- . The names chosen for the Thoroughbreds must be requested to the
Stud Book, in writing.
1. The breeders have to request the name of a foal before it participates in
its first race. This request will have no charge. The Colombian Stud Book
Commission will approve and authorize such name when the following
requirements are met :
a) When requesting the reservation of a name, before birth occurs, it must
specify to which product it is intended. This reservation will have no cost
and will be valid for a period of six (6) months;
b) When it is requested in the report of birth or before six (6 ) months of age,
giving up to three possible names for each product. This application have
not have cost;
c) When the requested name is not included in any of the paragraphs of
Article 33.
2. The breeders may leave a foal nameless to be named later by a new owner.
This application will cost the rate established for this purpose.
The Colombian Stud Book Commission shall approve the name and
authorize its use when the following requirements are met:
a) When the foal owner seeking approval of the name before it participates
in a public race.
b) If the requested name is not included in any of the paragraphs of Article 33. Paragraph 1-. The Transfer of the nameless foal will only be processed at the same time with the foal name.
Article 33°-. The Stud Book Commission will not accept the use of the following names:
a) The Group 1 winners, who are listed in Part I of the International Cataloguing
Standards, or Colombian Group I, II and III winners, regardless of the time when the
race occurred;
b) The stallions that have produced more than 15 foals Group I winners, or mares
that have produced more than two Group I winners and any stakes winner included
in the international list of protected names;
c) The stallions that are registered in the Colombian Stud Book in the Sire Book and
have had foals in Colombia;
d) Names consisting of 19 or more digits, considered as such letters, punctuation
marks and spaces, or consisting of more than four ( 4) words;
e) Names that have spelling or phonetic differences with others already registered; f) Names that are likely to be considered as publicity g) Names of exported horses, before 10 years of its exportation; h) Names that are considered obscene, offensive or vulgar, or have implicit such
suggestion;
i) Those representing cardinal numbers ; j) Those composed of numbers or acronyms; k) Those followed by numbers or acronyms; l) Those that may affect religious or political beliefs ; m) Names that correspond to farms, stables or racetracks operating in Colombia,
when there is no written authorization issued by the owners;
n) Those included in the list of protected names by the International Stud Book
Committee and ratified by the International Racing Conference ;
o) Names of famous or notable people, without written authorization from the person; p) The horses which have been entered in the Register of Disqualified Horses.
Article 34° -. Names may be accepted that have been previously used when: a) In the case of males that are not inscribed in the Register of Sires, or not been used for
breeding or were castrated, after ten (10) years from the date of its registration; b) In the case of females without foals, after fifteen (15) years from the date of
registration.
c) In the case of horses that never ran and were not used for breeding, after ten (10)
years from the date of death, or if not aware of this, fifteen (15) years from the date of
registration. Paragraph 1-. In cases of doubt, the Stud Book Committee may suggest the owner
to modify it, if in its judgment it has merit, and reject it when it deems it unsuitable.
Article 35° -. The Stud Book Commission may approve once, a name change, when
there has not ran, or entered stud, upon payment of such service.
Paragraph 1-. When a registered horse, is exported and then renamed due to the
regulations of the country of destination, it must be reported to the Colombian Stud
Book.
Paragraph 2-. Whenever the name change is accepted in the passport and pedigree
its previous name will be attested.
Article 36°-. No name change will be permitted to the horses imported into the
country. It will be mandatory to use, in parentheses, the abbreviation of the country of
birth after imported horse's name to distinguish it.
Article 37°-. The coats of registered horses must be very accurately described in the
report of birth or parentage respectively, describing it according to the following
designations:
a. Bay: The entire coat of the horse may vary from a yellow-tan to a bright auburn.
The mane, tail and lower portion of the legs are always black, unless white markings
are present.
b. Black: The entire coat of the horse is black, including the muzzle, the flanks, the
mane, tail and legs, unless white markings are present.
c. Chestnut: The entire coat of the horse may vary from a red-yellow to a golden-yellow.
The mane, tail and legs are usually variations of the coat color, unless white markings
are present.
d. Dark Bay/Brown: The entire coat of the horse will vary from a brown, with areas of
tan on the shoulders, head and flanks, to a dark brown, with tan areas seen only in
the flanks and/or muzzle. The mane, tail and lower portion of the legs are always
black, unless white markings are present.
e. Gray/Roan: The Jockey Club has combined these colors into one color category.
This does not change the individual definitions of the colors for gray and roan and in
no way impacts the two-coat color inheritance principle as stated in Rule 1(E).
f. Gray: The majority of the coat of the horse is a mixture of black and white hairs. The
mane, tail and legs may be either black or gray, unless white markings are present. g. Roan: The majority of the coat of the horse is a mixture of red and white hairs or
brown and white hairs. The mane, tail and legs may be black, chestnut or roan,
unless white markings are present.
Article 38° -. Chestnuts, grays or roans foals must meet the following:
a) Chestnut Sire and Chestnut Dam, must produce a Chestnut;
b) Gray roans foals must have of least one gray/roan parent. Paragraph 1-. When a product descends from a roan or gray horse, it shall require a
written report of the final color coat within six (6) months of the date of birth.
Article 39° -. The Stud Book Commission does not register horses whose coat
description disagrees with these established standards.
CHAPTER VII
Passport, Ownership and its Limitations Article 40° -. Enrollment in the Register of Property certifies the horse's property, unless
proved otherwise. To this end, a horse cannot be registered in the Register of Property,
without first ascertaining the right of he who intends to appear as the owner.
Paragraph 1° -. For all purposes, without prejudice to the rights of others, he who
appear as such in the Register of Property, will own the horses that are registered in
the Colombian Stud Book..
Article 41° -. The Colombian Stud Book issues a passport for all horses born in the
country, or imported horses that do not have it, document to be accompanied to all
proceedings concerned.
Article 42° -. The passport shall contain the following information:
a) Registration Number, b) Name, sex and color of the horse owner, c) Date and place of birth, d) Sire, Dam and Grandsire, e) Affiliation, f) Registration of ownership, tenure and its limitations, g) DNA typing, h) Campaign at racetracks, i) Photographs, when these are required, j) Vaccinations.
Paragraph 1-. When a product is registered with no name, the Colombian Stud Book will not issue the passport until it receives a request for name, executed in writing by the breeder or new owner that is applying for the corresponding transfer.
Article 43°-. For all proceedings at the Stud Book The passport has to accompany the respective application. Once it is processed, it will be returned to its owner.
Article 44°-. No copies or duplicates of passports will be issued, except in case of loss or destruction duly verified, the applicant may request it and, upon payment of established fees, the Stud Book Commission may authorize the expedition of a new one.
Article 45°-. When a horse is sold, the owner will fill in the passport, the corresponding
spaces in the name, identification and address of the purchaser and send it to the Stud Book, where the buyer, upon payment of the established fees, will have the passport returned to his registered address.
Article 46° -. Owners may authorize a third party to sign the transfer of sale, but shall inform in writing the Stud Book, of such authorization.
Paragraph -. Transfers will not be recorded when signed by persons not duly authorized by the last owner listed on the registration of a horse.
Article 47° -. When a stallion is syndicated, which means that the property has been divided into a number of rights or shares, the respective document must be sent to the Stud Book so it can register ownership in the respective book. The syndicate must appoint a spokesperson who will have representation at the Stud Book for everything related with this Regulation.
Article 48° -. The owner of a horse leased to run on a racetrack, or for breeding
purposes. A copy of these contracts must be submitted, duly signed and
authenticated, to the Stud Book, which will recorded in the corresponding register.
Article 49° -. Shared foal contracts, in which the owner of a broodmare transfers it
temporarily to receive a portion of the resulting foal, must be registered with the Stud
Book, so that both parties can be registered as breeders.
Paragraph -. In the case of leasing for breeding, the lessee is recognized as
temporary owner for the purposes of Article 30 °, of this Regulation.
Article 50° -. Any limitation in the property or possession of a Thoroughbred shall be
communicated in writing within thirty (30) days of its occurrence, to be recorded in
the passport and the corresponding register. These limitations may be only
overridden upon a resolution of the Commission of the Colombian Stud Book to such
effect, in obedience to orders reversing the original cause for such limitation.
Article 51° -. Upon the death of a horse, the owner must return to the Stud Book the
passport recording the date and cause of it, within a maximum period of one year.
CHAPTER VIII
Import and Export of Thoroughbred Article 52° -. All imported Thoroughbreds must be registered in the Colombian Stud
Book. For these purposes the importer shall submit an application for registration
within sixty (60) days of its arrival. The importer is responsible for complying with the
provisions of this Regulation.
Article 53°-. Application for registration shall be accompanied by a pedigree, made
by a person authorized by the Stud Book, and samples for typing, when the horse
comes from a country where it has not been done. In accordance with international
standards, the Stud Book of the exporting country must send directly to the
Colombian Stud Book the passport or Export Certificate, as the case may be, where
proof of identity, ownership, affiliation and blood typing or DNA testing and campaign,
if he has run, for proper registration in the Register of Imported Horses.
Article 54°-. The importer or the owner listed on the Export Certificate will be
registered as the first owner of the horse in the Stud Book, and must pay registration
fees in advance for this purpose.
Article 55° -. No records will be made of horses from countries whose Stud Books are
not recognized by the International Stud Book Committee.
Article 56°-. Until the coincidence of filiation and parentage verification of an
imported horse has been verified with a passport or Certificate of Export it will not
proceed to register. Importers will have a maximum of one hundred twenty (120) days
to settle any differences that are present in the registration process. After that,
registration will not be possible.
Article 57° -. All exported Thoroughbreds must be accompanied by a passport or a
Certificate of Export, which will be issued by the Colombian Stud Book. Before the
departure of a horse, confirmation of its identity and affiliation shall occur, and four
photographs of the product (front, left side, right side and rear) must be submitted. In
accordance with international standards, the Colombian Stud Book will send to the
Stud Book of the destination country, the passport with the photos, or an Export
Certificate, as the case may be, as proof of identity, ownership, affiliation and
parentage verification, campaign, if it has run, for proper registration there.
Paragraph 1-. The Colombian Stud Book may issue the exporter a copy of the
Export Certificate if such is required by competent authorities.
Article 58° -. When a horse is re-exported to the country of origin, the Colombian Stud
Book will send the Original Export Certificate received from the horse's country of origin,
keeping on file a certified copy of this document, along with proof of delivery.
CHAPTER IX
Rates, Penalties and Fines Article 59° -. The Stud Book Committee will periodically recommend the concepts for
which it will charge a fee, and submit its proposal to the Board of ASOCRIADORES
PSI, before the end of the respective year.
Article 60°-. Breeders, owners or interested parties, in making an inquiry from the
Colombian Stud Book must be prepay the set fees. ASOCRIADORES PSI, may
determine the system for collection of these rates for their members.
Article 61°-. The Stud Book Commission will set the time during which proceedings
may be made to the Stud Book. These terms will be incorporated into this
Regulation, if different from those described herein.
Paragraph 1-. Once After the deadline, the Colombian Stud Book cannot accept
service or birth declarations, , reproductive status of a mare reports, registrations,
name changes, requests for issuance of certificates, or other proceeding described in
this Regulation.
Article 62°-. For all purposes, all interested parties represent they know of the
existence of this Regulation and except its content. Therefore, any proven violation of
its rules will be punished by the Stud Book Commission.
Article 63° -. When the Stud Book Commission is aware of violations to this
Regulation it will, depending on its severity, apply appropriate sanctions. The
decisions taken will be reported to the Board of Directors of ASOCRIADORES PSI
Paragraph 1° -. When the violation of this Regulation involves an attempt to register
a horse with altered or false documents, or bad faith is found, a proceeding of
disqualification of the horse and its elimination of the respective books will occur, and
sanctions will be extended to those responsible.
Paragraph 2° -. When the registration of a horse is cancelled, it will not be able to re-
apply. Additionally the stud farm, breeder or owner who has propiatiated such act will
be expelled.
CHAPTER X
General Provisions
Article 64° -. The Stud Book Commission may amend this Regulation, when
appropriate, or when the issuance of a law or national or international standards so
warrant. Any amendment to this Regulation shall be ratified by the Board of
ASOCRIADORES PSI
Article 65° -. Cases not provided for in this Regulation will be studied and solved by
the Colombian Stud Book Commission, who will make decisions in such case
thereof, by a majority vote and monitor its application.
